WE'RE ALL EARS .

THANKS MAYOR.

CITY COUNCIL BY ZION.

BUT WE'RE FOR TIME.

THIS, YOU'RE LOOKING AT SECTION EIGHT THIS EVENING.

UH, SECTION EIGHT IS THE FINAL SECTION OF THE TYPICAL SINGLE FAMILY LOT IN WOOD SHORE.

UH, THE NEXT DEVELOPMENT SECTION COULD BE, UH, A PATIO TYPE SECTION ON THE FAR EAST AND ACROSS THE LAKES IN WOOD.

UM, AND THAT, THAT'S IN THE WORKS RIGHT NOW, BUT CERTAINLY NOTHING.

SO ANYWAY, SECTION EIGHT THAT YOU'RE LOOKING AT TONIGHT IS REALLY A CONTINUATION OF SECTION SEVEN.

A FEW MONTHS AGO YOU APPROVED, UH, SECTION SEVEN, WHICH SEVEN AND SECTION EIGHT OR 22 LOTS.

AGAIN, THEY'RE 70 FEET WIDE.

UH, SOME OF THOSE, WELL, THE LOTS AVERAGE ABOUT A 37, ABOUT 40 BP, WHICH IS LARGER THAN YOUR TYPICAL FOOT.

UH, I I CAN GIVE YOU A REAL QUICK RECORD OF THE STATUS.

UH, TODAY 320 LOTS HAVE BEEN DEVELOPED INCLUDING THE SECTION, THE SEVEN LOTS THERE.

SEVEN LOTS, WHICH HAD JUST HAD THE LOT DATE PERFORM THEM TODAY.

SO I SUSPECT THAT THE BILL WILL BE UNDERWAY PROBABLY WITHIN 60 DAYS OR ON THOSE LOTS.

UM, AND THERE, THERE ARE 200 IN WHICH CONSTRUCTION AND THAT'S IT.

THAT'S A, I CERTAINLY ANSWER ANY QUESTIONS OR ANYTHING ELSE YOU'D LIKE TO ADD? WHERE EXACTLY? CUZ THE MAP IS SO CLOSE UP.

WHERE IS IT? IS IT BACK THERE IN THE NEW SECTION WHERE THE HOMES, WHERE THE, THEY'RE REALLY CLOSE TOGETHER.

WHEN YOU SAY WHERE IS IT, YOU MEAN WHERE IS IT IN? YES.

MM-HMM.

.

OKAY.

SO IMAGINE THAT YOU'RE ON OYSTER CREEK DRIVE AND YOU'VE DRIVEN NOW INTO WHICH YOU ON WHICH YOU'RE CROSSING.

MM-HMM.

, IF YOU NOTICE THERE'S A, THERE'S A SPELL OUT FOR A STREET IMMEDIATELY ON YOUR LEFT IN THE ROUNDABOUT OR THE FIRE, THE ROUNDABOUT.

OH, ON LEFT HAND SIDE AS YOU'RE, THAT'S WHAT NO, BUT RIGHT AS YOU ENTER.

AS YOU ENTER, OKAY.

THERE'S A FIRST HOUSE, BUT THERE'S A STREET THAT GOES TO NOWHERE JUST PRIOR TO THAT FIRST HOUSE STREET.

OH, OKAY.

THERE'S THAT STUFF FROM THAT STREET.

MM-HMM.

.

THEN AS YOU CONTINUE TO ROUND ABOUT, YOU KNOW, THERE'S THREE STREETS RIGHT NOW COMING OFF ROUNDABOUT.

MM-HMM.

, THERE'S ANOTHER STUFF RIGHT FAR STOP.

THOSE TWO STUBS WILL BE EXTENDED IN THE CUL-DE-SAC.

IT'LL BE THOSE TWO CUL-DE-SACS AT YOUR PRICE SESSION.

OKAY.

BECAUSE I DROVE AROUND TRYING TO FIND IT AND I WAS LIKE, I DON'T KNOW WHERE THIS IS.

NOW I KNOW WHERE IT'S THESE ARE.

OH, I'M EXCITED.

THESE ARE PROBABLY ACTUALLY THE LOTS THAT ARE CLOSEST TO THE, TO, UH, CREEK OR CREEK DRIVE.

OKAY.

BETWEEN BUCKYS AND WOOD SHORE DRIVE AND RIGHT OF THAT AREA.

I SAID, BUT, BUT BETWEEN BUCKYS AND WOOD'S SHORE DRIVE.

THAT'S RIGHT.

THIS IS, THIS IS THE THANKS.

THANK YOU.

NEXT ITEM WOULD BE THOSE OPPOSED TO THE REAT.

FIRST TIME IS READ LETTERS FROM CITIZENS OPPOSED TO THE REAT.

I HAVE NONE.

NEXT WOULD BE TO HEAR FROM ANYONE IN CHAMBERS THAT IS OPPOSED TO THE REAT SCENE.

NONE.

WE WILL MOVE TO ITEM THREE COMMENTS FROM PLANNING THE ZONING COMMISSION.

UM, AND WE WILL NOW CLOSE DISCUSSION AND HEAR A RECOMMENDATIONS FROM PLANNING AND ZONING COMMISSION.

I MAKE A MOTION THAT THESE BE APPROVED.

I SAY WE HAVE A MOTION IN A SECOND.

ALL IN FAVOR SAY AYE.

AYE.

ANY OPPOSES MOTION CARRIES, UH, PLANNING ZONING RECOMME THAT THE RE BE GRANTED FOR SHORE SECTION.

NEXT, THAT WILL BE CONSIDERATION THE POSSIBLE ACTION FROM COUNSEL TO ACCEPT THE RECOMMENDATION FOR THE PLANNING AND ZONING COMMISSION THAT THE REAT BE GRANTED AS DRAWN.

HOW MAY THAT MOTION, MOTION MADE BY COUNCIL PERSON BOND? I WAS SECONDING THAT MOTION.

COUNSEL AGUILAR, ANY DISCUSSION? HEARING NONE.

ALL IN FAVOR? AYE.

AYE.

AYE.

IT'S UNANIMOUS.

THANK YOU.

UH, PLANNING THE ZONING COMMISSION.

CARRIE TO ADJOURN.

I'M MAKING MOTION TO ADJOURN.

ALL IN FAVOR PLANNING.

THE ZONING DOES ADJOURN.

[III. ADJOURN JOINT PUBLIC HEARINGS]

UH, CITY COUNCIL PORTION OF THE PUBLIC HEARING AND MOVE INTO THE REGULAR MEETING.

I'LL IMITATE A VOTE.

ALL THIS OVER.

AYE.

AYE.

UNANIMOUS CONSENT AGENDA IS APPROVED.

[VI. RECOGNITIONS]

WE WILL NOW MOVE TO ITEM FOUR, WHICH IS RECOGNITIONS.

AND WE HAVE A NUMBER OF EMPLOYEES THAT HAVE, UH, REACHED A 5, 10, 15, 20, 25, OR 30 YEAR, UH, MILESTONE.

UH, WE'VE RECOGNIZED ALL OF THESE FOLKS AT THE EMPLOYEE APPRECIATION LAUNCHING ON WEDNESDAY, BUT, UH, THESE ARE THE ONES THAT ACTUALLY RECEIVED THEIR AWARDS FOR, FOR THE FOR OF THE FIVE YEAR ANNIVERSARY.

UH, AND WE HAVE KIM O'CONNOR, WHO HAS BEEN WITH US FOR 15 YEARS.

HAVE CHRISTOPHER DUO BEEN WITH US FIVE YEARS OF 10 MONTHS.

BRITTANY FISHER IS A PART-TIME EMPLOYEE THAT HAS WORKED FOR THE CITY FOR FIVE YEARS.

JAMES FIT, OUR POLICE CHIEF HAS BEEN WITH US NOW FIVE YEARS IN EIGHT MONTHS.

JOHN RUTHERFORD HAS BEEN WITH US 10 YEARS IN FIVE MONTHS, MUCH AS KANYE HAS BEEN WITH US 30 YEARS AND SIX MONTHS.

THAT'S PRETTY GOOD.

UH, PRETTY GOOD AMOUNT OF SERVICE FOR, FOR A GROUP OF EMPLOYEES.

WE APPRECIATE THEIR HARD WORK DEDICATIONS.

WE

[VII. BUSINESS ITEMS]

WILL NOW MOVE TO BUSINESS ITEMS AND ITEM A IS CONSIDERATION IMPOSSIBLE.

ACTION TO APPROVE THE SECOND OF TWO READINGS OF RESOLUTION NUMBER 44 20 22 FOR

[00:15:01]

ECONOMIC DEVELOPMENT CORPORATION.

THIS DISPERSMENT OF FUNDS PROJECTS INCLUDING LOCAL SMALL BUSINESS ASSISTED INITIATIVE PROJECT, $100,000 IN TOTAL FUNDING TO ASSIST SMALL BUSINESS DEVELOPMENT AND IMPROVEMENT ACROSS THE CITY.

COMMUNITY BRANDING AND STRATEGIC PLANNING INITIATIVES.

75,000 IN TOTAL FUNDING TO PROVIDE DEVELOPMENT TO PROVIDE, DEVELOP, TO PROVIDE AND DEVELOP AN ECONOMIC STRATEGIC DEVELOPMENT PLAN AND COMPLIMENTARY BRANDING FOR THE CLTE SLASH CLTE EDC.

CONSTRUCTION REMEDIATION AT FIRE STATION ONE 150,000 IN TOTAL.

POTENTIAL FUNDING FOR VARIOUS CORRECTIVE ACTIONS RELATED TO CONSTRUCTION DEFECTS AT FIRE STATION.

NUMBER ONE, INCLUDING FORENSIC ENGINEERING SERVICES, ELECTRICAL AND H V A C REPAIRS AS WELL AS MOISTURE SLASH DAMAGE REMEDIATION RELATED TO SAID DEFECTS.

RENOVATION INCENTIVES.

50,000 IN TOTAL.

FUNDING FOR REIMBURSING GRANTS TO QUALIFYING SMALL BUSINESS WITH RENOVATION AND SIGN REHABILITATION COSTS.

COMMUNITY SIGNAGE.

60,000 FOR COMMUNITY IDENTIFICATION SIGNAGE AT THE VARIOUS CENTURY POINTS TO THE CITY.

AS WE MENTIONED AT THE PREVIOUS MEETING, THIS HAS TO BE READ TWICE BEFORE WE COULD TAKE ACTION.

THIS IS THE SECOND READING.

THESE FUNDS ARE IN THE BUDGET IN THE ED AT THE ECONOMIC DEVELOPMENT CORPORATION'S BUDGET.

AND THE BUDGET HAS BEEN APPROVED SO THAT THESE FUNDS ARE AVAILABLE.

AND AT THIS POINT I WILL CONSIDER A MOTION TO APPROVE RESOLUTION NUMBER.

I GUESS I PROBABLY OUGHT DON'T HAVE IT.

MM-HMM.

, I WAS GONNA SAY YOU'VE READ THE PROJECTS, SAYS HE NEED TO THE RESOLUTION.

I READ THE, THERE IT IS.

OH YEAH, I THINK YOU'RE FINE WITH, YOU CAN READ THE CAPTION.

YEAH, READ THE CAPTION.

YEAH.

AND IT WOULD BE RESOLUTION NUMBER 44 DASH 2022.

RESOLUTION OF SEA OF INCLUDE TEXAS CONTAINED IN PREAMBLE APPROVED ECONOMIC DEVELOPMENT PROJECTS TO BE ENACTED BY THE INCLUDE ECONOMIC DEVELOPMENT CORPORATION FOR THE FISCAL YEAR 2022.

2023.

IT PROVIDES THIS RESOLUTION TO TAKE EFFECT OF BEING FORCED FROM IT AF FROM AND AFTER IT'S PASSAGE AND ADOPTION.

SO THAT BEING SAID, I WOULD CONSIDER A MOTION TO APPROVE RESOLUTION NUMBER 44 20 22.

SO MOVED.

MOVE BY COUNCIL PERSON.

I'LL SECOND THAT MOTION AGUILAR DISCUSSION.

I DID HAVE A, JUST A COUPLE QUESTIONS.

UH, CUZ I WASN'T HERE FOR THE FIRST READING.

UM, ARE THE, THE APPLICATIONS, ARE THEY GONNA BE TRANSLATED TO SPANISH AS WELL? YEAH, WE DON'T HAVE, I THINK THERE IS ONE.

WE DO HAVE ONE WITH ONE THAT'S SPANISH ON, BUT WE NEED TO GET THE OTHERS DONE AS WELL.

THE RENOVATION NEEDS TO BE TRANSLATED.

SO, AND, UH, ARE THE, ARE THEY GOING TO, ARE THEY JUST GONNA BE AVAILABLE IN PAPER ON THE WEBSITE? THEY SHOULD BE, THERE SHOULD BE A PDF DOWNLOADABLE ON THE WEBSITE.

THEY'RE NOT FILLABLE ON THE WEBSITE.

THEY'RE NOT FILLABLE.

OKAY.

ARE WE GONNA ACTIVELY, LIKE, SEND A LETTER TO, I DON'T KNOW IF SOMEBODY HAS LIKE A REALLY BAD SIGN THAT NEEDS SOME RENOVATING OR WHATEVER, WHEN WE WOULD WE CONTACT THEM AND SAY, HEY, THIS IS AVAILABLE TO YOU IF YOU'RE INTERESTED.

SO WHEN WE COUNSEL WITH SOMEBODY, IF THEY'RE HAVE IT, THAT'S SOMETHING THAT'S OUT OF ORDER WHERE YOU WILL TELL THEM, HEY, THERE'S A PROGRAM HERE TO HELP YOU WITH THAT.

OKAY.

UH, WE HAVE A OUT OF COMPLIANCE SIGN AROUND THE CORNER ON MAINE THAT WE LET THEM KNOW THAT THEY COULD BRING THAT INTO COMPLIANCE AND THEN, UH, A COUPLE OTHER PLACES AROUND TOWN.

SO.

OKAY, COOL.

WE DON'T TYPICALLY SEND A LETTER THOUGH.

IF WE'RE STOP, LIKE IF WE SEE SOMETHING, WE'LL STOP IN AND SAY SOMETHING.

HEY, YOU'RE, THIS IS OUTTA COMPLIANCE.

OR WHEN TITO, THOSE GUYS, THEY'RE INSTRUCTED TO KIND OF LET 'EM KNOW, HEY, THERE'S ASSISTANCE HERE IF YOU NEED IT.

SO.

OKAY.

RIGHT.

AND AS COUNCIL MEMBERS, I THINK IT'S A GOOD IDEA TO, I MEAN, IF IT'S SOMETHING THAT WE SEE VISIT WITH THEM.

YEAH.

THIS, UH, CONSTRUCTION AND MITIGATION FOR THE FIRE STATION ONE $50,000.

IS THAT MEAN THAT WE'RE PROBABLY NOT GOING TO GET ANY MONEY FROM? UH, NO SIR.

THAT IS, THAT IS CONTINUING EXPENSE.

UH, WE STILL HAVE THE PEOPLE THAT BUILT IT.

WELL WE STILL HAVE, UM, WE DON'T, WE STILL HAVE SOME EXPENSES RELATED TO THE REMEDIATION.

THE OTHER COSTS WILL BE CAPTURED, UH, PENDING LEGAL ACTION ON THE, ON THE FUNDS FOR SMALL BUSINESSES.

YOU KNOW, THE, THE INITIATIVE AND THE RENOVATION PART.

DO YOU, DO YOU KNOW THE PERCENTAGE SIGN, LIKE HOW MUCH THEY HAVE TO PUT THIRDS, HOW MUCH WE PUT? SO ON THE RENOVATION GRANT, IT'S A 50 50 MM-HMM.

.

SO IN THE SMALL BUSINESS INITIATIVE IT, THERE'S A LITTLE BIT MORE FLEXIBILITY THERE.

TYPICALLY WE'VE HAD, I JUST MATTER OF FACT, I DON'T THINK WE'VE EVER DONE ANYTHING LESS THAN 50 OR MORE THAN 50 50, BUT WE, THERE'S SPRING TO, TO NEGOTIATE AND WHAT WE'RE

[00:20:01]

FINDING IS A LOT OF FOLKS ARE LOOKING FOR A LITTLE BIT MORE FLEXIBILITY AND GOING A LITTLE BIT LARGER ON THEIR PROJECTS.

WE'RE ACTUALLY LOOKING AT THREE 80 AGREEMENTS ON A NUMBER OF THESE.

OKAY.

WHICH WOULD BE A DIFFERENT ANIMAL ALTOGETHER.

YEAH.

OKAY.

THOSE ARE MY ONLY QUESTIONS.

THANK YOU.

MM-HMM.

, ANY OTHER QUESTIONS? COMMENT, HAVE A MOTION IN A SECOND.

I WILL ENTERTAIN A VOTE.

ALL IN FAVOR? AYE.

UNANIMOUS.

NEXT ITEM WOULD BE CONSIDERATION OF POSSIBLE ACTION TO ADOPT RESOLUTION NUMBER 51 DASH 2022 APPROVING AN INTERLOCAL AGREEMENT.

IT WOULD BE A RESOLUTION OF CITY COUNCIL OF CITY OF CLETE, TEXAS AUTHORIZING THE MAYOR'S SIGNATURE APPROVING FISCAL YEAR 2022.

2023 ROAD AND BRIDGE PROJECT UNDER THE CITY INTERLOCAL AGREEMENT WITH BRAZORIA COUNTY, WHERE THE CITY OF INCLUDE BRAZORIA COUNTY HAVE LONG PARTNER TO CONDUCT MUCH NEEDED ROAD MAINTENANCE PROJECTS UNDER A LONG STANDING INTER LOCAL AGREEMENT.

AND WHEREAS DISAGREEMENTS ALLOWS THE CITY TO USE COUNTY RESOURCES FOR THE OVERLAY OF ROADS LISTED ON THE INTERLOCAL AGREEMENT PROJECT REQUEST LISTS SUMMARY FISCAL YEAR 23 EXHIBIT B NOW THEREFORE BE RESOLVED BY THE CITY COUNCIL TO INCLUDE TEXAS, THAT THE PROJECT PROPOSED PROJECTS LISTED ARE HERE BY APPROVED AND THE MAYORS AUTHORIZED TO SIGN THE APPROPRIATE LOCAL AGREEMENT ISS 23 4 WITH COUNTY.

FURTHER, THE CITY WISHES TO THANK COMMISSIONER PAYNE AND THE COUNTY FOR THEIR ASSISTANCE READ PATHS AND ADOPTED THIS 27TH DAY OF OCTOBER, 2022.

IT WILL BE SIGNED BY MYSELF AT TESTED BY ONE CITY CLERK.

I THOUGHT WE HAD PASSED THIS ALREADY.

YOU DID? THIS IS THE ACTUAL AGREEMENT PORTION.

OKAY.

WITH THE, WITH THE FINAL COST INCLUDED? MM.

OR THE FINAL COST ESTIMATE? I WANNA SAY FINAL COST ESTIMATE, NOT FINAL COST, BUT FINAL COST ESTIMATE.

YEAH, WE, WE SIGNED THE INTERLOCAL AGREEMENT, BUT THIS IS THE ACTUAL RESOLUTION ADOPTING THE PROPOSED LIST.

YEAH, AND I WOULD NOTE THAT THIS IS NOT THE ONLY PROJECTS THAT WE PLAN.

WE ARE AGAIN TALKING ABOUT THE WORK THAT WE'LL BE DOING TO COINCIDE WITH THE CDBG PROJECT ON THOSE STREETS IN THE BRYANT SUBDIVISION.

BUT THIS IS THE ACTUAL COUNTY LIST, SO, OKAY.

OKAY.

DO I HAVE A MOTION TO APPROVE RESOLUTION 51 DASH 2022.

I'LL MAKE THAT MOTION.

MOTION LOADED BY COUNCILMAN AGUILAR SECOND ABOUT COUNCIL QUINN, ANY DISCUSSION? ENTERTAIN A VOTE.

ALL IF FAVOR, AYE.

AYE.

AYE.

UNANIMOUS.

THANK YOU.

NEXT ITEM WOULD BE CONSIDERATION OF POSSIBLE ACTION TO ADOPT RESOLUTION NUMBER 52 DASH 2022 APPROVING A REVISION TO THE CITY'S A FEE SCHEDULE TO INCLUDE REVISED FEES FOR WATER, WASTEWATER AND SOLID WASTE SERVICES.

IT WOULD BE RESOLUTION NUMBER 52 DASH 2022.

A RESOLUTION OF CITY COUNCIL OF CITY TEXAS APPROVAL OF REVISIONS TO THE CITY'S MASTER FEE SCHEDULE TO INCLUDE CHANGES TO THE CITY'S WATER WASTEWATER AND SOLID WASTE COLLECTION FEES WHERE THE CITY HAS PREVIOUSLY ADOPTED A MASTER FEE SCHEDULE IN 2019 WHERE THE CITY HAS NOT INCREASED ITS WATER WASTEWATER AND SOLID FEES SINCE 2016.

WHEREAS THE CITY, LIKE ALL OTHER BUSINESSES AND INDIVIDUALS ARE FACING SIGNIFICANT PRICE INCREASES FOR SUPPLIES, GOODS, AND SERVICES.

WHEREAS IT IS DESIRES OF INSURING THAT ALL FUNDS OF THE CITY ARE IN GOOD FINANCIAL HEALTH, WHICH SOMETIMES REQUIRES A RATE INCREASE FOR SERVICES OFFERED, WHEREAS THE CITY HAS BEEN PRESENTED TWO POTENTIAL OPTIONS FOR SUCH A RATE INCREASE.

NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CLTE, TEXAS, THAT THE RATE AND MODEL AND OPTION ONE OR TWO ARE A OR B, HOWEVER THEY'RE LISTED ARE HEREBY ADOPT FURTHER THAN SAID RATES SHALL BE ADDED TO THE CITY'S MASTER FEE SCHEDULE AND RATE CALCULATIONS FOR BILLING PURPOSES.

BE READ PAST AND ADOPTED THIS 27TH DAY OF OCTOBER, 2022 AND BE SIGNED BY MYSELF, ATTESTED BY ROSA, APPOINT CITY CLERK AND THEY ARE OPTION A AND B.

SO I ATTEMPTED, I THOUGHT WE MIGHT BE ABLE TO GARNER SOME ADDITIONAL SAVINGS ON THE WATER RATE.

THE GOAL HERE IS TO BREAK EVEN OR GET TO GET US TO A POINT WHERE WE'RE NOT LOSING SIG A SIGNIFICANT AMOUNT.

IF YOU RECALL, BWA WHO IS OUR PRIMARY WATER PROVIDER, RAISED THE RATES BY ABOUT 11.2%.

SO WE TRIED TO MODEL IN, UH, A RATE THAT WOULD ALLOW US TO CAPTURE THAT MONEY AND NOT BE IN THE NEGATIVE ON THAT BWA CON, ON THOSE BWA CONTRACTS, UH, BOTH OF THESE RATES ACHIEVE THAT GOAL.

OPTION A IS WHAT WAS ADOPTED FROM A REVENUE STANDPOINT IN THE BUDGET FOR THESE SERVICES.

UH, OPTION B IS A SLIGHT REDUCTION.

I HAD REALLY THOUGHT WE WERE GONNA GET A LOWER NUMBER, BUT WHEN CHRIS AND I RAN THE NUMBERS, UH, I THINK THERE'S A DOLLAR 82 DIFFERENCE BETWEEN BREAKING

[00:25:01]

EVEN AND WHERE WE PROPOSED TO GO.

I WOULD NOTE ALSO TO COUNSEL, WE'RE IN THE PROCESS GETTING READY TO KICK OFF OUR WATER WASTEWATER MASTER PLAN AND THERE WILL BE A RATE STUDY INCLUDED IN THERE.

MOST OF THE CITIES AROUND US HAVE GONE UP BETWEEN EIGHT AND 14%.

UH, THIS IS A, UH, FOR THE AGGREGATE AVERAGE IS ABOUT OPTION A WOULD BE ABOUT AN 8.7% INCREASE.

OPTION B WOULD BE ABOUT A FIVE POINT OR A 6.85% INCREASE.

THERE IS NOT A HUGE PERCENTAGE DIFFERENCE, IT'S NOT A HUGE DOLLAR AND SENSE DIFFERENCE.

UH, BUT WE DID TRY AND SQUEEZE IT DOWN.

SO THE, UH, OPTION A WOULD INCREASE THE AVERAGE BILL, UH, BY ABOUT $7 AND 1 CENT.

AND OPTION B WOULD INCREASE THE AVERAGE BILL BY $5 AND 39 CENTS.

AND SO WE BROUGHT THESE TWO OPTIONS THAT WHEN WE INITIALLY THOUGHT WE WERE GONNA BE ABLE TO BRING YOU LOWER NUMBERS, BUT ONCE WE GOT TO LOOKING AT THE CONSUMPTION, THE ACTUAL COST, THAT WAS NOT THE CASE.

SO, AND AGAIN, THIS IS THE FIRST RATE INCREASE THAT'S BEEN REQUESTED IN SIX YEARS.

SO WELL, LET'S GO AT IT LIKE THIS.

DO I HAVE A MOTION TO APPROVE RESOLUTION FIVE DASH 2022 FOR DISCUSSION? FOR DISCUSSION? OR DO YOU WANT A, UH, OPTION? WELL, FOR DISCUSSION AND THEN WE'LL DISCUSS THE OPTIONS.

OH, OKAY.

WELL, I'LL MAKE THE MOTION FOR DISCUSSION.

I'LL SECOND THAT MOTION.

WE HAVE A MOTION BY COUNCIL AND I AGUILAR THAT WE APPROVE THE 52 DASH 20 RESOLUTION 52 DASH 2022 FOR DISCUSSION THAT WE HAVE A SECOND BY COUNCIL PERSON ON FLOOR IS NOW OPEN FOR DISCUSSION.

UH, THE, THE CITY MANAGER HAS PRESENTED US WITH TWO OPTIONS, UH, OPTION B AND BASICALLY BREAK EVEN.

OPTION A IS A OPTION THAT GIVES YOU A LITTLE BIT OF MONEY FOR SOME MAINTENANCE.

RIGHT? ? WELL, PERSONALLY I WOULD ALWAYS ADVOCATE FOR NO INCREASE, BUT I KNOW THE TIMES WE'RE IN, UM, I, CJ YOU'RE THE ONE WITH THE NUMBERS.

IF, IF WE BREAK EVEN OR IF WE CHOOSE OPTION B, EITHER WAY WE'RE STILL GONNA, IF YOU RECALL, WHEN WE BUDGETED, WE BUDGETED A DRAW ON RESERVES FROM THE ENTERPRISE FUND.

MM-HMM.

THIS YEAR BECAUSE OF SOME PROJECT COSTS, WE'RE STILL GONNA BE DRAWING ON RESERVES.

UH, WE WILL BE LOOKING AT ONCE WE GET INTO THE WATER RATE STUDY.

I, MY, MY GUT IS, IS THAT WE'RE GONNA BE LOOKING INCREMENTAL INCREASES COMING UP.

WE'RE SUGGESTED UNDER THAT RATE STUDY TO GET US TO A PLACE, CUZ CURRENTLY WE DON'T HAVE ENOUGH RESIDUAL CAPACITY AND REVENUE TO FUND FUTURE DEBT.

NOW WE'RE SITTING ON A VERY SIZABLE RESERVE AT THE MOMENT.

BUT WHEN YOU LOOK AT THE COST OF WHAT IT WILL BE TO REPLACE A WASTEWATER OR ENLARGE A WASTEWATER TREATMENT FACILITY TO REDO THE INFRASTRUCTURE WORK, UH, TO COVER THAT DEBT, WE'RE PROBABLY NOT IN THE POSITION TO DO THAT.

SO STAFF IS COMFORTABLE IF YOU WANT TO GO TO BE RIGHT NOW WITH THE UNDERSTANDING THAT COUNCIL'S PROBABLY GONNA HAVE TO LOOK AT ANOTHER INCREASE LATER IN THE YEAR GOING INTO THE NEXT FISCAL YEAR.

SO THAT WAS, THAT WAS MY THOUGHTS.

YEAH.

YEAH.

SO EITHER OPTION, WE'RE LOOKING AT ANOTHER INCREASE NEXT YEAR.

YES, MA'AM.

THE, THE REALITY IS, IS WE'VE PUT BANDAIDS ON OUR SYSTEM FOR A LONG TIME AND IT'S TIME TO GET SERIOUS ABOUT DOING SOME SERIOUS REMEDIATION.

NOW LUCKILY WE ARE, UH, ABLE TO USE LIKE CDBG FUNDS, WHICH IS GONNA FUND THE MAJORITY OF THE WATER AND SEWER WORK AND THE BRYANT SUBDIVISION PROJECT.

BUT THAT NEED IS EXIGENT IN EVERY PART OF THE CITY OUTSIDE OF WOOD SHORE AND COLLEGE PARK.

SO IF WE IMPLEMENT OPTION BS, THERE ARE GONNA BE ANY REPERCUSSIONS OR ANYTHING THAT WE'RE GONNA FACE OR YOU'RE GONNA FACE, WELL WE'RE, WE'RE GONNA GET CALLS NO MATTER WHAT.

FOLKS DON'T LIKE TO PAY A PRICE AND THAT'S WHY, YOU KNOW, I REALLY WANTED TO MAKE THE EFFORT, CHRIS AND I TOOK, HAD A REAL LONG TALK ABOUT TRYING TO FIGURE OUT A WAY TO MAKE THIS AS LEAST IMPACTFUL AS WE COULD.

OUR GOAL WAS ACTUALLY NO, FOR OPTION B WOULD'VE BEEN A LOT LOWER, BUT WE REALIZED THAT THAT BREAK EVEN POINT BECAUSE OF OUR CONSUMPTION IS, IS WHERE IT IS.

SO ARE WE GONNA PUT SOMETHING IN THE WATER BILL THAT TELLS 'EM, YES MA'AM, THIS IS HAPPENING? OR ARE WE, I MEAN, NOT EVERYBODY READS THE NEWSPAPER.

NO.

YEAH, WE, WE WILL, WE WILL IMPLEMENT THIS AND EXPLAIN THIS IS THE, THE RATE THAT IS UNDERTAKEN AND WE'RE JUST HAVE TO MAKE OUR COST.

SO YEAH, I MEAN IT, I MEAN BASICALLY WHAT I UNDERSTAND, UH, ALL OF THE NEIGHBORS AND CITIES THAT ARE USING BWA WATER HAVE HAD TO RAISE THEIR RATES AS WELL.

YEP.

SIMPLY BECAUSE VWA RAISED THEIR RATES AND WE GONNA PRINT IT ON LIKE THE BILL ITSELF.

IS THERE LIKE A NOTE SECTION WHERE YES, MA'AM.

OKAY.

YES MA'AM.

DOES THIS INCREASES DUE TO YES.

THIS PERCENTAGE INCREASE BY THE WATER PEOPLE AND OKAY, I WAS GONNA, I COULD REMEMBER

[00:30:01]

IF HP SOMETHING, WELL IF YOU IMPLEMENT THE LARGER OPTION NOW, IS THAT GONNA LESSEN IT BEING A PHYSICAL YEAR OR IS THIS STILL GONNA BE WHAT IT'S GONNA BE? I MEAN, YOU'RE STILL GONNA YEAH, I, YEAH, I I DON'T KNOW WHAT THE RATE STUDY'S GONNA COME BACK TO SAY.

MY ASSUMPTION IS IS THAT WE'RE GONNA BE LOOKING AT INCREMENTAL INCREASES OVER THE NEXT FIVE OR SIX YEARS TO GET US INTO A POSITION TO TAKE ON DEBT.

BUT I DON'T KNOW WHAT THAT NUMBER IS.

AND OBVIOUSLY IF YOU'RE GENERATING MORE REVENUE NOW, THE NEED FOR FUTURE RATE INCREASES IS LOWER, BUT THERE'S STILL GONNA BE A NEED TO, TO DECREASE.

WHEN YOU TAKE A LOOK AT WHAT THAT, LIKE, I THINK LAKE JACKSON BUMPED THEIRS UP TO 1450 FOR THEIR BASE RATE.

UM, I DON'T KNOW WHAT FREEPORT ENDED UP SETTLING ON, BUT THEY WERE LOOKING AT A PRETTY SIGNIFICANT INCREASE AS WELL.

AND THE REALITY IS, IS THE, THE RELIANCE ON SURFACE WATER IS ONLY GOING TO INCREASE.

IT'S NOT GONNA DECREASE.

AND THE COST ASSOCIATED WITH TREATING THAT WATER IS GOING TO INCREASE.

UH, THE COST OF CHEMICALS HAVE GONE WHERE WE'VE BEEN SEEING AN EIGHT, EIGHT AND A HALF PERCENT INCREASE IN, UH, YOUR TYPICAL CPI, THE PRODUCTION COST AND IN OPERATIONAL COSTS RELATED TO TREATING WATER HAS GONE UP PROBABLY 13 TO 14%.

SO WE'VE, IT'S, IT'S NOT A HAPPY TIME.

YEAH.

RAW, RAW MATERIALS ARE A LOT OF RAW MATERIALS WERE ALMOST EVEN IMPOSSIBLE TO GET.

YEAH.

WELL I THINK, UH, WE WOULD, I THINK WE WOULD RATHER SAVE THE PEOPLE A COUPLE BUCKS WHILE WE CAN.

IS THAT OPTION A, B B? NO, THAT'S OPTION B.

HUH? THAT'S OPTION B.

WELL, IT'LL EASE 'EM INTO YEAH.

WHAT'S DOWN THE ROAD.

BUT STAFF RECOMMENDS OPTION A, IS THAT WHAT IT IS? WELL, OPTION A IS THE OPTION IS THE FIGURE THAT WAS USED TO CALIBRATE THE INITIAL BUDGET AS ADOPTED.

UH, WHEN CHRIS AND I TOOK A LOOK AT IT, WE FELT LIKE WE WERE COMFORTABLE AS LONG AS WE'RE NOT LOSING MONEY ON THE B W INCREASE GOING WITH OPTION B FOR THE TIME BEING, KNOWING THAT THERE'S GONNA BE A RATE INCREASE COMING.

RIGHT? MM-HMM.

AND THAT ACCOUNTS FOR NO, IF WE DO B NO BUDGET AMENDMENTS, NOTHING OF THAT SORT? THAT'S CORRECT.

OKAY.

AT THIS POINT, MOST OF OUR WASTEWATER TREATMENT PLANT IS IN FAIRLY DECENT SHAPE.

CORRECT? IT'S IN DECENT SHAPE.

UH, WE'RE HOPEFUL THAT OUR PARTNERS IN RICHWOOD WILL TAKE THE INITIATIVE AND GET THEIR OWN PLANT.

UH, WE HAVE, UH, THERE'S TIERED SET BY TCQ IN THE TEXAS WATER DEVELOPMENT BOARD, UH, PERCENTAGE OF USE.

AND THERE HAVE BEEN A COUPLE TIMES IN THE PAST YEAR THAT WE'VE COME UP TO A NUMBER THAT'S GOTTEN CLOSE TO WHERE WE WOULD ACTUALLY START THE DISCUSSION ABOUT DESIGNING AN EXPANSION OF THE PLANT.

SO, UH, IF WE TAKE IT, IF WE ARE ABLE, IF WE ARE OFF, IF IT WAS JUST OUR PLAN AND WE DIDN'T HAVE A PARTNERSHIP THERE, WE WOULD HAVE CAPACITY AT MORE THAN ADEQUATE CAPACITY GOING FORWARD.

THE REALITY IS, IS THE GROWTH IN RICHWOOD AND THE GROWTH INCLUDE, UH, YOU KNOW, YEAH.

BUT THE ADDITIONAL HOUSES WE'RE BRINGING ONLINE, PEOPLE DON'T STOP FLUSHING THE TOILETS, UH, EVEN THOUGH YOU GET A LOW FLOW TOILET.

AND SO YOU'RE STILL GONNA HAVE USAGE.

AND WE ARE AT SOME POINT GOING TO HAVE TO SAY, OUR PLANT'S GONNA HAVE TO GROW BY X AND IT IS RIDICULOUSLY EXPENSIVE.

YEAH.

YEAH.

IT DEPENDS ON WHEN TCEQ DECIDES THAT THAT HAS TO HAPPEN.

THAT'S CORRECT.

, SO THOSE BENCHMARKS START AT 60%, 70%, 80% AT 80% YOU HAVE TO BE IN FINANCE AND AT 90% YOU HAVE TO BE IN CONSTRUCTION.

SO, BUT THE DIFFERENCE BETWEEN THESE TWO ON AVERAGE IS ONLY A DOLLAR SOMETHING.

IT'S ABOUT A DOLLAR.

I'M GONNA SAY IN THE MEMO I QUOTED A DOLLAR, IT'S NOT TWO $2 $2 ROUGHLY.

YEAH.

YEAH.

WE REALLY THOUGHT WE WERE LOOKING AT A FOUR TO $5 DELTA UNTIL WE CRUNCHED THE NUMBERS REALLY HARD AND THEN WE REALIZED THAT WE WERE NOT.

SO DO WE EXPECT ANY, I MEAN I KNOW WE'RE, WE'RE INCREMENTALLY RAISING, BUT WHEN WE SAY INCREMENTALLY, WHAT ARE WE SHOOTING FOR? LIKE WE PASS A WHAT WE NEXT YEAR LOOK LIKE? I HAVE UNTIL WE ACTUALLY GET INTO THE, THE DEPTHS OF THE RATE STUDY, I REALLY DON'T KNOW.

SO IT COULD BE ANYTHING.

IT COULD BE AND NEXT YEAR, $15 MORE OR SOMETHING.

YEAH, NO, MY, MY RECOMMENDATION IS NEVER GONNA BE TO JERK THOSE NUMBERS UP THAT HIGH.

I THINK YOU NEED TO.

YEAH, THAT'S, I, I'VE, I'VE LIVED THAT NIGHTMARE BEFORE AND THAT'S THE LAST PLACE YOU WANT TO BE.

UM, TYPICALLY WHEN YOU SEE A SIGNIFICANT RATE HEIGHT LIKE THAT IS WHEN YOU'VE TIED YOURSELF TO A FINANCING PACKAGE THAT REQUIRES YOU TO DO THAT.

WE ARE NOT AT THAT POINT RIGHT NOW.

I SAID THE ONLY THING, THE ONLY THING THAT WOULD PUT US IN THAT POSITION IS IF OUR WASTEWATER PLANT COMPLETELY CRAPPED OUT.

WE HAD TO,

[00:35:02]

I BELIEVE THAT FREEPORT IS IN THAT STUDY RIGHT NOW.

FREEPORT IS IN THE MIDDLE OF THAT RIGHT NOW.

OH WOW.

IT'S JUST KIND LIKE, ARE WE GONNA RIP THE BANDAID OFF NOW OR CLOSE THAT IT'S NOT THAT MUCH OF A DIFFERENCE.

RIGHT.

SHOULD WE JUST GO WITH OPTION A? STEPH REALLY IS COMFORTABLE EITHER WAY.

LIKE I SAID, WE PUT THESE PROJECTIONS TOGETHER TO ENSURE THAT WE WEREN'T GONNA BE WELL, I MEAN, I MEAN, I DON'T WANT TO HAVE TO PAY ANY MORE MYSELF NO MORE THAN I WANT OUR RESIDENTS TO HAVE TO PAY MORE.

BUT IT'S COMING REGARDLESS.

IT'S COMING REGARDLESS.

THAT'S RIGHT.

WELL, I MEAN, NONE OF US WANT TO PAY THREE OR $4 A GALLON FOR GASOLINE, BUT THAT'S WHAT THEY'RE CHARGING US.

THAT'S RIGHT.

, THEY'RE, THEY'RE CHARGING US MORE FOR A GALLON OF WATER.

SO IF, IF WE DON'T RECOUP THAT COST AND WE GOTTA GIVE IT AWAY, IF WE DO OPTION A, DOES IT PUT US IN ANY KIND OF BETTER POSITION NEXT ONCE WE GET ALL THE YEAH.

YEAH.

I WOULD THINK MARGINALLY IF YOU INCREASE THE A NOW YOU'RE GONNA HAVE MAYBE, AND I DON'T, I DON'T WANT TO THROW NUMBERS AROUND BECAUSE I'M NOT CONFIDENT IN WHAT THE PROJECTIONS SHOULD SAY, BUT HYPOTHETICALLY SPEAKING, IF THE RECOMMENDATION WAS GONNA BE A 6% INCREASE THE COMING YEAR AND WE JUMPED ITS NUMBER UP, IT MIGHT BE A 4% INCREASE.

THAT'S HYPOTHETICAL.

I'M NOT SAYING THAT THOSE NU PLEASE DON'T QUOTE ME ANDREW, THANK YOU.

UM, IN THAT, ON THAT NUMBER, BUT THAT'S, I I, YOU COULD SEE THAT, I CAN SEE THAT FORMULA BRINGING DOWN WHAT THAT FUTURE INCREASE WOULD BE.

WELL, AS HE GETS EARLIER, YOU KNOW, BOTH OF THESE RATES ARE CONTINGENT ON DRAWING FUNDS FROM THE RESERVES.

YEAH.

SO IF YOU GO WITH OPTION A, YOU, YOU'RE DRAWING LESS FUNDS RIGHT FROM THE RESERVE.

IF YOU GO WITH OPTION B, PROBABLY DRAWING MORE FUNDS, THAT'S GREAT.

AND IF YOU DIVIDE THAT BY, IF YOU DIVIDE OPTION A BY THE SEVEN YEARS SINCE WE HAD A LAST RATE INCREASE, IT'S 1.1 PER A YEAR.

THAT'S CORRECT.

THE INFLATION RATE RIGHT NOW IS WHAT? EIGHT AND A HALF? EIGHT AND HALF.

HOW SOON WILL THE FEES GO INTO? UH, SO IF WE INSTITUTE, OR IF WE ADOPT THE BILL TONIGHT, IT WOULD BE THE DECEMBER BILLING CYCLE WHEN THESE NUMBERS WOULD SHOW UP.

YEP.

YEAH, WE WOULD GIVE 60 DAY NUMBERS.

RIGHT.

BUT, BUT BASICALLY, YEAH, TYPICALLY WE CAN'T DO ANYTHING WITHOUT A 60 DAY NOTICE.

THAT'S CORRECT.

IS THERE ANY WAY WE COULD, WE COULD, UH, POSTPONE IT UNTIL JANUARY? UH, OR DOES IT HAVE TO BE NO, THAT'S, YOU CAN DEFINITELY MAKE THAT A PART OF YOUR MOTION AND WE CAN INCLUDE THAT IN THE, IN THE FINAL RESOLUTION.

GET THROUGH THE HOLIDAYS WITHOUT AN 8% INCREASE.

YEAH.

GIVE EVERYBODY PLENTY OF NOTICE.

I MEAN THE, UH, THE, THE MOTION IS, THE MOTION IS TO APPROVE THE RESOLUTION WITH AN OPTION.

SO I MEAN YOU CAN HAVE, YOU CAN PUT THE OPTION IN AND PUT THE START DATE OF THE OPTION.

I WOULD THAT YOUR ATTORNEY, I HAVE NO WANT THAT, THAT IS CORRECT.

SO LIKE I SAID, SOMEBODY, SOMEBODY'S GOTTA MAKE A MOTION AS TO WHAT OPTION THEY WANT TO, WE WANT TO CHOOSE.

SOMEBODY'S GOTTA SECOND IT AND THEN WHEN THEY MAKE THAT MOTION, THEY CAN MAKE THE MOTION AS TO WHEN THEY WOULD LIKE FOR THE RATE TO START.

WHAT WERE THE TWO RATES AGAIN? SO THE RATES ATTACHED TO OPTION A WOULD BE A, AN AGGREGATE, UH, 8.73% INCREASE.

UH, SO THE BASE RATE WOULD MOVE TO $14.

UH, OPTION B WOULD BE AN AGGREGATE 6.85% INCREASE AND THE BASE RATE WOULD MOVE TO 1388.

UH, I WOULD ALSO NOTE THAT WE'VE INTRODUCED A THIRD OR ACTUALLY A FOURTH TIER.

WE VERY RARELY HAVE ANYBODY HIT THAT TIER, BUT TYPICALLY SPEAKING, WHEN YOU MODEL THIS, YOU WANT THREE TIERS, THREE OR FOUR TIERS BELONGED BEYOND THAT BASE RATE AND THEY SHOULD BE INCREASINGLY PUNITIVE.

THAT'S EXACTLY THE WAY WE MODELED THIS.

I TAKE THIS FROM THE TC Q TDB KIND OF WORKBOOK.

SO, AND TECHNICALLY SINCE COUNCIL AGUILAR MADE THE MOTION, HE SHOULD AMEND HIS MOTION TO WHICHEVER, WHICHEVER ALTERNATE HE, AND THEN Y'ALL CAN ACCEPT IT OR DENY.

THANKS

[00:40:01]

CHRIS.

SURE.

NO PRESSURE.

SORRY.

WELL, RIGHT NOW THE, RIGHT NOW IT'S JUST OPENLY FOR DISCUSSION.

SO LIKE I SAID, SOMEBODY YOU HAD MENTIONED OPTION B, THAT, THAT, THAT'S ONE THAT YOU PREFERRED.

DO I HAVE A SECOND FOR OPTION B? I REALLY DUNNO.

AT THIS POINT IT'S SO CLOSE.

NO SECOND FOR OPTION B.

THAT'S OKAY.

DO I HAVE A MOTION FOR OPTION EIGHT? I'LL MOVE THAT MOTION.

DO I HAVE A SECOND FOR OPTION EIGHT? DO YOU WANT IT TO LEAVE? I WAS GONNA SAY, I WOULD LIKE TO, I WOULD LIKE UP TODAY WITH, UH, THE START DATE TO BE JANUARY.

I HAVE A SEC.

I'LL SECOND OFF LIKE A BANDAID TWIST IN YOUR ARM.

WE HAVE A SEC.

NO, I'M, I'M JUST TORN BETWEEN THE TWO.

IT'S LIKE, WELL IF NOW OR LATER WE'RE GONNA GET POPPED AT SOME POINT.

YEAH, IT'S LIKE, WELL, FURTHER DISCUSSION IS ON THE TABLE DOWN.

WE HAVE A, WE HAVE A MOTION IN A SECOND TO ACCEPT OPTION A WITH A START DATE OF JANUARY 1ST.

2023.

CORRECT.

YOU LOOK AT THE DIFFERENCE IN THE BASE RATE, IT'S 12 CENTS.

YEAH.

WHAT'S THE BASE RATE RIGHT NOW? BASE RATE IS 13, UH, 1315.

IT'S LIKE, I WISH I HAD A CRYSTAL BALL SO I COULD SEE , THESE SUPPLY ISSUES, THE CHEMICALS AND ALL THAT STUFF WHERE WE CAN FINALLY GET THOSE BACK.

AND ANY FURTHER DISCUSSION, I'LL ENTERTAIN A VOTE.

ALL IN FAVOR? AYE.

UH, WHICH ONE ARE WE VOTING ON? THE ONE YOU SECOND OPTION A JANUARY 1ST.

OH.

OH, I, I THINK WE'RE JUST, IT'S MAN, I DON'T KNOW ENOUGH ABOUT EITHER ONE OF EM, SO I'M GOING SUSTAIN GOT A 3, 4, 1 UP STATUTE.

YES SIR.

OKAYS? WELL, I JUST, NONE OF US, NONE OF US LIKE TO RAISE COST ON ANYTHING, BUT WHEN UNFORTUNATELY IN THE WORLD WE'RE LIVING IN RIGHT NOW, THAT'S NOT POSSIBLE.

COULD BE WORSE.

IT COULD BE, YEAH.

KNOCK ON THE WOOD.

WELL, YEAH, WE DON'T WANT TO JINX OURSELVES.

YEAH.

OKAY.

THE NEXT ITEM WOULD BE ITEM D.

AND AT THIS POINT IN TIME, I NEED A MOTION TO TABLE THIS ITEM.

UH, WE ONLY RECEIVE ONE BID AND THE, UH, AND THE FOLKS AT THE UH, CDBG WANT US TO CONTACT THE PEOPLE THAT EXPRESSED INTEREST AND FIND OUT HOW COME WE DIDN'T GET WHAT ONE BID.

SO, SO MOVE AT THIS POINT WE CAN'T.

I'LL MOVE THAT MOTION.

THEY DON'T WANT US TO TAKE ANY ACTION ON THIS TILL WE DO SOME RESEARCH.

MOTION TO TAPE.

I'LL SECOND THAT MOTION.

HAVE A MOTION BY COUNCIL PERSON BOND.

SECOND BY COUNCIL AGUILAR THAT ITEM D BE TABLED.

ANY FURTHER DISCUSSION? HEARING NONE.

UH, ENTERTAIN A VOTE.

ALL IN FAVOR? AYE.

IT'S UNANIMOUS.

THANK YOU.

NEXT ITEM WOULD BE CONSIDERATION OF POSSIBLE ACT TO ADOPT ORDINANCE NUMBER 2211, APPROVING A REVISED CONTRACT WITH PURDUE BRANDON FELDER, COLLINS AND MOD LLC FOR COLLECTION SERVICES RELATED TO UTILITIES BILLING, IMPLEMENTING A CONTING FEE CHARGE FOR COLLECTIONS ON DELINQUENT ACCOUNTS AND IT WOULD BE AN ORDINANCE PROVIDING FOR A FEE TO DEFRAY COST OF COLLECTING DELINQUENT UTILITY ACCOUNTS RECEIVABLE.

ORDINANCE NUMBER 22 DASH 21 20 22 DASH 21.

STATE OF TEXAS, COUNTY OF BRAZORIA.

WHERE DOES CITY INCLUDE PURSUANT TO CHAPTER A OF SUB CHAPTER A OF CHAPTER 51, TEXAS LOCAL GOVERNMENT CODE MAY ADOPT AN ORDINANCE THAT IS FOR THE GOOD GOVERNMENT PIECE AND ORDER OF THE MUNICIPALITY AND IS NECESSARY OR PROPER FOR CARRYING OUT A POWER GRANTED BY THE LAW TO A MUNICIPALITY.

WHEREAS THE GOVERNOR AND BODY OF A MUNICIPALITY PURSUANT TO CHAPTER A OF CHAPTER SUB CHAPTER A OF CHAPTER 54, TEXAS LOCAL, LOCAL GOVERNMENT CODE

[00:45:01]

MAY ENFORCE EACH RULE ORDINANCE OF THE MUNICIPALITY.

WHEREAS THE CITY PURSUANT TO TEXAS LOCAL GOVERNMENT CODE 5 52 0.001 B MAY PURCHASE, CONSTRUCT, OR OPERATE A UTILITY SYSTEM AND MAY REGULATE THE SYSTEM IN A MANNER THAT PROTECTS THE INTEREST OF THE MUNICIPALITY.

WHEREAS THE CITY COUNCIL HAS DETERMINED THAT IT IS IN THE PUBLIC'S INTEREST TO ENSURE THE PROMPT PAYMENT OF DELINQUENT UTILITY ACCOUNTS.

WHEREAS A CITY OF INCLUDE HAS ENTERED TO A CONTRACT WITH A PRIVATE FIRM TO PROVIDE SERVICES FOR COLLECTIONS OF DEBTS AND ACCOUNTS RECEIVABLE RELATED TO DELINQUENT UTILITY ACCOUNTS.

NOW THEREFORE IT BE, IT BE IT ORDAINED BY THE CITY COUNCIL TO INCLUDE THAT THERE SHOULD BE IMPOSED AN ADDITIONAL FEE OF 20% ON ALL DEBTS AND ACCOUNTS RECEIVABLE, IE.

FINES, FEES, RESTITUTION, OTHER DEATHS AND COSTS THAT ARE MORE THAN 60 DAYS PAST DUE AND HAVE BEEN REFERRED TO A PRIVATE FIRM FOR ELECTION THAT RELATE TO DELINQUENT UTILITY ACCOUNTS OWED TO THE CITY OF IT WILL BE SIGNED ON THIS DAY OF WHATEVER BY MYSELF.

IT IS TESTED BY ROSIE'S APPOINTMENT CITY CLERK.

IT'S MODIFICATION WAS REQUESTED BY PURDUE BRANDON IN RELATION TO THEIR COLLECTION UTILITY BUILDING COLLECTION CONTRACT WITH THE CITY.

UH, THEIR REQUEST, I GUESS STATE LAW INCREASED THE AMOUNT THAT THEY COULD ASK FOR, UH, IN TERMS OF ADDITIONAL FEE, UH, UP TO 30%.

AND THAT WAS THEIR ORIGINAL ASK.

UH, I COUNTERED WITH A MUCH LOWER REQUEST.

UH, WE MET IN THE MIDDLE, UH, AT 20% AND THEY SAID THAT THAT IS THE LOWEST THAT THEY CAN GO AND CONTINUE PROVIDING THIS SERVICE.

IS THIS THE SAME COMPANY THAT DOES LIKE THE TAX DELINQUENCIES? THEY HANDLE THE TAX DELINQUENCY, THE COURT DELINQUENCY, UH, AND THEN THE UTILITY BILLING DELINQUENCY.

OKAY.

AND THEY DO IT FOR 95% OF ROHO COUNTY? YEAH, THAT'S THAT PROBABLY PROBABLY 99%.

SO THEY'RE CHARGING US THE 20%.

THEY'RE CHARGE, THE CHARGE TO THIS IS A CHARGE TO THE CUSTOMER AND THAT'S IT.

THIS IS FOR THE LIQUID ACCOUNT.

AND I, MY, MY THEORY IN MY DISCUSSIONS WITH MR. DARLA WAS IF THEY'RE BEHIND DELINQUENT ON THEIR BILLS, IT'S BECAUSE THEY PROBABLY CAN'T AFFORD IT.

MM-HMM.

, WE TYPICALLY TRY AND WORK WITH FOLKS AND PUT 'EM ON A PAYMENT PLAN BEFORE THEY GET TO THIS POINT.

YEAH.

TACKING ON AN ADDITIONAL 30% SEEMS ALMOST USELESS.

SO I ASKED THEM TO GO LOWER AND THEY SAID THAT THAT WAS THE LOWEST THAT THE NUMBER PRESENT, THE NUMBER PRESENTED WAS THE LOWEST THAT THEY COULD GO.

YEAH.

AND I MIGHT ADD THAT, THAT THIS WOULD ONLY APPLY IF THEY, IF THE ACCOUNT WERE REFERRED TO THEM FOR COLLECTION CORRECTION.

IF WE ARE, IF WE ARE WORKING WITH SOMEONE ON A PAYMENT PLAN, THAT THAT WOULDN'T GO TO THEM FOR COLAX.

THAT'S CORRECT.

THERE'S NOT A AUTOMATIC SYSTEM THAT SENDS IT TO THEM.

WE HAVE TO REFER IT TO THIS IS, THIS WOULD JUST BE, THIS WOULD JUST BE BASICALLY FOR PEOPLE THAT JUST WON'T ANSWER LETTER, WON'T ANSWER PHONE CALL, WON'T TRY TO WORK WITH YOU.

THIS WOULD BE FOR THOSE TYPES.

CORRECT? WE HAVE, OH, IN THIS SITUATION WE HAVE A LOT OF PEOPLE THAT ARE IN UTILITY DELINQUENCY AND DO, ARE WE TALKING ABOUT LIKE OUR, THE WATER? YEAH.

THIS IS WATER, SEWER, GARBAGE.

AND TYPICALLY WHAT'LL HAVE, WHAT YOU'LL SEE IS IF SOMEBODY GOES INTO DELINQUENCY AT THIS LEVEL, THEY'VE ACTUALLY LEFT THIS, LEFT THE CITY.

OKAY.

OR THAT'S WHAT I WAS WONDERING AS I THOUGHT, ARE WE SHUTTING OFF THEIR WATER AND THEY'RE JUST SITTING THERE FOR SIX MONTHS REFUSING TO PAY OR? WELL, I, I WILL SAY THAT WE'VE HAD A COUPLE OF CASES IN THE PAST TWO YEARS WHERE FOLKS HAVE LITERALLY JUST HAD THEIR WATER SHUT OFF AND SAT THERE AND REFUSED PAYMENT EVEN THOUGH WE'VE STRUCTURED PAYMENT AGREEMENTS AS LOW AS A DOLLAR A WEEK TO TRY AND GET THEM CAUGHT UP.

SO, UH, YEAH, THERE ARE A FEW, BUT THAT IS THE DEFINITE OUTLIER.

NINE TIMES OUTTA 10, WHAT YOU SEE IS SOMEBODY WALKS ON A BILL AND LEAVES TOWN AND THEN DOESN'T COME BACK.

IT'S, IT'S KINDA LIKE WHEN HE SHOWED US THE, THE, UH, TRAFFIC FINES WHERE THEY'RE IN NEW YORK AND NEW JERSEY AND, AND CHANCES OF GETTING MONEY FOR THE, OR LIKE YEAH.

BINDING GOLD UNDER YOUR CHAIR.

WELL, I JUST CAN'T BELIEVE PEOPLE CAN GO WITHOUT WATER.

WE TRY NOT.

YEAH.

WE TRY NOT TO LET THAT HAPPEN.

WE, WE, I I WILL SAY THAT DIANE AND THEM DO A GREAT JOB OF TRYING TO NEGOTIATE AND SOMETIMES IT COMES ALL THE WAY UP TO ME IF THEY CAN'T GET, THEY'RE EMPOWERED TO MAKE A DECISION AT A CERTAIN LEVEL AND IF THEY CAN'T GET 'EM TO THAT NUMBER THEN IT COMES TO ME.

BUT WE TRY AND WORK EVERY WHICH WAY WE CAN TO MAKE SURE FOLKS AREN'T CUT OFF, SO, AND THAT THEY CAN MAKE A FORM OF PAYMENT.

SO YEAH, LIKE I SAID, AS FAR AS I KNOW THIS, THAT POLICY HAS BEEN IN EFFECT FOR MM-HMM.

PRETTY MUCH EVER.

UH, I MEAN EVEN IF THERE'S, EVEN IF THERE'S AN ACCOUNT THAT THERE IS SOME QUESTION AS TO WHETHER IT'S A LEGITIMATE CHARGE OR WHATEVER, WE'VE ALWAYS, IN

[00:50:01]

THE PAST, OTHER CITY MANAGERS HAVE ALWAYS CHARGED THEM THE MINIMUM BILL AND THEN TRIED TO WORK OUT THE, THE DIFFERENCE.

CORRECT.

AND UH, CUZ I MEAN, IT'S HARD TO BELIEVE THAT A DRIPPING FAUCET CAN USE A WHOLE BUNCH OF WATER, BUT IT DOES.

IT DOES.

IT'S ALWAYS THE TOILET FLAPPER THAT GETS WARPED OUT.

ONE CAN REALLY SUCK SOME WATER.

YEP.

BUT, YOU KNOW, TRYING TO GET A LOT OF FOLKS TO UNDERSTAND THAT IS, IS IT'S REALLY HARD SOMETIMES.

IS 20% OUR CURRENT RIGHT NOW? NO, WE TYPICALLY, THERE'S A SURCHARGE ON TOP OF IT AND IT WAS A FLAT DOLLAR FEE AND I THINK IT EQUATED TO ABOUT 15 TO 20%.

I THINK IT WAS 20% ON THE HIGH SIDE.

AND THE STATE ALLOWED THEM TO GO UP TO 30%, WHICH LED THEIR, LED TO THEIR ASS.

GOTCHA.

NOW, I THINK MR. AGUILAR WAS HERE THE DAY THAT THEY WERE ALMOST LETHAL.

I'M SORRY, I SHOULDN'T SAY THAT.

BUT THAT WAS, AGAIN, IT'S SOMETHING, SOMETHING THAT CAME DOWN FROM THE STATE LEVEL THAT WE'VE GOT TO ACT ON AND TRY TO ENFORCE.

SO WHAT'S NEW? ANYONE CARE TO MAKE A MOTION TO APPROVE RESOLUTION NUMBER 22 20 22 DASH 21? UH, I, I'LL MOVE THAT MOTION.

I HAVE A MOTION BY COUNCIL PERSON BOND.

DO I HAVE A SECOND? I'LL SECOND.

SECOND BY COUNCIL PERSON.

MAD, LIKE I SAID, UH, THIS IS, YOU KNOW, THESE FOLKS HAVE DONE AN ADMIRABLE JOB FOR US SINCE THEY'VE TAKEN OVER OUR COLLECTION.

ABSOLUTELY.

AND, UH, YOU KNOW, THEY HAVE, THEY, THEY WERE WILLING TO NEGOTIATE A LITTLE BIT ON THE, UH, ON THE FEES.

SO I CERTAINLY APPRECIATE THAT BECAUSE I MEAN, YOU KNOW, WHEN, AT THE END OF THE DAY, THE PEOPLE THAT LIVE IN THE CITY, LIVE IN CITY, WE NEED TO TAKE AS MUCH CARE OF THEM AS WE CAN.

THAT'S RIGHT.

AND IF WE COULD SAVE THEM, WE COULD SAVE THEM 10%.

BUT UNFORTUNATELY WHAT I JUST HEARD, CJ THE MAJORITY OF THIS ARE PEOPLE THAT DON'T LIVE HERE ANYMORE.

RIGHT? WELL, I WOULD SAY THAT THAT'S, YOU'VE GOT, YOU DO HAVE A FEW THAT ARE HERE THAT DON'T PAY THAT ARE DELINQUENT, BUT YEAH, THE VAST MAJORITY, YOU KNOW, LIKE I SAID, THE PEOPLE THAT ARE WALKING, I WISH WE COULD CHARGE THEM A HUNDRED PERCENT.

BUT THAT'S THE, THAT'S BESIDE THE POINT.

NOW HURRICANE, I CAN HAVE 2008 TAUGHT ME I CAN LIVE WITHOUT ELECTRICITY.

I CANNOT LIVE WITHOUT RUNNING WATER.

I HEARD THAT.

THAT'S .

SO THAT'S WHY I'M LIKE, YOU THINK PEOPLE JUST DON'T PAY.

OKAY.

UH, ANY FURTHER DISCUSSION? I'LL ENTERTAIN A VOTE.

ALL IN FAVOR? AYE.

AYE.

UNANIMOUS.

THANK Y'ALL.
