AND I HAVE A REQUEST TO MOVE ITEM D TO THE TOP OF OUR LIST, AND IT WOULD BE CONSIDERATION AND POSSIBLE ACTION TO ADOPT RESOLUTION NUMBER 63 DASH 22 APPROVING A MASTER SERVICE AGREEMENT AND TASK ORDER WITH HD R INC. FOR ENGINEERING DESIGN, INSPECTION AND PROJECT MANAGEMENT AND SERVICES RELATED TO THE INSTALLATION OF A NEW CHILLER SYSTEM AT THE BR HESTER COMMUNITY CENTER. AND IT WOULD BE RESOLUTION NUMBER 63 DASH 2022. THE RESOLUTION OF THE CITY COUNCIL OF THE CITY INCLUDE TEXAS APPROVING THE MASTER SERVICE AGREEMENT AND TASK ORDER NUMBER ONE WITH HD R INC. FOR THE PROVISION OF ENGINEERING DESIGN AND PROJECT MANAGEMENT SERVICES FOR THE REHABILITATION REPLACEMENT OF THE H V A C SYSTEM AT THE BR HESTER CENTER PARTS OFFICE. WHEREAS HDR INC HAS BEEN ON THE CITY'S APPROVED ENGINEERING POOL FOR SEVERAL YEARS NOW. AND WHERE IS THAT HVAC SYSTEM AT THE BR HESTER CENTER PARKS OFFICE HAS EXPERIENCED CHRONIC, ACUTE AND EXPENSIVE FAILURES FOR SEVERAL YEARS, RESULTING FROM MULTIPLE DESIGN AND INSTALLATION FACTORS, WHEREAS A PART AS PART OF THE FISCAL YEAR 20 22, 20 23 BUDGET, THE CITY INCLUDED FUNDING FOR THE REPLACEMENT OF THIS SYSTEM IN ITS CAPITAL IMPROVEMENT PLAN WITH FUNDING FROM BOTH THE PARK AND HOT FUNDS PARTICIPATING IN PROJECT FUNDING WHERE HDR IS REGIONALLY RECOGNIZED AS LEADER IN THE FIELD OF MECHANICAL AND FACILITIES ENGINEERING. WHEREAS THE CITY IS DESIRES OF ENSURING THAT THE CAPITAL INVESTMENT AND NEW HVAC EQUIPMENT AND THE AT THE BR HESTER CENTER PARKS OFFICE IS PROFESSIONALLY DESIGNED, INSTALLED, AND INSPECTED SO THAT IT IS ASSURED OF THE VALUE FOR THIS PROJECT NOW THEREFORE BE RESOLVED BY THE CITY COUNCIL OF CITY OF CLTE, TEXAS, THAT THE MASTER SERVICE PLAN BETWEEN THE CITY OF CLO AND AND HDR INC. IS APPROVED. THAT TASK ORDER NUMBER ONE IS ATTACHED HERE TO, IS LIKEWISE APPROVED [00:05:01] TO ALLOW HDR TO DESIGN AND DEVELOP SPECIFICATIONS FOR A NEW HVAC SYSTEM FOR THE BR HESTER CENTER PARKS OFFICE AND FURTHER DIRECTING HDR TO SERVICE PROJECT MANAGER ON THE PROJECT TO INCLUDE SUPERVISION AND INSPECTION OF THE PROJECT TO ASSURE THE QUALITY AND EFFICACY OF THE PROJECTS IMPLEMENTATION. RED PASS ADOPTED THIS 20 DAY, 20TH DAY OF DECEMBER. BE SIGNED BY MYSELF, TESTED BY ROSA CORNER CITY CLERK. THIS HAS BEEN AN ONGOING ISSUE. UH, YOU'LL RECALL WE HAVE A, UH, CURRENT, THE CURRENT OPERATION OR THE CURRENT SYSTEM HAS TWO DIFFERENT MEDLING METAL COUPLINGS THAT HAVE FAILED ON MULTIPLE OCCASIONS AS WELL AS MULTIPLE PUMP FAILURES. IT'S NOT SIZED APPROPRIATELY FOR THE BUILDING THAT WE HAVE, AND WE'RE RUNNING ABOUT 50% CAPACITY. UH, SO WE'VE BEEN SPENDING A SIGNIFICANT AMOUNT OF MONEY IN THE FOUR YEARS I'VE BEEN HERE. WE'VE HAD TO MAKE A REPAIR EVERY SINGLE YEAR. UM, AND SO IT'S TIME TO, UH, TO REPLACE IT. TYPICALLY THESE SYSTEMS LAST BETWEEN 15 AND 20 YEARS. I THINK WE'RE ON YEAR 12 OR 13 OF THIS FACILITY IN THIS BUILDING. SO WE'RE APPROACHING, ITS NATURAL IN THE SPAN OF LIFE, BUT, UH, WE NEED TO GET SOMETHING DONE. UH, HDR'S RECOGNIZES AN EXPERT IN THE FIELD AND WE'D LIKE TO HAVE THEM COME IN AND NOT ONLY TO PROVIDE THE SPECIFICATIONS AND THE DESIGN, BUT ALSO INSPECT AND ENSURE THE QUALITY OF THE INSTALLATION SO THAT WE DON'T HAVE AN ONGOING ISSUE OR A LACK OF ACCOUNTABILITY. UH, WHEN IT COMES TO THE CONTRACTOR, AND THIS ISN'T THE SAME CONTRACTOR THAT, THAT, UH, THEY'LL SELECT THE CONTRACTOR, THEY'LL DEVELOP THE BID. OH, OKAY. THE SPECIFIC, THEY'LL DESIGN CONTROL THE BID AND THE SPECIFICATIONS AND WE'LL TAKE IT OUT FOR BID ONCE THE PROJECT'S READY FOR LETTING. OKAY. THEY'LL BASICALLY BE PROJECT MANAGER. YEAH. CORRECT. OKAY. I'LL HANDLE EVERYTHING FROM DESIGN TO THE CLOSEOUT. UH, JOHN'S HERE IF YOU GUYS WANT TO HAVE ANY, HAVE ANY QUESTIONS ABOUT HDR. THANK YOU COUNSEL FOR GIVING US THIS OPPORTUNITY THIS EVENING. UH, MY NAME IS JOHN PETERSON. I AM THE MUNICIPAL LEAD FOR THE, UH, GULF COAST BRANCH OF HDR STRETCHING FROM DOWN SOUTH OF CORPUS ALL THE WAY TO TO LOUISIANA. UM, WE DO THIS TYPE OF WORK. I'VE KNOWN WILL FOR A LONG TIME, UM, KNOWN CJ IN OTHER PLACES TOO. UM, THIS IS RIGHT UP OUR ALLEY THAT WE DO AGAIN, WE'RE GONNA COME, UH, WE'RE GONNA DO A SITE VISIT AND MEET WITH STAFF. TAKE A LOOK AT WHAT YOU HAVE, RESEARCH WHICH PRO WHAT'S THE PROBLEMS. UH, TALK TO, UH, SUPPLIERS. COME UP WITH A GOOD SOLUTION. COME UP WITH A GOOD SET OF PLANS AND SPECIFICATIONS TO HOLD THE CONTRACTOR TO. WHAT, UH, LEVEL OF SERVICE AND END RESULTS THAT Y'ALL HAVE WILL PROBABLY HELP THE CITY PROCESS BIDS. WILL PROB WILL CAST, UH, THE BIDS ON C PCAST TO GET MORE INTEREST. UH, C PCAST IS AN ONLINE BIDDING FORM, UH, TO GET, GENERATE MORE INTEREST, UH, HOPEFULLY GET, UH, SEVERAL BIDS IN FROM THAT. WE'LL PROVIDE A LETTER OF RECOMMENDATION AND THEN WE'LL, UH, HELP THE CITY THROUGHOUT THE PROJECT CLOSE OUT AND EVERYTHING ELSE. COOL. HAS HDR EVER DONE ANY, UM, ANY WORK WITH THE CITY OF CLU? YES, WE HAVE. WE WERE ACTUALLY PART OF THE WASTEWATER TREATMENT PLANT THAT'S RIGHT. WITH STRAIGHT WITH SCHRADER, WHENEVER THAT WAS DONE. THAT WAS AN AWARD-WINNING PLANT, I BELIEVE SO, YES. WE DO HAVE EXPERIENCE WORKING HERE WITH THE CITY OF CLUE, AND THEY WERE IN OUR INITIAL DRAW WHEN WE REVISED OUR ENGINEERING POOL BACK IN 2018 WHEN I FIRST ARRIVED THERE, ONE OF THE FIRST SUBMITTALS AND APPROVALS. ABOUT HOW MUCH ARE WE EXPECTING IT TO COST TO, I MEAN, IT'S GONNA BE COMPLETE OVERHAUL. LIKE THE SYSTEM THAT'S THERE IS GOING AWAY. SOMETHING BRAND NEW IS GONNA BE INSTALLED. CORRECT? IT'S 200,000. OKAY. I COULDN'T FIND IT CAUSE WE WENT OUTTA ORDER AND I WAS LIKE, WHERE? HERE? YEAH, THE, THE, I THINK THE AMOUNT THAT WE HAVE BUDGETED THIS YEAR IS 200,000. CORRECT. OKAY. SO HOPEFULLY IT'S LESS THAN THAT. ? YES, THE, THE, THE, THE CHILLED WATER PLAN, JUST THE PIECE ON THE OUTSIDE AND IT COOLS THE WATER. WE'RE NOT DOING THE WHOLE INNER INNER SYSTEM AIR HAMMERS AND EVERYTHING IS GOOD. OKAY. THIS IS THE ACTUAL PIECE THAT MAKES THE AIR COLD. OKAY. , YOU DON'T HAVE, WE WON'T HAVE THAT PROBLEM FOR THE NEXT FEW DAYS. OPEN, OPEN THE DOOR. YEAH. CAN YOU JAR THAT THOUGH? AND KEITH MIGHT PROBABLY NOT, SO, NO, THAT'S, I MEAN, PROJECT MANAGERS ARE GOOD, [00:10:02] SO, WELL, AND THE, THE ORIGINAL CONTRACT, UH, FROM THE ORIGINAL BID, UH, WE WENT THROUGH THE CONTRACT WITH THEM ON A, A PHONE CONFERENCE AND, AND, UH, THEY WERE VERY GOOD TO WORK WITH TO, TO MAKE SOME CHANGES THAT WE HAD REQUESTED AND ALSO ADD SOME, UH, SERVICES AS FAR AS INSPECTIONS AND SO FORTH. SO IT'S NOT JUST, SO WE HAVE SOMEBODY THAT'S COMING ON SITE THAT MAKES SURE THE CONTRACTOR'S DOING SOMETHING, DOING EVERYTHING THAT THEY'RE SUPPOSED TO DO. SO WE DON'T HAVE ANY PROBLEMS LIKE WE MAY HAVE HAD WITH OTHER PRIOR PROJECTS THAT WE DIDN'T HAVE SOMEBODY CHECKING, YOU KNOW? AND SO, UH, UH, THEY WERE VERY HELPFUL WHEN WE HAD THAT CONFERENCE AND, AND WENT THROUGH AND MADE CHANGES TO THE CONTRACT AND, UH, VERY OPEN, UH, TO CONSIDER OUR CONCERNS. SO, UM, GOOD. THE CONTRACT'S IN GOOD SHAPE, SO IF THEY'RE GONNA PUT A RIDGE MAN ON, THEY'LL CUT A HOLE IN IT. . YEAH. . WELL, WE DON'T GET INTO TOO MUCH DETAIL. YES, SIR. I FEEL COMFORTABLE KNOWING, OBVIOUSLY, YOU KNOW, WILL AND, AND WE WORKED IN, IN CITY PROJECT AND, AND I, I KNOW HE'S, HE'S GONNA HELP WHOEVER THE PROJECT MAN MANAGER IS OUT OVER THERE MAKING SURE THINGS ARE GETTING DONE AS WELL. SO MAYOR, I'LL, UH, I'LL MAKE A MOTION TO APPROVE RESOLUTION NUMBER 63. I'LL BE GLAD TO SECOND HAVE A MOTION BY COUNCILMAN AGUILAR THAT WE ADOPT RESOLUTION 63 DASH 2022 AND A SECOND BY COUNCIL PERSON. VAUGHN, ANY FURTHER DISCUSSION? HEARING NONE, I'LL ENTERTAIN THE VOTE. ALL IN FAVOR? AYE. AYE. WELCOME TO BOARD. THANK YOU. THANK YOU, JOHN. APPRECIATE IT. HAVE MERRY CHRISTMAS. MERRY CHRISTMAS. MERRY CHRISTMAS. NOW WE'LL MOVE BACK TO OUT BAY CONSIDERATION OF POSSIBLE ACTION TO ADOPT RESOLUTION NUMBER 60 20 22, AWARDING THE BID FOR ENGINEERING DESIGN SERVICES RELATED TO THE G O CDBG HAZMAT GRANT PROJECTS FOLLOWING THE REQUEST FOR QUALIFICATION SOLICITATION. AND IT WOULD BE RESOLUTION NUMBER 60 DASH 2022. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SLT, TEXAS AWARDING ENGINEERING DESIGN BID IN RESPONSE TO REQUEST FOR QUALIFICATION FOR SERVICES RELATED TO THE DESIGN OF REGIONAL FLOOD RISK REDUCTION IMPROVEMENT PROJECTS FUNDED THROUGH THE TEXAS G L O ADMINISTERED C D CDBG HAZMAT GRANT PROGRAM. WHEREAS THE CITY OCCLUDE IS IN PARTNERSHIP WHERE THE, WHEREAS THE CITY INCLUDED IN PARTNERSHIP WITH THE CITY OF LAKE JACKSON AND THE VELASCO DRAINAGE DISTRICT WAS AWARDED APPROXIMATELY 9.6 MILLION IN CDBG HAZARD MITIGATION HAZMAT GRANT FUNDS BY THE TEXAS GENERAL LAND OFFICE FOR THE MITIGATION OF FLOOD RISK ALONG THE FLAG LAKE PLANTATION DRAINAGE SYSTEM, THE PIN MONEY DRAINAGE SYSTEM, AND THE DIXIE DITCH A DRAINAGE SYSTEM. AND WHEREAS FEDERAL, STATE, AND CITY PROCUREMENT POLICIES REQUIRE THE SOLICITATION OF PROFESSIONAL SERVICES THROUGH A COMPETITIVE REQUEST FOR QUALIFICATION RFQ PROCESS. AND WHEREAS UNDER THOSE RULES, THE CITY DID ISSUE SUCH RFQ ON AUGUST 26TH, 22, 20 22, WHICH CLOSED ON OCTOBER THE 10TH, 2022 AND WHAT, AND WHEREAS THERE WAS ONLY ONE RESPONDING FIRM TO THE RFQ. AND WHEREAS THE CITY COUNCIL DECIDED TO REISSUE THE RFQ BASED ON THE STAFF AND THE CITY'S CONTRACTOR PROJECT MANAGEMENT CONSULTANTS RECOMMENDATIONS, WHEREAS THE RFQ WAS REISSUED AND CLOSED AT 3:00 PM FRIDAY, DECEMBER THE 16TH WITH A TOTAL OF FIVE RESPONDING PROPOSALS WHERE WHEREAS STAFF HAVE REVIEWED AND EVALUATED THOSE PROPOSALS AND RECOMMENDS BLANK OF BLANK, BE SELECTED AND APPROVED BY COUNCIL SO THAT NEGOTIATIONS ON A PROFESSIONAL SERVICE AGREEMENT CAN BE NEGOTIATED NOW THEREFORE BE RESOLVED BY THE CITY COUNCIL. THE CITY OF INCLUDE TEXAS. THAT BLANK OF BLANK IS HEREBY AWARDED THE BID TO NEGOTIATE A PROFESSIONAL SERVICE AGREEMENT RELATED TO FLOOD MITIGATION AND DRAINAGE IMPROVEMENTS FUNDED UNDER THE TEXAS GLO C D B G HAZARD HAZARD MITIGATION GRANT PROGRAM PROJECTS FOR THE CITY OF CLETE. FURTHER, THAT SHOULD SAID NEGOTIATIONS FAIL TO BE AGREEABLE TO THE PARTIES INVOLVED. THE CITY RESERVES THE RIGHT TO TERMINATE THOSE NEGOTIATIONS UNILATERALLY AND ENTER NEGOTIATIONS WITH THE NEXT HIGHEST SCORING RESPONDENT UNTIL SUCH TIME AS A FAVORABLE AGREEMENT CAN BE REACHED. RED PASSES ADOPTED THIS 20 DAY OF DECEMBER, 2022. IT'LL BE SIGNED BY MYSELF AND THE TEST BY ROSE APPOINTED AT CITY CLERK COUNSEL WILL RECALL THAT WE OPEN THIS, ONLY GOT ONE RESPONSE REOPENED IT THIS TIME. WE GOT FIVE. I WOULD CALL COUNSEL'S ATTENTION TO THE AGGREGATE SCORING SHEET. I WANT TO THANK JOHN AND WILL FOR SACRIFICING THEIR [00:15:01] WEEKEND OR PART OF THE WEEKEND, UH, ALONG WITH MYSELF ENJOYING SOME, UH, SOME REALLY, REALLY FASCINATING READING. AND BY FASCINATING, I'M STRETCHING THE TREE QUITE A BIT. NOT THAT WE DON'T LOVE OUR RESPONDENTS AND THEIR THEIR BIDS, UH, BUT AS A RESULT OF THAT SCORING, UH, YOU CAN SEE THAT THE SCORING PRETTY WELL ALIGNS ACROSS THE THREE OF US. UH, THE HIGH, UH, HIGH SCORE BELONGS TO FREEZING NICKELS INC. OF HOUSTON, TEXAS. IT'S OUR RECOMMENDATION THAT THEY BE AWARDED THE WORK. I WOULD ALSO NOTE THAT FREEZING NICKELS OR FNI, AS IT'S CALLED, UH, CONDUCTED THE INITIAL PLAN, WHICH WAS THE BASIS FOR THIS GRANT APPLICATION TO BEGIN WITH, AND THE WORK THAT WE'RE TALKING ABOUT, TALKING ABOUT DOING. SO THEY HAVE THE DATA, THEY HAVE THE EXPERTISE, AND I THINK THEY'LL BE ABLE TO HIT THE GROUND RUNNING AND, UH, AND GET US WHAT WE GET US WHERE WE NEED TO GO IN TERMS OF PERFORMING UNDER THIS GRANT, WHAT, WHAT WERE THE, UH, THE, WHAT WAS THE CRITERIA FOR THE, FOR THE SCORING? SO IF YOU TAKE A LOOK AT THE SCORING, UH, THE, THE AGGREGATE, AND LET ME PULL UP ONE OF MY SCORE SHEETS REAL QUICK. MY APOLOGIES. UH, BASICALLY IT WAS, UH, OVERALL CONFIDENCE AND EXPERIENCE TECHNICAL QUALIFICATIONS AND QUALITY ASSURANCE KEY STAFF INVOLVED IN THE REFERENCE CHECKS. AND SO THE, THE TOTAL OR THE TA A QA WAS 30 POINTS AND THEN 25 EACH FOR THE PERSONNEL AND THE, UH, OVERALL EXPERIENCE, AND THEN 10 FOR THE REFERENCE CHECKS. AND SO, UH, FREEZING NICKELS ON A COUPLE OF US SCORED PERFECT, UH, ACROSS THE BOARD, UH, BECAUSE THEY HAVE THE TECHNICAL EXPERTISE, THE STAFFING PLAN AND THE QA QUALITY ASSURANCE THAT WE FELT LIKE WAS WAS IN PLACE HAS FRIES AND NICHOLS. UH, I KNOW THEY WORK WITH OTHER CITIES AROUND US. DO THEY, HAVE THEY EVER DONE WORK WITH THE CITY OF FLUTE? THEY'VE DONE A LITTLE BIT OF WORK, I THINK A FEW YEARS BACK RELATED TO SOME TRAFFIC STUFF THAT WE SHARED WITH LAKE JACKSON. UH, AND THEN THEY ALSO, LIKE I SAID, WERE, THEY WERE, UH, THEY CONDUCTED THIS STUDY THAT FOR GENERATED THE PROJECT LIST WITH THE CITY OF CLETE, UH, UNDER CONTRACT WITH THE CITY OF LAKE JACKSON AS WELL. SO THEY WERE ALSO IN THAT FIRST CLASS OF INDUCTEE INTO OUR ENGINEERING POOL. SO YEAH, WITH THE, WITH THE FIRST, UH, WITH THE FIRST INITIAL EVALUATION OF THIS, OF THIS SYSTEM, THE CITY OF KLUTE, THE CITY OF LAKE JACKSON, COMBINED ON A, ON A PROPOSAL THROUGH FREEZING NICHOLS TO DO THE RESEARCH. THEY'RE THE ONES THAT FLEW THE DRONES OVER AND DID THE WHOLE NINE YARDS AS FAR AS THE INVESTIGATION OF WHAT NEEDS TO BE DONE. OKAY. THESE ARE THE GUYS THAT ARE DOING THE ENGINEERING WORK. THEY'RE NOT DOING THE ACTUAL PHYSICAL WORK. RIGHT? THIS IS JUST FOR THE ENGINEERING DESIGN, UH, OF THE PROJECT ITSELF. SO, WELL, SOMETIMES IT'S MORE IMPORTANT THAN THIS. THAT IS VERY, VERY TRUE. SO I MAKE MOTION, MOTION, WE APPROVE THIS, THAT RESOLUTION. I'LL SECOND THAT MOTION. I HAVE A MOTION BY CAPTAIN QUINN THAT WE ADOPT, FLEE AND NICKEL ADOPT RESOLUTION NUMBER 60 DASH 2022 WITH FREES AND NICKELS OF HOUSTON INCLUDED AS THE PRINCIPAL NEGOTIATION. YES, SIR. YES. AND HAVE A SECOND BY COUNCILMAN ALAR. SECOND, BECAUSE I BELIEVE ACCORDING TO THE, UH, ACCORDING TO THE RESOLUTION, THAT WE CAN'T AGREE TO TERMS AND WE HAVE THE RIGHT TO REJECT THEM AND MOVE TO THE, TO THE NEXT HIGHEST STORE. SO WE'LL SAY THAT THEY'RE GONNA BE THE INITIAL RESPONDER . OKAY. ANY FURTHER DISCUSSION? I JUST HAVE A QUICK QUESTION. HOW LONG IS, HOW LONG ARE WE EXPECTING THE WHOLE PROJECT FROM START TO FINISH TO TAKE, UH, DECADE OR, YEAH, THE, SO UNDER CONTRACT WE HAVE 18 MONTHS MM-HMM. , UH, FROM THE INITIATION. UM, WE'RE A LITTLE BIT BEHIND THAT SCHEDULE RIGHT NOW. WE CAN DO A ONE-TIME, ONE YEAR EXTENSION. WE'LL PROBABLY END UP DOING THAT DEPENDING ON WEATHER. UH, SO WE HAD A REALLY NICE DRY YEAR THIS YEAR, WHICH MEANS IT'S GONNA BE EXCEPTIONALLY WET AND SOGGY AND REALLY HARD TO WORK WITH, UH, WHEN IT ACTUALLY COMES TIME TO TURN DIRT. SO GOOD. BECAUSE THAT'S HOW THESE THINGS GO. SO, SO EVERYTHING HAS TO BE DONE AS LIKE, ALL THE WORK HAS TO BE DONE IN 18 MONTHS WITH, THAT'S A ONE YEAR AS EXTENSION OPTION? THAT'S CORRECT. IT DON'T TAKE LONG BUSY IN THAT AREA. IT DON'T TAKE, IT DON'T TAKE LONGER TO SPEND $9 MILLION. I HAVE QUESTION AND THEN JUST, NOT THAT I DOUBT OUR NUMBER ONE CHOICE, I REALLY DON'T. BUT THINGS HAPPEN. AND IF WE FORESEE GOING TO OUR NUMBER TWO CHOICE IS HAS THAT COMPANY BEEN, UM, DONE WORK FOR US BEFORE? YEAH. MCMANUS JOHNSON IS ACTUALLY CURRENTLY DOING OUR WATER WASTEWATER MASTER PLAN. THEY DID THE REMEDIAL WORK DOWN AT THE WASTEWATER TREATMENT FACILITY. UH, AND THEY'VE HANDLED, UH, SOME SHORT INTERIM, UH, LINE WORK LIKE THE CRESTWOOD REDESIGN, OTHER [00:20:01] PROJECTS LIKE THAT FOR US, THEY'RE, UH, I'VE WORKED WITH THEM IN THE PAST. THEY ALSO RUN OUR INITIAL ENGINEERING POOL WAY BACK WHEN, UH, THEY'RE A LITTLE BIT SMALLER, MORE RESPONSIVE FIRM. FREEZING NICKELS IS VERY LARGE, WHICH MAKES 'EM VERY EXPERTISE, BUT ALSO SOMETIMES A LITTLE BIT SLOWER. SO, UH, THEIR EXPERIENCE WITH THE CITY IS WHAT BOOSTED THEIR SCORE, UH, TO FINISH SECOND. MM-HMM. , I JUST, I JUST THOUGHT I RECOGNIZED ANYTHING. YES, YES MA'AM. OKAY. ANY FURTHER QUESTIONS, COMMENTS, DISCUSSION? HAVE A MOTION AND A SECOND. HEARING NO FURTHER, I WILL ENTERTAIN OR VOTE. ALL IN FAVOR? AYE. AYE. AYE. UNANIMOUS. THANK YOU. NEXT ITEM WOULD BE CONSIDERATION AND POSSIBLE ACTION TO ADOPT RESOLUTION NUMBER 61 DASH 2022 APPROVING AN AMENDMENT TO TASK ORDER NUMBER TWO WITH CS R S INC. TO REFLECT CHANGES TO REFLECT REVISED STAFF RATE AND GLL DRAW SCHEDULES RELATED TO SERVICES RENDERED IN THE ADMINISTRATION OF THE GLO CDBG HAZMAT GRANT PROGRAM. AND THIS WOULD BE RESOLUTION NUMBER 61 DASH 2022. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF INCLUDE TEXAS APPROVING AMENDING TASK ORDER NUMBER TWO, UNDER THE MASTER SERVICE AGREEMENT WAS C C S R S INC. FOR THE PROVISION OF THE GRANT PROJECT ADMINISTRATION UNDER THE G O CDBG HAZMAT GRANT PROGRAM, WHEREAS THE CITY HAS PREVIOUSLY APPROVED A MASTER SERVICE AGREEMENT WITH C CS R S INC. FOR THE DEVELOPMENT OF GRANT APPLICATION ADMINISTRATION, ADMINISTRATION SERVICES RELATED TO THE GLO HAZMAT GRANT PROGRAM. WHEREAS THE CITY HAS NOT BEEN ABLE TO EXECUTE PAYMENT REQUESTED UNDER INVOICING BY CRS BECAUSE THEIR INVOICE FAILED TO MEET THE GLOS GATE AND LOCK PROGRAM. AND WHERE C CRS HAS ALSO REVISED ITS STAFF ALLOCATION AND WAGE RATES SUBSEQUENT, WHICH NEED TO BE REFLECTED IN THE AGREEMENT NOW THEREFORE BE RESOLVED BY THE CITY COUNCIL OF CITY OF CLO, TEXAS. THAT TASK ORDER NUMBER TWO WITH CS RS IS HEREBY AMENDED TO REFLECT THE CHANGES THE CS R S STAFF WAGE ALLOCATION AND BILLING MODEL TO FACILITATE PAYMENT AND REIMBURSEMENT UNDER THE GUIDELINES OF THE G O HAZMAT GRANT PROGRAM. READ, PASSED AND ADOPTED THIS 20TH DAY OF DECEMBER, 2022, BE SIGNED BY MYSELF AND ATTESTED BY ROSE POINT AT CITY CLERK. SO I KNOW ALL THAT PROBABLY SOUNDS ABOUT AS CLEAR AS MUD. G O UH, INHERITED CDBG FROM TD H C A. AND SO, UH, AS THEY TRANSITIONED INTO THIS GRANT MANAGEMENT FIRM, THEY'VE BEEN WORKING ON THEIR POLICIES AND PROCEDURES AND THE GRANT DRAW PROGRAM IS A LITTLE BIT DIFFERENT FROM WHAT HAS PREVIOUSLY BEEN DONE UNDER CDBG. AND THEY'VE CREATED WHAT THEY CALL THEIR GATE AND LOCK PROGRAM WHERE CERTAIN PERFORMANCE BENCHMARKS HAVE TO BE MADE, BUT IT'S NOT NECESSARILY CHRONOLOGICAL TO THE ACTUAL WORK PERFORMED. I KNOW IT'S A LITTLE DIFFERENT. SO ONCE WE ENTER THE ENVIRONMENTAL PHASE OF THE PROJECT, THE ENVIRONMENTAL REVIEW PHASE OF THE PROJECT, THAT UNLOCKS OUR ABILITY TO ACTUALLY PAY THEM FOR THE GRANT ADMINISTRATION, THE, THE MOBILIZATION AND STARTUP, AS WELL AS THE ENVIRONMENTAL PHASE. ONCE WE ENTER THE ENGINEERING DESIGN PHASE, THAT UNLOCKS THE NEXT GATE, WHICH IS THEN ALLOWS US TO PAY FOR THE ENGINEERING DESIGN AND ALL THE ADMINISTRATIVE WORK RELATED TO THAT. THERE'S ANOTHER GATE WHEN WE START CONSTRUCTION. THERE'S ANOTHER GATE WHEN WE DEMOBILIZE FROM CONSTRUCTION, THERE'S ANOTHER GATE. THEY HAVE BEEN BILLING US AND WE HAVE BEEN UNABLE TO PAY THEM BECAUSE WE DIDN'T UNDERSTAND THE GATE UNLOCKED SYSTEM CORRECTLY. WE NOW HAVE THAT ALL SYNCED WITH GLO AND THAT'S WHAT THIS TASK ORDER REPRESENTS, IS THE UNDERSTANDING THAT THEY'RE GONNA BILL US NOT BASED AROUND THE HOURS THAT THEY'VE WORKED ON A SPECIFIC PORTION OF THE PROJECT, BUT UNDER THAT GATE. SO IF YOU TAKE A LOOK AT THE GATES OR IF YOU TAKE A LOOK AT THE BILLING NOW, THE INVOICING WILL BE COMPLETELY DIFFERENT FROM WHAT IT WAS. IT'LL REFER NOW TO WE MET THESE OBJECTIVES TO OPEN THIS LOCK ON THIS GATE AND WE'LL BE PREPARING TO MOVE TO THE NEXT GATE AND UNLOCK IT. IT'S WEIRD. YEAH. IT'S LIKE PLAYING A VIDEO GAME. EXACTLY. UM, AND SO, UH, I DON'T KNOW WHETHER LIKE THE GUYS THAT DEVELOPED THE SYSTEM ARE BIG ZELDA FANS, BUT WHATEVER IT IS, IT'S, IT'S, IT IS WHAT IT IS. UH, WE WANT TO MEET IT AND WE WANNA BE ABLE TO PERFORM UNDER THE CONTRACT. AND, UH, QUITE FRANKLY, THESE GUYS HAVE BEEN GOING SINCE THE SUMMER WITHOUT ANY COMPENSATION. SO WE'D LIKE TO GET THIS APPROVED. SO, SO THIS IS SOMETHING THAT, THIS IS SOMETHING THAT, UH, CDBG IS ON BOARD WITH. YES, THEY'VE REVIEWED IT, THEY'VE APPROVED THE PLAN, THEY'VE APPROVED THE, THE ALLOCATIONS, AND NOW THEY'RE, BECAUSE WHAT WE DO IS WHEN WE GET AN INVOICE FROM THEM, WE SHARE THAT WITH G O, WE THEN DRAW THE FUNDS AND PAY THEM OUT OF THAT DRAW THAT WE GET FROM GLO. AND GLO KEPT KICKING IT BACK WITH NO EXPLANATION FOR ABOUT TWO MONTHS. [00:25:01] AND FINALLY WE'RE LIKE, WHAT'S GOING ON? WHAT ARE WE NOT DOING CORRECTLY? AND THEN WE HAD A LONG MEETING WITH OUR TEAM AT GLO AND THEY EXPLAINED, YOU'RE NOT MEETING THE GATE AND LOCK SYSTEM, YOU NEED TO DO IT THIS WAY. SO WE'VE REDONE EVERYTHING TO FOLLOW THAT SYSTEM. NOW, NOW EVERYBODY'S ON THE SAME PAGE. HOPEFULLY MAYBE MAYBE FOR FOR THE NEXT TWO MONTHS. FOR THE NEXT TWO MONTHS UNTIL THEY CHANGE MORE RULES. CORRECT. SO, AND THERE'S NO CHANGE IN PAY OR ANYTHING LIKE THAT? NO. THE BASE AMOUNT THAT WE, THE, THE BASE AMOUNT THAT WE PAY IS THE BASE AMOUNT THAT WAS IN THE ORIGINAL CONTRACT. WE'VE NOT INCREASED THAT IN ANY WAY, SHAPE OR FORM. AND I WOULD NOTE WHEN WE AWARDED THEM, UH, THEY'RE ALLOWED TO TAKE A FEE UP TO I THINK IT'S 7% AND THEY CAME IN AT FOUR AND A HALF. SO WE'RE, WE'RE GETTING THEIR SERVICES AT A DISCOUNTED RATE. SO ARE THEY, OH, SORRY, GO AHEAD. ARE THEY CHARGING US ANY LATE FEE PAYMENTS OR ANYTHING? NO. NO. THEY HAVE NOT. THEY HAVE NOT CHARGED US ANY LATE FEES. THEY'VE BEEN EXCEPTIONALLY PATIENT. UH, I GOTTA GIVE KUDOS TO THEM FOR BEING PROFESSIONAL AND PATIENT WITH US AS WE ALL, AS THEY PUT IT, WE'RE ALL LEARNING THE SYSTEM TOGETHER. SO WELL, OKAY, SO IT'S NOT BASED LIKE ON AN HOURLY RATE, IT'S GETTING THROUGH THE LOCK AND GATE. WELL, THEIR WORK IS ON AN HOURLY RATE, BUT THEY HAVE TO COMPILE THEIR HOURS AND SHOW THEIR TASK RELATED TO THE GOT THE GATE AND THE LOCK, WHICH IS WHERE THE, THE FUNDAMENTAL DISCONNECT WAS OCCURRING BECAUSE WE'RE LIKE, OH, THEY'VE CHARGED THESE MANY HOURS TOWARDS ADMINISTRATION AND G O KEPT SAYING NO, THEY HAVEN'T ACHIEVED THE UNLOCKING OF THE GATE RELATED TO FREE, FREE DEVELOPMENT SERVICES BECAUSE THEY HAVEN'T STARTED THE ENVIRONMENTAL PROCESS. IT'S YEAH. FEDERAL FUNDS. YES. , I'M GLAD SOMEBODY, UM, UP HERE UNDERSTANDS IT. WELL, AND I, I GOTTA SAY, OUR FRIENDS AT VELASCO DRAINAGE, WE HAD A MEETING WITH THEM YESTERDAY, ARE A LITTLE FRUSTRATED BECAUSE WE KEEP TELLING 'EM TO TAMP THE BRAKES ON THE MAINTENANCE BECAUSE WE'VE GOTTA GET THE ENVIRONMENTAL FINISHED BEFORE WE CAN DO ANY REAL WORK IN THERE. SO YEAH. OKAY. I WOULD CONSIDER A MOTION TO APPROVE RESOLUTION NUMBER 61 DASH 2022. I'LL MAKE THAT MOTION BE MOTION MADE BY COUNCILMAN AGUILAR. DO I HAVE A SECOND? I'LL SECOND COUNCIL PERSON MADS FURTHER DISCUSSION, FURTHER QUESTIONS. HEARING NONE, I WILL ENTERTAIN THE VOTE. ALL IN FAVOR? AYE. AYE. AYE. UNANIMOUS. THANK YOU. YOU THINK THAT IF YOU THOUGHT THAT ONE WAS UNCLEAR WHAT YOU'D READ TO DO CONSIDERATION POSSIBLE ACTION TO ADOPT RESOLUTION NUMBER 62 DASH 2022 APPROVING TASK ORDER NUMBER THREE WITH CRS TO INCLUDE PROJECT SCOPING AND APPLICATION DEVELOPMENT RELATED TO THE 1.2 MILLION 2002 C D B G HAZARD MITIGATION METHOD OF DISTRIBUTION DEVELOPED BY H G A C A G L O TO AUGMENT THE GLO HD G O CDB G HAZMAT GRANT PROJECT. THIS IS AN ADDITIONAL 1.2 MILLION THAT THEY HAVE ALLOWED US TO APPLY FOR. SO THIS WILL BE A PRO, SHOULD BE AN ONGOING PROJECT. YES. THAT WILL IF WE RUN INTO SOMETHING THAT, THIS ONE THAT WE CAN'T FUND, WE CAN FUND WITH THIS ONE, CORRECT? CORRECT. WELL, YES AND NO. THAT WAS, UH, ONE OF THE LONGER DISCUSSIONS WE HAD A COUPLE WEEKS AGO ON A CONFERENCE CALL WITH H G A C. UH, G O AND JOHN, WE, WE, I HAD AN IDEA, WE KIND OF HAD AN IDEA WHAT WE WANTED TO DO. UNFORTUNATELY, THE AREA THAT WE WANTED TO DO WITH IT DIDN'T MEET THE LMI CRITERIA BY THEIR DESCRIPTION. SO THEY'VE ASKED US TO INSTEAD FOCUS ON THE PROJECT AREA CURRENTLY AFFECTED. SO WE'RE GONNA AUGMENT AND IMPROVE THE PROJECTS THAT WERE ALREADY APPROVING OR THAT WE'LL BE DESIGNED WITH THESE MONIES. OKAY. SO, SO IF THERE'S SOMETHING IN THERE THAT GOES OVER BUDGET IT, THIS WILL COVER IT, IT'S COVERING THAT, AND THEN WE'RE GONNA DO SOME VALUE ADDED TO THE PROJECT ITSELF. OKAY. BUT THIS WILL HAVE TO GO THROUGH THE GATEKEEPER TOO. YES. , IT'S GOT THE SAME GATE AND LOCK PROGRAM. UH, AND THIS IS ONE OF THOSE THINGS WE HAD, TYPICALLY WHEN A METHOD OF DISTRIBUTION IS DONE, UH, IT'S A STRAIGHT CASH INFUSION. IF YOU THINK ABOUT WHEN WE GOT THE METHOD OF DISTRIBUTION RELATED TO THE, UH, SAR, UH, THE, TO THE COVID RELIEF, THE ARPA FUNDS, THAT WAS JUST DIRECT CASH TO THE CITY. UH, THIS TIME GLO IT STARTED AS A METHOD OF DISTRIBUTION WHERE IT WAS GONNA BE A STRAIGHT ALLOCATION TO THE CITY. GLO AND H G C GOT TOGETHER AND DECIDED INSTEAD THAT THEY WANTED AN APPLICATION. SO WE'RE GONNA HAVE TO FILL OUT ANOTHER APPLICATION DESCRIBING HOW WE'RE GOING TO AUGMENT THE EXISTING PROJECT. THAT'S ONE OF THE THINGS WE'RE STRUGGLING WITH. WE'LL BE MEETING WITH [00:30:01] THEM AT 10 O'CLOCK TOMORROW MORNING TO TRY AND GET THAT PROJECT STARTED. BECAUSE WE HAVE A DEADLINE OF, I THINK IT'S JANUARY 10TH OR 11TH OR NINTH, WHEN FIRST WEEK, FIRST TWO WEEKS OF JANUARY, WE HAVE TO HAVE THE APPLICATION SUBMITTED GLL FOR THEIR APPROVAL OR FOR THEIR ACCOUNT FOR CONSIDERATION. BUT THIS IS THE SAME FIRM, SAME FIRM THAT'S HANDLING THE OTHER PROJECT. AND SAME, UH, AND THAT WAS THE OTHER QUESTION WE HAD WAS DO WE HAVE TO GO THROUGH THE WHOLE PROCESS AGAIN OF FINDING ANOTHER GRANT ADMINISTRATOR? IT'S COVERED UNDER MSA. WE DO NOT HAVE TO DO THAT THIS TIME. SO, UM, JUST TO WRAP IT AROUND MY HEAD AGAIN, AND WE'RE GOING TO USE THIS, THESE FUNDS TO EXPAND, EXPAND THE PROJECT THAT WE'RE ALREADY DOING. CORRECT. WE'RE NOT CREATING ANOTHER PROJECT. WE'RE NOT. WELL, THERE WILL BE SOME ADDITIONAL WORK. SO THINK ABOUT IT THIS WAY. IF YOU THINK ABOUT WE'RE GONNA, THIS GIVES US THE ABILITY TO DO INLINE DETENTION WITH THE DITCHES, NOT JUST IMPROVE THE BASIN. IT GIVES THOSE WORDS HE USED WHILE AGO, VALUE ADDED. RIGHT? THIS GIVES US THE ABILITY TO, UH, DO SOME INNOVATIVE STUFF. UH, WE HAD TALKED ABOUT DOING SOME CONCRETE LINING. THEY DON'T WANNA DO THAT AND WANTED TO GO TO A PERVIOUS, PRO PERVI PERVIOUS MATERIALS PROCESS. UH, THERE. SO WE'LL BE USING SOME DIFFERENT TECHNOLOGY, UH, IN THE, IN THE PROJECT BECAUSE OF THESE FUNDS. UH, WE'RE ALSO LOOKING AT SOME TRAIL CONNECTIVITY ASSOCIATED WITH THE IMPROVEMENTS THAT WE MAKE. SO, UH, BASICALLY LOOKING AT BASICALLY ALMOST A MONETIZING THE DITCHES THAT WE'RE PUTTING, THAT WE'RE IMPROVING, IF THAT MAKES SENSE. MM-HMM. . SO, UM, AUGMENTATION AND ENHANCEMENT. THERE YOU GO. . AND IT'LL BE UP TO THE GUYS AT FREEZING NICKELS TO DESIGN WHAT THAT LOOKS LIKE. I WOULD LOVE TO GIVE YOU VISUALS. I, I CAN SEE IN MY HEAD, BUT IT'S NOT GONNA TRANSLATE WELL TO WHAT I TRY AND SHOW YOU. THIS PUTS MORE COLLAGEN INTO THE, INTO THE LIPS. THERE YOU GO. THERE YOU GO. . THERE YOU GO. YOU ANYONE CARE TO MAKE A MOTION TO APPROVE RESOLUTION NUMBER 62 DASH 2022? I'LL DO IT. MR. QUINN MAKES THE MOTION. DO I HAVE A SECOND? I'LL SECOND. COUNCIL POSTON MAKES A SECOND FURTHER DISCUSSION, FURTHER QUESTIONS. DOES SO ONCE THEY GET EVERYTHING TOGETHER, DOES IT COME BACK BEFORE US TO SHOW US PICTURES? WE'RE GONNA GIVE YOU GUYS PROGRESS UPDATES AND SAY, THIS IS WHAT YOUR PROJECT'S GONNA BE AND THIS IS WHAT IT'S GONNA LOOK LIKE. OKAY. WHAT'S ON A VISUAL? YEAH, IT'LL BE, I MEAN, WE'LL GET A SET OF PLANS. WE'LL GET A SET OF PLANS WITH EVERYTHING ENGINEERED ON IT AT SOME POINT. YES. AND IT WILL SHOW US THEY'RE GONNA BUILD THIS DITCH, 900 FOOT LONG, 80 FOOT WIDE OR WHATEVER, WHATEVER. GOOD. OKAY. AND THE NICE THING ABOUT FREEZING AND NICKELS IS THEY DO A REALLY GOOD JOB OF GEO MODELING AND CAN SHOW US KIND OF HOW IT'S, WHAT THE VISUAL WILL LOOK LIKE ONCE IT'S ALL DONE.
