NEXT ITEM IS A NOTE OF MAILINGS THAT WERE SENT OUT. THERE WERE 16 MAILINGS SENT OUT. NONE WERE RETURNED. SO WE PRESUME THEY'RE ALL DELIVERED. AND THE NEXT ITEM WILL BE COMMENTS, PUBLIC COMMENTS. UH, I PRESUME THE THE OWNERS OF THE PROPERTY ARE HERE GOING TO SPEAK. UH, FIRST ITEM IS VARIANCE TO ALLOW EX EQUIPMENT AND THE BUILDING LINE SETBACK AT THE PROPERTY LOCATED AT NINE 10 WEST KYLE, LEGALLY DESCRIBED AS DINGLE NUMBER TWO A 0 0 6 6 J GROVES KLUT LOT 14 TRACK 38 FLOORS OPEN FOR COMMENT. IS THE APPLICANT HERE? YEAH, IF YOU CAN PLEASE COME UP TO THE MIC. YES MA'AM. I AM HERE FOR MY PARENTS. THEY'RE NOT VERY FLUENT ENGLISH. SURE. AND I'M HERE FOR NINE 10 WEST KYLE ROAD. PULL THE BIKE DOWN. JUST A THERE YOU GO. MM-HMM. . AND SO, UH, THEY WANT TO ADD A PORCH. YES. THEY WOULD ENCROACH ON THE SETBACK. YES. YES. AND WAS THERE A PORCH THERE PREVIOUSLY? YES, THERE WAS. OKAY. AND SO HOW FAR WOULD THIS PORCH ENCROACH? I'M SORRY? HOW FAR IS THE ENCROACHMENT LINE TO YOU? I KNOW THAT FROM THE CITY LINE, IT'S LIKE 50 FEET FROM THEIR PROPERTY TO THE CITY LINE. JUST FROM THE ONE SIDE. BUT IT'S LIKE SEVEN FEET SHORT FOR THE ALLOWED MEASUREMENTS ON THE OTHER SIDE. THE DRAWING THAT I SAW IT HERE SHOWED A 10 BY 20 OR EIGHT, EIGHT BY 20, EXCUSE ME. SO THE TOTAL PORT SIZE WOULD BE EIGHT BY 20? CORRECT. IT'S EIGHT BY 28. HEY ROSIE, CAN YOU GO TO THE NEXT EIGHT BY 28? YEAH. IT SAYS IT ON THE GROUND. EIGHT BY 28. THERE WE GO. MM-HMM. . YES MA'AM. THANK YOU. AND SO WHEN WE DO A VARIANCE, THERE ARE THREE QUESTIONS THAT BASICALLY HAVE TO BE ANSWERED BY THE COUNSEL. AND DO YOU WANNA EXPLAIN, OH, I'M SORRY. WHEN YOU DO A VARIANCE, THERE ARE THREE. WOW. TRY THAT. THERE ARE THREE QUESTIONS THAT HAVE TO BE ANSWERED LEGALLY BY THE COUNSEL TO ALLOW THE VARIANCE TO PROCEED. AND THE FIRST IS, UH, IS THERE A QUALIFYING HARDSHIP? SECOND IS, IS WOULD THIS SPECIFIC ZONING, UH, OR IT MAKE YOU UNABLE TO, YOU HAVE REASONABLE USE OF YOUR PROPERTY. AND THE THIRD, WILL IT HAVE AN IMPACT ON YOUR NEIGHBORS? AND SO THAT'S WHAT COUNSEL'S GONNA TAKE UP OR THE BOARD OF ADJUSTMENTS. NOW, COUNCIL ACTING AS BOARD OF ADJUSTMENTS IS GONNA TAKE UP IS THE CONSIDERATION OF THOSE THREE QUESTIONS. OKAY. OKAY. WE GO STRAIGHT OFF OF HERE. OR IS THERE ANYBODY HERE THAT'S OPPOSED? OH, I DO WE HAVE ANY MEMBER OF THE PUBLIC OPPOSED TO THIS APPLICATION FOR A VARIANCE? THIS, THIS HOUSE SITS ON THE CORNER OF, UH, KYLE VINE. CORRECT? CORRECT. SO ONE SIDE OF THE HOUSE IS, YEAH, IT'S GOT, ITS ONE SIDE OF THE HOUSE IS ALMOST ON VINE STREET. YES. . THAT'S, WELL, IT, IT LOOKS LIKE IT ALMOST MAYBE STARTED FACING VINE ORIGINALLY AND THEN, UH MM-HMM. , I'M NOT QUITE SURE THAT THAT'S THE CASE, BUT IT LOOKS LIKE IT MIGHT HAVE WANTED TO. AND IT'S ON A, ON A ONE OF OUR FAVORITE 45 DEGREE ANGLES THAT WE LIKE IN OUR STREETS HERE IN INCLUDE. AND SO IT MAKES IT A LITTLE AWKWARD. IS WHERE IN FAR IN, SO FAR AS WHERE THE, THE HOUSE LIES IN RELATION TO THE STREET HOUSE. WHAT NOW? AND HOW MUCH DID WE SAY IT WAS GOING OVER? IT'S GOING TO ENCROACH, UH, HOLD ON. I'M SORRY. LEMME GET BACK IN MY PACKET. IT, IT'S SIX IT 20 FOOT A SET. 20 FOOT SETBACK. OH, 20. AND SO WE'RE, WE'D BE AT, UH, IF IT'S 10 FOOT WIDE, WE'D BE AT LIKE SEVEN FEET OVER WHAT'S EIGHT FEET? EIGHT FEET OVER. YEAH. SORRY, WHAT'S EIGHT FEET WIDE? YEAH, EIGHT FEET WIDE. I'M SORRY. YOU'RE CORRECT. SO IS THE SETBACK RIGHT UP TO THEIR FRONT DOOR? UH, IT THE, WELL, IT'S AT THE, SO IF YOU THINK ABOUT, YOU SEE THE PICTURES? YEAH. IF YOU TAKE A LOOK AT THIS PICTURE HERE, HAVE IT TODAY AND CLOSED IT WHERE YEAH. ACTUALLY, IF YOU CAN SCROLL BACK, THE PROPERTY'S KIND OF PIE SHAPED. IF YOU LOOK, THE FIR THE CLOSEST TO CLOSEST CORNER TO THE STREET IS 27 FEET. I THOUGHT IT WAS LIKE A GENERATED, LIKE, TO LET US KNOW WHAT IT WAS GONNA LOOK LIKE. IT SUPPOSED [00:10:02] WAS THAT TO MAKE THE LIVING ROOM BIGGER, I'M ASSUMING? WAS THAT LIKE THE LIVING ROOM? YES, SIR. MADE BIGGER. THAT WAS TO MAKE, AND Y'ALL, Y'ALL HAVE GENERATED, SO YOU INCORPORATED THE ORIGINAL PORCH, WHICH WAS WITHIN THIS, WHICH WAS LEGAL, CORRECT? CORRECT. YES SIR. AND NOW YOU'RE WANTING ANOTHER PORCH. THEY WANTED TO ADD ANOTHER ONE. SO I THINK IF YOU GO THROUGH THE, YOU KNOW, FROM THE LEGAL STANDPOINT, IF YOU COULD LOOK AT THE THREE QUESTIONS, YOU KNOW, IS THERE A, IS THERE A UNIQUE CONDITION YOU, YOU COULD CONSIDER AS UNIQUE CONDITION BECAUSE OF THE SHAPE OF THE ROAD IN RELATION TO THE LOT? SO I THINK YOU MIGHT BE ABLE TO QUALIFY UNDER NUMBER ONE. COULDN'T BACK THAT OTHER QUARTER. JUMP TO THE EASY ONE. NUMBER THREE, WOULD IT ADVERSELY AFFECT THE NEIGHBORS? I DON'T SEE THAT IT WOULD, I DON'T HAVE IT. NOBODY'S HERE SAYING IT WOULD ADVERSELY AFFECT THEM. UH, SO THE KEY CONSIDERATION WOULD BE NUMBER TWO. UM, DOES IT PREVENT THEM FROM HAVING REASONABLE USE OR COULD THEY DO SOME FEASIBLE ALTERNATIVES SUCH AS CHANGING THE SIZE OR DESIGN OF THE BUILDING? IF YOU LOOK AT THE PICTURE, IF THEY DO THE PORCH ALL THE WAY ACROSS THE FRONT OF THE HOUSE, A FULL 28 FEET, THEN IT ENCROACHES AT, BUT YOU KNOW, WHERE THEY'RE STARTING BY THE DRIVEWAY, THERE'S A 42 FOOT SETBACK. SO I DON'T KNOW WHAT POINT, BUT AT SOME POINT, IF THEY MAKE THAT PORCH SHORTER, MAYBE IF THEY MAKE IT INSTEAD 28 FEET LONG, THEY MAKE IT 20 FEET LONG OR SOMETHING LIKE THAT. I THINK IT WOULD FIT WITHIN WITHOUT ENCROACHING INTO THE, THE SETBACK. SO, YOU KNOW, THAT THAT COULD BE AN ALT, YOU KNOW, POSSIBLY A FEASIBLE ALTERNATIVE TO GRANTING THE VARIANCE. ALTHOUGH I DON'T KNOW WHERE THAT CUTOFF POINT WOULD BE. 'CAUSE YOU KNOW, WE DON'T HAVE THAT MEASUREMENT. UM, AND THEN IF YOU SEE FURTHER BACK WHEN YOU'RE LOOKING AT NUMBER TWO ABOUT, YOU KNOW, REASONABLE USE AND THERE'S A PROVISION ABOUT IS DID THEY CREATE THE, THE SITUATION, RIGHT? AND THAT'S, I GUESS GOES TO, UM, MR. CHRIS'S QUESTION ABOUT THEY HAD A PORCH PREVIOUSLY, BUT THEY ENCLOSED IT. AND SO NOW THAT'S KIND OF WHAT IS PREVENTING THEM FROM HAVING A PORCH NOW BECAUSE THEY AIN ENCLOSED THEIR ORIGINAL PORCH. SO I MEAN, I THINK A, I THINK THE KEY QUESTION TO ME FROM THE, FROM ANALYZING THE, THESE LEGAL QUESTIONS IS, YOU KNOW, WOULD IT BE FEASIBLE FOR THEM TO MAKE A PORCH, LET'S SAY HYPOTHETICALLY THAT RUNS 20 FEET IN FRONT OF, LONG, IN FRONT OF THEIR HOUSE AND STILL STAYS WITHIN THE SETBACK RATHER THAN GOING THE FULL LENGTH OF THAT HOUSE. RIGHT. UM, I THINK THAT COULD BE A REASONABLE ALTERNATIVE, WHATEVER THAT IS. 20 FEET LONG OR 18 FEET LONG, OR AT WHATEVER POINT THEY GET TO WHERE THEY'RE WITHIN THE SETBACK. OR IF THEY WERE TO NARROW THE PORCH. CORRECT. YEAH, YEAH, YEAH. BOTH OF THOSE, BOTH OF THOSE, BOTH OF THOSE DIVISIONS EIGHT FOOT WIDE OR 28 FEET LONG, IF THEY REDUCED ONE OR BOTH OF THOSE, THEY COULD SCALE IT BACK AND FIT WITHIN THE SETBACK LINE. WELL, ANYTHING SMALLER THAN A EIGHT FOOT WIDE PORCH, YOU JUST, WHY EVEN BUILD ONE? THEY WOULD HAVE TO, THEY WOULD HAVE TO SHORTEN IT BECAUSE THE EIGHT FOOT'S NOT GONNA, I MEAN, IF YOU, EVEN IF YOU CUT IT BACK TO TWO FOOT, IT'S NOT GONNA MAKE ANY DIFFERENCE. YEAH. IT'S NOT. RIGHT. IS ANYBODY GOOD WITH MATH THAT COULD SEE TWO WHAT THAT REDUCTION WOULD BE? THAT WOULD BE, IF THEY CUT IT BACK TO TWO FOOT, THEY'RE WITHIN THE SETBACK LIMIT. MM-HMM. ? NO, NO, NO. THE LENGTH, THE 28 FEET LONG I'M TALKING ABOUT. BUT IF THEY CUT THE WIDTH TO TWO FOOT, RIGHT, RIGHT, RIGHT, RIGHT. THEY'RE IN THE SET. THAT'S NOT THE, THAT'S NOT THE FEASIBLE ALTERNATIVE. PROBABLY EVEN IF YOU SAW IN THE LENGTH, THAT'S JUST GONNA LOOK AWKWARD. YEAH. SO WILL IT CLEAR FROM THE DOOR TOWARDS THE DRIVEWAY? WILL THAT GET IT WITHIN THE SETBACK? I'M GUESSING THAT DOOR. OH, IT'S A DOOR THERE. RIGHT? RIGHT HERE. IF YOU'RE USING THE, UH, IF YOU'RE USING THE POWER POLE, UH, AS YOUR GUIDE, YOUR RADIUS THERE, HOLD ON OR BRING THAT OUT RIGHT AT RIGHT AT THE DOOR WOULD GIVE YOU 25 FEET. SO FROM THE DOOR TO THE GARAGE WOULD BE ACCEPTABLE AS FAR AS THAT BACK GOES? YES. YOU'RE PRETTY MUCH CUTTING IT IN HALF LENGTHWISE. CORRECT? YEAH. DO WE HAVE TO ON THE, JUST FOR VERIFICATION, DO EACH ONE OF THESE, OR IS IT ONE OF THESE THREE THAT HAVE TO BE, OKAY, SO THE VARIANCES ARE NOT AS STRICT AS THAT, WHATEVER THE OTHER ONE THAT YOU HAD PREVIOUSLY. RIGHT. THE, THE PLATS THREE PLATS. OKAY. SO THE VARIANCE, THEY'LL STILL HAVE SOME DISCRETIONS. RIGHT. THESE ARE THE QUESTIONS. THEY SHOULD, THEY SHOULD COMPLY WITH ALL THREE. YOU KNOW, IF THEY COMPLY WITH ALL THREE, THEN YOU GRANT THE VARIANCE. RIGHT. UH, SO THAT THERE IS A, THEIR LOT IS UNIQUE THAT, UH, YOU KNOW, IT PREVENTS THEM FROM HAVING REASONABLE USE OF THEIR PROPERTY. IF YOU SAY NO, AND, [00:15:01] UH, AND ALSO THAT IT DOESN'T HARM ANY NEIGHBORS. IF YOU'LL FIND ALL THREE, THEN YOU WOULD, YOU KNOW, YOU SHOULD FAIRLY MUCH AUTOMATICALLY GRANT THE VARIANCE. RIGHT. BUT, UH, YOU DO HAVE MORE DISCRETION WITH REGARD TO THE VARIANCE. YOU'RE ONLY, YOU'RE ONLY, YOU KNOW, YOU FACE MORE PERIL IF YOU WR IF YOU WRONGFULLY DENY A VARIANCE, THEN YOU HAVE SOME LEGAL LIABILITY 'CAUSE YOU WRONGFULLY DENIED IT. RIGHT. UM, UH, BUT IF YOU WRONGFULLY GRANT A VARIANCE, THEN YOUR ONLY PENALTY IS YOU'RE SETTING PRECEDENT FOR OTHER PEOPLE. RIGHT. SO, BUT, BUT THERE'S NOT A, YOU KNOW, THERE'S NOT A LEGAL PENALTY THAT SOMEBODY COULD GO TO COURT AND SAY, HEY, Y'ALL VIOLATED THE RULES. RIGHT. SO YEAH, THEY'RE ABOUT THE ONLY HOUSE IN THAT AREA THAT HAS A LOT SHAPED LIKE THAT. OR THERE, THAT PARTICULAR, THAT PARTICULAR STREET HAS A LOT OF WEIRD SHAPE LOTS. BUT AS FAR AS THE CORNER WENT LIKE THAT BECAUSE IT'S, BECAUSE IT'S GOT A BIG ARCHWAY THAT GOES AROUND LIKE THAT. AND THERE'S A LOT OF DIFFERENT, THERE'S A LOT OF VARIANCE. I MEAN, UH, A LOT OF, UH, LOT LOTS ON THERE THAT ARE, ARE ODD SHAPED. DO WE KNOW IF THERE'S ANY OTHER ONES ON THAT ROAD THAT'S HAD TO REQUIRE VARIANCE TO GET WHAT THEY WANT? I DON'T KNOW. NOW, IF I REMEMBER CORRECTLY, THE HOUSE, I BELIEVE THERE WAS, THERE WAS ONE BY THE RAILROAD TRACKS, IF I REMEMBER CORRECTLY, THE HOUSE ACROSS THE STREET ON VINE, RIGHT THERE, THERE THEIR CARPORT OR THEIR GARAGE OR SOMETHING IS ALMOST ON THE ROAD. OR JUST LIKE A, YOU TALKING ABOUT THE, THE ONE THAT'S ACROSS THE STREET FROM THE MUL VINE? YES. THERE, THE CARPORT IS NOT VERY FAR FROM THE STREET, IF I REMEMBER CORRECTLY OR SOMETHING THERE THAT'S NOT VERY FAR FROM THE STREET. YEAH. BECAUSE OF THE ANGLE OF THE ROAD, IT MAKES, THERE'S A LOT OF OPTICAL ILLUSION THAT HAPPENS ALONG THERE TOO. SO, YEAH. SO I JUST WANNA MAKE SURE AND CLARIFY ON NUMBER TWO, YOU KNOW, IT'S, UH, DEPRIVE OF REASONABLE USE. SO REASONABLE, IT'S NOT DEFINED. IT'S WHATEVER Y'ALL THINK IS REASONABLE. SO THAT'S WHY YOU HAVE A LITTLE BIT MORE, UH, DISCRETION IN GRANTING THE VARIANCE. RIGHT. AND, YOU KNOW, IS, IS MAKING THE PORCH LESS THAN 28 FEET AND BRING IT, I GUESS, FROM APPROXIMATELY THE FRONT DOOR TO THE GARAGE, UH, THE DRIVEWAY, IS THAT, UH, IS THAT FEASIBLE? RIGHT? SO BOTH OF THOSE REASONABLE AND FEASIBLE ARE KIND OF NO STRICT DEFINITION ON THAT. SO I I THINK Y'ALL COULD GO EITHER WAY, UM, WITH, WITH REGARD TO THE AWARENESS. BUT KEEP IN MIND, YOU KNOW, WHENEVER YOU MAKE THE DECISION, YOU KNOW, YOU MAY HAVE OTHER PEOPLE COME IN FOR THE SAME RELIEF. RIGHT. I WILL SAY THAT THE KEY POINT IS, IS THEY'RE ASKING FOR PERMISSION, NOT FORGIVENESS. CORRECT. WELL, THAT WAS WHAT I WAS THINKING. THEY HADN'T ALREADY BUILT IT IN US AND ASKED FOR FORGIVENESS AND THEY'RE TRYING TO GET IT STRAIGHT BEFORE THEY BUILT IT. CORRECT. AND I THINK THE THING WITH ME IS THAT, UH, THE NUMBER THREE IS THAT IT DOESN'T AFFECT ANY RIGHT. NEIGHBORING PROPERTIES. AGREED. UH, I THINK, WHICH DID BEFORE. SO IT'S NOT GONNA OBSTRUCT THE VISION OF ANYTHING OF THAT INTERSECTION OR ANYTHING LIKE THAT. NO. NOW THE FACT THAT THEY'RE AWAY FROM THE INTERSECTION YEAH. THE HOUSE SITS SO FAR BACK, I DON'T SEE IT WOULD PREVENT ANYTHING OR CREATE ANY SIGHTLINE ISSUES. OKAY. COULD IT IN THE FUTURE CREATE ANY PROBLEMS FOR LIKE THAT, THE DRAINAGE OR ANYTHING, OR THE POWER LINE? IT'S RIGHT THERE. NO, I THINK YOU'RE, THERE'S ONLY LIKE ONE HOUSE BETWEEN THEM AND THE RAILROAD TRACK, ISN'T IT? AH, THAT'S THE, THAT'S THE OTHER THING. THAT'S THE OTHER THING. THIS IS THE NURSING HOME OVER THERE. OKAY. OKAY. UH, IN TERMS OF THE DRAINAGE, I DON'T KNOW THAT IT WOULD ANY, I MEAN, YOU'VE GOT, HOW, HOW WIDE IS THE, THE LITTLE SLAB THAT RUNS FROM THE FRONT DOOR OUT NOW? STAIRS? YEAH, THERE'S, YEAH, THERE'S A LITTLE PAD THAT THE SIDEWALK, SIDEWALK DRIVEWAY. FOUR FEET. FOUR FEET WIDE. OKAY. SO IT'S, IT'S, I MEAN, I DON'T KNOW THAT IT'S GONNA HAVE ANY NEGATIVE IMPACT ON DRAINAGE OR NOT. OKAY. AND IT'S, WE WOULD CONTAIN THAT ALL HOPEFULLY WITHIN OUR EASEMENT. SO, BUT IS THAT BEFORE, AFTER WE COVER IT UP WITH A PORCH? HMM. UH, I'D LOVE TO THINK ABOUT THE WHOLE WRONG PLACE. WHAT KIND OF PORCH IS IT? WELL, I'M JUST ASSUMING YOU DON'T WANT SOMEBODY TO COME TO DO WORK AND DAMAGE THEIR PORCH BECAUSE IT'S IN THE EASEMENT. THAT'S THE WHOLE REASON WHY YOU CAN'T BUILD UNDER THE EASEMENT. BUT IS THERE, OR IN THE EASEMENT THERE'S SOME DAMAGE FOR REPAIR OR MOWING. I DUNNO. THAT'S MY ONLY QUESTION. WILL IT BE, I WAS JUST TOLD IF YOU BUILD IN THE EASEMENT AND THERE'S DAMAGE TO IT, THERE'S NO REPORT. IT'S YOUR DAMAGE. YEAH. WELL, [00:20:01] IF WE'VE MADE THAT CLEAR TO THEM. YEAH. WELL, WE HAVE TO MAKE THAT CLEAR. WHICH SIDE OF THE SIDEWALK WE DON'T KNOW YET. WE'RE WAITING ON THE ENGINEER TO COME BACK AND LET US KNOW. WELL, YOU KNOW, SIDEWALK GONNA BE A PROBLEM. YEAH, YEAH. 'CAUSE YOU'RE GOING TO DO THE DRAINAGE TO HAVE THE SIDE. WELL, I, I THINK RIGHT NOW WE'RE LEANING BECAUSE OF THE WAY THE CROSSWALK IS AT THAT INTERSECTION GOING ON THE OTHER SIDE OF THE STREET. UM, BUT THAT'S, THEY HAVEN'T MADE A FINAL DETERMINATION YET, SO. WELL, YEAH, IT IS ON THE OPPOSITE SIDE THERE. IF, IF THAT LIGHT POLE FALLS, IT'S GONNA FALL ON THEIR HOUSE ANYWAY. THAT'S TRUE, . YEAH, THAT'S TRUE. THAT IS TRUE. OKAY. MY ONLY CONCERN, AND THE ONLY ONE I HAVE ANSWERING IT IS IN FAIRNESS TO THEM, THEY IMPROVED THEIR HOUSE, BUT BY DOING THAT, THEORETICALLY STOPPED THE CHANCE OF A PORCH. THEY HAD A PORCH ENCLOSED AND IMPROVED THE HOUSE, I'M SURE. UH, BUT TOOK AWAY THE CHANCE OF A FULL LENGTH TORCH ACCORDING TO THE ORDINANCE. BUT LIKE YOU SAID, IS IT GONNA HURT ANYBODY ELSE? PROBABLY NOT. THE ONLY PROBLEM THAT, THAT I'M LOOKING AT FROM WHERE I'M SITTING, THESE VARIANCES ARE COMING REGULAR BECAUSE WE'VE SET THE PRECEDENTS THAT YOU DON'T SAY NO. SO YOU ASKED FOR PERMISSION. IF THEY CUT IT TO, IF THEY CUT IT TO 20 FOOT WIDE LONG, THEY'RE GONNA BE, THEY'RE GONNA BE REAL CLOSE. IT'S A TOUGH SPOT. SO WHAT'D YOU SAY, MAYOR? I, IF THEY CUT IT TO 20 FOOT WIDE STILL 28 FOOT, THEY'RE GONNA BE REAL CLOSE. YEAH, I KNOW THEY DON'T WANNA DO THAT, BUT THINK IT'S AN OPTION. YEAH. AND HAVE THEY DISCUSSED MAYBE GOING OFF THE BACK TOWARDS VINE STREET, THE COURT? WELL, THAT'S WHAT I, WE, THIS THE SIDE THAT'S, I DON'T THINK IF YOU'RE LOOKING AT THE FRONT, THE RIGHT SIDE, COULD THEY, WELL, I WAS THINKING THE LEFT SIDE, IF YOU LOOK BACK TOWARDS VINE STREET, IT LOOKS LIKE THERE'S A DRIVEWAY AND A CULPRIT THERE THAT LOOKED TO BE ABANDONED. MY, THE ASSUMPTION WAS INITIALLY WHEN I LOOKED AT THE, THE APPLICATION IN THE, AND THE SITE THAT, THAT THE HOUSE MIGHT HAVE FRONTED AT ONE POINT TOWARDS VINE AND THEN RIGHT HERE LATER. MM-HMM, , ROSIE, CAN YOU TAKE US DOWN THE STREET VIEW? I THINK THIS IS THE GARAGE INE, BUT THERE'S A BACK FLOOR. I MEAN, THERE'S A, A DOOR THERE DIRECT, UH, THE OTHER DIRECTION TOWARDS, UH, ONTO VINE STREET, PLEASE. OH, FROM VINE STREET. OKAY. UH, NO COMING BACK. JUST GOES STRAIGHT. YEAH. RIGHT THERE. KEEP GOING. YEAH. AND THEN GO DOWN. TAKE A RIGHT. TAKE A RIGHT AND TAKE A, MAKE SURE YOU GET YOUR SIGNAL. TAKE A RIGHT. MAKE SURE YOUR SIGNAL SO EVERYBODY, THE DRIVER KNOWS . RIGHT, RIGHT THERE. THERE'S THE DRIVEWAY. AND THEN IF YOU TURN AND TURN THE VIEW TOWARDS THE HOUSE, OH, MAYBE GO DOWN A LITTLE BIT MORE. I'M SORRY. UH, NO. WELL, YEAH, BACK TOWARDS THE LITTLE PINK TOY PARKING. OH, I SEE WHAT YOU'RE SAYING. YEAH. BUT WHAT DID THAT EVEN LEAD TO TOWARDS THERE? THAT WAS PROBABLY JUST A SECOND DRIVEWAY. YOU THINK THAT'S WHAT THAT WAS? I, I COULDN'T TELL. 'CAUSE IT LOOKED LIKE THE AIR THE GARAGE WAS ADDED ON AT A LATER DATE. SEE, THIS IS, THIS IS, IF I'M LOOKING AT IT CORRECTLY FROM THE FRONT VIEW, THAT'S THE GARAGE. SO THIS WAS BROUGHT THAT ONE TIME. THIS MAY HAVE JUST BEEN A CARPORT OR SOMETHING. OKAY. THAT LOOKS LIKE THAT'S ALL BEEN PRETTY WELL CITED IN THERE. YEAH. UH, YOU'VE DONE A GREAT, THEY'VE REMODELED THIS HOUSE, HAVEN'T THEY? YES. YEAH. MAY I HAVE ? NO, NO, NO. I WAS JUST, THEY'VE DONE A REALLY NICE JOB WITH IT. IT LOOKS GOOD. THANK YOU. MAY I GO AHEAD AND MAKE A MOTION TO APPROVE, OR, OR GRANITE OR, WE HAVE, WE, WELL, I THINK WE, I THOUGHT WE WERE ALREADY TALKED. I THOUGHT WE ALREADY ANSWERED THEM. I THOUGHT WE WERE JUST FOCUSING ON NUMBER TWO, THAT THERE'S FEASIBLE ALTERNATIVES, BUT THAT, THAT, DO THEY WANT TO MAKE IT SMALLER? THAT'S THE ALTERNATIVE. I MEAN, I, IF IT WAS MY HOME, I WOULDN'T WANT TO YEAH. THAT'S A FEASIBLE ALTERNATIVE. THAT'S JUST FOR GUIDE FOR, FOR Y'ALL TO KNOW WHAT TO CONSIDER ASKING. DO WE YES OR NO ON ALL THREE OR JUST ONE? YEAH. I KNOW WE HAD TALKED ABOUT YES, ON ONE AND THREE AND WE WERE TALKING ABOUT TWO THREE, DIDN'T BELIEVE THERE WAS AN ISSUE IMPAIRED. WELL, I MEAN, I DON'T THINK THERE'S A, I DON'T THINK THERE'S AN ISSUE WITH ONE OR THREE. [00:25:02] I MEAN, THE, THE, YEAH, THE SHAPE OF THE PROPERTY, THE SHAPE OF THE PROPERTY IS, IS A UNIQUE SITUATION. I AGREE. YES. UH, DON'T THINK IT WOULD BE DETRIMENTAL TO ANY NEIGHBORS. THE ONLY THING IS THAT SAYS THAT NUMBER TWO SAYS APPLICATION OF THE SPECIFIC ZONING. REGULAT REGULATIONS DEPRIVE THE PROPERTY OF REASONABLE USE, WHICH CANNOT BE REMEDIED BY FEASIBLE ALTERNATIVES SUCH AS CHANGING THE SIZE OR DESIGN OF THE BUILDING AND IMPROVEMENTS. I MEAN, YOU KNOW, THAT PART, I MEAN, IT IT'S RESTRICTING THE USE OF WHAT YOU WANT IT FOR. YEAH. BUT I MEAN, IT, IT CAN, IT CAN MEET THE REGULATIONS IS WITH, WITH A FEASIBLE ALTERNATIVE. SUCH AS, SUCH AS CHANGING THE SIZE. MM-HMM. . BUT THERE AGAIN, IS IT REASONABLE? IS IT REASONABLE? I THINK, I THINK REASONABLE. AND LIKE, UH, OUR ATTORNEY SAID REASONABLE AND FEASIBLE CAN BE TWO WORDS THAT CAN BE INTERPRETED IN DIFFERENT WAYS WITH THIS. IT JUST DEPENDS ON HOW YOU WANT TO INTERPRET THEM. HAVE TO MEET ALL THREE TO BE GRANTED. SO HOW, OKAY, SO HOW DOES THIS WORK? WE, WE ALL AGREE ON ONE AND TWO. DO WE ALL HAVE TO AGREE ON TWO OR HOW DOES THIS WORK? OKAY, Y'ALL CAN JUST DO IT. OR DO WE JUST NEED A MOTION? THIS THIS, THESE THREE QUESTIONS ARE FOR Y'ALL'S GUIDANCE. OKAY. UM, AND SO, UH, IMPLICIT IN YOUR VOTE IS THAT YOU EITHER AGREE TO ALL THREE OR YOU DISAGREE WITH ONE OF THE THREE. RIGHT? SO IF, IF SOME PEOPLE SAY, HEY, I AGREE, ONE AND TWO, ONE AND THREE, BUT TWO, THEY DIDN'T MAKE IT THERE. SO I'M VOTING NO. RIGHT. THEN YOU CAN VOTE. NO. UH, YOU DON'T SPECIFICALLY HAVE TO SAY, YOU KNOW, WHAT THE, UH, WHAT THE REASON IS. RIGHT. UH, IF Y'ALL, BUT YOU HAVE TO AGREE ON ALL ONE, TWO, AND THREE TO, TO VOTE. YES. DOES THAT MAKE SENSE? BUT Y'ALL ARE NOT REQUIRED TO GO THROUGH EACH, EACH ITEM. IT CAN BE IMPLICIT IN YOUR VOTE THAT YOU EITHER AGREE MADE ALL THREE OR NOT. YOU CAN APPROVE OR DENY IT'S OUR GUIDELINE TO FOLLOW THE ORDER. CORRECT. OR AS FAR AS CORRECT. SO DO I TAKE A VOTE FOR WE HAVE A MOTION WITH, WE HAVE A MOTION ON THE FLOOR. WE HAVE A MOTION. WE DON'T HAVE A SECOND. I'LL SECOND. I HAVE A SECOND. AND THE MOTION WAS TO GRANT? CORRECT. OKAY. ANY FURTHER DISCUSSION? HEARING NONE. I ENTERTAIN A VOTE. ALL IN FAVOR? AYE. AYE. ALL OPPOSED? AYE. AYE. AYE. I'M SORRY. SO THE MOTION TO GRANT HAS BEEN DENIED. BUT ON THAT SAME TOKEN, IF THEY, IF THEY'RE WOULD CONSIDER SHORTENING THE PORCH TO GET WITHIN THE SETBACK LIMITS, THEY WOULD, THEY WOULDN'T NEED A VARIANCE. RIGHT. OKAY. SO THEY WILL, IF THEY CONSIDER IT MAKING IT YES. CONSIDER, CONSIDER MAKING IT 20 FOOT OR SO INSTEAD OF THE 28 FOOT. YES. SO IF THEY STARTED AT THE, ON THE OTHER SIDE OF THE DOOR GYM, I THINK THEY WOULD AND, AND THEY STAYED WITH THEM. STANDARD EIGHT FOOT WIDTH, THAT WOULD ALLOW THEM TO STAY WITHIN THE 25 FOOT BUILDING SETBACK. IT WOULDN'T GO ALL WAY. IT COULD, IT WOULDN'T GO ALL THE WAY ACROSS THE FRONT OF THE HOUSE. IT WOULD JUST GO FROM THE, FROM THE GARAGE PAST THE DOOR, SOMEWHERE IN THAT NEIGHBORHOOD. WELL, WE DON'T REALLY KNOW UNTIL THEY MEASURED HOW FAR YOU GET. YEAH. BUT SOMEWHERE IN THAT NEIGHBORHOOD. YEAH. OKAY. I, I'LL RUN IT BY THEM. SEE WHAT THEY THINK. OKAY. THANK YOU MA'AM. THANK YOU. THAT WILL CLOSE THE, WE WILL ADJOURN THE PUBLIC HEARING AND MOVE INTO THE MOTION. SECOND. MR. LOPEZ MADE THE MOTION. MR. AGUILAR MADE THE SECOND. MR. LOPEZ MADE THE MOTION. MR. AGUILAR MADE THE SECOND. WHO WERE THE I'D? SAME, SAME FOLKS. [00:30:01] MR. MR. SAME PEOPLE AND THE OTHER. OKAY. DO I NEED A MOTION TO ADJOURN THE PUBLIC HEARING? OKAY. WE'RE GONNA ADJOURN THE PUBLIC HEARING AND MOVE INTO THE REGULAR COUNCIL MEETING. FIRST ITEM IS CITIZEN VISITOR'S COMMENTS. I HAVE NONE SIGNED UP. ROSIE, DO WE? OKAY. [IV. CONSENT AGENDA] WE'LL FOREGO THAT AND MOVE TO THE CONSENT AGENDA. AND ITEMS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED ROUTINE AND ARE GENERALLY ENACTED IN ONE MOTION. THE EXCEPT OF THIS RULE IS THAT COUNCIL MEMBERS MAY REQUEST ONE OR MORE ITEMS TO BE REMOVED FROM THE CONSENT AGENDA FOR SEPARATE ACTION. TONIGHT'S AGENDA IS MINUTES. COUNCIL MEETING. MAY 7TH, 2024 AT 7:00 PM I HAVE A MOTION TO APPROVE THE CONSENT AGENDA. SO MOVE, MOVE BY COUNCILPERSON BOND. SECOND BY I'LL SECOND. COUNCILMAN AGUILAR? UH, ANY ITEMS NEED TO BE REMOVED? ANY DISCUSSION? HEARING NONE. I'LL ENTERTAIN THE VOTE. ALL IN FAVOR? AYE. UNANIMOUS. THANK YOU. [V. BUSINESS ITEMS] THEN WE'LL MOVE INTO THE BUSINESS ITEMS AND THE FIRST ITEM IS BRADS PORT CHAMBER OF COMMERCE ANNUAL TOURISM REPORT AND REQUEST FOR CONTINUED FUNDING. OKAY. I'M EDITH FISHER. I'M THE DIRECTOR OF TOURISM FOR THE BRAZOSPORT CONVENTION AND VISITORS COUNCIL. LEMME SEE. OH, THERE WE ARE A DIVISION OF THE BRA SUPPORT AREA CHAMBER OF COMMERCE. WE PROMOTE THE AREA AS A LEISURE DESTINATION. WE CARRY OUT A STRATEGIC PLAN THAT'S PUT TOGETHER BY OUR BOARD OF DIRECTORS. WE MAKE AN ANNUAL PRESENTATION TO YOU TO LET YOU KNOW HOW WE SPEND THE, UM, TAX FUNDS THAT WE RECEIVE. AND WE ARE FUNDED BY OCCUPANCY TAXES COLLECTED NOT ONLY IN CLU, BUT LAKE JACKSON, FREEPORT, AND SURFSIDE BEACH. THESE ARE THE CURRENT, UM, PROPERTIES IN CLU THAT WE WORK TO FILL UP. WE WANT PEOPLE TO COME TO THE AREA AND SPEND THE NIGHT. UH, ONE WAY WE DO THAT IS WORKING WITH OUR INDUSTRY PARTNERS. WE WORK WITH OUR LOCAL ACCOMMODATIONS AND ATTRACTIONS. UM, THE OFFICE OF THE GOVERNOR, TOURISM DIVISION, PARKS AND WILDLIFE, UM, TDOT AROUND HOUSTON IS A REGIONAL, UM, TOURISM INITIATIVE THAT IS MADE UP OF ABOUT 14 COMMUNITIES AROUND HOUSTON. UM, WE TRY TO GET THOSE INTERNATIONAL VISITORS THAT ARE COMING TO HOUSTON FOR 10 TO 14 DAYS TO SPEND MORE TIME IN OUR AREA RATHER THAN TO COME INTO HOUSTON AND THEN GO TO DALLAS OR SAN ANTONIO. ANOTHER WAY WE PROMOTE THE AREA IS THROUGH OUR ADVERTISING EFFORTS. WE'VE HAD EITHER PAID ADS, EDITORIALS, OR LISTINGS IN THESE PUBLICATIONS. UM, THESE ARE SOME EXAMPLES OF THE ADS THAT WE USE OR THAT WE RUN. THEY HAVE, THEY, WE ALWAYS LIST THE CITIES AND THEM AND OUR WEBSITE OR A LINK TO THE WEBSITE. SO LAST YEAR, UM, ALL OF THESE LISTINGS, ADS AND EDITORIALS, UM, REACHED MORE THAN 3 MILLION PEOPLE. AND IF WE WOULD'VE HAD TO PAY FOR EACH ONE, IT WOULD'VE BEEN OVER $125,000. UM, OUR ADVERTISING IS BUDGET IS A FRACTION OF THAT. SO WE ATTEND SHOWS AND CONFERENCES TO PROMOTE THE AREA. LAST YEAR WE DID THE DALLAS TRAVEL AND ADVENTURE SHOW. THE, UM, TEXAS TRAVEL COUNSELORS SHOW, WHICH IS AN APPOINTMENT STYLE SHOW. IT IS ATTENDED BY THE TEX ON EMPLOYEES THAT WORK AT THE TRAVEL INFORMATION CENTERS AROUND THE STATE. SO THEY ARE GREETING THE VISITORS THAT ARE STOPPING BY THAT ARE ASKING FOR PLACES TO VISIT IN TEXAS. SO I HAVE SIX MINUTES TO VISIT WITH TWO COUNSELORS AT A TIME. THIS LAST YEAR I HAD 45 APPOINTMENTS IN ONE DAY. AND THE GOOD THING IS THAT I'VE BEEN HERE FOR A WHILE AND THAT THEY'VE BEEN IN THEIR ROLES FOR A WHILE AND THEY'VE ACTUALLY COME TO THE AREA ON STUDY TOURS. SO IT'S, UM, SO I DON'T HAVE TO TELL THEM ABOUT EVERY SINGLE THING WE HAVE. SO IT'S MAINLY A WAY TO UPDATE THEM ON WHAT'S HAPPENING IN OUR AREA. AND THEN WE ALSO DID THE STATE FAIR. WE HAD OUR BROCHURES, UM, UP THERE THE ENTIRE FOUR WEEKS OF THE STATE FAIR. AND ON TWO OF THOSE DAYS WE HAD DESTINATION DAY CALLED BRAZOSPORT DAY. AND I WAS ABLE TO WORK AND GIVE OUR, UM, INFORMATION OUT TO ALL THE THOUSANDS OF PEOPLE THAT ARE NEW TO TEXAS AND THEN THE ONES THAT JUST LOVE TO COME TO THE STATE FAIR. SO OUR WEBSITE IS ANOTHER BIG TOOL. UM, LAST YEAR WE HAD 109,000 PAGE VIEWS. WE HAD SWITCHED OUR ANALYTICS TO THE NEWEST GOOGLE ANALYTICS. AND, UM, I THINK IT'S A LOT MORE ACCURATE ON WHAT PEOPLE ARE LOOKING FOR. UM, WE'VE ALREADY HAD TO, UH, UPGRADE OUR BANDWIDTH ON OUR WEBSITE TWICE IN THE LAST YEAR. 'CAUSE WE'VE HAD SO MANY MORE, UM, PEOPLE LOOKING THROUGH THE WEBSITE. SO THE TOP PAGES PEOPLE LOOK FOR ARE THE BEACHES AND THEN PLACES TO STAY, FISHING, PLACES TO EAT, AND UH, LOCAL EVENTS. AND [00:35:01] THEN THE PEOP THE USERS TO THE WEBSITE WERE FROM HOUSTON, DALLAS, FORT WORTH, AUSTIN, SAN ANTONIO, AND CHICAGO. THOSE WERE OUR TOP FIVE, UM, LOCATIONS ACCORDING TO GOOGLE. AND THEN OUR TOP REFERRING SITES ARE FACEBOOK AND VISIT HOUSTON. SO WE CONTINUED TO WORK WITH THE LONE STAR COASTAL ALLIANCE, WHICH IS WORKING WITH SENATOR WEBER TO GET BRAZORIA, MATAGORDA, GALVESTON, AND JEFFERSON COUNTY DESIGNATED AS A NATIONAL RECREATION AREA. WE WORKED WITH THE OFFICE OF THE GOVERNOR'S, UM, TOURISM DIVISION. WE WERE ABLE TO GET SOME CO-OP ADVERTISING, UM, WITH A NEW PROGRAM THEY HAD AND THEN CONTINUE TO, TO SUPPORT ALL LOCAL PARTNERS. UM, LIKE THE MIGRATION CELEBRATION, THEY, LAST YEAR WAS THEIR FIRST TIME SINCE 2019, UM, TO HAVE THEIR EVENT. SO THE, UM, TRAVEL IMPACTS IN 2023. SO FOR CLU IT WAS 41.9 MILLION IN DIRECT TRAVEL SPENDING. UM, 3.4 MILLION IN TAX RECEIPTS. THOSE ARE STATE AND, UM, LOCAL TAXES. AND THOSE WERE, THERE WAS JUST A SLIGHT INCREASE, I THINK LIKE MAYBE 2%. AND THEN THERE'S UM, LAST YEAR 570 PEOPLE THAT WORKED IN THE TRAVEL INDUSTRY INCLUDE. AND UM, THOSE ARE NUMBERS FROM BRAZORIA COUNTY TOO. AND SO THEY'RE PRETTY SIMILAR. THEY'RE PRETTY FLAT COMPARED TO 2022, BUT WE'VE ALREADY SEEN THIS FIRST, UM, THE LAST TWO MONTHS OF THIS YEAR, A HUGE INCREASE FROM 2023. SO I MENTIONED WE ARE PART OF THE CHAMBER. THE CHAMBER SERVES OVER 700 MEMBERS FROM SMALL BUSINESSES TO LARGE INDUSTRY, UM, NONPROFITS AND GOVERNMENT ORGANIZATIONS. THE CHAMBER PROVIDES UNIFIED SUPPORT AND PROMOTION FOR THE ENTIRE BROWSER SUPPORT AREA FOR ECONOMIC PROSPERITY. WE WORK WITH LOCAL INDUSTRY AND GOVERNMENT TO BOOST GROWTH. AND WE DO THAT WITH, UM, RESOLUTIONS, LETTERS, UM, TESTIMONIES FROM THE CHAMBER BOARD AND STAFF, UM, TO OUR DECISION MAKERS. UM, AND THE CHAMBER FACILITATES QUARTERLY MEETINGS WITH THE LOCAL MAYORS AND MANAGERS OF THE EIGHT CITIES THAT MAKE UP THE RISE SUPPORT AREA TO EXCHANGE IDEAS AND, UM, COLLABORATE ON NEW PROJECTS. LAST YEAR, OUR CHAIRMAN OF THE BOARD WAS SCOTT DAIGLE WHO WAS WITH ME GLOBAL. AND THIS YEAR OUR CHAIRMAN OF THE BOARD IS, UH, COMMISSIONER DEPA. SO, UM, ANOTHER PROGRAM WE'RE CONTINUING IS OUR SHOP LOCAL WEEKEND THAT IS COMING UP IN JUNE. JUNE 21ST, 23RD. UM, WE ENCOURAGE EVERY PEOPLE TO COME BY OUR OFFICE, PICK UP A SHOPPING BAG, A LIST OF CHAMBER MEMBERS, AND HAVE BREAKFAST. AND THEN THEY CAN GO ON A SHOPPING SPREE OR THEY CAN JUST GET GROCERIES OR PAY THEIR CAR INSURANCE. UM, AS LONG AS THEY DO THIS BUSINESS WITH A CHAMBER MEMBER, THEY CAN TURN IN THEIR RECEIPT, UM, TO US WITH THEIR NAME AND CONTACT INFORMATION. AND THEN WE DO A DRAWING ON TUESDAY, THE FOLLOWING TUESDAY FOR A THOUSAND DOLLARS. UM, AND SO THIS WAS A GOOD PROGRAM. IT BENEFITS NOT ONLY THE CONSUMERS BUT ALSO OUR BUSINESSES. UM, IT HELPS PROMOTE OUR BUSINESSES, OUR SHOP LOCAL. SO THAT MY PRESENTATION AND I ALSO SENT YOU OUR MARKETING PLAN FOR THIS YEAR. SO I WANNA GO AHEAD AND THANK YOU FOR YOUR CONTINUED SUPPORT. AND WE'RE HOPING THAT WE COULD GET AN INCREASE IN OUR FUNDING FROM FOR NEXT YEAR, FOR 2024. SO I'LL BE HAPPY TO ANSWER ANY QUESTIONS YOU MAY HAVE. I HAVE A QUESTION. I JUST DON'T KNOW HOW TO ASK IT. IS IT COMMON TO HAVE MORE THAN ONE CHAMBER FOR A AREA CITY? UH, IS THAT JUST SOMETHING THAT'S A MATTER OF PREFERENCE OR, I DON'T KNOW. I WOULDN'T SAY IT'S COMMON. IT'S USUALLY BASED ON DEMOGRAPHICS. AND SO AS FAR AS ECONOMIC DEVELOPMENT, WHICH IS THE BACKBONE OF CHAMBERS, THIS IS ONE MARKET AREA. SO HAVING ONE CHAMBER HAS MADE SENSE FOR, UM, FOR OUR ECONOMIC DEVELOPMENT EFFORTS. I DON'T KNOW, SANDRA HAS BEEN WITH THE CHAMBER A LONG TIME, SO I DON'T KNOW IF YOU WANNA ADD ANYTHING TO THAT. NO, YEAH, WE, WE'VE COVERED ALL EIGHT CITIES ALL OF THESE YEARS AND IT REALLY IS A BETTER ADVANTAGE TO GETTING PEOPLE DOWN HERE. UH, STRENGTH, I MEAN, 'CAUSE WE HAVE ANOTHER CHAMBER THAT'S, THAT'S IN WORKS AND DOING AND DOING THE SAME THING. I'M ASSUMING, UH, THE HISPANIC CHAMBER OF COMMERCE, DID THEY DO THE EXACT, I MEAN, I, I APOLOGIZE FOR MY IGNORANCE. THIS MAY NOT BE THE RIGHT TIME TO ASK IT, BUT, WELL, I'M NOT SURE WHAT THEIR PROGRAMS ARE, BUT I KNOW THAT THEY, IT JUST SAYS CHAMBER OF COMMERCE, SAME THING AS, AS FAR AS I'M AWARE OF, THEY DON'T HAVE A TOURISM DIVISION. YEAH. AND IT'S, WE DO HAVE . SO THEN THERE'S NOT A COMMON, THERE'S, IT'S AN INDIVIDUAL BASED. WELL, IT DEPENDS. I MEAN, YOU KNOW, I MIGHT OUGHT TO BE ASKING IT, RIGHT? I'M TRYING ANGLE ANGLETON HAS ONE, BRAZORIA HAS ONE. WEST COLUMBIA HAS ONE. YEAH. YEAH. IT'S KIND OF, IT'S KIND OF THE, [00:40:01] LIKE I SAID, IT JUST LIFE ALLIANCE CLUB, WHATEVER GROUP YOU WANNA BE IN, HUH? YEAH, PRETTY MUCH. BUT I MEAN, I THINK THE, HIS, I THINK THE HISPANIC CHAMBER IS HISPANIC CHAMBER OF BRAZORIA COUNTY. THEY, THEY COVER EVERYBODY. IT'S . OKAY, WELL THAT'S, THAT, THAT EXPLAINS. IIII DIDN'T KNOW WHICH ONE. THEY GO ALL THE WAY TO PEARLAND. THEY GO GOTCHA. THEY GO EVERYWHERE. OKAY. THEY GO FROM, THEY GO FROM QUINTON BEACH TO PEARLAND FOR SURE. AND FROM SWEENEY WEST COLUMBIA ALL THE WAY TO JONES CREEK OR ARTS CREEK, LITTLE BIT MORE. WE, EVERYONE TOGETHER, WE ALL DECIDED, YOU KNOW, WE DON'T COMPETE WITH EACH OTHER. NO, THAT'S THE GOAL. I, I WAS WONDERING. OKAY. THANK YOU. I, I HAD, I DO HAVE A QUESTION. OKAY. UM, WITH, I GUESS WE, WE HAVE DONE IN THE PAST, UH, LIKE INFORMATIONAL SESSIONS WITH THE HISPANIC CHAMBER. DO YOU GUYS OFFER THE SAME KIND OF THING WE DO THAT, UM, THOSE ARE FOCUSED TO OUR ENTIRE MEMBERSHIP. 'CAUSE WE'RE, WE ARE A MEMBERSHIP BASED ORGANIZATION. THE CHAMBER IS. AND SO WE, UM, ONCE A YEAR SEND OUT A SURVEY TO OUR MEMBERS, TO OUR MEMBERSHIP TO ASKING THEM, YOU KNOW, HEY, ARE WHAT, LIKE WHAT BURNING QUESTION DO YOU WANT US TO WORK ON? OR WHAT ISSUES IS YOUR BUSINESS FACING? AND SO WE HAVE DONE, UM, WORKSHOPS IN THE PAST. UH, WE DID A SHOP LOCAL EXPO WHERE WE HAD SPEAKERS ADDRESS SMALL BUSINESSES. UM, SO WE HAVE COMMITTEES IN THOSE COMMITTEES MEET ON A REGULAR BASIS, WHETHER IT'S QUARTERLY OR MONTHLY, AND TO ADDRESS OUR MEMBERSHIP NEEDS. SO WE HAVE, UM, WE HAVE A TRANSPORTATION COMMITTEE THAT MEETS QUARTERLY. UH, WE HAVE A, UH, BUSINESS PROFESSIONALS NETWORK. THEY MEET, ALSO MEET QUARTERLY. UM, IT'S A NETWORKING GROUP. WE HAVE OUR GOVERNMENT AFFAIRS THAT MEETS QUARTERLY. AND THEN WE HAVE MEMBERSHIP LUNCHEONS THAT ARE NOT, WE WOULDN'T SAY THEY'RE MONTHLY BECAUSE THEY'RE BASED ON SPEAKER AVAILABILITY. 'CAUSE WE DON'T WANNA HAVE AN EVENT JUST TO HAVE AN EVENT OR HAVE A LUNCHEON JUST TO HAVE ONE. WE WANNA MAKE SURE THAT WE'RE GETTING THE INFORMATION TO OUR MEMBERSHIP THAT THEY, THAT THEY'RE INTERESTED IN. THEY HAVE, THEY HAVE QUARTERLY MAYOR CITY, MOUNTAIN MAYOR, CITY MANAGER MEETING OUR TODAY. AS A MATTER OF FACT, I THINK MR. AGUILAR IS ASKING, YOU'RE TALKING ABOUT IT LIKE A FOCUSED EVENT ON A COMMUNITY OR A SPECIFIC RIGHT. LIKE IF, LIKE IF WE, IF WE CAME TO YOU AND SAID, YOU KNOW, WE WANT TO HAVE SOMETHING HERE. WHAT WE DO WITH THE HISPANIC CHAMBER, UH, AND I THINK IS A GREAT, UH, SERVICE THAT THEY OFFERS. YOU KNOW, THEY BRING IN THEIR MEMBERS THAT ARE HERE IN THE CITY. UM, AND WE TALK ABOUT WHAT WORK WE'RE DOING HERE IN THE CITY. YOU KNOW, WHETHER IT BE OUR, UH, DOWNTOWN PLAN OR OUR MASTER PLANS OR ANYTHING LIKE THAT. I MEAN, IS THAT SOMETHING THAT YOU GUYS OFFER OR IS THAT SOMETHING THAT DO IT EVERY QUARTER YOU MIGHT OFFER? I JUST TOLD YOU WE DO IT EVERY QUARTER. THEY HAVE A MAYOR, CITY MANAGERS MEETING EVERY QUARTER. NO, I'M SAYING WITH THE MEMBERSHIP, LIKE WITH THE BUSINESS, WE, WE DON'T DO IT JUST BY EACH CITY THAT THAT'S ALL THE MAYORS OF CITY MANAGER FROM ALL THE EIGHT CITIES. NOW IN THE PAST WE'VE HAD, UM, OUR STATE OF THE COMMUNITY WHERE WE HAVE HAD, UM, TIME FOR EACH OF THE CITIES, BUT WE HAVE EIGHT. SO THAT WOULD BE A LONG LUNCHEON OR A LONG EVENING. AND WE TRY TO BE RESPECTFUL OF OUR MEMBERSHIP'S TIME. RIGHT. UM, SO THAT IS, DOES THAT KIND OF ANSWER? I DON'T, YEAH. SO WHAT IF, IF CALVIN OR CJ EVER CALLED SANDRA UP AND SAID, HEY, YOU KNOW, WE HAVE THIS, UM, THIS EVENT OR THIS ISSUE, WE THINK YOU CAN, COULD YOU HELP US ADDRESS IT? OF COURSE WE WOULD. WE WOULD DO THAT. YEAH. OKAY. BUT WE DON'T. AND WE DON'T, UM, I MEAN, ON OUR MEMBERSHIP YOU ARE LISTED BY YOUR BUSINESS CLASSIFICATION. UM, WE DON'T SEGMENT IT BY CITIES EITHER. SO, 'CAUSE WE REALLY TRULY SEE THIS AS ONE AREA. SO WHAT'S GOOD FOR CLUT IS GOOD FOR LAKE JACKSON AND VICE VERSA. SO WE DON'T, WE DON'T PROMOTE ONE CITY OVER ANOTHER REGARDLESS OF WHERE YOUR BUSINESS IS AT. OKAY. THANK YOU. BECAUSE, AND YOU KNOW, WHEN PEOPLE CALL FOR, UH, SAY THEY'RE RELOCATING, EVERYBODY ASK FOR FREEPORT BECAUSE THEY'RE RELOCATING TO INDUSTRY AND THEY THINK THEY INDUSTRY HAS A FREEPORT ADDRESS, SO THEY WANT A FREEPORT ADDRESS. SO, UM, AND THAT'S NOT ALWAYS THE CASE. I MEAN, WE GIVE THEM THAT INFORMATION, BUT YOU KNOW, THEY DON'T REALIZE THAT CLUT IS JUST AS CLOSE [00:45:01] TO INDUSTRY AS FREEPORT IS OR LAKE JACKSON. THANK YOU. SURE. OKAY. THANK YOU. THANK YOU MA'AM. THANK YOU. YOU WON'T HAVE ANY OTHER QUESTIONS OR COMMENTS. THANK YOU EDITH. UH, NEXT ITEM WOULD BE CONSIDERATION OF POSSIBLE ACTION TO ADOPT RESOLUTION NUMBER 26 DASH 2024, INCREASING THE NUMBER OF APPOINTMENT SLASH MEMBERS TO THE LIVABLE CENTERS DOWNTOWN DEVELOPMENT TASK FORCE COMMITTEE. AND IT WOULD BE RESOLUTION NUMBER 26 DASH 2024 RESOLUTION IN CITY COUNCIL OF CITY CLUTE, TEXAS, APPROVING THE CREATION OF A LIVABLE CENTER'S DOWNTOWN DEVELOPMENT TASK FORCE. WHEREAS THE CITY OF CO COMPETED AND ADOPTED A LIVABLE CENTER STUDY TO SERVE AS THE BASIS FOR FUTURE POLICY AND PROJECT DECISIONS AS THEY RELATE TO THE COMMUNITY'S FUTURE DEVELOPMENT. AND WHEREAS THE SUCCESSFUL IMPLEMENTATION OF THIS PLAN CALLS FOR COORDINATION BETWEEN THE CITY COUNCIL, THE PLANNING AND ZONING COMMISSION, THE PARKS BOARD, THE EDC AND OTHER BODIES, BOTH PUBLIC AND PRIVATE. AND WHEREAS AT SUCCESS ALSO RELIES ON THE WORK OF CHAMPIONS TO HELP PROMOTE COMMUNITY PARTICIPATION AND BUY-IN WHEREAS CITY COUNCIL HAS ADOPTED A SEVEN MEMBER BOARD RESOLUTION ON BAY 7 20 24 AND IS NOW INCREASING THE LIVABLE CENTER DOWNTOWN DEVELOPMENT TASK FORCE TO NINE MEMBER BOARD. WHEREAS THE CITY COUNCIL, CITY ECLU FINDS THE ABOVE RECITALS TO BE TRUE. NOW THEREFORE BE RESOLVED BY THE CITY COUNCIL OF CITY ECLU, TEXAS, A LIVABLE CENTER DOWNTOWN DEVELOPMENT TASK FORCE IS HEREBY CREATED. FURTHER THAT SAID, BODY SHALL BE MADE UP OF NINE MEMBERS WITH ONE MEMBER BEING APPOINTED FROM THE CITY COUNCIL PLANNING AND ZONING COMMISSION, THE PARKS BOARD AND ECONOMIC DEVELOPMENT CORPORATION BOARD REP RESPECTIVELY. AND THAT THE REMAINING FIVE MEMBERS SHALL BE VOLUNTEERS PRESENTLY REPRESENTING VARIOUS COMMUNITY INTERESTS APPOINTED BY THE MAYOR WITH COUNCIL APPROVAL. READ PAST AND ADOPTED THE 23RD DAY OF MARCH, 2024 AND SIGNED BY MYSELF AND TESTIFIED ROAD CITY CLERK. UM, I, IF YOU, YOU GUYS CAN RECALL, UH, DURING OUR LAST MEETING, I DID MENTION THAT I WAS GOING TO, UH, BRING TO YOU GUYS A RESOLUTION, UH, EXPANDING THE BOARD. UH, ONE OF THE REASONS THAT I WANTED TO EXPAND IT IS NOT ONLY WE HAD, WE HAD A LOT OF INTEREST WITHIN THE BOARD AND THE PLANS THAT WE'RE DOING, BUT I ALSO WANTED TO ADD ONE POSITION FOR A INDUSTRY PARTNER. UH, BECAUSE I THINK INDUSTRY IS ONE OF THE BIG, I MEAN, IT'S OUR BIGGEST I JOB CREATOR THAT WE HAVE HERE. UM, SO I REACHED OUT TO BASF, WHICH IS OUR BIGGEST INDUSTRY PARTNER, AND I WAS ABLE TO GET A HOLD OF, UH, MR. DAVID WINDER, WHO'S THEIR COMMUNITY RELATIONS PERSON. UH, AND HE ACCEPTED BEING ON THE BOARD. SO OF COURSE WE CAN'T JUST ADD ONE, WE HAVE TO ADD TWO. AND, UH, DURING THE NEXT RESOLUTION, YOU'LL SEE, UH, THE OTHER BOARD MEMBER THAT WE'VE PICKED. AND I THINK, UH, YOU GUYS WON'T BE DISAPPOINTED. I HAVE A MOTION TO APPROVE RESOLUTION NUMBER 26 DASH 2024. I'LL MAKE THE MOTION. MOTION MY MOTION MADE BY COUNCILMAN LOPEZ. DO I HAVE A SECOND? I'LL SECOND. SECOND. BY COUNCIL PERSON. MADDOX DISCUSSION. HEARING NONE, I ENTERTAIN THE VOTE. ALL IN FAVOR. A UNANIMOUS. OKAY. NEXT ITEM IS CONSIDERATION AND POSSIBLE ACTION TO ADOPT RESOLUTION NUMBER 27 DASH 2024 APPOINTING MEMBERS TO THE LIVABLE CENTER DOWNTOWN DEVELOPMENT TASK FORCE. AS MR. AGUILAR MENTIONED, WE DO HAVE TWO CANDIDATES, UH, TO FILL THE COMMUNITY DRIVEN POSITIONS. WE'RE STILL LOOKING FOR SOMEBODY FOR THE PARKS AND REC POSITION. UH, AND THE TWO NOMINEES, UH, FOR THAT ARE MR. ARNOLD W AND, UH, MR. DAVID LINDER WINDER. WINDER . I HAVEN'T FOUND, AND MAYBE WILL CAN HELP ME WITH THIS, UH, BUT I HAVEN'T FOUND A REPRESENTATIVE FROM THE PARKS BOARD, UH, TO JUMP ON BOARD. SO, UH, THAT'S ONE POSITION WE'RE DOWN. UH, BUT I'M SURE WE HAVE QUALIFIED PEOPLE ON THE PARKS BOARD. UH, I JUST HAVEN'T BEEN ABLE TO GET A YES OUT. SO THE THING IS THAT A LOT OF VOLUNTEERS VOLUNTEER FOR OTHER BOARDS TOO. SO, UH, SOMETIMES HARD. YEAH. SOME OF OUR PARK BOARD MEMBERS ARE MEMBERS OF COUNTY PARK BOARD RIGHT. AND OTHER THINGS AS WELL. RIGHT? SO, LIKE I SAID, WE HAVE THE QUALIFIED PEOPLE, BUT MAYBE WILL CAN HELP ME GIVE HIM A NUDGE. [00:50:03] OKAY. THIS WOULD BE RESOLUTION NUMBER 27 DASH 2024. RESOLUTION OF CITY COUNCIL OF THE CITY OF FLUTE, TEXAS, APPOINTING MEMBERS TO THE LIVABLE CENTER DOWNTOWN DEVELOPMENT TASK FORCE. WHEREAS THE CITY OF FLUTE DID RECENTLY COMPLETE AND ADOPT A LIVABLE CENTER STUDY TO SERVE AS THE BASIS FUTURE POLICY AND PROJECT DECISIONS AS THEY RELATED TO THE COMMUNITY'S FUTURE DEVELOPMENT. WHEREAS THE SUCCESSFUL IMPLEMENTATION OF THIS PLAN CALLS FOR COORDINATION BETWEEN THE CITY COUNCIL, THE PLAN AND ZONING COMMISSION, THE PARKS BOARD, DDC, AND OTHER BODIES, BOTH PUBLIC AND PRIVATE. WHEREAS THAT SUCCESS ALSO RELIES ON THE WORK OF CHAMPIONS TO HELP PROMOTE COMMUNITY PARTICIPATION AND BUY IN. AND WHEREAS CITY COUNCIL DID PREVIOUSLY ADOPT RESOLUTION 16 DASH 2024 CREATED A SEVERAL MEMBER LCD TASK FORCE FOR SAID PURPOSES. AND THIS RESOLUTION WILL ADD TWO ADDITIONAL AT LARGE COMMUNITY VOLUNTEER MEMBERS, INCREASING COMMUNITY REPRESENTATION WITH A NINE MEMBER BOARD. WHEREAS THE CITY COUNCIL OF STATE CITY DESIRES TO FILL THE POSITIONS FOR THE PARK RECREATION BOARD REPRESENTATIVE COMMUNITY VOLUNTEER POSITION AND COMMUNITY VOLUNTEER PO POSITION FOUR, COMMUNITY VOLUNTEER POSITION FIVE NOW THEREFORE BE RESOLVED BY THE CITY COUNCIL OF CITY INCLUDE TEXAS, THAT WE HEREBY APPOINT THE FOLLOWING MEMBERS TO THE LIVABLE CENTER'S DOWNTOWN DEVELOPMENT TASK FORCE PARKS AND RECREATION BOARD REPRESENTATIVE IS STILL OPEN. COMMUNITY VOLUNTEER POSITION FOUR. ARNOLD VAUGHN COMMUNITY VOLUNTEER POSITION FIVE DAVID WINDER. FURTHER, THESE APPOINTEES SHALL SERVE A TERM DETERMINED ONE YEAR MAY BE REAPPOINTED BY CITY COUNCIL IN PERPETUITY FOR AS LONG AS THIS TASK FORCE IS OF SERVICE TO THE CITY. RED PASS AND ADOPTED THIS 23RD DAY OF MAY, 2024, SIGNED BY MYSELF AND ADJUSTED BY ROSIE APPOINTMENT CITY CLERK. I HAVE A QUESTION. IF WE FIND A PARKS BOARD REPRESENTATIVE, WE GOTTA DO ANOTHER RESOLUTION. YOU'LL HAVE TO, WE'LL HAVE TO APPOINT SOMEONE ELSE YEAH. IF WE CAN. I JUST WANTED, WANTED TO CONFIRM THAT. YES, SIR. EVERY I I THINK EVERY TIME WE DO ONE BOARD, WE HAVE TO MAKE A RESOLUTION. OKAY. ALRIGHT. IT HELPS US TO TRACK, IN ADDITION TO THE FORMAL APPOINTMENT, IT HELPS US TO TRACK WHO'S ON WHAT AND FOR HOW LONG. OKAY. ALRIGHT. I HAVE A MOTION TO APPROVE RESOLUTION NUMBER 27 DASH 2024. I'LL MAKE A MOTION. MOTION MADE BY COUNCIL FIRST MADDOX. SECONDED BY I'LL SIR COUNCILMAN CHRIS, ANY DISCUSSION? I HAVE A QUESTION. CAN Y'ALL MOVE FORWARD AND START MEETING AND DOING EVERYTHING EVEN WITHOUT THIS LAST 40? THAT'S WE PLAN TO YES. YES MA'AM. YEAH. 'CAUSE UH, I THINK THERE'S A LOT TO DISCUSS WITHIN THE GROUP. OKAY. OKAY. THEY COULD, BUT THEY COULD HAVE A TIE. VOTE. . GOOD BOY. THAT'S TRUE. BETTER HURRY. UH, THAT'S, THAT'S THE PURPOSE OF SEVEN NINE MM-HMM. . OKAY. HAVE A MOTION AND A SECOND. ANY ANY FURTHER DISCUSSION? HEARING NONE. I ENTERTAIN THE VOTE. ALL IN FAVOR? AYE. UNANIMOUS. THANK YOU. NEXT ADDRESS, CONSIDERATION AND POSSIBLE ACTION TO ADOPT RESOLUTION NUMBER 28 DASH 2024 APPROVING PARTICIPATION IN THE TEXT DOCK ACTIVE TRANSPORTATION PLAN GRANT. AND IT WOULD BE RESOLUTION NUMBER 28 DASH 2024. RESOLUTION OF CITY COUNCIL, CITY OF CLUE AUTHORIZING EXECUTION OF AN ADVANCED FUNDING AGREEMENT, A FA WITH TEXAS DEPARTMENT OF TRANSPORTATION FOR A TRANSPORTATION ALTERNATIVE SET ASIDE TASA PROJECT, WHEREAS ON OCTOBER 26TH, 2023 BE AMENDED ORDER 1 1 6 5 7 5. THE TEXAS TRANSPORTATION, TEXAS TRANSPORTATION COMMISSION, AUTHORIZED CSJ OH NINE 12 DASH 31 DASH 3 47 PROJECT CALLED THE PROJECT TO RECEIVE TRANSPORTATION ALTERNATIVES SET ASIDE TASA FUNDS FOR PROJECT CONSTRUCTION AND TEXAS DEPARTMENT OF TRANSPORTATION, TEXAS, OR THE STATE OVERSIGHT. AND WHEREAS THE TASA FI FUNDS REQUIRE A LOCAL MATCH, THE CITY OF CLU COMMITS TO PROVIDE THE MATCH. THE LOCAL MATCH IS COMPRISED OF CASH OR TRANSPORTATION DEVELOPMENT CREDITS, TDCS. AND WHEREAS THE CITY IS RESPONSIBLE FOR ALL NON-REIMBURSABLE COSTS AND A HUNDRED PERCENT OF OVERRUNS, IF ANY. AND WHEREAS THE GOVERNING BODY OF THE CITY DESIRES [00:55:01] TO REAFFIRM ITS SUPPORT OF THE PROJECT AND APPROVE AND AUTHORIZE EXECUTION OF AN ADVANCED FUNDING AGREEMENT A FA WITH TDOT FOR THE PROJECT. NOW THEREFORE BE RESOLVED BY THE CITY COUNCIL OF THE CITY OF INCLUDE TEXAS, THAT THE MAYOR OF THE CITY OF CL IS AUTHORIZED TO ENTER INTO AN A FFA WITH TEXDOT FOR THIS PROJECT. DULY READ, PASSED AND ADOPTED BY THE MAJORITY VOTE OF ALL MEMBERS OF THE CITY COUNCIL, OF THE CITY OF KLU, TEXAS ON THE 23RD DAY OF MAY, 2024. AND IT WOULD BE SIGNED BY MYSELF AND I TESTIFY, TESTIFY ROAD APPOINTMENT CITY CLERK. SO, UH, I WANT CREDIT WILL HERE FOR HUSTLING. AFTER THE, UH, LIVABLE CENTERS GRANT, WE WERE ABLE TO, UH, WE'VE DEVELOPED A REPUTATION, A GOOD ONE WITH HGAC AND TDOT WHO RECOMMENDED US FOR THIS APPLICATION AND THIS PROCESS. SO HE WORKED, UH, WITH CSRS AND, AND OTHER STAFF TO HELP PUT THIS TOGETHER AND GET IT IMPLEMENTED AND GET IT SUBMITTED TO THE STATE. SO, UH, THIS IS A PLANNING GRANT. IT'S NOT A, WE WON'T, WE WON'T SEE A, WE WON'T SEE A TANGIBLE PRODUCT FROM THIS FOR A WHILE, BUT BASICALLY IT'S TO HELP US DEVELOP A FULL ON TRANSPORTATION ALTERNATIVE PROJECT OR PROJECTS. AND IT'S A DIRECT OUTGROWTH OF THE LIVABLE CENTERS. THEY SAW THE SUCCESS THAT WE HAD IN IMPLEMENTING THAT. NOW THEY WANNA HELP US PLAN OUT WHAT OUR NEXT STEPS ARE IN REGARDS TO TRAIL DEVELOPMENT, SIDEWALKS, INTERSECTIONS, THAT KIND OF STUFF. AND WE'RE ALREADY IN TALKS. WILL, DO YOU WANNA TALK ABOUT THE RCP AND, UH, PROBABLY NOT. OKAY. I DID WANNA SAY SOMETHING ON THIS QUESTION. YES. UM, SO TEXTILE AWARD, $288,000 TO SUSPECT THE PLANNING PROJECT. UM, THE CITY'S MATCH WILL BE COVERED BY THE TRANSPORTATION DEVELOPMENT CREDITS. RIGHT. UM, SO THERE IS NO CASH REQUIRED ANY MONEY FROM THE CITY TO PROCEED. SO THIS IS A A HUNDRED PERCENT OF THAT GRANT FUNDS, FUNDS FOR THE PROJECT. THAT WAS MY ONLY QUESTION. YES, SIR. I'M SORRY. AND I SHOULD HAVE CLARIFIED THAT READING, BUT YEAH, THE TDCS WE'VE ALREADY, UH, CREATED OR ALREADY HAVE, SO THANK YOU. THAT'S A HUNDRED. YEAH. A HUNDRED PERCENT FUNDED AT NO COST TO THE CITY TO MOVE FORWARD WITH THIS. AND WHAT ARE WE STUDYING EXACTLY? SO, LIKE CJ WAS SAYING, TAKING WHAT WE DID WITH LIVABLE CENTERS, UM, THERE'S BEEN SEVERAL THINGS COME OUT OF THAT ALREADY. TDOT HAS CONTACTED US AND IT IS INCLUDING SOME FREIGHT PARKING AND SIDEWALK PROJECTS ALONG 2 88 OR 3 32 AND 2 88 B YOU KNOW, AS A RESULT OF THE LIVABLE CENTER STUDY. UM, AND THIS IS GONNA LOOK AT A BIGGER AREA AROUND THE WHOLE CITY. IT INCLUDES THE WHOLE CITY LIMITS. UM, BUT WE'RE LOOKING AT, YOU KNOW, UH, PUBLIC TRANSPORTATION, THE, THE TRANS, THE, THE GULF COAST TRANSIT STOPS, SIDEWALKS, TRAILS, YOU KNOW, MAYBE THE TRAILS, CONNECTING PARKS, CONNECTING TO DIFFERENT NEIGHBORHOODS. JUST ALL TYPES OF, OF TRANSPORTATION AND WAYS TO MOVE PEOPLE AROUND THE CITY SAFELY OTHER THAN ROADS. SO ALL KIND, WALKING, BIKING, PUBLIC TRANSPORTATION. THERE A KEY POINT OTHER THAN ROADS. YES, SIR. THAT OKAY. SO IT WON'T INCLUDE ROADS? NO, THIS IS, IT CAN, BUT THAT'S NOT THE FOCUS. I MEAN, YES, I'M SURE SOME ROAD STUFF WILL BE INCLUDED, BUT THE FOCUS IS WHAT THEY CALL ACTIVE TRANSPORTATION, MEANING WALKING TRAILS, BIKING, PUBLIC TRANSPORTATION. THIS WILL, THIS WILL HELP THIS PLANT. THE PLAN AT THE END WILL HELP US SEE HOW WE CAN MAKE THE CITY A MORE ACCESSIBLE AREA. RIGHT, RIGHT. YOU KNOW, WE'VE GOT THE CIP GOING. SO THIS, AND THEN THE OTHER GRANT HE MENTIONED IS KIND OF TAKING ALL OF THIS AND TRYING TO COMBINE IT INTO, INSTEAD OF MAYBE A SERIES OF, OF SIX, YOU KNOW, SEPARATE PLANS. START BRINGING ALL THIS TOGETHER INTO ONE COMPREHENSIVE PLAN. LOOKING AT THE, THE CENTER'S DEVELOPMENT, UM, LAND USE DEVELOPMENT IN THE FUTURE, SIDEWALKS, TRAILS, TAKING EVERYTHING AND BRINGING IT TOGETHER. THAT'S GREAT. WELL, GOOD JOB WILL, THANK YOU. THANK YOU. THANK YOU. VERY GOOD. YOU WANT CARRIED TO MAKE A MOTION TO APPROVE RESOLUTION NUMBER 20 OR NUMBER 27 DASH OH 28. SO MOVED. MOVED BY COUNCIL PERSON BONDS SECOND BY COUNCILMAN AGUILAR. DISCUSSION. HEARING NONE, I'LL ENTERTAIN A VOTE. ALL IN FAVOR A AYE. UNANIMOUS. THANK YOU. [VI. WORKSHOP ITEM] NEXT ITEM WOULD BE A WORKSHOP ITEM AND IT'S ORDINANCE NUMBER 24 DASH OH OH FOUR, REGULAR REGULATING ITINERANT AND OUTDOOR VENDORS. HMM. SO YOU RECALL WE'VE HAD A NUMBER OF BUSINESSES, UH, HAVE OPENED UP IN CONDUCTING OUTDOOR SALES. WE HAVE ANOTHER BUSINESS THAT'S LOOKING TO OPEN UP AND CONDUCT OUTDOOR SALES. UH, OR HAVE YOU STARTED OPERATIONS YET? NOT YET. NOT YET. SO, UH, WE'RE LOOKING FOR GUIDANCE FROM YOU GUYS ON, UH, WE'VE TALKED ABOUT FIVE DAYS PER 120 DAYS. WE'VE TALKED ABOUT A LIMITATION, WE'VE TALKED ABOUT LEAVING IT WIDE OPEN. WE NEED YOUR GUIDANCE AND INPUT ON WHAT YOU WOULD LIKE TO SEE IN TERMS OF A REGULATION. DO WE WANT TO ALLOW 365 DAY SALES? DO WE WANNA LIMIT IT TO WEEKDAYS? DO WE, HOW, HOW DO Y'ALL WANT US TO PROCEED WITH THIS? YEAH, AND SO WE HAVE THIS PARTICULAR WE TALKED ABOUT BACK IN JANUARY ABOUT SOME OTHER, UH, DIFFERENT EXCEPTIONS [01:00:01] POSSIBLY TO THE ORDINANCE. AND UH, UH, WE HAVE THIS SPECIFIC BUSINESS, UH, HERE THAT, UM, UH, THEY'RE BASED IN BAY CITY AND THEY DO, UM, COLLECTION OF BLOOD PLASMA. UH, AND THEY'VE RENTED A, A SPACE IN THE SHOPPING CENTER. SHOPPING CENTER. THEY'RE AT THE, UH, SAME SHOPPING CENTER IS THE, UH, IS, UH, THE BAKERY, UH, FOOD CITY, THAT AREA. OKAY. SO THEY, THEY OPEN UP A SPACE, BUT THEY'RE, THEIR, UM, THEIR BUSINESS IS, IS PREDICATED ON USING A, A MOBILE UNIT, UH, WHERE THEY, THEY ACTUALLY DRIVE UP AND THEY PARK AND GET THE, UH, UH, THE BLOOD PRODUCTS. NOW, IT'S NOT A DONATION, IT'S, IT'S, IT IS A FOR PROFIT TYPE DEAL. SO I MEAN, THEY, THEY PAY FOR THE DONATION OR, YOU KNOW, UH, SO IT IS KIND OF A, SOME SORT OF COMMERCE, NOT JUST LIKE RED CROSS OR WHATEVER. RIGHT. BUT, UM, ANYWAY, UH, THEY WOULD BRING THEIR VEHICLE AND PARK IT AND I BELIEVE THEY HAVE A LEASE, UH, WITH THE LANDLORD TO RENT RESERVED SPACE IN THE PARKING LOT AS WELL AS RENT A SPACE OFFICE SPACE. YOU, NOT NOW. AND, UM, AND SO, UH, UH, THEY WOULD PARK, THEY WOULD PARK IN THE MORNING AND THEN DO THE TAKE CARE OF WHAT THEY'RE GONNA DO AND THEN DRIVE BACK TO BAY CITY EVERY DAY BECAUSE THEY NEED TO TAKE THOSE BLOOD PRODUCTS BACK TO THEIR MAIN FACILITY. AND SO, UH, THEY WOULD, UH, GO BACK AND FORTH. THEY WOULD NOT BE PARKING OR STAYING, UH, OVERNIGHT. UM, AND SO THEY, AND, AND THEY REPRESENTATIVE, THEY CAN TALK MORE SPECIFICALLY, BUT THEY, THEY REQUESTED TO HAVE SOME EXEMPTION, UH, INCLUDED IN THE ORDINANCE TO ALLOW FOR AN EXEMPTION FOR PEOPLE DEALING WITH, UH, BLOOD PRODUCTS. SO I'LL TURN IT OVER TO THE GENTLEMAN HERE. HI EVERYBODY. UM, MY NAME IS MASON ST. FELIX. I'M THE DIRECTOR OF STRATEGIC INITIATIVES FOR JOINT PARACHUTE. UM, THERE WE GO. CAN YOU HEAR ME BETTER? YES, SIR. YEAH. PERFECT. ALRIGHT. UM, SO I, I WANTED TO JUST TAKE AN OPPORTUNITY JUST TO INTRODUCE, UH, WHAT WE DO. MR. DUNCAN TOUCHED ON IT A LITTLE BIT, BUT PARACHUTE IS A, THERE WE GO. IS A SLIGHTLY DIFFERENT PLASMA COLLECTION ORGANIZATION. WE ARE BASED OUT OF AUSTIN. WE HAVE 47 LOCATIONS IN DEVELOPMENT ACROSS THE COUNTRY, AND, UM, CURRENTLY HAVE 23 LOCATIONS OPENED, UH, IN THE COUNTRY. ONE OF THEM IS BASED IN BAY CITY. WE ARE LOOKING TO EXPAND AND GO INTO EVEN SMALLER MARKETS. OUR BUSINESS MODEL IS SMALL MARKETS IN GENERAL. WE GO INTO MARKETS THAT ARE ABOUT 20,000 INDIVIDUALS AND THAT'S WHERE WE PLACE OUR PLASMA CENTERS. AND WHAT WE BRING INTO THE COMMUNITY WHEN WE GO IN IS BOTH AN ECONOMIC IMPACT, BUT ALSO AN OPPORTUNITY TO COLLECT PLASMA THAT IS THEN UTILIZED FOR LIFESAVING THERAPIES IN, IN, UM, BY DIFFERENT PHARMACEUTICAL COMPANIES. UM, OUTSIDE OF US WE DO NOT OURSELVES PRODUCE OR MANUFACTURE ANY OF THE, UH, ANY OF THAT, THAT TYPE OF THERAPY. SO I'VE ALREADY, I'VE TOUCHED ON SOME OF THIS. I WANT TO KIND OF SHOW YOU THE BRAND THAT WE, UH, REPRESENT. SO THIS IS ONE OF OUR SITES HERE IN BAY CITY, AND THIS IS JUST GENERALLY OUR BRAND. WE, WE CONSIDER OURSELVES ONE OF, IF YOU GOOGLE ONLINE AND YOU LOOK UP PLASMA CENTERS, YOU GENERALLY FIND A LOT OF NEGATIVE, NEGATIVE COMMENTS OR FEEDBACK AROUND PLASMA DONATIONS. BUT THE WAY WE HAVE BUILT IT, WE'VE BUILT IT AROUND TECHNOLOGY. WE HAVE, UH, IF YOU LOOK AT OUR REVIEWS OR IF YOU LOOK GO BY ANY ONE OF OUR BUILDINGS, YOU WILL SEE THAT THE WAY WE OPERATE IS SLIGHTLY DIFFERENT THAN WHAT YOU WOULD GENERALLY SEE IN OTHER PLACES. WHAT WE ARE LOOKING TO DO HERE IN INCLUDE IS OPERATE A FOUR DAY A WEEK OPERATION, WHICH FOR US IS ABOUT 40 DONATIONS PER PER DAY. THE AVERAGE FEE THAT WE COMPENSATE, UM, UH, TO EACH DONOR IS ABOUT $50. WE BRING IN ABOUT $384,000 IN ANNUAL, UH, ECONOMIC IMPACT INTO THIS COMMUNITY. BUT THAT IS, OUTSIDE OF THAT DOES NOT INCLUDE WHAT WE ARE PAYING FOR RENT. UM, IN THE SPACE THAT WE ARE RENTING, WE'VE SIGNED A TWO YEAR LEASE, UH, WITH AN EXPECTATION TO EXPAND THAT. UH, AND, AND OUR GOAL IS JUST TO BE REALLY GOOD BUSINESS PARTNERS AND COMMUNITY PARTNERS. WE'VE BEEN WORKING WITH THE LANDLORD HAND IN HAND IN FIGURING OUT HOW WE CAN ALSO HELP SUPPORT AND BRING BUSINESS TO THE OTHER, UH, TENANTS WITHIN THAT COMMUNITY AS WELL. RIGHT. SO WE WANT TO BE REALLY GOOD BUSINESS PARTNERS THERE. WE CURRENTLY OPERATE OUR MOBILE LOCATION IN WEST COLUMBIA. WE HAVE, UM, WE'VE BEEN OPERATING THERE SINCE, UH, JANUARY. UM, AND IN THAT AREA IT'S ABOUT, IT'S ABOUT THE SAME TYPE OF NUMBERS THAT YOU SEE HERE. BUT, UH, ONE THING WE'VE DONE IS WE'VE PARTNERED WITH THE LOCAL PIZZA SHOP WHERE WE PURCHASE PIZZA, [01:05:01] WHERE WE BRING IN, UH, THE, WE BRING IN CUSTOMERS FOR THEM. WE PARTNERED WITH THE NAIL SALON. WE'VE PARTNERED WITH JUST THE DIFFERENT COMMUNITIES OR THE DIFFERENT BUSINESSES AROUND US. UH, WE LEVERAGE OUR TECHNOLOGY PLATFORM THAT WE'VE BUILT TO HOW WE ATTRACT DONORS AND ALLOW THEM TO ESSENTIALLY LEVERAGE THAT AND SEND CUSTOMERS AND BUSINESSES TO THEM. UM, I'LL JUST TAKE YOU GUYS HERE EXACTLY WHAT THIS LOOKS LIKE AND WHAT IT IS THAT WE, WE HAVE BUILT. UM, IT IS, IT'S A MOBILE UNIT, BUT IT'S ESSENTIALLY WHEN YOU WALK IN, IT'S, IT'S AS IF YOU ARE IN A BRICK AND MORTAR BUILDING, UM, AND YOU'RE ABLE TO COME IN. OUR DONORS, THE FEEDBACK THAT WE'VE RECEIVED IS, IT FEELS NO DIFFERENT THAN BEING INSIDE OF A BUILDING. IT'S AIR CONDITIONED. IT'S, UM, IT'S VERY SPACIOUS. IT FITS ABOUT 10 BEDS IN THERE, ONE EXAM ROOM IN THERE. UM, AND WE CAN GO THROUGH THE FULL DONATION PROCESS SELF. IT'S SELF-CONTAINED. WE DO NOT LEAVE ANY TYPE OF WASTE. WE COME IN IN THE MORNING AND WE RETURN BACK TO BAY CITY 'CAUSE THERE IS A GENERATOR AND OTHER COMPONENTS. WE CARRY A, UH, MINUS 40 FREEZER INSIDE OF THAT, UH, UNIT. THAT MUST RETURN BACK TO THE LARGER FREEZER IN THE BRICK AND MORTAR WHERE WE CAN MOVE THE PLASMA INSIDE OF IT. UM, OUR, OUR TEAM IS A TEAM OF ABOUT FIVE PEOPLE. THEY'RE LOCAL, THEY'RE BASED OUT OF, OUT OF BASE CITY. THEY WILL COME IN, THEY WILL, UH, DRAW THE DONATIONS. DONORS WILL COME THROUGH AND DONATE, AND THEN WE RETURN BACK EVERY SINGLE NIGHT. AND OUR GOAL IS TO BE HERE LONG TERM AND TO JUST TO BUILD A LONG, UM, A A LONG, YOU KNOW, PARTNERSHIP HERE IN THE COMMUNITY. WE'VE SIGNED A 20 YEAR LEASE IN BAY CITY. WE DON'T PLAN ON GOING ANYWHERE THERE. UM, AND WE INTEND TO, TO MAINTAIN THE SAME LEVEL OF COMMITMENT HERE IN THIS CITY AS WELL. SO IF BUSINESS WAS GOOD ENOUGH, YOU MIGHT SOMETIMES AT SOME POINT SETTLE INTO A STOREFRONT, OR DO YOU ALWAYS SENSE ANTICIPATE IT BEING MOBILE HERE IN TOWN OR, UH, IT, IT DEPENDS ON, ON THE DEMAND, BUT WE ARE LOOKING AT THE COMMUNITY. SO IF YOU LOOK AT LAKE JACKSON CLUTE IN THIS SPECIFIC AREA, THAT IS SOMETHING THAT WE HAVE THAT WE ARE LOOKING AT. I BELIEVE WE'VE MET BEFORE. SO IT'S THE THOUGHT . YEAH. UM, BUT WE, WE ARE LOOKING IN CONSIDERING A, A BRICK AND MORTAR, BUT WE, WE'D WANT TO ENSURE THAT IT WOULD MAKE SENSE FOR US TO SURE. MAKE THAT INVESTMENT. AS FAR AS, UH, I GUESS THE PLASMA SIDE OF IT, AND I DON'T KNOW IF YOU'D KNOW, BUT, UH, HOW OFTEN CAN SOMEBODY DONATE? HOW, UH, DOES IT HAVE SOMETHING LIKE NEGATIVE IN THEIR HEALTH FOR A WHILE OR HOW DOES, HOW DOES THAT PROCESS GO? YEAH, SO PLASMA DONATIONS IS, BLOOD DONATIONS IS REGULATED BY THE FDA. PLASMA DONATIONS IS REGULATED EVEN MORE BY THE FDA. UH, YOU CAN ONLY DONATE ONCE, UH, TWICE IN A SEVEN DAY PERIOD WITH 24 HOURS IN BETWEEN. SO ESSENTIALLY ABOUT 104 TIMES PER YEAR. UM, THERE'S NO, THIS HAS BEEN AROUND SINCE ABOUT 1980S. THERE'S NO ANY, THERE'S NO STUDIES OUT THERE THAT HAS FOUND ANY SPECIFIC OR ANY NEGATIVE IMPACT TO A DONOR'S HEALTH DONATING ON A LONG-TERM PERIOD. UM, WE TAKE ALL PRECAUTIONS, WE FOLLOW, AND WE HAVE TO MAINTAIN ALL FDA REQUIREMENTS, STATE REQUIREMENTS AS WELL. SO WE ARE REGISTERED WITH THE DEPARTMENT OF HEALTH WITH THE CLIA, UH, STATE CLIA BOARD HERE IN THE STATE. UM, AND THEN WE ARE REGULARLY AUDITED BY THE FDA, WHEREVER WE OPEN A MOBILE LOCATION. THAT WILL BE SUBJECT TO FDA AUDITS AS WELL. OKAY. AND THE RE JUST THE REASON THAT I'M ASKING, JUST SO EVERYBODY OR THE COUNCIL MEMBERS WOULD KNOW, IS THAT, WHAT AREA DID YOU SAY THAT IT WAS AT? THIS IS GONNA GO IN AT THE, AT THE 1 0 1 BRAZOSPORT NEXT TO THE, UH, IN THAT FOOD CITY BY THE NEW RO STAR, BY BELTS AND GAS STATION. AND I, YES, SIR. THE, THE ONLY THING, AND IF HE'S, YOU KNOW, IF YOU HAVE THE STUDIES, YOU KNOW, I UNDERSTAND. I'M NOT WELL VERSED IN THE MEDICAL FIELD. NO PROBLEM. IT'S JUST THAT THAT AREA THERE, YOU KNOW, IS OUR LOW INCOME AREA. UH, AND I DON'T KNOW IF I HAVE TO SAY ANYTHING ELSE, BUT IF, IF, YOU KNOW, THESE PEOPLE COME IN AND, YOU KNOW, YOU OFFER PAYMENT TO THEM AND THEY COME IN EVERY TWO DAYS, EVERY TWO DAYS, I JUST WANNA MAKE SURE THAT IT DOESN'T HAVE, LIKE YOU SAID, ANY DETRIMENT TO IT. BUT IF I, I CAN I, CAN I JUST ADD SOMETHING TO THAT? I, I THINK ONE OF THE THINGS WE TAKE INTO CONSIDERATION IS A DONOR CANNOT JUST COME IN AND JUST DONATE. THEY HAVE TO GO THROUGH A SCREENING PROCESS. AND THAT SCREENING PROCESS IS DONE ON EVERY SINGLE DONATION WHERE [01:10:01] WE CHECK THE HEALTH OF THE DONOR. SO FROM VITAL SIGN TO WEIGHT TO, UH, TO ALL, ALL PARTS OF THEIR PROTEIN HEMATOCRIT. SO ALL THOSE THINGS MUST BE WITHIN, UM, WITHIN THE GUIDELINES IN ORDER FOR THEM TO DONATE. AND THOSE AGAIN, ARE, UM, ARE WITHIN THE FDA GUIDELINES. WE WILL, WE WILL NOT TAKE A DONOR THAT IS UNHEALTHY. UM, IT'S DETRIMENTAL TO OUR BUSINESS TO DO THAT. SO WE DON'T WANT TO GET SHUT DOWN BY THE FDA. SO IT'S DEFINITELY MORE ADVANTAGEOUS TO US TO MAKE SURE THAT THE DONOR'S HEALTHY TO DONATE. OKAY. THAT, THAT WAS MY ONLY CONCERN, SO THANK YOU. YEAH. IS IT THE SAME SCREEN PROCESS AS DONATING BLOOD? THEY CHECK IRON LEVELS AND ALL THAT GOOD STUFF? SLIGHTLY MORE SO WHEN YOU, WHEN YOU DONATE BLOOD, YOU DO NOT GO THROUGH A PHYSICAL, UM, WHEN YOU DONATE PLASMA, THE FDA REQUIRES YOU TO GO THROUGH AN ACTUAL PHYSICAL, UM, THAT WE PERFORM. AND TECHNICALLY YOU'RE NOT SELLING ANYTHING. WE'RE NO, WE ARE NOT SELLING ANYTHING. SO THEY'RE JUST TECHNICALLY OPERATE OPERATING IN A MOBILE UNIT. WELL, THAT'S, WE HAD A, UH, THAT WE HAD A LENGTHY DISCUSSION ABOUT WHAT CONSTITUTES BUYING, SELLING, OR THERE'S A COMMODITY TRADED FOR A MONETARY PURPOSE. AND WHILE WE SAY IT'S OUTDOOR SALES, THAT'S REALLY, WE'RE TALKING ABOUT OUTDOOR COMMERCE. AND SO THAT'S WHY WE ARE HERE HAVING THIS DISCUSSION. I WOULD'VE NEVER HAVE THOUGHT THIS WOULD BEEN CONSIDERED OUTDOOR SALES. I JUST, IT'S WEIRD. I HADN'T EVEN THOUGHT ABOUT SOMETHING LIKE THIS. IT IS, BUT AT THE END OF THE DAY, THEY'VE GOT A COMMODITY THAT THEY'RE GETTING AND THEY'RE TRADING SOMETHING OF VALUE FOR IT. AND THEN THAT COMMODITY IS, I'M ASSUMING SOLD OR DO YOU YEAH. Y'ALL, Y'ALL, Y'ALL, Y'ALL IN TURN SELL THE PLASMA TO PHARMACEUTICAL COMPANIES OR Y'ALL SELL IT TO SOMEBODY ELSE THAT'S NOT DONATED TO PEOPLE. RIGHT. Y'ALL ARE FOR-PROFIT BUSINESS, NOT A NON-PROFIT. THIS, THIS IS A FOR-PROFIT. YES. THIS IS A FOR-PROFIT BUSINESS. OKAY. UM, IT'S NOT A CHARITY. I'M NOT, I I'M NOT GONNA SIT HERE AND SAY THAT, BUT, UM, IT IS A, FOR-PROFIT BUSINESS, IT IS, IT IS A SOLD, UM, TO PHARMACEUTICAL COMPANIES. HOWEVER, JUST WITHIN THE CITY THOUGH, WE, WE ARE JUST PROVIDING THE COMPENSATION TO THE DONORS. WE ARE NOT AC ENGAGING IN ANY ACTIVE SALE WITHIN THE CITY LIMITS. I HAVE A QUESTION. MAINLY FOR US. UH, SO ARE WE, IS IT ABOUT THE BUSINESS OR IS IT THE OUTSIDE SALES THAT WE'RE ITS THE OUT. WELL, I THINK IT'S THE, AT THE END OF THE DAY, IT'S THE, THE DISCUSSION HERE ISN'T ABOUT THE SPECIFIC BUSINESS. THEY, THEY, THEY'RE CAUGHT UP IN THIS 'CAUSE THEY'RE TRYING TO FIGURE OUT WHAT THEY CAN DO WHEN THEY CAN DO IT. WE'RE TRYING TO GET CLARIFICATION FROM COUNCIL ON WHAT PARAMETERS DO YOU WANT US TO SET ON BUSINESS IN GENERAL AND OUT. AND I THINK PROBABLY WE WANNA RENAME THE, I THINK THE ORDINANCE PROBABLY SHOULD BE RENAMED TO OUTDOOR COMMERCE AS OPPOSED TO OUTDOOR SALES. BECAUSE AT THE END OF THE DAY, IT'S BECAUSE I'M CONFUSED WITH THE MONEY OR THE NUMBERS THAT YOU SAID THAT YOU BRING IN, IN ASPECT, IF I GET PLASMA, DOES THAT MEAN I GONNA GO GET MY NAILS DONE OR BUY PIZZA? I I DON'T, YEAH, I DON'T CONVERT TO, I DON'T SEE EITHER TWO. YEAH. PERSONALLY. YEAH, I, I CAN SPEAK TO THAT. UM, SO IN, IN ANY OF THE COMMUNITIES THAT WE ARE IN, GENERALLY THE DONORS ARE LOCAL. SO WHEN, WHEN WE SAY THAT THAT GOES BACK INTO THE COMMUNITY, WHAT WE SEE IS MOST OF OUR DONORS AND, AND WE HAVE THE DATA TO BACK THIS UP, MOST OF OUR DONORS GO BACK AND ACTUALLY SPEND THAT MONEY LOCALLY, WHETHER IT'S IN LOCAL SHOPS OR, YOU KNOW WHAT, WHEREVER. OKAY. I TOOK IT DEER YOUR NAILS AND THINGS LIKE THAT. CORRECT. UH, IT'S, IT IS, IT IS THEIR MONEY. IT'S THEIR DISCRETION. YEAH. THERE AIN'T NO SALES TAX INVOLVED. I'M THE REASON WHY THIS WOULD BE APPLICABLE TO THE, THE ORDINANCES IS THE ORDINANCES. YOU CAN'T, YOU KNOW, DO SALES OR COMMERCE IN THE PARKING LOT. YOU HAVE TO DO IT WITHIN THE FOUR WALLS OF THE BUILDING. AND IF YOU DO OUTSIDE SALES OR COMMERCE, THEN YOU HAVE TO, YOU HAVE A LIMITED NUMBER OF DAYS THAT YOU CAN DO THAT. 'CAUSE WE WERE TALKING ABOUT, YOU KNOW, PEOPLE THAT, YOU KNOW, WE ALREADY, AND, AND WE DO IN THE ORDINANCE, WE HAVE THAT, HEY, YOU HAVE TO HAVE A, A BRICK AND MORTAR LEASE OR PERMISSION FROM THE PERSON WITH THE BRICK AND MORTAR LEASE TO DO SOMETHING OUT IN THE PARKING LOT. SO THAT'S WHY THIS WOULD RUN AFOUL OF THAT ORDINANCE AND WHY THEY WANT TO CREATE THE EXCEPTION FOR THEIR SPECIFIC TYPE OF BUSINESS. BUT NO, I DON'T, I WAS JUST GONNA SAY, I DON'T KNOW THAT WE, AND I DON'T WANNA TAKE WORDS OUTTA YOUR MOUTH OR THE COUNCIL'S MOUTH, BUT I DON'T KNOW THAT WE WANNA REGULATE THIS BUSINESS FOR IT'S SPECIFICALLY, I THINK WE WANNA SAY, YEAH, THIS IS ABOUT, THIS IS ABOUT SOME MORE FOOD TRUCKS AND TRAILERS SITTING AROUND SELLING AND NOT HAVING BRICK AND MORTAR AND PAYING PROPERTY TAXES. RIGHT. THAT'S REALLY WHERE THIS IS AT. AND THEN, AND SO IN THIS CASE, THEY'VE GOT A BRICK AND MORTAR LEASE. THEY HAVE THE SITE THEY'RE PAYING IN TO ULTIMATELY, SO THAT IS THEN THAT'S NOT JUST RENTING THE PARKING LOT. CORRECT? THAT'S CORRECT. WE, WE, WE HAVE A BRICK AND MORTAR SPACE THERE. UM, JUST NOT, JUST NOT OPERATING OUT OF IT. WELL, THEY CAN'T, WE, WE HAVE NOT STARTED OPERATIONS YET BECAUSE WE WANT, WE [01:15:01] WANT TO ENSURE THAT WE ARE GOING TO, WE'RE VERY CAREFUL ABOUT GOING INTO ANY CITIES AND JUST OPERATING, JUST LIKE WE ARE REGULATED BY THE FDA. SO BEFORE WE SUBMIT THIS ADDRESS AND BEGIN OPERATING HERE AND SUBJECT OURSELVES TO, PLUS I ASK THEM A QUESTION, IF THEY'RE, THEY'RE APPARENTLY RENTING A 600 SQUARE FOOT SPACE IN THE SHOP, JUST 645 SQUARE FEET. YEAH. IN THE, IN THE UNIT. AND LIKE, WELL, WHY COULDN'T Y'ALL JUST TAKE THE BLOOD AND DO ALL THE OPERATIONS IN THE BUILDING INSTEAD OF IN THE MOBILE UNIT? AND THE DIFFERENCE IS, A COUPLE OF THINGS IS DIFFERENT TYPE OF EQUIPMENT AND THEY'D HAVE TO HAVE DIFFERENT TYPE OF LICENSING. SO THEY'VE ALREADY SET THEMSELVES UP TO DO IT AS A MOBILE UNIT THAT THEY, IF THEY WANNA DO IT INSIDE THE BUILDING, THEY WOULD HAVE TO HAVE DIFFERENT EQUIPMENT, DIFFERENT SETUP, AND DIFFERENT LICENSING. SO, UH, THAT'S WHY THEY'RE, THEY'RE SET UP TO DO THIS THROUGH A MOBILE UNIT AND WHY THAT CORRECT. THEY COULDN'T JUST MOVE INSIDE THE BUILDING. CORRECT. WOULD'VE TO HAVE THE WE OPERATE REFRIGERATION UNIT, IT WOULD'VE TO HAVE THE REFRIGERATION UNIT HAVE TO HAVE DISPOSAL. YEAH. THE, OH, ASIDE FROM THE EQUIPMENT ITSELF AND, UM, PUTTING THAT INSIDE THE, THE MOST IMPORTANT THING IS THIS MOBILE UNIT OPERATES UNDER THE, UM, FDA LICENSE OF BAY CITY. SO IT CANNOT HAVE A SECONDARY BRICK AND MORTAR ADDRESS. IT MUST BE MOBILE AND IT MUST RETURN BACK TO THAT BRICK AND MORTAR IN ORDER TO OPERATE WITHIN THAT LICENSE. I JUST DON'T WANNA CONFUSE YOU, SIR, LIKE THIS, THIS IS A JAM UP BUSINESS AND YOU GOT IT TOGETHER. JUST DON'T ACCUSE THE FACT THAT YOU MAY BE AN, PROBABLY ARE AN EXCEPTION TO, WHAT'S THE WORD I'M LOOKING FOR? OUTSIDE? OUTSIDE COMMERCE. COMMERCE THAT WE'RE USED TO SEEING. YES. AND WHEN WE PASS THIS, WE HAVE TO UNDERSTAND THAT, THAT HOW MANY WE'RE DOWN THE LINE. DOES IT AFFECT YEAH. AM I SAYING IT RIGHT? WELL, IT'S GONNA AFFECT EVERYONE. WELL HERE'S THE, HERE'S THE KICKER TO THE WHOLE DEAL BECAUSE EVERY, EVERYTHING THAT WE PUT IN THIS ORDINANCE, WE JUST SAID THAT THEY HAD TO HAVE A SALES TAX CERTIFICATE IN THE CITY OF CLUE. THAT'S TRUE. SO I MEAN, UH, YOU KNOW, I'M PRESUMING THAT, THAT THIS IS A SELLABLE PRODUCT AND THAT IT WOULD HAVE, I DON'T THINK SALES TAX REVENUE. NO. I THINK THE WAY THAT THEY HAVE IT SET UP AND IT, YOU KNOW, IT'S A LITTLE BIT DIFFERENT. UM, BECAUSE IT'S TAKING, UH, UH, BLOOD PRODUCTS AND THEY GO THROUGH THE FDA LICENSING, UH, UNDER, UNDER FDA REGULATIONS, IT'S PROBABLY NOT CONSIDERED AS ACTUALLY SELLING PLASMA. IT'S A THAT'S CORRECT. THE FDA HAS SET IT UP AS MORE OF A DONATION TYPE DEAL, EVEN THOUGH THEY ARE BEING COMPENSATED. WELL, I THINK MAYOR'S TRYING TO SAY THAT THEY MAY BE CARVED OUT BY THE DEFINITION OF THEIR INABILITY TO GET A SALES TAX, CORRECT. RIGHT. SO THAT, I DON'T THINK THEY WOULD FALL WITHIN THE SALES TAX REQUIREMENT. BUT UH, IF THE ORDINANCE SAYS THAT'S AN ABSOLUTE, THEN THAT WOULD HAVE TO BE EXCEPTION. IT WOULD'VE TO BE A VARIANCE. IT WOULD HAVE TO BE, YEAH, WE'D HAVE TO HAVE THAT IN THE ORDINANCE THAT, THAT, YOU KNOW, THIS ORDINANCE DOESN'T APPLY TO BLOOD AND PLASMA COLLECTION. AND UH, AND THEN IF IT DOESN'T APPLY TO THEM, THEN THEY DON'T HAVE TO HAVE A SALES TAX CERTIFICATE. RIGHT? WELL, I MEAN, I DON'T THINK THE ORDINANCE SAYS THAT. I THINK IT JUST SAYS YOU HAVE TO HAVE A SALES TAX ORDER. SO WE WOULD HAVE TO MAKE THAT CLEAR IN THE EXCEPTION. RIGHT. SO DO, SO I HAVE A QUESTION. HOW DO THEY FALL? OKAY, I'M JUST READING LIKE, IS IT ITINERANT OUTDOOR SALES MEANS YOU'RE SAYING THEY HAVE A LEASE WITH INSIDE THAT COMPLEX. CORRECT. THIS IS SAYING THAT THEY, THAT IN ORDER TO FALL UNDER THE RULES, IT WOULD, THEY WOULDN'T HAVE THAT LEASE. THEY'D BE LIKE, YOU OWN A BUSINESS. NO RE I'M, I'M IN THE PARKING LOT SELLING STUFF AND YOU'RE JUST GONNA LET ME DO IT. ISN'T THAT WHAT THIS IS? YEAH. BUT EVEN IF YOU OWN THE LEASE, LET'S SAY, LET'S SAY YOU OWN THE SHOP, YOU HAVE A CLOTHING STORE AND YOU WANT TO, EVERY ONCE IN A WHILE HAVE A PARKING LOT SALE AND PUT THE CLOTHES OUT IN THE PARKING LOT. THAT ORDINANCES RESTRICTS YOU TO ONLY BEING ABLE TO DO THAT FIVE DAYS FOR EVERY 120 DAYS AND A TOTAL OF 20 DAYS A YEAR OR SOMETHING. IT, IT'S RESTRICTIVE. EVEN IF, EVEN IF YOU, YOU'RE SELLING STUFF THAT'S INSIDE AND YOU JUST WANNA HAVE A SIDEWALK SALE, UH, SO MANY TIMES A YEAR, THAT IS, THAT RESTRICTS THE NUMBER OF DAYS YOU CAN DO THAT, WHICH WOULD NOT ALLOW THEM TO OPERATE. 'CAUSE THAT'S TOO RESTRICTIVE TO THE NUMBER OF DAYS THEY WANT TO OPERATE. GETS INTO THE QUESTION OF DO WE A, DO WE CARVE OUT A SPECIFIC THING FOR THIS TYPE OF BUSINESS? OR B DO WE WANT TO EVEN LIMIT THE DAYS? DO, DO WE WANT TO EXPECT, HOW FLEXIBLE DO WE WANT TO BE IN THE ORDINANCE? RIGHT. 'CAUSE IN THEIR PARTICULAR CASE, THEY'RE NOT SELLING ANYTHING. RIGHT. WELL, WHAT ABOUT A SPECIFIC USE PERMIT RATHER THAN THIS APPLYING TO THEM AT ALL JUST BECAUSE THEY'RE A MOBILE UNIT? WELL, BUT THAT, THAT, SO, OKAY. OKAY. SO SPECIFIC USE PERMIT APPLIES TO ZONING. SO IF YOU'RE VIOLATING ZONING, [01:20:01] NOT VIOLATING THIS SPECIFIC ORDINANCE, SO YOU COULD SAY THAT IN THIS ORDINANCE YOU COULD SAY WE CAN GRANT VARIANCES. YOU KNOW THAT IF THEY WANT AN EXCEPTION THAT THEY WOULD GO THROUGH SIMILAR TO SP SPECIFIC USE PERMIT, SAME TYPE OF PROCEDURE. BUT IT WOULDN'T BE CALLED SPECIFIC USE PERMIT BECAUSE THAT ONLY APPLIES TO ZONING REQUIREMENTS. RIGHT. SO YOU COULD SAY, Y'ALL CAN, YOU CAN, YOU CAN PUT THE ORDINANCE RATHER THAN SAY WE'RE GOING TO CREATE EXEMPTION FOR, YOU KNOW, BLOOD AND PLASMA PRODUCTS. WE CAN PUT AN ORDINANCE THAT IF YOU, IF YOU WANT AN EXCEPTION, YOU CAN PETITION TO THE COUNCIL AND THE COUNCIL CAN EITHER GRANT OR DENY YOUR VARIANCE. I THEN Y'ALL HAVE TO COVER EVERYTHING IN YOUR YEAH. 'CAUSE I MEAN MY, YOU DON'T HAVE TO THINK OF EVERYTHING IN ADVANCE IN YOUR ORDINANCE. RIGHT. THIS'S SO DIFFERENT THAN SOMEBODY JUST, YOU KNOW, PUT HAVING A HIGHER CELL AND PUTTING ALL THEIR THE OUTSIDE. THIS IS JUST DIFFERENT SPECIFIC USE PERMIT. WELL THAT'S THAT'S WHAT HE WAS JUST EXPLAINING. I'M SORRY. YEAH. LEGALLY SPECIFIC USE PERMIT ONLY IS EXCEPTION TO ZONING. THIS IS NOT A ZONING REGULATION, THIS IS JUST A GENERAL BUSINESS REGULATION. IT'S NOT ZONING LIKE YOU HAVE TO, THIS IS NOT LIKE, OKAY, THIS IS A C ONE REQUIREMENT OR A C TWO REQUIREMENT. UM, THE SAME THING AS, SO, OKAY, SO I GUESS C SORRY CHRIS. YEAH, GO AHEAD. BUT COMING BACK TO THE CONVERSATION OF THIS ORDINANCE. MM-HMM. , UM, I DON'T KNOW IF I LIKE THE WAY IT'S WRITTEN. I KNOW THAT IT'S A WORKSHOP ITEM, UH, AND THAT IT'S PRESENTED TO COUNCIL. UH, BUT THE WAY IT'S WRITTEN NOW IS TOO PRIVATE, IS TOO, UH, I THINK IT'S TOO EXCESSIVE. THE ONE THING I WILL SAY IS, UH, IF WE ARE PLANNING, AND I'M SORRY THAT YOU HAVE TO FALL UNDER THIS 'CAUSE I THINK WE HAVE NO PROBLEM WITH YOUR BUSINESS, BUT IF IT DOES FALL UNDER, UNDER THIS, I, INSTEAD OF SEEING A WORKSHOP JUST WITH THE COUNCIL MEMBERS, I THINK I'D LIKE TO SEE A WORKSHOP WITH ACTUAL BUSINESS OWNERS OR BUSINESS PEOPLE THAT THIS WILL AFFECT. UH, 'CAUSE IT'S GONNA AFFECT THEM. UH, AND IT MIGHT AFFECT FUTURE BUSINESS OWNERS TRYING, DOING SOMETHING SIMILAR. YOU KNOW, I'M NOT SURE, BUT THAT'S MY THOUGHT. AND THIS ONE MEAN, IT'S LIKE THEY HAVE A MOBILE UNIT, SO IT'S NOT LIKE THEY'RE PUTTING OUT TABLES AND PUTTING OUT GOODS AND SELLING THEM. YOU HAVE TO BE VETTED. THEN THEY DO THE, WHAT IT WAS, THE SCREENING PROCESS. THE SCREENING AND EVERYTHING. YOU GO INSIDE OF A FOUR WALLS IF YOU WILL. MM-HMM. . AND SO IT'S, IT'S LIKE, IT'S SO DIFFERENT THAN WHAT I'M THINKING OF SOMEBODY JUST GOING OUT AND PUTTING, YOU KNOW, SOMEBODY. I THOUGHT IT WAS JUST BECAUSE FOR PEOPLE, LIKE HE OWNS THE BUSINESS. I COME AND LEASE HIS PARKING LOT FROM HIM BECAUSE HE HAS A LEASE. HE'S NOT THE, THE OWNER OF THE PROPERTY, BUT HE HAS A LEASE. AND SO I LEASE TO SIT IN THE PARKING LOT AND SELL MY GOODS AT VALENTINE'S OR WHATEVER. THAT'S, THAT'S, I'M SELLING WIND CHIMES IN THE PARKING LOT OR WHATEVER. THAT'S MATTRESSES. WELL, WHO DIDN'T LOVE A GOOD INSURANCE PARKING LOT SET? , . I, MY, MY, MY CAR INSURANCE HAGGLED OVER IN 105 DEGREE HEAT UNDERNEATH A TENT . UM, BUT NO, I, I THINK THAT THE PROBLEM IS, IS WE'VE GOT SUCH A LARGE, THIS IS A HUGE ISSUE. AND SO WHAT I'M HEARING FROM THE COUNCIL, IF I'M NOT MISTAKEN, AND I DON'T WANNA PUT WORDS IN YOUR MOUTH, IS THAT YOU DON'T HAVE, IF WE WERE TO USE OUR DISCRETION ON ALLOWING THIS BUSINESS TO OPERATE, YOU'RE OKAY WITH THAT? YOU MAY, I WOULD BE OKAY WITH THIS. AND YOU CAN'T SAY YES. I'M JUST, THAT'S WHAT I'M HEARING AND INTERPRETING. YOU ARE HEARING CORRECTLY YOUR BODY LANGUAGE AND YOUR MOOD IS SUGGESTING WITHOUT VOTING. YES. YOU'RE VERY OBSERVANT. OKAY. SO WE WILL COME BACK AND RECRAFT THIS AGAIN AND TRY AND GET A LITTLE BIT MORE COMMUNITY INPUT AND I MEAN, THAT'S UP TO YOU. GUESS WE CAN PROCEED. I JUST THINK THAT'S FINE. THAT SOUNDS GOOD. THANK YOU GUYS. THANK YOU. SORRY IT TOOK US SO LONG TO GET TO YOU. WHAT'S THAT? SORRY IT TOOK US SO LONG TO GET TO YOU. OH NO, THAT'S FINE. . THAT'S MINE. OH, I'M SORRY. . . JUST GRAB ME LIKE GRAB ME, GRAB. OKAY. [VII. NOTICE/ANNOUNCEMENTOF UPCOMING EVENTS AND MEETINGS] NEXT ITEM IS NOTICE AND ANNOUNCEMENTS OF UPCOMING EVENTS AND MEETINGS.
