IT IS SIGNED BY ROSIE, APPOINTMENT CITY, CLERK CITY OF KLUT, TEXAS. UM, AS WITH ALL ITEMS, UH, THE PUBLISH AFFIDAVIT IN HERE AND THE NOTICE OF MAILINGS ARE IN HERE OVER 14 SENT OUT. WITH THAT BEING SAID, I DROPPED MY HAT. THE FLOOR IS NOW OPEN FOR, UH, COMMENTS FROM THE, UH, PERSON MAKING THE REQUEST. AND MR. HAYSLIP TERRY IS THE INDIVIDUAL HERE THAT'S MAKING THE APPLICATION. UH, COUNSEL, MR. ESCOBEL IS NOT HERE TONIGHT. UH, I'VE TRIED TO CONTACT HIM ON NUMEROUS QUE UH, OCCASIONS. I CALLED HIM TODAY. I ALSO WENT BY HIS HOUSE SINCE IT'S RIGHT HERE, NO ANSWER AT THE DOOR. SO I'LL HAVE, IF YOU'D LIKE TO ASK ME QUESTIONS ON IT, I'LL HELP BEST I CAN. OKAY. UH, MY ONLY QUESTION IS, UH, I NOTICED IN THE, IN THE THING THAT IT SAYS IT WILL NOT OBSTRUCT TRAFFIC AND IT WILL NOT OBSTRUCT PUBLIC SAFETY. I'M SORRY. I SAID IT'S, YEAH, MAYOR MAYOR'S ASKING IF IT WOULD OBSTRUCT THE VISUAL OR THE PUBLIC SAFETY. NO, NO VISUAL OBSTRUCTION. YEAH, NO VISUAL. NO VISUAL OBSTRUCTION AND NO, NO. A NO ADVERSE CONDITIONS FOR THE EMERGENCY SERVICES? NO. WHAT? NO ADVERSE CONDITIONS FOR THE EMERGENCY SERVICES. NO AC NO ACCESS PROBLEMS OR FIRES OR ANYTHING LIKE THAT. IT'S ALL OPEN. AND THIS IS ONE OF THE OLDER HOUSES BUILT A LONG TIME AGO, AND, UH, BUILT, IT'S BUILT ONE FOOT OFF THE PROPERTY LINE. UH, THIS IS THE CARPORT. HE JUST, HE JUST WANTS TO STAY LINED UP WITH THAT. IT'S NOT A VIEW OBSTRUCTION OR ANYTHING LIKE THAT. MR. DUNCAN, DO YOU WANT TO GO THROUGH THE VARIANCE FORM AND WHAT? SURE. OKAY. SO THIS IS THE CARPORT OR THE, I THINK IT IS THE CARPORT, YES. OKAY. THIS IS THE CARPORT, THE VARIANCE REQUESTED HERE AS TO, UM, UH, THIS WOULD VIOLATE THE SETBACK RULES. IS THAT RIGHT? RIGHT. OKAY. AND SO, UH, YOU KNOW, IN ORDER TO GRANT A VARIANCE, YOU HAVE TO FIND THREE THINGS. NUMBER ONE, YOU HAVE TO SAY, UM, THAT, UH, THERE'S A CONDITION THAT'S UNIQUE TO HIS PROPERTY THAT'S NOT SIMILAR TO HIS NEIGHBORS. RIGHT. SO FOR SOME REASON, THE SHAPE, THE LOCATION, UH, OF HIS PROPERTY, UM, HE'S THE ONLY ONE IN THIS SITUATION AND, UH, AFFECTED BY THE SETBACK AND OTHER NEIGHBORS, UM, UH, ARE THEIR, THEIR PROPERTY IS DIFFERENT THAN HIS. AND SO, YOU KNOW, I DON'T KNOW. THAT WOULD BE A FACT QUESTION AS FAR AS, YOU KNOW, WHAT IS UNIQUE ABOUT HIS PROPERTY THAT IS NOT THE SAME AS HIS NEIGHBORS? UM, THE SECOND QUESTION WOULD BE YOU HAVE TO SHOW THAT, THAT THIS WOULD BE, UH, DENYING IT WOULD BE A, A, UH, A HARDSHIP, UH, UNDUE HARDSHIP THAT WOULD PREVENT DEVELOPMENT OF HIS PROPERTY. UM, YOU KNOW, THAT'S A LITTLE BIT, UM, UH, VAGUE AS FAR AS WHAT IS WHAT CONSTITUTE AN UNDUE HARDSHIP. BUT TYPICALLY IT MEANS THAT, UH, A PROPERTY JUST COULDN'T BE DEVELOPED, UH, AT ALL, UM, BECAUSE OF, UH, THIS SETBACK RULE AND THAT THAT WOULD MAKE A HARDSHIP THAT HE CAN'T EVEN REALLY USE HIS PROPERTY. IT, IT WAS ALMOST LIKE A, A TAKING BY THE GOVERNMENT THAT PREVENTS HIM FROM BEING ABLE TO EVEN USE HIS PROPERTY AT ALL, UH, BECAUSE OF THIS RULE. UH, I DON'T THINK THAT THAT NECESSARILY [00:10:01] APPLIES IN THIS CASE. UM, AND THEN THE THIRD, UH, QUESTION WOULD BE, DOES, UH, GRANTING THE VARIANCE WITH THAT, UH, ADVERSELY AFFECT THE NEIGHBORS OR IMPAIR, UH, THE PURPOSE OF THE REGULATIONS? THAT'S WHAT WE TALKED ABOUT. IT DOESN'T SEEM LIKE, BECAUSE IT WOULDN'T AFFECT EMERGENCY SERVICES OR IT WOULDN'T, UH, AFFECT, UH, THE SIGHT LINES OF THE ROAD. IT SOUNDS LIKE THREE IS NOT A PROBLEM. UH, BUT NUMBER ONE, THE QUESTION IS, UM, IS IT THE CONDITION FOR HIS PROPERTY UNIQUE AND DIFFERENT FROM HIS NEIGHBORS? I DON'T KNOW IF THAT'S THE CONDITION OR NOT. SO THAT WOULD BE THE, THAT WOULD BE THE FIRST QUESTION IS WHAT'S UNIQUE ABOUT HIS PROPERTY THAT IS DIFFERENT FROM SURROUNDING PROPERTIES? WELL, IF YOU WENT BY THERE AND LOOKED, IF YOU'RE STANDING ON THAT CORNER IN FRONT OF HIS HOUSE, LOOKING DOWN THE SIDE OF HIS HOUSE WHERE HE IS WANTING TO PUT THIS, I'M SORRY. WHERE HE IS WANTING TO PUT THIS, UH, THERE'S, THERE'S NOT ANYTHING THAT I CAN SEE THAT'S VIEW OBSTRUCTING. THAT'S WHAT YOU'RE ASKING. NO, HE'S ASKING NO, NO. WHAT, WHAT'S THE DIFFERENCE? WHAT MAKES IT UNIQUE? YEAH, YEAH. FOR EXAMPLE, I'LL GIVE AN EXAMPLE. LET'S SAY SOMEBODY HAS A CORNER LOT AND THE CITY HAS DITCHES BEHIND AND ON THE SIDE OF THE LOT. AND SO, UH, HIS LOT IS DIFFERENT FROM THE PEOPLE FURTHER DOWN THE LINE. AND SO, YOU KNOW, ENFORCING A SETBACK AGAINST HIM WOULD MEAN THAT, UH, UH, HE CAN'T DO WHAT OTHER PEOPLE CAN DO IN HIS CONDITION JUST BECAUSE HIS LOT IS DIFFERENT THAN EVERYBODY ELSE'S LOT. EXACTLY. RIGHT. AND SO THE QUESTION IS, IS SOMETHING ABOUT HIS LOT DIFFERENT THAN EVERYBODY ELSE AROUND HIM? WHERE IT'S PLACED IS UNIQUELY DIFFERENT, BUT NOT THE LOT. YEAH. THE, THE OR HIS HOUSE IS PLACED TOWARDS THE CLOSENESS OF THE PROPERTY LINE IS WHAT IS UNIQUE ABOUT IT. THE REST OF 'EM ARE SET BACK AND, UH, NOT ONLY THAT, THERE'S A HUGE OAK TREE BETWEEN HIM AND THE NEIGHBOR STRAIGHT BEHIND HIM. AND IT'S NOT, LIKE I SAID, IT'S NOTHING OBSTRUCTING ABOUT IT AT ALL. OKAY. PARALYZED. WELL, I THINK THE, I THINK THE UNIQUENESS, IT'S UNIQUELY TO THE FACT THAT IT'S SET OUT FAR TOWARDS THE ROAD IN COMPARISON TO THE REST OF THE NEIGHBORS. YEAH. WELL, THE, THE, THE UNIQUENESS IS, IS THAT HIS, HIS HOME IS BUILT TO WITHIN ONE FOOT OF THE PROPERTY LINE, WHICH WAS PROBABLY NOT ENFORCED WHEN THAT THE FIVE FOOT RULE WAS PROBABLY NOT EVEN THE EFFECT WHEN THAT, WHEN THAT HOUSE WAS BUILT. YEAH. RIGHT. CORNER OF COLLEGE. BUT THAT DOESN'T GRANDFATHER HIM COULD DO IT AGAIN. RIGHT. WELL, YEAH, LET'S SAY, LET'S SAY THAT THERE'S A, LET'S SAY, I DON'T THINK HE, I MEAN, THERE, THERE'S NOTHING ABOUT THE LOT. IT'S ABOUT WHERE HE BUILT THE HOUSE, RIGHT? I THINK, WELL, THAT'S, AND I THINK MR. DUNCAN'S SPEAKING THE LEGALITY OF MR. MR. CHRIS'S QUESTION. MR. CHRIS'S QUESTION IS, IS THE FACT THAT HE HAS A HOUSE THAT'S WITHIN THAT ONE FOOT SETBACK DOESN'T JUST MEAN YOU CAN GO BUILD ANOTHER STRUCTURE BEHIND, RIGHT? CORRECT. ON THAT SAME LINE? CORRECT. IS IT POSSIBLE THERE ARE OTHER LOTS OR OTHER HOUSES THAT ARE BUILT TOO CLOSE TO THE PROPERTY LINE? YES, SIR. AND OTHER PARTS OF CLO? YES, SIR. THERE ARE. IT'S NOT POSSIBLE. IT'S REALITY'S SCARED BUNCH. NO, I WAS TRYING TO BE FAIR WITH THAT QUESTION. YEAH, IT'S A REALITY I'M SURE HONOR. SO, SO THIS STARTS A PRECEDENT OF THAT THIS IS GOING, THIS COULD HAPPEN ALL OVER TOWN IN A MATTER OF SPEAKING. SEE, THAT'S WHAT I'M WONDERING TOO. WELL, IF PEOPLE WANNA BUILD A CARPORT, AND, AND AT WHAT POINT IF THEY SELL THAT PROPERTY, DOES IT BECOME TO A PROBLEM WITH ENCROACHMENTS ON SURVEYS OR, UH, SOMEONE BORROWING MONEY FROM A PLACE BECAUSE IT DOESN'T MEET THE CITY STANDARDS, STANDARDS AND ORDINANCES? UH, I HATE TO TELL ANYBODY WOULD DO THEIR HOUSE, BUT AT SOME POINT, WE'VE GOT PEOPLE NOW JUST PUTTING STUFF UP AND THEN ASKING FOR PERMISSION. THAT'S NOT THE CASE WITH THIS GENTLEMAN. BUT THESE VARIANCES CONTINUE TO ALLOW, BASICALLY FOR OUR ORDINANCES TO BE OVERRUN, WHICH IS THE SECOND CRITERIA. WE, WE DID A VARIANCE JUST LIKE THIS ON CRESTWOOD STREET, ON THE SIDE OF THE HOUSE. SO THEN WHAT'S THE POINT OF THE ORDINANCES? IF WE SET A PRECEDENT AND WE JUST KEEP, ALREADY GOT A PRESIDENT SET, WE GOT UNTIL WE STOPPED, WE GOT ANOTHER HOUSE, WE'VE OKAYED TO DO A SETBACK. MM-HMM. , UH, LEAN TWO ON THE SIDE OF THE HOUSE, THE END OF THE HOUSE, RIGHT OVER TO THE PROPERTY LINE. WELL, I CAN NAME YOU TWO PEOPLE THAT WAS TOLD NO 'CAUSE OF THE SAME REASON. YEAH. SO, UH, IT'S UP TO Y'ALL. WELL, I MEAN EVERYBODY, I MEAN, EVEN THIS GUY HAS BEEN TOLD NO, HIS, HIS, HIS OPTION IS TO IS TO COME TO US, BRING IT TO US. CORRECT. I MEAN THAT'S, THAT'S, THAT'S WHY WE'RE HERE IS HE'S EXERCISING HIS OPTION TO BRING IT TO US TO, TO MAKE THE FINAL [00:15:01] DECISION. AND THE THREE CRITERIA WE'RE SUPPOSED TO GO WITH IS UNIQUENESS OF THE LOT FOR ONE FORM OR FASHION AND THE HARDSHIP FOR NOT ALLOWING IT. AND WHAT WAS THE THIRD ONE? UH, WILL IT ADVERSELY AFFECT NEIGHBORS OR, OKAY. YEAH. OR LIKE, YOU KNOW, PER EMERGENCY SERVICES OR VIEW LINES OR SIGHT LINES ON THE ROAD OR HARM THE NEIGHBORING PROPERTIES. RIGHT. BUT, YOU KNOW, TYPICALLY THESE ARE SUPPOSED TO BE, UH, SETBACK. UM, NOW YOU MENTIONED THE TREE. I MEAN, THERE IS A CASE WHERE THERE'S A, UH, THE PEOPLE COULD, YOU KNOW, CUT DOWN THE TREE AND THEN BUILD, UH, BUT IT WAS A HISTORIC, YOU KNOW, IT WAS A HISTORIC OAK TREE WHERE THEY SIGNED A TREATY OR SOMETHING UNDERNEATH IT. RIGHT. SO THEY SAID, WELL, YOU KNOW, BECAUSE OF THAT VERY UNIQUE CIRCUMSTANCE, WE'LL, GRANT THE VARIANCE. BUT THE QUESTION IS, IS HIM NOT BEING ABLE TO HAVE A, A CARPORT CREATING SUCH A, A HARDSHIP ON HIM THAT IT, IT PREVENTS HIM FROM, YOU KNOW, FAIRLY USING HIS PROPERTY AND, YOU KNOW, HE HAS A HOUSE THERE. HE'S BEING ABLE TO FAIRLY USE HIS PROPERTY AS IS. HE'S BEEN ABLE TO FAIRLY USE HIS PROPERTY FOR SEVERAL, MANY YEARS SINCE THEY BUILT THAT HOUSE. RIGHT. SO, YOU KNOW, I DON'T KNOW THAT, UH, THAT WOULD FIT THE SPECIFIC, YOU KNOW, LEGAL REQUIREMENT OF, OF HARDSHIP. RIGHT. IS, IS HE THE ORIGINAL OWNER? JERRY? THE, WHAT IS HE THE ORIGINAL OWNER THAT I DIDN'T INVESTIGATE. HOW LONG HAS HE LIVED AT THE RESIDENCE? NO, SEVERAL YEARS. OKAY. I'VE BEEN HERE SINCE 79. HE'S BEEN THERE FOR, FOR A LONG TIME. OKAY. SO THIS ISN'T A NEW SITUATION THAT'S COME UP? YES. OKAY. SO IT'S NOT LIKE, BY NOT DOING THIS, IT'S GOING TO HURT HIM. IS IT THIS WAY? PUT HIM, OTHER THAN NOT HAVING A CARPORT WELL, AND WORRY ABOUT IT TOO FAR THIS WAY OR THAT WAY? YES, MA'AM. IS IT ? SO BASED ON THE PICTURE THAT WE'RE LOOKING AT ON OUR SCREENS, THE CARPORT'S GONNA GO RIGHT THERE WHERE THAT PICKUP TRUCK IS. IT LOOKS LIKE IT HAS A IGLOO OR SOMETHING IN THE BACK OR A DRONE OF SOME KIND? NO, NO, NO. IT GOES BEHIND THE PROPERTY, BEHIND THE HOUSE. OKAY. 'CAUSE THAT'S WHAT WAS THROWING ME OFF WAS THIS WAS THE PICTURE, BUT THE DIAGRAM MAKES IT LOOK LIKE IT'S IN THE BACKYARD, LITERALLY GOING ALL THE WAY TO THE FENCE. YOU CAN SCROLL THE OTHER WAY. OH, I DIDN'T KNOW THAT. THIS ONE? NO MA'AM. THE SKETCH. YEAH, THERE WE GO. THAT, THERE YOU GO. SCROLL JUST A LITTLE BIT MORE. SORRY. MM-HMM, . SO IT SAYS, OR MAYBE ZOOM OUT TO THE TEXT. YOU CAN SEE WHERE IT SAYS AT THE TOP OF THE PAGE FRONT, THAT'S THE FRONT OF THE HOUSE THAT YOU'RE LOOKING AT IN THAT PHOTO. SO WHERE, CAN YOU GO BACK TO THE, THE SATELLITE IMAGE? YEAH, THE SATELLITE IMAGE LOOKS LIKE IT'S, THAT'S WHAT I DID WAS I GOT GOOGLE. SO WHERE, WHERE'S IT GONNA GO ON? IT'S BEHIND, BEHIND THE HOUSE. CAN YOU POINT TO WHERE, BECAUSE LIKE BEHIND THE HOUSE, TO ME IT LOOKS LIKE THERE'S A FENCE THERE. THERE'S A SHED. SO IF YOU SEE THE, THE SHED, WHERE IS IT? UH, I DUNNO WHAT IT'S TO THE, TO THE LEFT OR WHERE THE CARS ARE? YES, MA'AM. WHERE THE CARS ARE IN THAT, WHERE PARKED CORRECTLY? UH, TOP RIGHT CORNER. I MEAN TOP LEFT CORNER WHERE THE CARS ARE? NO, MA'AM. WHERE THE CARS ARE PARKED BEHIND THE HOUSE. OKAY. I DON'T THERE KNOW WHAT THE FRONT AND THE BACK IS, I THINK IS WHAT I PROMISE IS. 'CAUSE BECAUSE THERE'S TWO, IT'S LIKE THERE'S TWO DRIVEWAYS OR SOMETHING DOWN THERE. I THINK. SEE THERE'S LIKE, THERE'S TWO DRIVEWAYS. SO I'M LIKE, WHICH PART IS THE FRONT? HE'S, HE'S ON THE CORNER. HE'S ON THE CORNER OF THE DROP INTO SOMETHING ELSE. OH. THAT'S WHY HE HAS TWO DRIVEWAYS. OKAY. BECAUSE THAT'S THROWING ME UP. 'CAUSE I'M LIKE, WHICH WAY? WHICH IS THE FRONT WHICH THIS, THIS IS THE FRONT OF THE HOUSE. OKAY. OKAY. THIS IS THE AREA THAT HE WANTS TO PUT THE, WELL HECK AM IT, THIS IS THE AREA THAT HE WANTS TO PUT THE CARPORT UP. WHERE'S THE HOUSE? THE HOUSE IS RIGHT HERE. RIGHT. OKAY. AND THEN HE STILL ACCESSES THAT THROUGH COBB STREET, I GUESS, RIGHT? HE'S STILL COMING OFF THE DRIVEWAY. AND WHAT HE'S ASKING TO DO IS HE'LL BE DRIVING OUT ON THE COP? YES. OKAY. YES, SIR. RIGHT ON THE CORNER OF THE, I KEEP SLID OR THE BLOCK RIGHT ON THE CORNER. SO THE LINE THAT HE'S GONNA BE CLOSE TO IS GOING TO BE THE FENCE THAT IS ON THAT LEFT HAND SIDE, CORRECT. OKAYS, IT'S JUST HE'S GONNA BE TOO CLOSE TO THE PROPERTY LINE OR HE'S, HE'S GOING OVER IS HE'S GONNA BE TOO CLOSE TO THE PROPERTY LINE. HE'S WITHIN ONE FOOT OF THE PROPERTY LINE. IF HE THE HOUSE, THE FOOT THAT WAY YEARS BACK, WELL, THE HOUSE IS ALREADY ONE FOOT. IF HE LINES THE, THE PAD UP WITH IT, HE'S ONE FOOT TOO CLOSE TO THE BUILDING LINE OR OVER THE BUILDING. OR ACTUALLY IT'D BE FORFEIT OVER THE BUILDING LINE OVER THE SETBACK. AND IS THAT BASED ON WHERE THE, IS THERE EMPTY LOCK THAT'S BEHIND THAT HOUSE? NO, THERE'S A, IT'S A LIKE A HALF LOCK. I DON'T KNOW HOW THAT CARVE OUT GOT THERE, BUT THAT'S WHAT THAT IS. [00:20:01] THAT'S WHERE THE TREE LAY OR SETS, UH, MAYBE THERE'S A GOOD, DIDN'T THEY JUST BUILD A NEW HOUSE THERE BESIDE THAT? A NEW, IS THERE A NEW HOUSE OVER THERE BESIDE THAT? NO, IT'S NOT ON THAT ONE. NO. THE HOUSE BEHIND HIM IS PROBABLY 75 FEET OR SO. MAYBE 80 IS UH, PAST THAT END OF THE UH, BUT THIS IS THE SIZE 20 FOOT, CORRECT? YES, SIR. THAT'S CORRECT. THE 30, UH, THE 20 SAY I GOT IT OVER HERE. 20 BY 35, I BELIEVE IT IS. YEAH. YEAH. THE 20 FOOT SIDE IS THE ONE THAT THIS, THIS PROP, THIS HOUSE LINE RIGHT HERE IS ONE FOOT FROM THIS PROPERTY LINE? YES, SIR. AND HE WIND UP LINE THAT UP STRAIGHT TO THE SIDE OF THE HOUSE. AND IS THAT, IS THAT ONE FOOT FROM BUILDING FROM VACANT HALF LOT OR, OR ONE FOOT FROM NO VACANT LOT THERE. OH, I THOUGHT YOU SAID THERE WAS A HALF LOT THERE. THERE'S, WELL IF YOU TAKE, I'M TRYING TO FIND THE AERIAL. DO YOU WANT ME TO FIND AN AERIAL AND THAT WE CAN ZOOM INTO? ACTUALLY YEAH, I CAN DO THAT HERE. CAN I, OH, I CAN'T, WHOA, . SORRY, I SCREWED IT UP. UH OH. OPERATOR. WHILE SHE'S WORKING ON THAT, IS IT, IS IS THERE IS, WOULD THIS CAUSE ANY ISSUES IN THE FUTURE? I MEAN, WHAT ISSUE WOULD THAT REALLY CAUSE? WELL, IT'S, IT'S, IT'S THE HAND THAT, IT'S THE STEP DOWN. IT'S TWOFOLD. IT'S, WE'VE GOT AN ORDINANCE THAT SAYS ONE THING. WE'RE CONGREGATING OUR ORDINANCE. SO THAT'S ONE THING THAT NEEDS TO BE ADDRESSED. THE SECOND ITEM IS, IS IN THE FUTURE, IF SOMEBODY GOES TO, LET'S SAY BUY THAT HE FEE HIS, HE'S AND THE ASSIGNS, I'M ASSUMING HE'S GONNA LIVE THERE FOR THE REST OF HIS LIFE. THEY GO TO SELL IT. AND THEN SOMEBODY HAS AN ISSUE GETTING BANK FINANCING BECAUSE THEY'RE OUTSIDE OF THE ORDINANCE. UHHUH . NOW, TYPICALLY SPEAKING, I THINK THAT'D BE MORE ASSOCIATED WITH AN, WITH A STRUCTURE. RIGHT. MORE SUBSTANTIAL. BUT HE PUTS A FOUNDATION DOWN. HE'S PUT A FOUNDATION OVER THE LINE. SO, SO IS HE IT, IS THAT WHAT HE'S PLANNING ON DOING? IT'S NOT JUST GOING TO BE A CARPORT. HE'S GOING TO BE POURING CONCRETE UNDERNEATH IT TOO. WELL, THAT'S CONCRETE'S ALREADY THERE. THE CON HE'S POURING CONCRETE AND HE WANTS TO NOW BUILD A STRUCTURE UP THAT MATCHES THAT LINE. SO THAT'S, THAT'S THE, THIS IS AN EXISTING SLAB THAT HE'S GONNA PUT IT ON? YES, SIR. OKAY, BECAUSE I, I WAS JUST WONDERING. 'CAUSE I MEAN, 'CAUSE IF, IF HE'S BUILDING THE WHOLE THING, HE'S GOT PLENTY OF ROOM TO GO THAT WAY AND GET FIVE FOOT. YEAH, HE'S GOT 44 BACK TO THE FENCE ON THE BACKSIDE PLUS 58 WIDE LEFT. YEAH. YEAH. UM, SO THIS IS THE, THIS IS THE PROPERTY, RIGHT? HE PUT UP A SMALLER CAR, IT'S GONNA LINE UP WITH THAT SHED, HE PUT UP A SMALLER CAR. IT'S, HE JUST, IT'S THE ONE FOOT TO THE LEFT WE'RE FIVE? YES. NO, NO, NO. THE ONE FOOT'S TO THE, TO THE SOUTH. TO THE STREET. TO THE STREET, YES, SIR. TO, TO KYLE. YES, SIR. OKAY. SO, AND THERE'S A REASON HE CAN'T DO A 31 FOOT LONG CARPORT, SIR. IS THERE A REASON HE DIDN'T WANT TO DO A 31 FOOT CAR FOR HIM? THAT'S THE SIZE HE ASKED FOR. OKAY. 20 BY 35. YEAH, 30 FOOT, WHICH IS KIND OF STANDARD. 31 WOULD PROBABLY BE MORE EXPENSIVE, BUT A 30 30, IT GOES IN FIVE FOOT INCREMENTS. SO HIS OTHER OPTION IS TO PUT UP A 31 INSTEAD OF 35. YEAH. THEN HE DOESN'T NEED, THEN HE WOULDN'T NEED ANYTHING. WHAT IS THE BUILDING THAT'S IN FRONT? IT GOT LIKE 27 FEET FROM THE EDGE OF THE ROAD TO WHERE THAT WOULD START. WAS IT 30 VERSUS 30? A LITTLE MORE. I THINK THAT'S A LITTLE, SHE STILL BIT A CAR 30 FEET, RIGHT? HUH? YEAH, A CAR GOES INTO A 10 TO 21ST FOOT. THE PROBLEM IS THAT IT'S GONNA BE TOO FAR. THEY AIN'T GONNA HAVE A, FOR THE CAR, IT'S ONLY GONNA BE ONE. OKAY. YEAH. BUT IT'S ONLY GONNA BE ONE. IT COULD BE BE AN OPTION VERSUS NONE FAR. I THINK IT SAID SAID FOUR FEET. FOUR FEET. YOU SAID IT'S GONNA BE FOUR FOOT TO WELL, YEAH. SO THE, THE PAVEMENT IS ALREADY THERE. IT'S FOUR FOOT OVER THAT THE, THE HOUSE IS A FOOT AWAY. SO IT'S, UM, I'M TRYING TO THINK OF THE BEST WAY TO EXPLAIN THIS BETWEEN MS. ME AND MR. DUNCAN IS FIVE FEET, WE'LL SAY MAYOR, HIS CHAIR EXUDES ONE FOOT, OR CHRIS'S CHAIR EXUDES ONE FOOT IN THE MAYOR'S SPACE, EVEN THOUGH IT'S NOT A SPACE, THE MAYOR'S SPACE, BUT IT'S ACTUALLY FOUR FOOT OVER THE BUILDING LINE BETWEEN THE TWO OF US. AND SO THE, THE HOUSE IS ALREADY ONE FOOT OVER THE LINE, WHICH IS ACTUALLY FOUR FOOT INTO THE BUILDING LINE, IF THAT MAKES SENSE. I SEE. SO I THINK AN IMPORTANT IDEA THAT JUST CAME UP IS, IS IS REGARD TO HARDSHIP AND HIM BEING ABLE TO USE HIS PROPERTY. IF HE DID A 30 FOOT CARPORT INSTEAD OF A 35 FOOT, THERE WOULD BE NO PROBLEM. RIGHT? RIGHT. THAT'S WE ASKED. SO, SO IF HE YEAH. ARE WE IMPEDING HIS USE OF THE, OF THE HARDSHIP? HARDSHIP SO THAT HE CAN'T DEVELOP HIS PROPERTY? WELL, HE COULD JUST PUT A SMALLER CARPORT THAT WOULD STILL FIT, YOU KNOW, A 30 FOOT CARPORT [00:25:01] AND THERE WOULD BE NO ISSUE. SO, YOU KNOW, THAT'S ANOTHER QUESTION IS DOES IT REALLY CAUSE A HARDSHIP FOR HIM TO DO A 30 FOOT CARPORT INSTEAD OF A 35 FOOT? IT'S NOT A ALL OR NOTHING PROPOSITION. SO TECHNICALLY THAT DOESN'T MEET THE HARDSHIP REQUIRE DOESN'T MEET THE THREE REQUIREMENTS. YEAH. IF, IF A 30 FOOT CARPORT IS AN OPTION, WHICH THEY MAKE 'EM IN 30 FOOT SIZE, THEN I DON'T SEE WHERE THAT EXTRA FIVE FOOT CREATES ANY HARDSHIP FOR HIM. BECAUSE A CAR WILL EASILY PUT UNDER A 30 FOOT TWO CARS VERSUS 35. SO IF IT'S JUST A COSMETIC, I WANT IT TO LINE UP WHERE MY HOUSE ALREADY LINES UP. THAT'S NOT REALLY A DEVELOPMENT HARDSHIP, ASSUMING THAT'S CORRECT. I MEAN, YOU'RE JERRY YOU'RE FAMILIAR WITH THE LAYOUT. I MEAN, IS IT, COULD YOU DO PUT A 30 FOOT CARPORT THERE AND JUST NOT GO 35 AND THAT WILL SOLVE THE PROBLEM FOR OUR SETBACKS CONCERN? YES, SIR. RIGHT. OKAY. I DON'T THINK, I DON'T THINK LEGALLY THE, THE DIFFERENCE BETWEEN A, I WANT A 35 1 TO EXTEND FURTHER, BUT I COULD PUT A 31 AND I COULD STILL HAVE A FUNCTIONAL CARPORT. I DON'T KNOW, I DON'T THINK THAT LEGALLY PRESENTS A HARDSHIP FOR HIM. WELL, YOU'RE EVEN AT, EVEN AT 30 OR 35, YOU WOULD ONLY BE ABLE TO LINE ONE VEHICLE UP. SECOND ONE, YOU COULDN'T PUT ONE BEHIND IT ANYWAY IF YOU HAD THE COMPANY. YEAH. SO FRONT TO BACK. YEAH. SO YOU WOULDN'T, BUT IT LOOKS LIKE, LOOKS LIKE THAT WASN'T ADVANTAGE THAT I, I I DIDN'T SEE THE DIAGRAM, BUT IT LOOKS LIKE THE DIAGRAM, THE CAR WOULD BE BIG ENOUGH TO HAVE FOUR CARS, RIGHT? ALMOST. YES. YEAH, FOUR CARS. SO BY GOING 30 FOOT, IT WOULD REDUCE THE NUMBER OF CARS, BUT HE WOULD STILL HAVE A CARPORT. YES. DO I HAVE A MOTION THAT WE HAVE OUR BUILDING OFFICIALS THAT SUGGEST TO HIM THAT HE BILLS A 30 BY 20 INSTEAD OF A 35 BY 20, AND HE'LL GET THAT. AND I WOULD GO THAT BACK. I WOULD MAKE A MOTION THAT WE DON'T HONOR THE VARIANCE. AND THEN WHATEVER HE COMES BACK WITH WOULD BE, I DON'T KNOW. WE CAN TELL HIM WHAT KIND OF CARPORT CAN WE, SO I WAS GONNA SAY, TECHNICALLY WE NEED TO CLOSE THE, CLOSE THE DISCUSSION AND THEN WE CAN TAKE ACTION. OKAY. ANY OTHER COMMENTS OR QUESTIONS? WE WILL CLOSE THE PUBLIC COMMENTS [III. ACTION TAKEN AS RESULT OF PUBLIC HEARING ] AND WE WILL MOVE TO ACTION TAKEN AS A RESULT OF THE PUBLIC HEARING. UH, HER HEARD A MOTION BY COUNCILMAN CRIB THAT THE VARIANCE BE REJECTED. DO I HAVE A SECOND? I'LL SECOND HAVE A SECOND. BY COUNCILPERSON BOND DISCUSSION. HEARING NONE, I'LL ENTERTAIN A VOTE. ALL IN FAVOR? AYE. AYE. AYE. AYE. AYE. IT'S UNANIMOUS. UH, BUT WITH THAT BEING SAID, I WOULD, I WOULD SUGGEST THAT, THAT THIS STILL ALLOWS HIM TO COME BACK AND JUST DO A SMALL YEAH. I WOULD SUGGEST THAT, OH, YOU DON'T HAVE TO COME BACK. I WOULD SUGGEST THAT WE, I WOULD SUGGEST THAT YOU TELL HIM THAT HE CAN GET INSIDE THE SET SETBACK AND BUILD BILL. OKAY. BILL. WITHOUT, WITHOUT NO PROBLEM. I FINE. ALRIGHT. THANK Y'ALL. THANK BUT THE 35 FOOT SIDE IS THE PARKING THAT'S GONNA BE YES SIR. OKAY. YES. THE 20 FOOT, THE 20 FOOT THIS WAY? NO, NO PROBLEM. OKAY. ALRIGHT. [IV. CITY COUNCIL AS BOARD OF ADJUSTMENTS/APPEALS ] WITH THAT ONE BEING COMPLETED, WE WILL NOW MOVE TO COUNCIL SETTING AS BOARD OF ADJUSTMENTS AND APPEALS AND CONSIDER A VARIANCE FOR A PROPOSED SIGN TO BE LOCATED AT 1 0 1 DIXIE DRIVE THE KENTUCKY FRIED CHICKEN. AND I DON'T SEE, UH, A NOTICE IN THIS ONE. THERE'S, UH, NO NOTICE. UH, THIS IS AN, THIS IS AN APPEAL FOR THE OBJECTION ON A SIGNED ORDINANCE. OKAY. WELL, I READ ABOUT 30 EMAILS IN HERE AND I DON'T KNOW IF I UNDERSTAND ANY OF THEM. . SO, UH, KIND OF BRING COUNCIL AND EVERYBODY ELSE UP TO SPEED. KFC OBVIOUSLY IS COMING TO TOWN. UH, WE'RE ALL EXCITED ABOUT THAT. WE'RE LOOKING FORWARD TO OUR DOUBLE DOWNS AND CHICKEN MINIS. UM, BUT, UH, THE, UH, THE QUESTION AT THE END OF THE DAY, THEY WOULD LIKE SIGNAGE ABOVE AND BEYOND WHAT OUR SIGN ALLOWED ALLOW OUR SIGN ORDINANCE CURRENTLY ALLOWS. SO CURRENTLY THEY WOULD BE ALLOWED A SMALLER, [00:30:01] UH, FLUSH FACED MONUMENT SIGN. TYPICALLY WHAT YOU'VE SEEN AT THE LITTLE CAESARS PIZZA IN THE SAME DEVELOPMENT, THEY INITIALLY WANTED AN OFFSITE SIGN NEAR THE HIGHWAY TO CREATE GREATER VISIBILITY SO FOLKS WOULD KNOW THAT KFC WAS THERE. UH, WE EXPLAINED THAT OFFSITE SIGNAGE IS NOT ALLOWED UNDER OUR ORDINANCE. THEN WE TALKED ABOUT THE POTENTIAL FOR, UH, THEY ASKED ABOUT A POLE SIGN, UH, ABOUT A 50 FOOT, TWO FOOT TALL POLE SIGN. WE EXPLAINED THAT THEY WERE NOT IN THE ZONE, AND I'LL BE VERY HONEST WITH YOU, OUR, OUR SIGN ORDINANCE IS VERY AMBIGUOUS, SO IT LEADS A LOT OF ROOM TO INTERPRETATION AND QUESTIONING. UM, BUT BASICALLY THEY ASKED FOR A 52 FOOT POLE SIGN. WE EXPLAINED, NOPE, CAN'T HAVE THAT. THEN THEY CAME BACK AND WANTED TO KNOW ABOUT THE POTENTIAL TO DO A PYLON SIGN SIMILAR TO THE ONE THAT'S ALREADY EXISTED IS 35 FOOT TALL. THAT TYPE SIGN IS ALLOWED FOR THE SHOPPING CENTER AS A WHOLE, NOT FOR AN INDIVIDUAL BUSINESS WITHIN THAT SHOPPING CENTER. AND IT WOULD OCCLUDE THE VISIBILITY OF THE SHOPPING CENTER'S, UH, PYLON SIGN AS WELL. SO STAFF AGAIN TOLD THEM NO, UH, AND MR. UH, JA, UH, FROM THE ARCHITECTURE FIRM AND ENGINEERING FIRM THAT'S HEADING UP THIS PROJECT AT THAT POINT, OPTED TO FILE FOR A, AN APPEAL BASED ON OUR DENIAL. WE PUT THEM IN CONTACT WITH, UH, SAKA, WHICH OWNS THE PROPERTY TO SEE IF THEY COULDN'T FIGURE OUT A WAY TO MESH INTO THE CURRENT SIGNAGE, UH, AND DO SOMETHING TO, TO AVAIL THEMSELVES OF THAT. UH, BUT THAT'S WHERE WE'RE AT NOW. I THINK THIS, ARE YOU HERE TO SPEAK ON BEHALF THE SIGN ORDERS? YES. OKAY. DO YOU WANNA I'M OKAY. CAN EVERYBODY HEAR ME? YES, SIR. OKAY. SO GOOD EVENING EVERYONE. UM, SO YEAH, SO WE WAS, YOU KNOW, DENIED A SIGNED PERMIT. WE'RE TRYING TO PERMIT A SIGN, BUT, UM, YOU KNOW, ACCORDING TO THE ORDINANCE THAT YOU WERE REFERRING TO, WE DO FULFILL THE REQUIREMENTS FOR OUR POLE SIGN. UH, WE'RE ONLY GOING 50 FEET, WHICH, UH, LET'S SEE, CHAPTER SIX, SECTION SIX DASH 36, FUNNY ENOUGH, UH, STATES THAT, UH, A SIGN HAVING A, A HEIGHT OF 50 FEET OR LESS IN THE SIZE OF 400 SQUARE FEET SHALL BE ALLOWED ON THE PREMISES. UM, AND SO BASICALLY WHAT WE'RE, YOU KNOW, PRESENTING IS NOT GOING OUTSIDE OF, YOU KNOW, ANYTHING YOU'VE, UH, PRESENTED THANK FURTHER INTO THAT ORDER. DOES THERE SOMETHING ABOUT SPEED LIMIT? SPEED LIMIT? YEAH. SO THAT, THAT, THAT SIZE SIGN AND THAT, THAT THAT HEIGHT IS ONLY ALLOWED ON A, ON A PROPRIETARY STREET THAT WOULD HAVE A SPEED LIMIT OF 60 OR 55 OR HIGHER. OKAY. I MEAN, SO WE ARE ON DIXIE DRIVE, SO THAT IS WITHIN THE RIGHT OF WAY ALSO. RIGHT. BUT SO YOU, YOU CAN'T BE WITHIN THE RIGHT OF WAY. THIS IS THE ACTUAL ORDINANCE. UH, NUMBER ONE, YOU CAN'T BE WITHIN THE RIGHT OF WAY. AND AGAIN, THIS IS AMBIGUOUS, SO IT, IT ISN'T VERY CLEAR. YEAH. BUT YOU'RE NOT WITHIN THE ZONE SPEED ZONE. 'CAUSE THE SPEED ZONE ON, ON DIXIE DRIVE IS 35 MILES AN HOUR. OKAY. 35 MILES AN HOUR. CORRECT. OKAY. SIX. AJ, AJ LOVE YOU. 36. LOVE L-O-V-I-N-G. HE'S, HE'S, HE'S, HE'S CITING ITEM NUMBER THREE. YES. NO FREE FREESTANDING POLE SIGN SHALL BE ALLOWED OR PERMITTED EXCEPT ON ANY PREMISES HAVING A COMMON BOUNDARY WITH THE RIGHT OF WAY OF ANY FEEDER ROAD FOR STATE HIGHWAY 2 2 88 SLASH 3 32 LO LOCATED WITHIN THE CITY. AND ON-PREMISES SIGNAGE, HAVING A HEIGHT OF 50 FEET OR LESS AND 400 SQUARE FEET OR LESS IN SIZE MAY BE PERMITTED. YEAH. AND THAT'S 2 88. THAT DOESN'T HAVE, I DIDN'T SEE A SPEED ZONE. WELL, THAT, YEAH, THERE'S LATER IT TALKS ABOUT SPEED ZONE, BUT THIS IS RELATES TO THE YEAH, THIS RELATES TO THE 50 FOOT SIGN. THOSE ARE ONLY ALLOWED ON THAT FRONTAGE. CORRECT. SO BASICALLY THOUGH THE 50 FOOT POLE IS BASICALLY ON STATE HIGHWAYS, NOT . THAT'S CORRECT. AND HAS VISIBILITY FROM THE HIGHWAY. SO ARE YOU SAYING YOU FEEL THAT THE SIGN COULD BE SEEN FROM THE HIGHWAY? YES. UM, SO WE'RE WITHIN THE RIGHT OF WAY. SO WE'RE RIGHT OFF DIXIE. AND SO THAT GOES STRAIGHT TO THE HIGHWAY. THAT'S NOT A FRONTAGE ROAD. FRONTAGE ROAD. I THOUGHT, I THOUGHT I READ THAT THE YEP. YEAH. IT'S NOT A FEEDER ROAD TO THE, TO THE HIGHWAY. YEAH. IT SAYS, WHERE DID I READ THAT NUMBER? HOLD ON, I'M SORRY. I THOUGHT I READ IT SOMEWHERE. YOU DID SIR. IT SAYS, YEAH, IT WAS IN THERE SOMEWHERE. IT'S, UH, COMMON BOUND WITHIN THE RIGHT OF WAY OF ANY FEEDER ROAD. CORRECT. FOR STATE HIGHWAY 2 8 3 32, I DON'T THINK WE CAN CONSTITUTE DIXIE DRIVE AS A FEEDER ROAD. OKAY. SO EVEN THOUGH IT RUNS TWO, UH, 2 88, YOU WOULDN'T, UH, CONSTITUTE IT AS THAT. NO, SIR. DOESN'T MATTER. FEEDER ROADS RUN PARALLEL TO CORRECT. CORRECT. AND HAVE ACCESS. FEEDER [00:35:01] ROADS ARE THE ROADS THAT YOU GET ONTO THE HIGHWAY. MM-HMM. . YEAH. WHEN YOU GET TO THE END OF DIXIE, WHEN YOU GET TO THE END OF DIXIE DRIVE, YOU HAVE TO TAKE A RIGHT TO GET ONTO THE HIGHWAY. I SEE. YEAH. I THINK THAT, YOU KNOW, THEY DON'T QUALIFY AS FOR A 50 FOOT SIGN UNDER NUMBER THREE, YOU KNOW, THE, UH, WHAT MR. SNIPES TALKED ABOUT AS FAR AS, UH, UH, VAGUE OR MAY BE CLEAR, UNCLEAR. IF YOU LOOK AT NUMBER SIX IN A SHOPPING CENTER, YOU KNOW, IN THE PARKING AREA OF THE SHOPPING CENTER, UH, WILL NOT EXCEED, UH, 35 FEET, UH, DIFFERENT ONE THERE. AND, AND THEN, SO THAT'S THE QUESTION OF IS THE INTENTION OF THAT NUMBER SIX IS THAT THERE WILL BE A SINGLE 35 FOOT SIGN THAT LISTS, YOU KNOW, ALL OF THE SHOPPING CENTER, ALL OF THE SHOPS IN THAT CENTER. IS THE INTENT OF THAT TO BE A SINGLE SIGN OR COULD THERE BE A SECOND SIGN, UH, IN THE SHOPPING CENTER NOT TO EXCEED 35 FEET? RIGHT, RIGHT. AND THERE'S ALREADY A PILE-ON SIGN THERE THAT THEY COULD INTEGRATE THERE TOO. UM, OR GO WITH A SIGN THAT NOT TO EXCEED EIGHT FEET AND HEIGHT. RIGHT. AND SO THE QUESTION IS, BUT DOES THAT SECTION MEAN BUT ONLY ONE SIGN IN THE PER SHOPPING CENTER? OR IS THERE POTENTIAL FOR MORE THAN ONE SIGN IN THE SHOPPING CENTER UP TO 35 FEET ? RIGHT, THAT'S WHAT I THOUGHT. I DUNNO WHERE IT'S AT. AND IT'S, THAT'S, IT HAS TO BE A PEDESTAL SIGN. IT GETS INTO DESIGN IN ANOTHER AREA OR ANOTHER CHAPTER. I'M GETTING READY TO PULL THAT UP. YEAH. AND THAT'S WHERE THEY CAME BACK WITH A PILE ON OR PEDESTAL, SINGLE BASE AT 35 FEET. AND WE EXPLAINED YOU CAN'T DO THAT EITHER BECAUSE THERE'S ALREADY ONE FOR THAT SHOPPING CENTER. YEP. OKAY. SO AS OF RIGHT NOW, IT DOESN'T FIT UNDERNEATH NUMBER THREE WITH SECTION 6 36. CORRECT. IS THAT, IS THAT THE MAIN UH, RIGHT NOW? YEAH, WE WERE ARGUING THAT IT DOES, SINCE IT DOES, UH, IT'S ONLY 50 FEET, WHICH IS HITS THAT REQUIRED MAXIMUM, BUT IT DOES, BUT IT'S NOT ON THE HIGHWAY. IT'S NOT, BUT AS OF NOW, WE KIND OF DISAGREEING THAT IT'S NOT ON THE HIGHWAY. OKAY. SO EVEN, UH, THE VISIBILITY THING, UH, ISSUE THAT HAS NO BEARING. I'M SORRY. YEAH, THAT'S, UH, THAT'S, THAT GETS BACK INTO THE, THE QUESTION ABOUT THE OFFSITE ON-SITE SIGNAGE. AND AGAIN, THAT'S NOT ALLOWED. SO, OKAY. SO WHAT IS ALLOWED IN THAT SHOPPING CENTER CAN, THEY ARE LOCATED, RIGHT? SO THEY, THEY CAN, THEY CAN GO ONTO THE PYLON SIGN, WHICH HAS MULTIPLE TENANTS THAT MULTIPLE TENANTS WITH IT. SO THAT'S THE TENANT SIGN. THAT'S THE TENANT SIGN. IT'S A THREE FOOT, UH, TH 35 FOOT TALL. YEAH. THAT'S WHAT, THAT'S WHAT'S ALLOWED THERE. OR THEY CAN DO A PEDESTAL SIGN MONUMENT TO SIGN THAT IS NO MORE THAN EIGHT FOOT IN HEIGHT. AND SO IF YOU THINK ABOUT THAT SAME DRAG, THERE'S LITTLE CAESARS WITH THEIR MONUMENT SIGN THAT FACES DIXIE. 'CAUSE THEY HAVE A DIXIE ADDRESS THAT HIGHLIGHTS THAT BUSINESS. SO THEY COULD DO AN EIGHT FOOT HIGH MONUMENT SIGN, OR THEY COULD GO ON THE PYLON SIGN. NOW WOULD THEY HAVE TO CLARIFY THAT THAT'S ANYWHERE IN THAT PARKING OR IS THAT IN FRONT OF THEIR NO, THEY DON'T HAVE IS BECAUSE THEY SHARE A COMMON ADDRESS WITH A SUITE WITH SUITES THERE. WE'VE ALLOWED THAT VARIANCE TO, WE'VE ALLOWED THEM TO PLACE THAT SIGN ON THAT PROPERTY. I GUESS THAT'S NOT AN OPTION. , I THINK, I THINK IN IT'S NOT A, NOT A PREFERRED OPTION. I THINK AT THE END OF THE DAY, THEY'RE PAID TO ASK, THEIR JOB IS TO, TO ADVOCATE AS MUCH AS THEY CAN. OUR JOB IS TO SAY THAT THAT'S NOT ALLOWABLE UNDER OUR ORDINANCE, AND THAT'S WHY WE'RE HERE BEFORE YOU NOW, BECAUSE THEY WANTED AN APPEAL. SO, AND THEY ALWAYS HAVE THE OPTION TO ADD A SIGN TO THE SHARED SIGN THAT'S USUALLY LIKE MM-HMM. WHERE IT SAYS, RIGHT. AND SO THAT'S, THESE RESTAURANTS WE GAVE MR WE GAVE MR THE ONE THAT'S GOT OLLIE'S ON. RIGHT, RIGHT. YEAH. OH, YOU'RE TALKING ABOUT ON THE HIGHWAY? YEAH, ON THE HIGHWAY. OH YEAH. YOU ABSOLUTELY CAN SPOT YOUR SPONSOR YOURSELF ON THE HIGHWAY SIGNAGE COMING IN AT THE EXIT. SO YOU TALKING ABOUT THE WORD, THE LITTLE HIGHWAY SIGN THAT SAY, YEAH. IS THERE A PROCESS FOR THEM TO DO THAT? WHATEVER. THAT'S, THAT'S, THAT'S ACTUALLY A PROCESS WITH TDOT. SO THEY WOULD TAKE THAT PER, THEY WOULD ASK TEXT OUT PER TO BE ADDED TO THAT SIGN AS A SPONSOR AND THEN TEXT OUT WOULD ADD IN THERE, BUT THERE'S NOT A THERE, THEY WOULDN'T BE ABLE TO GO PUT A KFC SIGN NEXT TO THE THE BURGER KING SIGN OR THE WHAT, BURGER SIGN OR ANYTHING LIKE THAT. BURGER KING A GOOD SIGN. WELL, SO BURGER KING, WHAT BURGER? ALL OF THOSE BUSINESSES ARE LOCATED WITHIN THAT FRONT OR FEED. OR FEED. THEY'RE NOT LOCATED ON THE FEEDER ROAD NEXT TO 3 32, 2 88 B. THAT'S WHY THEY'RE ALLOWED TO HAVE THE SIGNS THAT, THAT TALL WELL, I, [00:40:01] I GUESS I'M GONNA BE THE BEARER OF BAD NEWS. I'VE BEEN SITTING HERE FOR 18 YEARS AND WE HAVEN'T ALLOWED ANYTHING LIKE THAT ANYWHERE IN TOWN. AND I, I DON'T FORESEE IT BEING YEAH. DOABLE HERE. NO, I UNDERSTAND. , YOU KNOW, LIKE HE SAID, WE'RE HERE TO ASK THE QUESTIONS. WE'RE HERE TO, YOU KNOW, GET TO THE BOTTOM OF WHAT WE CAN DO AND WHAT'S IN OUR POWER TO DO. YEAH. AND WE WOULD, WE WILL BE MORE THAN HAPPY TO ISSUE ANY PERMITS FOR ANYTHING THAT'S INSIDE THE ORDINANCE. I SEE. OKAY. YEAH, I MEAN THE, I MEAN THE, THE THING IS, IF WE ISSUE A VARIANCE NOW, YOU KNOW WHAT STOPS THE SAME OTHER BUSINESSES THAT ARE THERE TO COME AND THEN WE'RE GONNA HAVE A, A SIGNAGE WARS . YES. THEN WE'RE GONNA HAVE A WHOLE SECTION FULL OF 52 FOOT, YOU KNOW, OR 50 FOOT SIGN. WE WENT THROUGH THIS WITH THE COLLEGE AND THE HIGH SCHOOL AND YEAH. AND, AND THAT'S, UH, AND HONESTLY, I THINK AT THE END OF THE DAY, I, I DON'T KNOW, I DON'T WANNA SPEAK FOR ANYBODY, BUT MOST FOLKS I THINK TEND TO USE THEIR PHONE TO GET DIRECTIONS. AND YOU GUYS ARE GONNA BE THE KFC FOR THIS REGION. SO EVERYBODY I THINK IS GONNA KNOW WHERE YOU'RE AT. YOU'RE THE, AS FAR AS I KNOW, YOU'RE GONNA BE THE ONLY ONE ON THIS END OF BRAZORIA COUNTY. SO, I MEAN, UH, I DON'T THINK IT'S GONNA BE, I THINK YOU'RE GONNA FIND THAT YOU'RE, YOU'RE NOT GONNA HAVE TO ADVERTISE AS MUCH AS YOU THINK . THEY'RE GONNA KNOW HOW THEY'RE GONNA KNOW HOW TO FIND YOU. I THINK A PEDESTAL SIGN ACTUALLY WOULD BE MORE, I THINK IT WOULD BE MORE, I THINK FOR THAT AREA IT WOULD LOOK NICE. IT WOULD LOOK NICE, BUT I THINK THAT IT WOULD GET PEOPLE'S ATTENTION MORE THAN THE PYLON SIGN OR SOMETHING REALLY HIGH. 'CAUSE PEOPLE ARE GOING 35 MILE AN HOUR. AND SO I THINK THE PEDESTAL SIGN WOULD GRAB THEIR ATTENTION MORE. I THINK THAT'S WHY LITTLE CAESARS DID IT. YEP. DO YOU REALLY KEEP THAT? I DO BECAUSE I WANTED TO DRIVE THEN I CAN'T AFFORD IT. ON DIXIE DRIVE. WHERE ARE YOUR EYES FOCUSED COMING IN OR OUT? YOU'VE GOT TRAFFIC, YOU'VE GOT, YOU'VE GOT VISUAL VIEW. MM-HMM. . RIGHT. AND YOU DRIVE RIGHT UNDERNEATH IT WITHOUT SEEING IT TO SOME EXTENT, BUT THAT'S NOT NEITHER HERE NOR THERE. BUT, SO AT THIS TIME, DO YOU, DO WE ANY MORE COMMENTS? MM-HMM. STILL IN THE HEARING? OKAY. I WAS GONNA SAY, ANY MORE COMMENTS? NOT, I'M GONNA CLOSE THE [V. ACTION TAKEN AS RESULT OF BOARD OF ADJUSTMENTS/APPEALS ] HEARING AND REQUEST AN ACTION BY THE COUNCIL SITTING AS THE BOARD OF ADJUSTMENTS AND APPEALS. THE ACTION WOULD BE TO CONSIDER OR DENY THE SIGN VARIANCE FOR THE LOCATION AT 1 0 1 DIXIE DRIVE, KENTUCKY FRIED CHICKEN MAYOR, I'LL MAKE A MOTION TO DENY THE VARIANCE. WE HAVE A MOTION BY COUNCILMAN AGUILAR TO DENY THE VARIANCE. DO I HAVE A SECOND? I'LL SECOND. SECONDED BY COUNCILMAN LOPEZ. ANY FURTHER DISCUSSION? HEARING NONE. I'LL ENTERTAIN A VOTE. ALL IN FAVOR? AYE. AYE. IT'S UNANIMOUS. I'M SORRY, BUT WE'RE GONNA HAVE TO, WE'RE GONNA HAVE TO, WE'RE GONNA HAVE TO LIVE WITH WHAT WE'VE GOT. YOU'RE BUILDING IT. THEY'RE GONNA COME. THEY ARE . NO PROBLEM. UM, GUYS, YEAH. THANK YOU FOR YOUR TIME. THANK YOU. YOU SAW THAT TOO? YEAH. OH, AND BY THE WAY, I WORKED AT THE KENTUCKY FRIED CHICKEN THAT WAS HERE IN 1973. GOOD. HAVE A GOOD NIGHT. THANK YOU. NEXT ITEM BE SAYS VISITOR COMMENT. I SEE NONE IN THE PACKAGE. SO WE WILL FOREGO READING THAT ITEM [VII. CONSENT AGENDA ] AND MOVE TO THE CONSENT AGENDA. SEVEN THREE ITEMS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE AND ARE GENERALLY ENACTED IN ONE MOTION. THE EXCEPTION TO THIS RULE IS THAT COUNCIL MEMBERS MAY REQUEST ONE MORE ITEM BE REMOVED FROM CONSENT AGENDA FOR SEPARATE ACTION. TONIGHT'S AGENDA, OUR REGULAR COUNCIL MEETING, NOVEMBER THE NINTH, 2023 AT 7:00 PM THOUGH I HAVE A MOTION TO APPROVE THE CONSENT AGENDA. SO MOVED. I'LL SECOND. MOTION BY COUNCIL PERSON V. SECONDED BY COUNCILMAN AGUILAR. ANY DISCUSSION? ANY ITEMS NEED TO BE REMOVED? HEARING NONE. I'LL ENTERTAIN A VOTE. ALL IN FAVOR? AYE. AYE. UNANIMOUS. [VIII. BUSINESS ITEMS (Part 2 of 2)] NEXT ITEM WOULD BE PRESENTATION ON THE HOTEL OCCUPANCY TAX REPORT FROM THE BRAZOSPORT ARTS AND SCIENCES. MR. WESLEY COFIELD. GOOD EVENING. UH, MR. DUNCAN, MR. SNIPES COUNCIL, MR. MAYOR, THANK YOU SO MUCH FOR HAVING ME HERE TONIGHT. IT IS, UH, ALWAYS MY DISTINCT PLEASURE TO COME AND REPORT ON THE GOOD WORK THAT WE'RE DOING OUT AT THE CENTER FOR THE ARTS AND SCIENCES. TO THANK YOU FOR YOUR COMMITMENT [00:45:01] TO THE CITIZENS OF THIS FINE COMMUNITY AND FOR YOUR, UH, COMMITMENT TO, UH, UH, ARTS AND CULTURES, WHICH WE KNOW ARE IMPORTANT ELEMENTS TO HELP A COMMUNITY THRIVE. AND I THINK WE'RE ALL IN OUR PARTNERSHIP TOGETHER, DOING A WONDERFUL JOB OF THAT. MY NAME IS WESS COPELAND. I'M THE EXECUTIVE DIRECTOR OF THE CENTER FOR THE ARTS AND SCIENCES. UH, I KNOW YOU HAVE A LONG AGENDA, SO I'LL TRY TO KEEP THIS AS BRIEF AS I POSSIBLY CAN. , UH, THE CENTER FOR THE ARTS AND SCIENCES FOR, I KNOW EVERYONE ON COUNCIL KNOWS WHAT WE DO, BUT JUST FOR THE RECORD, UH, WE ARE A MULTIPLE DISCIPLINARY, UH, ORGANIZATION THAT INCLUDES BRAZOSPORT CENTER STAGES, WHICH HAS BEEN DOING SHOWS SINCE 1943, THE BRAZOSPORT MUSEUM OF NATURAL SCIENCE AND BRAZOSPORT ART LEAGUE, WHICH HAS BEEN AROUND SINCE 1955. WE ALSO INCLUDE, UH, SUPPORT FOR BASF PLANETARIUM AND BRAZOSPORT SYMPHONY ORCHESTRA WITH THESE ORGANIZATIONS. WE AND THESE PROGRAMS, WE PROVIDE ADMINISTRATIVE FACILITIES AND MARKETING SUPPORT FOR ALL OF THEM. AND THESE THINGS BRING VITALITY AND HELP ELEVATE THE QUALITY OF LIFE FOR OUR RESIDENTS, AND OF COURSE, PROVIDE REASON FOR VISITORS TO TRAVEL TO OUR COMMUNITY AS WELL AS BEING AN IMPORTANT RESOURCE FOR VISITORS WHO ARE ALREADY HERE LOOKING FOR ENRICHING EXPERIENCES. WE HAVE A GREAT DESIRE, WE KNOW THE AWESOME RESPONSIBILITY THAT WE HAVE TO CONTRIBUTE TO THE TOURISM, TO CULTURAL TOURISM, TO THE BRAZOSPORT REGION. INCLUDES SPECIFICALLY, WE KNOW THAT TRAVELERS HERE WILL SPEND THEIR MONEY IF WE GIVE THEM A RE GIVE THEM REASONS ENOUGH TO STICK AROUND. AND OUR, UH, STAFF AND OUR VAST, UH, UH, POOL OF VOLUNTEERS WORK TIRELESSLY TO DO THAT. IT IS IN OUR BEST INTEREST TO HAVE THE HOTELS FILLED WITH VISITORS. I KNOW THAT WE'VE HAD A LITTLE BIT OF A STRUGGLE WITH THAT RECENT DAYS, BUT WE CONTINUE TO STRIVE TOWARDS DOING THAT. AND IT IS OUR GOAL TO PROVIDE ACTIVITIES, EVENTS, AND ATTRACTIONS THAT ENCOURAGE HOTELS STAYS. NOW THERE IS A MEMORANDUM OF UNDERSTANDING DRAFTED AND SIGNED BY BOTH THE TEXANS FOR THE ARTS AND THE TEXAS HOTEL AND LODGING ASSOCIATION THAT PROVIDES GUIDELINES FOR DETERMINING THE IMPACT ON TOURISM FOR ORGANIZATIONS LIKE THE ONE I REPRESENT. I'M PROUD TO REPORT OUR ROBUST CAMPAIGNS TO PROMOTE CULTURAL TOURISM AND HOST HOTEL STAYS WITH THE FOLLOWING ACTIONS. ONE IS THAT THE RECIPIENT WORKS WITH ITS AREA LODGING OPERATORS OR CONVENTIONS AND VISITORS BUREAU TO PROMOTE LOCAL EVENTS THROUGH HOTEL CONCIERGE SERVICES, UH, LOBBY AREA FLYERS OR SIMILAR MEASURES. AND WE ARE CONTINUING OUR HOTEL RELATIONS CAMPAIGN TO COMMUNICATE DIRECTLY WITH HOTEL STAFF AND MANAGERS, ALERTING THEM TO THE ACTIVITIES, EXHIBITS, AND EVENTS ASSOCIATED WITH THE CENTER. EVERY MONTH WE BRING THEM LISTS OF EVENTS HAPPENING AT THE CENTER. WE ALSO BRING 'EM TREATS SO THEY REMEMBER US AND THEY, THEY LIKE, THEY LIKE TO SEE US COMING. I HAVE PROUDLY ALSO, I HAVE PROUDLY SERVED ON THE KLU VISITORS BUREAU BOARD FOR MANY YEARS NOW AND WILL CONTINUE TO FIND WAYS FOR THE CENTER FOR THE ARTS AND SCIENCES AND THE CVB TO LEVERAGE AND AMPLIFY EACH OTHER'S MESSAGES. WE HAVE A COMMON PURPOSE AND A COMMON GOAL. ANOTHER IS THAT THE RECIPIENT BOOKS, HOTEL ROOMS FOR VISITING ARTISTS AND OFFERS HOTEL RELATED INFORMATION TO ATTENDEES OF THE ORGANIZATION'S HOTEL OCCUPANCY, TAX FUNDED EVENTS. WE MAKE A STANDARD PRACTICE THAT BOTH OUR CONSTANT CONTACT EMAIL, UH, UH, EMAIL LIST, WHICH IS OVER 6,000 PEOPLE ON IT AND IN OUR TICKETING SYSTEMS, UH, CRM, TO ENCOURAGE PEOPLE ATTENDING EVENTS TO STAY IN AN AREA HOTEL WITH DIRECT LINKS TO THOSE, TO THOSE LISTS OF HOTELS, ESPECIALLY IF THEY ARE LOCAL AND HAVE OUT OF TOWN GUESTS COMING TO THE EVENT. THERE IS NO REASON WHY YOU GOTTA HAVE THE WHOLE FAMILY COMING TO SEE A KID IN A SHOW STAY IN YOUR HOUSE WHEN THEY CAN STAY IN A HOTEL, RIGHT? SO WE ENCOURAGE THAT. WE ALSO, UH, MARKET EVENTS OUTSIDE THE LOCAL AREA THROUGH STANDARD MEDIA PROMOTIONS OR ADVERTISING WEBSITES, MAILING LISTS, LOCAL AND REGIONAL AND NATIONAL LISTINGS, INCLUDING ADS IN TEXAS HIGHWAYS MAGAZINE AND ALSO MEDIA OUTREACH FOR REGIONAL AND STATEWIDE NEWS AGENCIES. IT IS NOT UNUSUAL TO FIND US ON, ON, UH, ON, UH, GREAT DAY HOUSTON OR OTHER OTHER NEWS SOURCES. THE FUNDED ENTITY MAY SHOW A DIRECT IMPACT ON THE HOTEL INDUSTRY BY USING LOCAL LODGING FACILITIES FOR GALAS OR OTHER EVENTS THAT ARE HELD BY THE HOTEL TAX FUNDED ENTITY. UH, I WILL SAY THAT, THAT WE WERE LOOKING FOR SPACE FOR MEETINGS AND SPECIAL EVENTS SUCH AS OUR RECENT BOARD RETREAT AND ORIENTATION, AND WE WENT TO CLUT HOTELS FIRST. UNFORTUNATELY, THEY WERE PLANNING RENOVATIONS, WE'RE NOT ABLE TO ACCOMMODATE US, BUT I LEARNED TODAY THAT, UH, THAT THERE ARE REMODELS UNDERWAY AND THAT MEETING ROOMS AT THE, AT THE HAMPTON INN WILL BE AVAILABLE SOON. AND WE LOOK FORWARD TO HOLDING THOSE MEETINGS AND SPECIAL EVENTS USING KLUT HOTELS. ALSO, THE RECIPIENT THROUGH AUDIENCE OR ATTENDEE QUESTIONNAIRES DEMONSTRATES THAT TOURISTS OR OTHER OUT OF TOWN VISITORS HAVE ATTENDED ITS HOTEL TAX FUNDED EVENTS WITH THE MUSEUM AND THE ART GALLERY. WE HAVE TENS OF THOUSANDS OF VISITORS SINCE THE COVID SHUTDOWN. WE NOW AVERAGE 31% OF THE [00:50:01] GUESTS THAT COME IN ARE OUT OF COUNTY GUESTS DURING OUR REGULAR BUSINESS HOURS. NOW, I WILL SAY 31% IS PRETTY, PRETTY IMPRESSIVE. IT IS DOWN A LITTLE BIT. I THINK PART OF THAT THOUGH IS BECAUSE WE HAVE MORE AND MORE LOCAL PEOPLE COMING AND TAKING ADVANTAGE OF THIS REALLY FANTASTIC RESOURCE THAT WE HAVE AVAILABLE TO THEM THROUGH OUR PARTNERSHIP TOGETHER WITH CENTER STAGES. JUST UNFORTUNATELY WE HAD TO CANCEL THE SECOND WEEKEND OF SOUND OF MUSIC. BUT OF THE SHOWS THAT WE DID, UH, PRESENT, 19% OF THEM OF THE GUESTS CAME FROM OUT OF TOWN. AND OUR ELIZABETH AND MAD FEAST, WHICH IS KIND OF OUR FLAGSHIP EVENT THAT WE DO EVERY OTHER YEAR THAT WE WERE ABLE TO BRING BACK IN 2022, 25%, ONE OUT OF EVERY FOUR VISITORS CAME FROM OUTSIDE BRAZORIA COUNTY. WE ARE, UH, CONTINUE TO DEVELOP VIDEO PROMOTIONAL PIECES FOR BOTH THE CENTER AND THE ELIZABETH MADWELL FEAST TO ATTRACT THE ATTENTION OF MEDIA GROUPS OUTSIDE OF THE AREA. IN ADDITION, WE ARE RE WE ARE REFRESHING OUR PUBLICATIONS FOR INCLUSION AT TEXAS TRAVEL CENTERS AROUND THE STATE TO HIGHLIGHT HOW A WEEKEND OR VACATION STATE IN OUR COMMUNITY CAN SATISFY THE DESIRES OF TRAVELERS. AND WE WILL CONTINUE TO WORK IN THAT WAY. AND EVEN OUR NON HOT FUNDED, UH, UH, PROGRAMS SUCH AS THE PLANETARIUM THEY HAVE OPENED AND, AND, UH, THEY HAVE STARTED WORKING TOWARDS DOING THINGS LIKE SATURDAY SHOWS SO THAT VISITORS HAVE ANOTHER REASON TO COME TO THE CENTER FOR THE ARTS AND SCIENCES, WHICH WILL THEN, OF COURSE BENEFIT, UH, THE MUSEUM AND EVERYTHING ELSE. AGAIN, I AM VERY GRATEFUL TO THIS COUNCIL FOR SUPPORTING AND COMMIT AND CONTINUING YOUR COMMITMENT TO ARTS CULTURE VIBRANCY IN THE CITY OF CLUTE. AND I LOOK FORWARD TO MANY YEARS MORE OF, OF PARTNERING WITH YOU TO TOWARDS THESE SAME ENDS. AND IF THERE ARE ANY QUESTIONS FOR ME, I'D BE HAPPY TO ANSWER THEM. I HAVE GIVEN EVERYONE A, A BROCHURE THAT IS A SAMPLING OF THE MANY OFFERINGS THAT WE HAVE HERE, UH, THAT WE DO ON A VERY KIND OF STRICT BUDGET, BUT WE'RE ABLE TO DO A LOT BECAUSE OF YOU AND BECAUSE OF OUR VAST VOLUNTEER POOL. ANY QUESTIONS FOR ME? JUST KEEP UP THE GOOD WORK. THANK YOU, MR. CHRIS. I HAVE A QUESTION. YES, SIR. IT'S KIND OF BEEN, I DON'T KNOW ON WHAT LEVEL THE MUSEUM YES, SIR. UH, I GUESS I'M A LITTLE SHOCKED IN HERE ABOUT WHERE IT KIND OF DISCUSSES THE MUSEUM, AND I KNOW YOU CAN'T GET EVERYTHING IN ALL, BUT THERE'S NOT ANYTHING IN HERE ABOUT THE, MY UNDERSTANDING, REALLY EXTENSIVE IVORY COLLECTION THAT THE MUSEUM BOASTED TO HAVE. UH, AND IT'S NOT EVEN IN HERE. UH, AS FAR AS PEOPLE COMING TO SEE THINGS, DO Y'ALL KEEP ANY KIND OF PERCENTAGE OF LIKE, MAYBE WHAT GOES TO THE SAKE OF , WHETHER IT BE THE PLANETARIUM, THE, UH, CLARION OR THE, OR THE MUSEUM, OR IS IT JUST ALL KIND OF LUMPED TOGETHER? NO, SIR. SO WHAT WE DO IS, IS, AND I WILL SAY THAT, YOU KNOW, THEY SAY THAT NEVER LET A GOOD CRISIS GO TO WASTE. RIGHT BEFORE COVID, WE HAD JUST A REGULAR SIGN IN BOOKS THAT THE MUSEUM MAINTAINED AND THAT THE ART LEAGUE MAINTAINED AND ALL OF THAT. AND I WOULD TO COME MAKE THIS REPORT, I'D HAVE TO GO IN THERE AND I'D HAVE TO KIND OF GUESS. OKAY, SO THE SMITH FAMILY CAME IN AND THEY BROUGHT THEIR FAMILY. WELL, WE'D HAVE TO KIND OF GUESS HOW MANY PEOPLE WERE THERE. WELL, WHAT WE DO NOW IS THAT WHEN PEOPLE COME IN, SPECIFICALLY DURING THE DAY, WE HAVE THAT'S, WE CALL THAT A SELF-GUIDED TOUR OF BOTH THE MUSEUM AND THE ART LEAGUE. AND SO THEN THEY TELL US HOW MANY ADULTS, HOW MANY KIDS, AND HOW MANY ARE COMING FROM OUTSIDE BRAZORIA COUNTY, KNOWING THAT SOMETIMES IT IS PEOPLE WHO ARE LOCAL COMING IN AND IF THEY BUY TICKETS AND WE JUST LOOK AT THE ZIP CODE, WELL, IT'S A LOCAL ZIP CODE, BUT THEY'RE PROBABLY, THEY MIGHT BE BRINGING IN OUT OF TOWN GUESTS WITH THEM. AND SO THAT'S WHY WE ASK THAT QUESTION. WE THINK IT'S A TRUER REPORTING OF WHAT WE DO. NOW, SPECIFICALLY WITH THE IVORY COLLECTION ITSELF, UH, NO, I, I HAVE NOT MENTIONED THE IVORY COLLECTION ITSELF, BUT THE THE EXHIBITS ARE MYRIAD, YOU KNOW, SO, YEAH. YES, SIR. DID I ANSWER YOUR QUESTION? I'M SORRY. I, I HOPE I DID IT. IT HIT ON IT. I DON'T KNOW THAT, I GUESS I, I'M NOT FROM LACK OF CLARIFICATION. I JUST, UH, I'M CONCERNED ABOUT THE MUSEUM OVER THERE FROM THE FEEDBACK I GET, UH, THAT OBVIOUSLY IT, IT'S A GREAT SOURCE OF ANYTHING. AND YOU KNOW, IS THAT AGE, IS THAT NEW CELL PHONES? IS THAT I WANNA SEE A MOVING DINOSAUR. I DON'T WANNA SEE A DEAD ONE. UH, YOU KNOW, I DON'T KNOW. SURE THING, BUT, UH, IT SEEMS TO BE A REALLY, AND THAT'S MAYBE BECAUSE I'VE KIND OF HAD, I'VE DONE SOME THINGS OVER THERE. YES, SIR. MADE A PAYMENT. I'VE TRIED, I'VE TRIED TO DO THE PLANETARY THING, BUT I CAN'T SIT ON MY BACK IN THE DARK LIKE THAT STORM I UNDERSTAND THREE TIMES AND I HAD TO G LEAD BOTH ALL THREE TIMES. SURE. BUT, UH, SO MAYBE I WAS JUST A LITTLE MORE INTRIGUED BY THAT STUFF, BUT I DON'T KNOW WHAT YOU DO TO EITHER PROMOTE IT OR LACK OF PROMOTION. I WILL, I WILL TELL YOU THAT WE ARE, SO IF WE'RE LOOKING AT MODERNIZING [00:55:01] AND UPDATING THE MUSEUM, IS THAT, IS THAT A LITTLE I DON'T, MORE SPECIFIC. WELL, I DON'T KNOW THAT, IS THAT A MAYBE OR, YEAH, I, I, I WOULD LOVE TO SEE THAT HAPPEN AT THIS AND I DON'T KNOW HOW YOU DO THAT. UH, YEAH, SURE. I CAN SAY THAT, THAT THE MUSEUM HAS ITS OWN BOARD OF DIRECTORS. IT IS AN INDEPENDENT ORGANIZATION. THE THINGS THAT HAPPEN WITHIN THAT, WE HAVE A CONTRACT WITH THE CITY OF KLUTE FOR SUPPORTING THE MUSEUM THROUGH FACILITY SUPPORT, PAYING UTILITIES, KEEPING THE PLACE MAINTAINED, ALL OF THAT. UM, AND SO, AND SO THAT'S WHAT WE DO AND WE'VE, WE'VE BEEN WORKING TO, TO REALLY GET A LITTLE MORE GRANULAR ON HOW MUCH WE ACTUALLY SPEND IN THAT SUPPORT TO BE ABLE TO PROVIDE TO YOU AND TO PROVIDE TO THEM. WE DID WORK BECAUSE OF THE CAPITAL CAMPAIGN THAT WAS STARTED LIKE 10 YEARS AGO. ONE BIG SORT OF CRACK IN THE FOUNDATION THAT WE SAW ORGANIZATIONALLY WAS THAT, UH, WE DIDN'T QUALIFY FOR GRANTS FOR PRIVATE FOUNDATIONS BECAUSE THEY CONSIDERED THE CENTER A LANDLORD BECAUSE ALL OF THE GROUPS, EACH OF THOSE GROUPS HAD THEIR OWN 5 0 1 C3 CORPORATE ORGANIZATIONS AND BOARDS OF DIRECTORS. SO THOUGH WE DON'T CHARGE RENT AND WE DON'T CHARGE FOR UTILITIES AND MAINTENANCE FEES AND THOSE SORT OF THINGS, WE WERE STILL VIEWED AS A LANDLORD. SO FROM THAT MOMENT, THAT KIND OF GAVE US A LITTLE CLUE OF SOME ACTIONS WE NEEDED TO TAKE, WHICH INCLUDED STARTING TO CONSOLIDATE THESE GROUPS UNDER ONE CORPORATE UMBRELLA SO THAT WE COULD PROVIDE MORE DIRECT PROGRAMMING SUPPORT, SUCH AS WHAT YOU'RE MENTIONING NOW. THE MUSEUM HAS NOT YET COME ON BOARD WITH THAT, BUT WE DO THINK THAT IT IS JUST A MATTER OF TIME THAT THAT WILL HAPPEN. AND WE ARE, WE ARE, WE ARE CONTINUING TO CAMPAIGN TOWARDS THOSE ENDS, BUT WE DO HAVE, WE HAVE, THE PLANETARIUM IS NOW CONSOLIDATED UNDER THE CENTER'S UMBRELLA. THE ART LEAGUE IS CENTER STAGES IS, AND I THINK THE SYMPHONY'S READY TO TAKE A VOTE JUST ANYTIME I'M SUPPOSED TO GO SPEAK WITH THEM ON THAT ON TUESDAY EVENING, SO THAT WE ARE ONE ORGANIZATION PROVIDING ALL OF THESE FIVE VIBRANT PROGRAMS. AND THEN WE'LL BE ABLE TO DO A LITTLE BIT MORE WITH UPDATES AND THOSE SORT OF THINGS. OKAY. THANK YOU. I JUST, LIKE I SAID, I JUST, THERE SEEMS TO BE CONCERN WITH, AND LIKE I SAID, IT COULD JUST BE THE TIMES. I DON'T KNOW, YOU KNOW, I, I'VE HAD THIS SAME CONVERSATION ABOUT THE COUNTY FAIR, SO THINGS ARE CHANGING . WE HAVE TO, WE HAVE TO STAY RELEVANT AND WE HAVE TO KEEP UPDATING AND SUCH AND, AND, UH, AND UH, WE WILL CONTINUE TO WORK TOWARDS THAT. OKAY. IT'S OUT OF MY DIRECT CONTROL RIGHT NOW, UNFORTUNATELY. I'M SURE I UNDERSTAND THAT. WE JUST WEREN'T THE ONE STANDING HERE TO ASK THE QUESTION. NO, WELL, WELL, AND I MEAN, I MEAN, YOU KNOW, WITH THE, WITH THE MUSEUM, THEY HAVE THEIR OWN BOARD OF DIRECTORS, AND SO THEY ARE DIRECTLY IN CONTROL OF THEIR OWN PROGRAMMING AND SUCH. WE, SO Y'ALL TAKE THE, I'M SORRY, I DON'T MEAN WANNA DRAG THIS OUT, BUT, SO IS THAT HOW Y'ALL DIVIDE THE MONEY? IS, IS THERE AN EQUAL SHARE? IS IT WHOEVER NEEDS IT, OR IT'S, IT'S NOT AN, IT'S NOT AN EQUAL SHARE. WE USE, WE USE VOLUMETRIC DATA TO BE ABLE TO DETERMINE HOW MUCH WE ARE ACTUALLY PRO PROVIDING SUPPORT FOR EACH OF THE HOT QUALIFIED PROGRAMS, SUCH AS THE MUSEUM. SO IF IT GETS LESS PEOPLE, IT GETS LESS MONEY. SO IN FACT, IT COULD DETERIORATE. WELL, I DON'T, IT'S A FREE ADMISSION, SO, SO THERE'S NOT, THERE'S NOT, THERE'S NOT A REVENUE STREAM WHEN IT COMES TO WELL, I, I JUST MEANT WITHIN THE ORGANIZATION ITSELF. RIGHT. BUT THAT'S WHAT, IT'S A SEPARATE ORGANIZATION THAT'S SELF-FUNDED. SO THAT'S WHERE WE PUT A LITTLE BIT OF MONEY TOWARDS THAT. BUT THERE, BULK OF THEIR MONEY COMES FROM THE DONATIONS TO SUBSCRIBERS, CORPORATE SUPPORTERS OF THE ACTUAL MUSEUM. AND SO WHAT WESS IS TRYING TO DO NOW IS BRING THEM INTO THE FOLD WHERE THEY'RE NO LONGER INDEPENDENT SO THAT THEY CAN GO SEEK GRANTS AND TRY TO BE A LITTLE BIT MORE, I DON'T WANNA SAY THAT THE BOARD'S NOT INNOVATIVE, BUT MORE INNOVATIVE. WELL, AND TO HAVE, HAVE PROFESSIONAL STAFF TO BE ABLE TO HELP LEAD THOSE EFFORTS AS WELL. OKAY. AND, AND, UH, WE SUPPLY, WE SUPPLY AN EQUAL AMOUNT OF, OF SPACE UTILITIES, UH, MAINTENANCE, YOU KNOW, FOR ALL THE GROUPS THAT ARE IN THAT BUILDING. SO, I MEAN, YOU KNOW, LIKE I SAID, THE, THAT'S BASICALLY WHAT OUR, WHAT OUR CONTRIBUTIONS ARE IS, IS TO MAKE SURE THAT THE BUILDING DON'T FALL DOWN. SURE. I UNDERSTAND THAT. YOU KNOW, UH, I JUST, LIKE I SAID, IF IT'S BASED ON USE IT POSSIBLY, I COULD SEE WHERE IT COULD DETERIORATE RIGHT. THAT POINT. SURE, SURE. AND, AND WE, WE WOULD, WE WOULD LOVE TO SEE SOME UPDATES AND WE'D LOVE TO BE ABLE TO HELP WITH THAT DIRECTLY. AND I, I JUST WANNA SAY THAT EVERY TIME SOMEBODY NEW COMES TO TOWN, THAT'S THE FIRST PLACE I POINT FOLKS. AND EVERY TIME I HEAR, MAN, I CAN'T BELIEVE THIS PLACE HAS THAT. IT'S AMAZING. IT'S, IT'S, IT'S GOOD LUCK FINDING ANOTHER COMMUNITY OUR SIZE WHO HAS THOSE AMENITIES AND THOSE RESOURCES. YEAH. ALL FOR ME. I MEAN, WES, YEAH. I THINK YOU'VE DONE AN INCREDIBLE JOB. AND THE, ONE OF THE THINGS THAT I DIDN'T [01:00:01] KNOW UNTIL I STARTED VOLUNTEERING WITH YOU GUYS IS THAT IT'S JUST VOLUNTEER BASE. YOU KNOW, I THOUGHT THAT YOU GUYS HAD A PAID STAFF AND, YOU KNOW, TO DO ALL THESE THINGS. AND, AND I'M AMAZED THAT IT'S BEEN ABLE TO RUN THIS LONG WITH JUST VOLUNTEERS. SO THANK YOU. WELL, WE DO, WE DO HAVE A PAID STAFF. IT'S A VERY MODEST PAID STAFF. STAFF. IT'S A VERY SMALL STAFF. UH, WHEN THE PLACE OPENED, THEY HAD SOMEONE TO CLEAN THE TOILETS AND SOMEONE TO ANSWER THE PHONES. SO, YOU KNOW, THEY, THEY REALIZE THAT THE NATURE OF VOLUNTEERISM HAS CHANGED OVER THE LAST NEARLY 50 YEARS AS WELL. BUT WE RELY, WE WE'RE ABLE TO GO, WE'RE ABLE TO STRETCH OUR DOLLARS AS FAR AS WE CAN BECAUSE OF THE COMMUNITY SUPPORT FROM VOLUNTEERS THAT WE HAVE. YEAH. NO, YOU GUYS ARE DOING GREAT THINGS. AND I, IT'S, IT'S ONE OF THE LIKE, UH, GREAT THINGS THAT WE HAVE IN THE COMMUNITY INCLUDE. UM, SO I MEAN, I LOVE IT AND IT'S AWESOME. I COMMEND EVERYONE FOR THEIR EFFORTS. I'M SORRY I COMMEND EVERYONE FOR THEIR EFFORTS. WELL, THANK YOU SO MUCH. I APPRECIATE IT. COME OUT AND SEE US AT THE CENTER. WE'RE ALWAYS HAVE SOMETHING GOING ON. FOR SURE. HOW DOES ONE GO ABOUT VOLUNTEERING WITH YOU? YOU NOW, YOU JUST CALL ME DIRECTLY. YOU KNOW, WE CAN, BUT WE DO HAVE A VOLUNTEER COORDINATOR, AMANDA HELMS, WHO WORKS, UH, ALSO IN THE MARKETING OFFICE. SHE'S OUR VOLUNTEER COORDINATOR. UH, THERE IS AN ONLINE FORM ON OUR, ON OUR WEBSITE THAT IF YOU GO TO THE SUPPORT BUTTON AND YOU CLICK, IT LOOKS LIKE A JOB APPLICATION IS VERY MUCH WHAT IT LOOKS LIKE. UM, BUT YOU CAN CALL US DIRECTLY OR YOU CAN, YOU CAN SEND US AN EMAIL AND WE WILL WORK TO MATCH, MAKE YOU, TO ONBOARD YOU TO GIVE YOU THE ORIENTATION AND DO THE BACKGROUND CHECKING AND EVERYTHING ELSE THAT WE NEED TO DO TO, TO GET YOU, GET YOU INVOLVED. OH. AND IF YOU WANT TO AUDITION FOR A SHOW NOW, JUST COME UP ON AUDITION DAYS. IT'S AS EASY AS THAT. SHE'S GONNA BE, SHE'S NEXT ACTOR. OH, IS THAT RIGHT? I RING. I'LL BE RINGING THE BELLS FOR CALVIN ON SATURDAY NIGHT. OH, FANTASTIC. . WELL, I KNOW YOU'LL HAVE A LONG AGENDA. ANY OTHER QUESTIONS BEFORE? NO, THANK YOU. WE ALRIGHT. THANK YOU. THANK YOU MUCH. THANK YOU SO MUCH, MUCH. AND MERRY CHRISTMAS TO EVERYONE. I'M SORRY I DIDN'T GET THE, I DIDN'T SEE THE MEMO ABOUT THE HATS, BUT , THANK YOU. THANK YOU. WE DIDN'T GET ONE. WE JUST HAD ONE ON OUR DESK. . UH, NEXT ITEM WOULD BE CONSIDERATION OF POSSIBLE ACTION TO ADOPT RESOLUTION NUMBER 61 DASH 2023 AS THE OFFICIAL BALLOT CONTAINING THE NAMES OF THE NOMINATED CANDIDATES FOR THE BRA COUNTY APPRAISAL DISTRICT. MM-HMM. , WE KNEW WHAT A, UH, WHAT A FUN TOPIC IT'S BEEN, UH, IN RELATION TO, UH, IN, IN RELATION TO THE APPRAISAL PROCESS. UH, TO MY KNOWLEDGE, SINCE I'VE BEEN HERE, THIS IS THE FIRST TIME WE'VE EVER HAD THE BALLOT. AND, UH, SO WE WANTED TO GIVE Y'ALL THE OPPORTUNITY TO PROVIDE INPUT. UM, WE HAVE NO, UH, NO RECOMMENDATION TO MAKE. I'M SURPRISED THAT FOLKS ACTUALLY VOLUNTEERED TO DO THIS. SO KNOWING HOW POPULAR THEY BECOME. SO WHAT POSITION IS THIS NOW? I'M SORRY. NO, NO. THIS IS THE, THIS IS THE, THE BCA, THIS IS THE BCA, THE BRAZORIA COUNTY APPRAISAL DISTRICT. THIS IS THE BOARD OF DIRECTORS. THIS IS THE PEOPLE WHO SIT IN THOSE MEETINGS AND REVIEW AND CONTEMPLATE WHAT THE RATES ARE GONNA BE. HERE ARE THE APPEALS, ET CETERA. NOW, IS THIS A BOARD THAT'S ACTUALLY GONNA DO SOMETHING OR IS THIS A BOARD THAT'S GONNA BE TOLD TO DO SOMETHING? WELL, I, THAT'S AN ORGANIZATIONAL ISSUE. I WOULD, UH, DEPENDS ON WHO'S ON. SO HOW DID SET UP FOR THAT POSITION? I'M DETERMINE NOMINATED HOW MANY VOTES DO THESE CITIES, BECAUSE I, I SEEN THIS WITH SOME OTHERS THAT HAD LIKE A ENORMOUS AMOUNT VOTES LIKE THOUSAND BOAT. YEAH. SO IT, IT'S BASED ON TOTAL VALUE. SO, AND HOW MANY VOTES DOES THE CITY OF CL HAVE? WE GET 19. 19? YES. HMM. INTERESTING. WHICH, WHICH IS NOT ENOUGH TO ELECT ONE PERSON. YEAH. SO WE COULD VOTE FOR NO ONE AND THEY'D STILL BE GOOD. THAT'S EXACTLY RIGHT. WELL, TYPICALLY THIS HAS CAME, THIS HAS CAME UP BEFORE WHEN I, ONE OF THE LAST TIMES THAT I REMEMBER LOOKING AT IT WAS WITH MS. HESTER WHEN SHE WAS HERE. AND HER COMMENTS TO ME WERE THAT TYPICALLY THE CITY OF INCLUDE VOTED ALONG THE SAME LINES AS BRADFORD INDEPENDENT SCHOOL DISTRICT. DO WE HAVE ANY, ANY OF THESE PEOPLE? ARE THEY FROM FLUTE? WOULD YOU KNOW? I'M LOOKING, I DON'T SEE [01:05:01] ANY NAME I RECOGNIZE. I DON'T KNOW. I DO, YOU KNOW, I KNOW BUNCH OF MY NAMES ON THERE. THEY'RE NOT FROM FLUTE. MM-HMM. ABOUT SUSAN'S BORE IN DANBURY. OKAY. I MEAN, I KNOW THERE WAS SOME SPORES HERE INCLUDED AT ONE TIME, BUT YEAH. WELL, I'VE ALWAYS WONDERED THIS TOO. MY QUESTION IS HOW, HOW DO YOU GET ON THE BALLOT? HOW DO YOU GET ON THIS LIST? HAS THERE ALWAYS BEEN A BOARD? YEAH. YEAH. THERE'S ALWAYS BEEN A BOARD. THERE'S ALWAYS BEEN A BOARD. YEAH. I JUST ASSUMED IT WAS APPOINTED TO BE A PERFECTLY HONEST WITH YOU. YEAH. I MEAN TOO WELL IN WAY. IT'S KIND OF WHAT I'VE BEEN TOLD IT. IMAGINE THAT. YEAH. WHAT'S THAT? I I I WAS UNDERSTANDING IT WAS AN APPOINTED POSITION, NOT A ACTUAL, PROBABLY HAVE TO GO TO THE MEETING WHERE THEY MAKE NOMINATION TO GET SOMEBODY TO NOMINATE YOU. YEAH. THIS, I'M SORRY, I SAY THAT, THAT, SO WHAT, WHAT EXACTLY ARE WE SUPPOSED TO BE DOING WITH THESE? ARE WE SUPPOSED TO BE VOTING? IF, IF YOU, IF YOU WANT TO PUT YOUR BALLOTS TOWARDS, IF YOU WANNA PUT OUR, OUR 19 VOTES TOWARDS ONE PERSON, OR IF YOU WANNA SPREAD 'EM AMONGST THE OTHERS, OR IF YOU DON'T WANNA TAKE ANY ACTION AT ALL. I JUST WANTED TO MAKE SURE THAT THE COUNCIL HAD, THEY WANT VOTES AND THEY OUGHT TO BE HERE SPEAKING UPON THEMSELVES TO YEAH. I DON'T, THEY PROBABLY DON'T KNOW IT'S EVEN HAPPENING BECAUSE THAT'S, THIS HAS BEEN GOING ON FOR FOUR. IT'S THE BS THEY HAVE JUST THOUSANDS OF VOTES. YEAH. WOW. LIKE US, YOU KNOW, VERSUS ACTUAL CITIES. I REALLY AND TRULY, I DON'T THINK ANY OF THE CITIES HAVE A TREMENDOUS AMOUNT OF VOTES. NO. IT'S ALL LAKE JACKSON OBVIOUSLY, PROBABLY HAS, HAS THE VOTE FAIR LAND PROBABLY HAS A TON OF VOTES. I WOULD IMAGINE. WE HAVE THE VOTE AS A WHOLE FOR ONE PERSON. NO, NO, NO. WE CAN SPREAD OUR VOTES OUT. YOU CAN SPREAD YOUR VOTES. YOU CAN NOT VOTE. YOU CAN TAKE NO ACTION. WE JUST WANTED TO BRING IT TO YOU. SO HOW DO WE DO, HOW DO WE VOTE? UH, WE LET THEM KNOW. MAKE A MOTION. WE MAKE A MOTION. YOU HAVE A RESOLUTION BEFORE YOU THAT SAYS, I WANT TO, OR YOU WOULD MAKE A MOTION TO PASS RESOLUTION IN THE NAME WHOEVER YOU WANTED TO ALLOT VOTES TO. YEAH. RESOLUTION READS. WHEREAS THE OFFICIAL BALLOT CONTAINING THE NAMES OF THE DULY DOMINATED CANDIDATES FOR THE BOARD OF DIRECTORS OF THE BRAZORIA COUNTY APPRAISAL DISTRICT, HAS BEEN RECEIVED FROM THE CHIEF APPRAISER OF THE BRAZORIA COUNTY APPRAISAL DISTRICT. WHEREAS THE CITY OF CLU WISHES TO CAST ITS VOTES THERE OWN NOW THEREFORE BE RESOLVED. THE CITY OF PLU DOES HEREBY DETERMINE AND CAST ITS VOTES FOR THE CANDIDATES, FOR THE BOARD OF DIRECTORS, FOR THE BRAZO COUNTY APPRAISED DISTRICT AS FOLLOWS. AND THEN WE HAVE TO LIST WHO, WHOEVER WE, WHOEVER WE VOTE AS A WHOLE. LIKE WE'LL SAY THAT'S CORRECT. WELL, SO CAN I JUST MAKE A MOTION TO NOT VOTE? OR WELL, I THINK, OR HOW DOES THAT WORK? THAT'S YOU, THAT'S YOUR MOTION IS TO DECLINE OR TO MAKE, I'LL MAKE THE MOTION. I'LL MAKE THE MOTION TO DECLINE. NO, NO. WELL, I MEAN HE, SO BASICALLY YOUR RESOLUTION WOULD BE TO REJECT TO NOT TO DENY THE RESOLUTION AND NOT VOTE INDIVIDUALLY OR AS A WHOLE? AS A WHOLE. AS A WHOLE. WE'D HAVE TO DO IT AS A COUNCIL. 'CAUSE THE CITY ONLY GETS, THE CITY AS A WHOLE ONLY GETS 19 VOTES. WELL, IF WE DON'T VOTE, WE CAN'T DRIVE . I, I MAKE A MOTION THAT WE DO. BUT, BUT WELL, I WAS GONNA SAY, YOU HAVE A MOTION STANDING ON THE FLOOR. DO I HAVE A SECOND ON THE DENIAL OF THE RESOLUTION? I DON'T, I JUST DON'T FEEL LIKE I, I DON'T EVEN KNOW WHO ANY OF THESE PEOPLE ARE. ANYTHING THAT THEY'RE ABOUT. THAT'S EXACTLY WHAT I'M, THE APPRAISAL DISTRICT HAS. THIS IS THE APPRAISAL DISTRICT. UM, NOT TOO HAPPY WITH ANYBODY RIGHT NOW. I KNOW, I KNOW. DISTRICT NOT WHO ARE THESE THEN? THIS IS JUST THE BOARD. YEAH, THIS IS THE SO WHAT DOES THE BOARD EXACTLY DO THEN? WELL, THEY'D BE LIKE US, RIGHT? THAT THEY SERVE AS THE GOVERNING COUNCIL FOR THE, THE APPRAISAL DISTRICT. AND SO WHEN THERE'S AN APPEAL, WHEN THERE'S SOMETHING THAT THEY, SO THIS IS IF I WANT TO GO BEFORE THEM TO PROTEST MY TAXES? NO, NO. YOU, NO, NO. OKAY. THIS IS, THIS IS BASICALLY THE BOARD THAT, THAT THE, THE APPRAISAL DISTRICT HAS A BUDGET AS WELL. JUST LIKE THE CITY AND THE APPRAISAL DISTRICT IS, THEY PROBABLY SET THE SALARIES AND THE, AND THE, THE MILEAGE AND THE MILEAGE REIMBURSEMENTS AND THOSE KIND OF THINGS. OKAY. NOW THAT MAKES MORE SENSE. OKAY. THEY HANDLE THE, THE, THEY SET THE POLICIES FOR THE CAD AND THE BUDGET. WHERE DO YOU KEEP THOSE AT? WHERE I JUST DON'T THINK I KNOW ENOUGH TO DON'T BUDGET. WELL, I MEAN, SO LIKE SAID [01:10:01] WE GOT 19 VOTES, WE'RE NOT GONNA BE ABLE TO ELECT ANYBODY TO START. BUT I LIKE HATE I, I'LL SECOND THE DENIAL OF A VOTE BECAUSE I JUST DON'T KNOW ENOUGH ABOUT IT TO BE ABLE TO MAKE AN INFORMED DECISION. OKAY. WELL, I'LL HAVE A SECOND ON THE DENIAL DISCUSSION. HEARING NONE, ENTERTAIN A VOTE. ALL IN FAVOR? AYE. AYE. ALL OPPOSED? AYE. AYE. WHATEVER. I'M, I'M KIND OF ON THE FENCE. WELL, YOU GOTTA GET OFF OF IT. I NAY KNEE MAYBE? NO. OKAY. NAYYY UH, MOTION FAILS. OKAY. DO I HAVE ANOTHER MOTION? I MAKE A MOTION THAT WE DO THE ADOPTION TO VOTE ON THE NOMINEES. SO WE'RE JUST GONNA PICK NAMES. YOU NEED TO NO, YOU NEED TO PICK THE PERSON OR THE PERSONS. YEAH, I YOU MAKE A MOTION THAT YOU CATCH 19 VOTES FOR THIS PERSON, OR SIX, VOTE FOR THAT AND 10 VOTE WHATEVER. YEAH, I KNOW MR. I KNOW MR. WELL, MY MR IS FOR NUMBER SIX, MR. HAYES. OKAY. NOW, I DON'T KNOW THAT I FEEL COMFORTABLE SPEAKING FOR THE WHOLE ALL THE SIX VOTES. I MEAN, IS THAT WHAT YOU'RE, IS THAT WHAT I HAVE TO DO THOUGH? YOU'RE BASICALLY, YOU'RE MANY VOTES. YOU, YOU'RE MAKING A, YOU'D LIKE TO MAKE A MOTION THAT WE CAST OUR 19 VOTES FOR ERIC HAYES. I DO. YES, SIR. OKAY. I'LL DO I HAVE A SECOND? IS THIS, IS, IS THIS INDIVIDUAL FROM FREEPORT OR, MM-HMM. . OKAY. I'LL SECOND OR THIS? SOMEBODY SECOND. SECOND. HAVE A MOTION BY COUNCILMAN CHRIS. A SECOND BY COUNCILMAN LOPEZ. YEAH. I DON'T KNOW MR. HAY. HE'S, FROM WHAT I KNOW IS HE SPEAKS HIS MIND. HE'S PROPERTY OWNERS AND IT GETS A LITTLE IDEA. THAT'S JUST MY PHONE. OKAY. I DON'T KNOW ANYTHING ELSE. I DON'T KNOW ANYBODY ELSE FURTHER DISCUSSION? DOES ANYBODY ELSE KNOW ANYBODY ELSE? NO, I DON'T. I DON'T KNOW ANY. I KNEW THAT NAME SOUNDS FAMILIAR, BUT I CAN'T REMEMBER FROM WHERE. MARY, DO YOU KNOW ANYBODY ON HERE? NO. YOU PROBABLY KNOW MORE PEOPLE THAN US. IF THAT'S THE GLEN JONES. IF THAT'S THE GLEN JONES. I KNOW, I KNOW HIM. I KNOW. NUMBER 15. 15. YEAH. SUSAN SPORTS. SPORTS. THAT NAME SOUNDS VERY FAMILIAR. SHE'S FROM, IT'S, IT'S, IT'S JEFF'S, IT'S AMBER. IT'S, THEY LIVE IN DANBURY, BUT YEAH. UH, HER SON IS WHO YOU THINK IT IS. OKAY. YEAH. YEAH. WELL, YOU DIDN'T HEAR ME SAY THIS, BUT I WOULDN'T CAST ONE FOR GLEN JONES MYSELF. BUT MY PERSONAL OPINION, THERE'S ABOUT FIVE ON HERE. I WOULDN'T VOTE FOR EITHER. THAT'S MY PERSONAL, I DUNNO WHAT THEY DO. SO YOU'VE GOT A MOTION NOW A SECOND. DO I, I HAVE A MOTION FOR 19 VOTES FOR ERIC HAY. AND A SECOND. ANY FURTHER DISCUSSION? ENTERTAIN A VOTE. ALL FAVOR. AYE. I I'M GONNA ABSTAIN. I JUST DON'T KNOW ENOUGH ABOUT ANY OF THIS. GEORGE SANDERS COULD BE CAPTAIN. ISN'T CAPTAIN SANDERS THE ONE FROM KFC? ? COLONEL SANDERS. COLONEL COLONEL. COLONEL . HOW, HOW YOU IMP MILITARY. DID YOU VOTE? I DIDN'T HEAR YOU. YES, SIR. IYE? I, OKAY, SO I HAVE FOUR FOUR. I WANT SUBSTANTIAL, UH, MS. MADDOCK ABSTAINS. OKAY. NEXT ITEM WILL BE RESOLUTION NUMBER 62 DASH 2023. A RESOLUTION OF THE CITY INCLUDE REVISING THE MA THE CITY'S MASTER FEE SCHEDULE TO INCLUDE REVISED CHARGES RELATED TO CERTAIN EMERGENCY MEDICAL SERVICES, BILL TO INSURANCE CARRIERS, AS CALLED FOR BY SENATE BILL 24 76, AND THE TEXAS DEPARTMENT OF INSURANCE. AND IT WOULD BE RESOLUTION NUMBER 62 DASH 2023 OF RESOLUTION OF THE CITY OF CLUE TEXAS APPROVING THE REVISIONS TO THE CITY'S MASTER FEE SCHEDULE TO INCLUDE CHANGES TO THE CITY'S FEES FOR EMERGENCY MEDICAL SERVICES. WHEREAS THE CITY HAS PREVIOUSLY ADOPTED A MASTER FEE SCHEDULE IN 2019, WHEREAS THE CITY, LIKE OTHER BUSINESSES AND INDIVIDUALS WERE FACING SIGNIFICANT PRICE INCREASES FOR SUPPLIES, GOODS, AND SERVICES. WHEREAS RECENT CHANGES TO STATE LAW HAVE INCREASED THE OPPORTUNITY FOR, FOR CLUE EMS TO RECAPTURE COSTS FOR, FROM SERVICE FROM INSURANCE PROVIDERS. WHEREAS THERE'S DESIROUS OF ENSURING THAT ALL FUNDS IN THE CITY ARE IN GOOD FINANCIAL HEALTH, WHICH SOMETIMES REQUIRES A RATE INCREASE FOR SERVICES OFFERED. WHEREAS THE CITY IS DESIROUS OF CAPTURING AS MUCH REVENUE AS POSSIBLE FOR SERVICES RENDER BY KLU EMS. NOW, THEREFORE BE RESOLVED BY THE CITY COUNCIL, CITY OF KLU, TEXAS, THAT THE RATES FOR EMS LISTED IN THE ATTACHED MASTER FEE SCHEDULE ARE [01:15:01] HEREBY ADOPTED. RED PASS THAT ADOPTED THIS 14TH DAY OF DECEMBER, 2023 WILL BE SIGNED BY MYSELF AND ATTEST BY ROSA . SO THERE'S A WHOLE LOT OF YES. STUFF ON THE SCHEDULE, BUT ALL WE'RE ACTUALLY ADDING, OH, YOU'RE ACTUALLY IS THE LAST PORTION ON THE SECOND OR MAYBE THE THIRD PAGE, UH, RELATED TO THE EMS FEES? YES, SIR. AND SO, UH, SENATE BILL BASICALLY ALLOWS US NOW TO REGISTER OUR RATE WITH THE TEXAS DEPARTMENT OF INSURANCE, WHICH BASICALLY PUTS US ON THE DOCKET FOR CONSIDERATION OR HIGH ENHANCED CONSIDERATION BY INSURERS THEMSELVES. IN THE PAST WE'VE BEEN BEHIND EVERYBODY ELSE. SO IF THE DOCTOR AND THE HOSPITAL AND THE ANESTHESIOLOGIST AND EVERYBODY GOT PAID FIRST, THEY WERE REGISTERED, THEY HAD A COST ANALYSIS, THEY GOT PAID. NOW THIS PUTS US IN THE REGISTRY WITH THE INSURANCE DEPARTMENT AND MAKES PAYMENT TO US ENFORCEABLE AS WELL. SO, UH, AGAIN, THIS IS A FEE THAT WE CHARGE TO THE INSURANCE AGENTS. WE DON'T BILL, WE NEVER PURSUE BILLING AGAINST OUR RESIDENTS. UH, SO THIS IS SOMETHING THAT'S GONNA HELP US RECAPTURE MORE ADDITIONAL REVENUE. UH, WE LAST UPDATED OUR FEES IN 20 20 20 19. 20 19, 20 19. SO THIS IS THE FIRST TIME IN FOUR YEARS. IT IS A FAIRLY SIGNIFICANT INCREASE, UH, BUT IT'LL HELP US RECAPTURE THOSE COSTS AND PASS THOSE COSTS INTO THE, INTO THE INSURANCE PROGRAM. SO, AND THESE ARE IN LINE WITH THE SENATE BILL? YES, SIR. YES, SIR. SO THE, THE, UH, SENATE BILL ALLOWS FOR CAPTURE UP TO 325% OF TOTAL COST ABOVE, UH, WITH THE UNDERSTANDING AND, AND A 50% MODIFIER OR $500 MODIFIER ON TOP OF THAT. SO THIS IS THE MAX THAT WE CAN ASK THE STATE AND THE INSURANCE COMPANY FOR BASED ON THE SERVICES RENDERED. SO IF IT'S AN ADVANCED TIER TWO CALL, WE'RE GONNA CHARGE THAT FULL 27 45. DID YOU, DID YOU SAY 325% ABOVE? THAT'S RIGHT. AND WHEN I SAY 325%, THAT'S 325% ABOVE WHAT MEDICARE PAYS, RIGHT? SO IF YOU THINK ABOUT WHERE THIS NUMBER IS IN RELATION TO WHAT WE ACTUALLY GET ON A MARY CARE RUN, THAT'LL TELL YOU THE ANEMIC AMOUNT OF MONEY WE GET FOR THOSE CALLS. WHAT IF SOMEBODY'S NOT INSURED AT CJ? DO THEY PAY FOR ANYTHING? NO, WE DON'T, WE DON'T GO BACK. WE DON'T PURSUE FOLKS THAT DON'T HAVE INSURANCE. TYPICALLY, THEY WOULD BE COVERED ON OUR MEDICAID OR MEDICARE IF THEY'RE, IF THEY'RE WITHOUT INSURANCE, IF THEY'RE WORKING AT THAT LEVEL. WE DON'T GO AFTER THE INDIVIDUAL RESIDENT SO AGGRESSIVELY. ALRIGHT, MA'AM, WE DON'T AGGRESSIVELY BILL. SO YOU'LL GET A BILL, RIGHT? BECAUSE WE HAVE, WE'RE NOT GONNA SEE COLLECTION, WE'RE NOT GONNA TELL YOU ABOUT IT BECAUSE YEAH, RIGHT. NO, I UNDERSTAND. I'M JUST WONDERING. YEAH. IS THAT FOR LIKE ALL THE SERVICES THAT EMS OFFERS, LIKE AMBULANCE AND EVERYTHING OR? RIGHT. SO IF YOU, IF YOU TAKE A LOOK HERE, THIS IS THE ADVANCED LIFE SUPPORT, BASIC LIFE SUPPORT, TWO DIFFERENT LEVELS OF SERVICE, TWO DIFFERENT LEVELS OF PERSONNEL THAT MIGHT BE ON THE TRUCK. UH, AND THEN YOU HAVE YOUR DISPOSABLES THAT YOU'RE GONNA USE THAT ARE GONNA BE DIFFERENTIATED. UH, BUT BASICALLY IT ALL GETS BACK TO CODING FOR THE HOSPITAL OR FOR THE, FOR THE INSURANCE COMPANY ITSELF. OKAY. SO, YEAH, I MEAN, SO THESE ARE ITEMS THAT WE HAVE BILLED FOR IN THE PAST, JUST CHANGING THE RENT? YES. YEAH, IT'S BASICALLY SAYING THAT IF YOU'VE STUBBED YOUR TOE, IT'S GONNA BE ONE CHARGE. IF YOU'RE HAVING A MASSIVE CORONARY, WE'RE GONNA CHARGE YOU A LOT MORE BECAUSE THERE'S GONNA BE A LOT MORE SERVICES RENDERED. SO, OKAY. OKAY. DO I HAVE A MOTION TO APPROVE RESOLUTION NUMBER 62 DASH 2023? I'LL MAKE A MOTION AND I'LL SECOND THE MOTION. MOTION MADE BY COUNCIL PERSON MADDOX, SECONDED BY COUNCILMAN AGUILAR. FURTHER DISCUSSION. HEARING NONE, I'LL ENTERTAIN A VOTE. ALL IN FAVOR? AYE. AYE. AYE. OKAY. NEXT ITEM WOULD BE CONSIDERATION AND POSSIBLE ACTION TO ADOPT RESOLUTION NUMBER 63 DASH 2023, UH, APPROVING THE CSRS TAX TASK ORDER NUMBER FIVE FOR THE ADDITIONAL COST FOR SPECIAL ENVIRONMENTAL SERVICES TO PERFORM THE ARCHEOLOGICAL ARCHEOLOGICAL SURVEY THAT HAS, THAT HAS BEEN REQUIRED BY, FOR THE C-D-B-G-M-I-T PROJECT, SIR? OH, SORRY. IT WOULD BE RESOLUTION NUMBER 63 DASH 2023. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CL TEXAS APPROVING WORK TASK ORDER AUTHORIZATION NUMBER FIVE, WITH CSRS INC. FOR THE PROVISION OF SPECIAL ENVIRONMENTAL SERVICES, INCLUDING ARCHEOLOGY, ARCHEOLOGY, ARCHEOLOGICAL SURVEYS FOR CERTAIN AREAS RELATED TO THE GLO FUNDED FLOOD MITIGATION PROJECTS WHERE THE CITY HAS PREVIOUSLY ENTERED INTO A MASTER SERVICE AGREEMENT WITH CSRS INC. FOR THE PROVISION OF THE GLO FUNDED CDBG FLOOD MITIGATION PROJECTS, WHEREAS THE CITY HAS PREVIOUSLY APPROVED OTHER RELATED TASK AUTHORIZATIONS [01:20:01] RELATED TO THE PROJECT. WHEREAS A REVIEW OF THE PROJECT BY GLO AND THE TEXAS HISTORICAL MISSION THC, HAS DETERMINED A NEED FOR A SPECIAL ENVIRONMENTAL REVIEW OF CERTAIN PORTIONS OF THE PROJECT, WHICH ARE NOT ORIGINALLY INCLUDED IN THE SCOPE PROJECT SCOPE OR DESIGN. AND WHERE CSRS AND CITY STAFF REVIEWED, REVIEWED MULTIPLE PROPOSALS FOR SERVICES AND FOUND THAT AMA TERRA WAS THE MOST QUALIFIED AND MOST COST AND COST EFFICIENT SUCH SERVICE PROVIDER. NOW THEREFORE BEING RESOLVED BY THE CITY COUNCIL, CITY OF CLUTE, TEXAS, THE TAX TASK AUTHORIZATION OF NUMBER FIVE BETWEEN THE CITY AND CRS IS HEREBY APPROVED. FURTHER, THE CITY SHALL PAY CRS $19,587 AND 70 CENTS TO REIMBURSE THEM. THE SERVICES RENDERED TO AMERA FOR SAID PROFESSIONAL SERVICES. READ PAST THE 14TH DAY OF DECEMBER, 2023, SIGNED BY MYSELF AS THE TESTIFIED ROSA APPOINTMENT CITY CLERK. THE QUESTION WAS, WHY ARE WE LOOKING FOR DINOSAURS THERE? WE'RE NOT LOOKING FOR DINOSAURS. THAT'S THE GOOD NEWS. THE BAD NEWS IS WE'RE LOOKING FOR DEAD PEOPLE IN A CEMETERY THAT SHOULDN'T BE THERE. WE'RE ALSO LOOKING FOR DEAD PEOPLE IN ANOTHER SPOT THAT SHOULDN'T, WELL, SHOULD BE THERE BUT SHOULDN'T BE THERE. UH, NOT REGISTERED GUEST, WE'LL PUT IT THAT WAY. THEY WANTED TO, UH, WHEN WE MET WITH THC AND THE GLO TO DISCUSS THIS, THERE WERE FOUR SITES THAT THEY HAD SELECTED. UM, BECAUSE OF THE COST OF THE ACTUAL PROJECT, WE NARROWED IT DOWN TO THESE TWO, UH, BECAUSE WE THINK WE'RE GOING TO EXCISE THE OTHER TWO SITES OUT OF OUR SCOPE OF WORK. THAT BEING, IF YOU THINK ABOUT WHEN WE GOT THE GRANT, THE $10.2 MILLION GRANT TO DO THE DRAINAGE IMPROVEMENTS, WE HAD DITCH A UP THERE JUST SOUTH OF WOOD SHORE. WE HAD THE PENN MONEY CHANNEL SYSTEM AND THE, UH, FLAG LAKE CHANNEL SYSTEM THAT WERE ALL GONNA BE DONE UNDER THIS PROJECT. ALL THAT WE WERE GONNA GO BACK AND FIX THE DRAINAGE AND ALL OF THEM THAT WAS IN 20 $20 AND IN 2020 $3 POST PANDEMIC, UH, WE CAN'T AFFORD TO DO ALL THREE SEGMENTS. AND SO WE FOCUSED ON THE PENN MONEY SYSTEM AS THE ONE WHERE WE WERE GOING TO DO OUR WORK. UH, AND SO THEY HAD REQUESTED TWO SITES IN ASSOCIATED WITH THE PENN MONEY SYSTEM, BOTH OF 'EM LOCATED AT OR NEAR THE CEMETERY, UH, WHERE WE'LL BE DOING SOME INLINE DETENTION AND DRAINAGE UPGRADES AND WHERE THEY HYPOTHESIZE THAT THERE MAY BE ENSLAVED PEOPLE BURIED. SO I GUESS THIS COME FROM SOME HISTORY INFORMATION OR THIS, UH, THE HISTORICAL SOCIETY. AND, AND WHAT WE TRIED TO POINT OUT WAS, IS THEY WERE NOWHERE. THE SITE WHERE WE INTEND TO DO OUR IMPROVEMENTS IS NOWHERE CLOSE TO WHERE THE POTENTIAL GRAVES UNMARKED GRAVES MIGHT BE. UH, BUT THE HISTORICAL COMMISSION HAS SAID THAT BASICALLY WE HAVE TO DO THIS TO ENSURE THAT THERE'S NOBODY BURIED, WHETHER THEY'RE NOT SUPPOSED TO BE BURIED IN THE CEMETERY AND THIS IS GONNA BE X-RAY SERVICES OR WHAT? NO, THIS IS, UH, THEY WILL DO A ACTUALLY, THEY WILL ACTUALLY DIG DOWN, DO A TEST PIT. YEAH. SO THEY'RE GONNA LIKE TAKE THE MAKE LINES, MAKE LIKE A GRID AND START DIGGING DOWN RIGHT INTO THE, OKAY. YEAH. AND APPARENTLY THESE SITES WERE IDENTIFIED INITIALLY IN THE 1960S AND SO THAT'S WHY THEY WANT TO FIRM UP AND MAKE SURE THAT THOSE ARE IN FACT NOT EFFECTIVE SITES. TRACK COLE FIND THEM. AND THE WHAT IF THEY DO FIND SOMETHING? I SAID, WHERE'S THE PROJECT GOES ON HOLD? THE PROJECT BASICALLY GOES ON HOLD UNTIL SOMEBODY FIGURES OUT HOW TO MITIGATE IT. YOU HAVE NO RESPECT FOR HISTORY? WELL, I'LL BE HONEST WITH YOU. I MEAN, ONE OF THE SITES THAT IS NOT INCLUDED IN THIS SURVEY WAS A, WHAT THEY CALL A PRE-COLUMBIAN RESIDENTIAL SITE ON LAKE BENDS. WE'VE ALREADY BUILT A SUBDIVISION ON TOP OF IT. MM-HMM. . AND WHEN I INQUIRED ABOUT THE, WE PUT A SUBDIVISION ON TOP OF IT AND PUT PLUMBING INTO THE HOMES IN THAT SUBDIVISION, WHY WERE WE NOT REQUIRED AT THAT TIME TO DO THIS? AND THEY SAID, WELL, YOU'RE DIGGING A DITCH. IT'S DIFFERENT. AND I WAS LIKE, I DON'T SEE THE DIFFERENCE. YOU'RE STILL GOING INTO THE GROUND AND DIGGING STUFF UP AND IF WE COULD DO IT TO BUILD HOUSES, WHY CAN'T WE DO IT? TO BUILD A DITCH AND IMPROVE THE LIVES OF THE, THE, THE COMMUNITY? SO, WELL THAT WAS KIND OF LIKE THE SENSITIVE AREAS THAT WE BUILT A GROCERY STORE OVER. YES. OKAY. I WOULD CONSIDER A MOTION TO APPROVE RESOLUTION NUMBER 63 DASH 2023. IF I READ IT HERE CORRECTLY, THE MONEY THAT WE SPEND ON THIS WILL BE A PORTION OF OUR MATCHING. IT WILL, IT WILL BE COUNTED AS ADDITIONAL MATCH TOWARDS OUR GRANT. SIR, WHAT'S THE 70 CENTS FOR ? THAT WAS JUST THE, THAT WAS THE BILL THAT WAS PROVIDED OR THE, THE NU THE [01:25:01] NUMBER THAT GOT THERE. I THERE WE HAVE TO DO IT RIGHT? CORRECT. IT'S, WE'RE OBLIGATED TO DO THIS. YES MA'AM. OKAY. WELL WE COULD POST STUFF ON THE WEBSITE THAT WE HAVE A ARCHEOLOGICAL SITE GOING THAT'S GONNA BRING A LOT MORE, UH, STAFF WILL REQUEST THAT YOU DISCUSSED WITH US BEFORE YOU PROCEED WITH THAT PLAN. I DO. I HAVE A MOTION. I'LL MAKE THE MOTION. MOTION MADE BY COUNCIL PERSON. MADDOX, DO I HAVE A SECOND? I'LL SECOND. COUNCILMAN LOPEZ MAKES A SECOND FURTHER DISCUSSION. HERE IS WHERE IT IS. ALL IN FAVOR? AYE. AYE. AYE. UNANIMOUS. THANK YOU. NEXT ITEM WOULD BE CONSIDERATION POSSIBLE ACTION TO ADOPT RESOLUTION NUMBER 64 DASH 2023 FOR THE APPROVAL OF THE FISCAL YEAR 2024 AND LOCAL AGREEMENT BETWEEN BRAZORIA COUNTY AND THE CITY OF KLU FOR ROAD REPAIR AUTHORIZING THE MAYOR SIGNATURE TO EXECUTE CONTRACT ON ON THE CITY'S BEHALF. AND IT WOULD BE RESOLUTION NUMBER 64 DASH 2023. A RESOLUTION OF CITY COUNCIL OF CITY OF CLUTE, TEXAS AUTHORIZING THE MAYOR'S SIGNATURE APPROVING FISCAL YEAR OF 2024 ROAD AND BRIDGE PROJECTS UNDER THE CITY'S INTER-LOCAL AGREEMENT WITH BRAZORIA COUNTY. THE CITY OF KLUTE BRAZORIA COUNTY HAVE LONG PARTNERED TO CONDUCT MUCH NEEDED ROAD MAINTENANCE PROJECTS UNDER A LONG-LASTING INTERLOCAL AGREEMENT. AND WHEREAS THE AGREEMENT ALLOWS THE CITY TO USE CURRENT USE COUNTY RESOURCES FOR THE OVERLAY OF ROADS LISTED ON THE INTERLOCAL AGREEMENT PROJECTS REQUEST SUMMARY F FISCAL YEAR 24 EXHIBIT A NOW THEREFORE BE RESOLVED BY THE CITY COUNCIL OF CITY OF CLUTE, TEXAS, THAT THE PROPOSED PROJECT LISTED ARE HEREBY APPROVED AND THE MAYOR IS AUTHORIZED TO SIGN THE APPROPRIATE INTER LOCAL AGREEMENT. I ASKED 24 DASH 0 0 1 1 WITH BRAZORIA COUNTY. FURTHER, THE CITY WISHES TO THANK COMMISSIONER PAYNE AND THE COUNTY FOR THEIR ASSISTANCE. READ PAST THIS, HAD ADOPTED THIS 14TH DAY OF DECEMBER, 2023, SIGNED BY MYSELF AND TO TESTIFY BY ROSA POINT OF THE CITY CLERK. I WOULD NOTE, I'M SORRY. NO, GO AHEAD. I WOULD NOTE THAT WE WILL BE COMING BEFORE WE START THIS WORK TO SHORE UP THE SIDES OF THE ROAD, ESPECIALLY IN AREAS LIKE CEMETERY AND SMITH WHERE IT IS JUST THE, THE DROUGHT HAS JUST DEVASTATED THE ROAD. ALRIGHT. YOU READ MY MIND BECAUSE I SAW SMITH STREET. YES. NO, I WANTED TO MAKE SURE YOU KNEW WE HAD, WE'VE ORDERED THE PIPE. WE WERE READY TO START INSTALLING IN THERE BECAUSE IT IS DEADLY. DIDN'T WE APPROVE THIS? YOU APPROVED THE INITIAL, THIS SPECIFIES THE ACTUAL STREETS THAT WE'RE GONNA BE DOING SO AND IS THERE A SPECIFIC ORDER THAT WE'RE GONNA GO THROUGH? UH, WE'LL START WHERE THE STARTING POINT WILL BE WHERE WE SHORE THE ROADS UP FIRST. UH, SO WE DON'T HAVE A SPECIFIC SITE YET, BUT ONCE WE GET, ONCE THEY GET ON SCENE AND WE DETERMINE HOW WE'RE GONNA SHORE THE ROADS UP OR WHICH ONES ARE GONNA BE SHORED AT FIRST, THAT'S WHERE WE'LL START. SO, BECAUSE I KNOW WE HAVE THAT PROJECT GOING ON IN SHANKS. THAT'S WHAT I WAS WONDERING TOO. DOES THEY HAVE A CERTAIN SHANKS? HAVE THEY? NO, WE JUST GOT THE, UH, FINAL ENGINEERING TODAY. OKAY. SO A MOTION ANYONE CARRIED TO MAKE A MOTION TO APPROVE RESOLUTION NUMBER 64 DASH 2023. SO, SO MOVED BY COUNCILOR CHRIS, SECONDED BY COUNCILMAN AGUILAR. DISCUSSION, FIX ROSE. HEARING NONE, I'LL ENTERTAIN THE VOTE. ALL IN FAVOR A UNANIMOUS AYE. WE WILL FIX SOME ROADS. NEXT ITEM WOULD BE POSSIBLE CONSIDERATION. CONSIDERATION OF POSSIBLE ACTION TO ADOPT RESOLUTION NUMBER 65 20 23 DONATING THE EXISTING CL FIRE DEPARTMENT BRUSH TRUCK TO THE BRAZORIA COUNTY FIREFIGHTERS ASSOCIATION FOR FIRE FIELD USE. IT WOULD BE RESOLUTION NUMBER 65 DASH 2023. RESOLUTION OF THE CITY OF KLU TEXAS APPROVING THE DONATION OF A CERTAIN FIRE BRUSH TRUCK TO THE BRAZORIA COUNTY FIREFIGHTERS ASSOCIATION. WHEREAS THE KLU VOLUNTEER FIRE DEPARTMENT HAS UTILIZED UNIT 9 0 1 FOR ALMOST THREE DECADES, WHEREAS THE INSTEAD OF PLACING THE VEHICLE AS SURPLUS EQUIPMENT INTO AUCTION, THE CITY IS DESIROUS OF SEEING IT CONTINUE TO SERVE THE PEOPLE OF BRAZORIA COUNTY AND WHEREAS THE BRAZORIA COUNTY FIREFIGHTERS ASSOCIATION HAS EXPRESSED AN INTEREST IN USING THE TRUCK FOR FIELD USE AND WHEREAS THE BRAZORIA COUNTY FIREFIGHTERS ASSOCIATION IS WILLING TO ACCEPT THE ASSIGNMENT OF FIRE UNIT NUMBER 9 0 1 VIN NUMBER ONE GBKC 34 FXSJ 1 1 203 2 FOR CONTINUED SERVICE IN THEIR MISSION. NOW THEREFORE IT BE RESOLVED BY THE CITY COUNCIL. CITY OF CLUE THAT THE FIRE U UNIT 9 0 1 SAME [01:30:01] VIN NUMBER , IT'S HEREBY DONATED TO THE MISSOURI COUNTY FIREFIGHTERS ASSOCIATION. THIS RESOLUTION DULY PASSED THIS 14TH DAY OF DECEMBER, 2023. SIGNED BY MYSELF AND THE TESTIFY ROSA APPOINTMENT CITY CLERK. THIS VEHICLE IN ELH HAVE SERVED THE CITY AND THEY HANG WELL AND THEY HANG AS FAR AS BEING A SMALL VEHICLE THAT CAN GET AROUND. BUT AS FAR AS ONE OF THE UH, LAST FIRES IN HANG A COUPLE MONTHS AGO IN EL HANG, UH, THE TRUCK ITSELF CAUGHT ON FIRE OH FROM THE ENGINE COMPARTMENT AS FAR AS THE ELECTRICAL SYSTEM. AND THEN WE HAD A LOW COMPRESSION ALSO AND THEY'LL HANG FROM THE ENGINE. SO AS FAR AS PUTTING ANY MORE MONEY IN, IN INTO THIS VEHICLE, UH, THE PUMP THAT'S ON THE BACK AND THEY'LL HANG IS SABLE IN THEIR HANG AS FAR AS HAVING ANYBODY ELSE PUT ANY MONEY INTO IT FOR THE PUMP OPERATION. UH, THE COUNTY HAS IDENTIFIED EVERYTHING INTEREST IN THEIR HANG AS FAR AS THE ASSOCIATION HAS AN INTEREST IN IT. 'CAUSE THAT TRUCK WOULD BE PARKED IN THEIR HANG AS FAR AS IN A CENTRAL LOCATION AND WE'D BE UTILIZING IT NARROW HANG FOR DEMONSTRATION OF BRUSH FIRES, UH, SMALL FIRES AND STUFF AS FAR AS THAT, THAT PUMP AND NARROW HANG THAT'S, UH, OPERATIONAL CAN BE UTILIZED RIGHT THERE IN THE, FOR OUR USE. AND AS FAR AS FOR OTHER FIRE DEPARTMENTS WITHIN THE COUNTY ONTO THOSE, UH, I WOULD NOTE WE, UH, WE ARE WAITING ON THE LIGHT REPLACEMENT OF THE RAPID RESPONSE VEHICLE. YES. UH, WE THINK JANUARY WE'RE YEAH, JANUARY NEURO HANG. AS FAR AS ONTO IT, MERRI HANG AS FAR AS RIGHT NOW THEY'RE WAITING ON THE, UH, THE TANK AND THEY'LL HANG AS FAR AS THEY GOT EVERYTHING ELSE BUILT ONTO IT. THEY'RE JUST WAITING FOR THE DELIVERY OF THE TANK ONTO THOSE. SO WE'LL GET THAT. CAN WE, OR WILL WE PUT A VALUE ON THIS AS FAR AS A YES, WE CAN PUT A VALUE ON IT. WE'LL RIDE 'EM WITH A DONATION OF, UH, IS THAT EVEN AN OPTION? WE'VE NEVER DONE THAT WHEN WE DID THE AMBULANCE FOR THE POLICE CAR. I MEAN, NOT THAT, NOT SAYING THAT IT'S GOING IN THAT SPOT.
