MAYOR COUNCILMAN AGUIAR MAKES A MOTION.
ANY DISCUSSION? ANY ITEMS NEED TO BE REMOVED? HEARING NONE.
NEXT ITEM WOULD BE, DID YOU SAY FLAVOR? YOU DID SAY
[IV. BUSINESS ITEMS]
ITEM WILL BE A PROCLAMATION PROCLAIMING NATIONAL FLAG DAY.I HAVE ONE THAT WAS PRESENTED TO, FROM, FROM KJ, ZT.
FAMILY LIFE, FAITH, COMMUNITY FINANCIAL SECURITY, AND THEIR PROCLAMATION READS.
WHEREAS KJ ZT FAMILY LIVE SOCIETIES HAVE LONG PROCLAIMED THEIR PATRIOTISM BY CELEBRATING AND HONORING NATIONAL FLAG DAY 14TH.
AND WHEREAS KJZT FAMILY LIVE SOCIETIES PERFORM MANY RELIGIOUS, CHARITABLE, CULTURAL AND PATRIOTIC ACTIVITIES THROUGHOUT TEXAS.
AND WHEREAS THE VOLUNTEERS OF THESE ADULTS AND JUNIOR SOCIETIES PROVIDE GREAT SERVICE TO OUR STATE AND NATION THROUGH CIVIC AND PATRIOTIC PROJECTS.
AND WHEREAS KJ ZT FAMILY LIFE CALLS UPON THEIR SOCIETIES TO TELL THE IDEALS AND OBJECTIVES OF KJ ZT FAMILY LIFE AND TO UNITE IN OBSERVATION OF NATIONAL FLAG DAY.
NOW, THEREFORE, I MAYOR CALVIN SHIFFLET OF THE CITY OF CLUTE TO HERE BROUGHT PROCLAIM JUNE 14TH, 24, 20 24 AS NATIONAL FLAG DAY AND CALL UPON ALL CITIZENS TO SHOW THEIR APPRECIATION FOR THE CONTRIBUTIONS MADE TO THE LOCAL COMMUNITIES AND TO THE STATE OF TEXAS BY MEMBERS OF KJZT FAMILY LIVE AND WITNESS WHERE OF HEARING TO SET MY HAND AND CALLED THE SEAL OF THE CITY OF KLUT.
[00:05:01]
IS SIGNED BY MYSELF.AND, UH, WE HAVE ONE I THINK THAT READS ALMOST IDENTICALLY.
UH, THAT IS FROM THE OFFICIAL ONE FROM THE CITY OF KLU WITH THE CITY SEAL ON IT.
ROSIE, WOULD YOU WANNA PUT THE SEAL ON THEIRS? COME DOWN ONE AND GET IN FRONT OF THE BLUE TARP.
OKAY, ROSIE, YOU'LL BE BACK UP THERE.
RONNIE, RONNIE HAD ME OUT OVER THERE BY.
NEXT ITEM WOULD BE CONSIDERATION OF POSSIBLE ACTION TO APPROVE RESOLUTION NUMBER 29 DASH 2024 APPROVING CONTINUAL CONTINUING PARTICIPATION IN THE AMENDMENT AND THE AMENDMENT, AND ADDEND TO THE CITY'S CORPORATE AGREEMENT WITH BRAZO COUNTY FOR PARTICIPATING IN THE CDBG HOME, SEG PROGRAMS AND RESOLUTION NUMBER 29 DASH 2024.
RESOLUTION OF CLU TEXAS APPROVING AN AMENDMENT ADDEND TO THE INTERLOCAL CORPORATIVE CORPORATION AGREEMENT BETWEEN THE CITY OF INCLUDE AND BRAZORIA COUNTY, FURTHER APPROVING THE CITY'S APPLICATION FOR FUNDING AND CONTINUING PARTICIPATION IN THE COMMUNITY DEVELOPMENT BLOCK GRANT, CDBG HOME AND SEG PROGRAMS AS ADMINISTERED THROUGH THE BRAZO COUNTY DEPARTMENT OF COMMUNITY DEVELOPMENT.
WHEREAS THE CITY UDE, THIS RESIDENTS HAVE BEEN BENEFITED SIGNIFICANTLY, SIGNIFICANTLY OVER THE YEARS FROM PROJECTS FUNDED BY THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENTS, CDBG HOME AND SEG PROGRAMS AS ADMINISTERED BY BRAZORIA COUNTY.
AND WHEREAS THE CITY COUNCIL IS DESIROUS OF MAINTAINING THE CITY'S PARTICIPATION IN THESE PROGRAMS AND FURTHERING OUR LONGSTANDING RELATIONSHIP WITH BRAZORIA COUNTY, WHEREAS BRAZORIA COUNTY IS DESIROUS OF CONTINUING THAT RELATIONSHIP AS PROPOSED BY THEIR REQUEST FOR A LETTER CONFIRMING CONTINUATION AND PROPOSED AMENDMENT ADDEND TO THE CORPORATE CORPORATION AGREEMENT.
AND NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL, CITY OF CLUTE, TEXAS, THAT THE AMENDMENT ADDEND TO THE INTER-LOCAL COOPERATIVE CORPORATION AGREEMENT BETWEEN THE CITY OF CLU AND BRA COUNTY FOR THE ADMINISTRATION OF THE CDBG HOME AND SEG PROGRAM IS HEREBY APPROVED, AND THE MAYOR IS HEREBY AUTHORIZED TO SIGN THE CONTINUING COMMITMENT LETTER AND GRANT AGREEMENT TO ENSURE THE CITY'S CONTINUED PARTICIPATION IN THIS AGREEMENT IN THESE PROGRAMS. THIS RESOLUTION DULY PASSED THIS 13TH DAY OF JUNE, 2024 AND SIGNED BY MYSELF AND TESTIFY BY ROSA POINT CITY CLERK.
SO WE ALTERNATE YEARS, IF YOU RECALL WHAT THE OTHER CITIES IN THE COUNTY, UH, LAST YEAR, THEY HELPED PAY FOR THE BRIAN SUBDIVISION WATER PROJECT.
UH, THIS YEAR WE'RE NOT INCLUDED IN THE FORMULA ALLOCATION, BUT IF THERE'S RESIDUAL FUNDS, THIS ALLOWS US TO ACCESS THOSE FUNDS.
AND THIS CONTINUES OUR CON THEY HAVE TO PROVE TO HUD EVERY FEW YEARS THAT ALL THESE CITIES ARE STILL COMMITTED.
SO STAFF RECOMMENDS APPROVAL OF THE RESOLUTION.
THERE'S A, THESE FUNDS ARE BASICALLY FOR LOW TO MOD INCOME.
AND YOU HAVE TO, YOU EITHER HAVE TO SPEND IT ON PROJECTS THAT BENEFITS THE WHOLE CITY OR PROJECTS THAT BENEFIT, THAT BENEFITS LOW MOD INCOME AREAS.
AND THE LAST, THE LAST TIME THAT I WAS, THAT WERE THREE 50, UH, 2 92 90, YEAH.
SO WE GET ONE LIKE EVERY OTHER YEAR.
[00:10:02]
I'LL, I'LL MAKE, AND IF SOMEBODY DON'T SPEND THEIRS, WE CAN GET SOME OF THEIRS.HOW, HOW OFTEN DOES THAT HAPPEN THOUGH? THAT SOMEBODY HAS MONEY ON IT? HONESTLY, IT, IT HAPPENED TO US.
UH, WE GOT IT, WHAT, 21 AND 22? BECAUSE NOBODY HAD USED THE 22 FORMULA.
YEAH, WE GOT REALLY? YEAH, WE JUST HAD ONE LAST YEAR.
BUT THAT WAS THE FORMULA ALLOCATION.
BUT THE YEAR BEFORE THAT, OR TWO YEARS BEFORE THAT, WE HAD GOTTEN IT BECAUSE WE'D ALSO GOTTEN OUR FORMULA ALLOCATION PLUS RESIDUAL FROM OTHER CITIES THAT HADN'T USED THEIR MONEY.
YEAH, I THINK, I THINK ONE YEAR WE ALMOST GOT DOUBLE.
THAT WAS THE RILEY RILEY ROAD SEWER PROJECT.
I'LL MAKE THE MOTION TO APPROVE.
WE HAVE A MOTION BY COUNCILMAN AGUILAR THAT WE APPROVE RESOLUTION NUMBER 29 DASH 2024 AND THE, AND THE ADDENDUM.
I'LL SECOND SECONDED BY COUNCILMAN LOPEZ.
ANY FURTHER DISCUSSION? HEARING NONE.
NEXT ITEM IS CONSIDERATION OF POSSIBLE ACTION TO ADOPT A RESOLUTION NUMBER 30 DASH 2024, AUTHORIZING THE MAYOR'S SIGNATURE ON AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF LAKE JACKSON AND THE CITY
IT WOULD BE RESOLUTION NUMBER 30 DASH 2024.
A RESOLUTION OF THE CITY COUNCIL OF CITY OF CLUTE, TEXAS APPROVING AN INTERLOCAL AGREEMENT WITH THE CITY OF LAKE JACKSON, TEXAS FOR THE CDL TRAINING AND TESTING SERVICES.
WHEREAS THE CITY OF CLUTE, THE CITY OF LAKE JACKSON, HAVE LONG PARTNERED ON PROJECTS AND ACTIVITIES.
AND WHEREAS THE CITY OF LAKE JACKSON HAS BOTH CAPACITY AND THE WILLINGNESS TO PROVIDE CDL TRAINING TO INCLUDE EMPLOYEES, AND WHEREAS THE CITY OF INCLUDE IS IN NEED OF MORE STAFF TRAINED AND CERTIFIED WITH CDLS.
AND WHEREAS UNDER CHAPTER 7 91, THE TEXAS GOVERNMENT CODE, BOTH ENTITIES ARE ABLE TO ENTER INTO AN INTERLOCAL AGREEMENTS FOR THE RE RESOURCE SHARING.
WHEREAS BOTH THE CITY OF CLU, THE CITY OF LAKE JACKSON, ARE IN AGREEMENT ON THE FORM AND CONTENT OF SUCH AN INTERLOCAL AGREEMENT.
NOW, THEREFORE BE RESOLVED BY THE CITY COUNCIL, CITY OF KLU, TEXAS HEREBY APPROVES THE INTERLOCAL AGREEMENT BETWEEN THE CITY AND THE CITY OF LAKE JACKSON FOR PROVISIONS OF CDL TRAINING AND TESTING SERVICES DESCRIBED IN THE DOCUMENT ATTACHED HERE TO AS EXHIBIT A PASSED AND ADOPTED THIS 13TH DAY OF JUNE, 2024, APPROVED BY MYSELF AND TESTED BY ROSA POINT OF
SO WE WOULD BE SENDING OUR, OUR STAFF THERE TO TRAIN AND TEST.
UH, NORMALLY WHEN WE DO THIS, WE'VE HAD TO GO TO ALVIN BEFORE, SORRY, JOHN, DON'T MEAN TO PUT YOU ON.
TYPICALLY WHENEVER, UH, EMPLOYEES GO FOR, UH, CDLS, THEY TAKE THE TEST, GET THE PERMIT, AND THEY STUDIED THE WORK, AND THEN THEY HAD TO GO TO THE, UH, DBS OFFICE AND DRIVE WITH THE OFFICER.
NOW, ALL THAT, THOSE PROGRAMS HAVE CHANGED.
IT'S REQUIRING SO MANY HOURS OF TRAINING ON HAND.
THEY WILL STILL ON, ON THEIR OWN, GET THEIR PERMIT, BUT THEN LIKE JACKSON HAS GOT SOME OF THEIR EMPLOYEES WHO ARE TAKING THEIR TIME AWAY FROM THE CITY.
SO THEY'RE ACTUALLY BECOMING TRAINERS WITH THIS OTHER COMPANY WHERE THEY WILL ACTUALLY TAKE THE EMPLOYEES AND SEND 'EM THROUGH THE PROGRAM OF LOOKING AT THE TRUCK, GOING OVER EVERYTHING YOU NEED TO, TO GO OVER AND TAKE 'EM THROUGH THE DRIVING PROCESS AND THEN GET 'EM PREPARED FOR THE FINAL TEST TO GET YOUR LICENSE.
UH, SO THAT'S WHERE THOSE HOURS COME IN THERE WHERE THEY, THEY TAKE THE TIME TO DO THAT FOR US.
SO WE'LL BE ABLE TO, UH, WORK THROUGH THE LOCAL WITH THEM TO SEND OURS OVER THERE TO WHERE THEY CAN, UH, BE TRAINED BY THE SAME GUY THAT TRAINS THEIR OWN EMPLOYEES.
SO IT'S, IT IS A GOOD WAY OF, OF DOING IT.
OTHERWISE YOU'D HAVE TO SEND 'EM OFF TO A SCHOOL.
I WANNA SAY IT'S LIKE, UH, SEVEN DAYS WHERE THEY HAVE TO BE GONE TO A TRAINING.
UH, AND THE COST OF IT IS, IS IT'S PROBABLY AROUND 35, I THINK AROUND $3,500 TO SEND 'EM TO THIS TRAINING BECAUSE YOU'RE PAYING FOR THE TRAINING, PLUS YOU HAVE TO PAY 'EM OVERNIGHT, STAY TO STAY SOMEWHERE.
SO THIS IS A PROGRAM WHERE THEY'VE, THEY'VE GOT EMPLOYEES THAT ARE TRAINED IN DOING THIS.
AND LIKE I SAID, THEY WILL TAKE THEIR TIME OFF FROM WORK, UH, VACATION BECAUSE THEY'RE ACTUALLY PAID FROM THE COMPANY THAT THAT, THAT DOES THIS.
SO, UH, BUT THEY WOULD, THEY WOULD ACTUALLY TAKE THE EMPLOYEES TO TRAIN 'EM THROUGH THE PROGRAM SO THEY CAN BE PREPARED TO TAKE THEIR CDL TEST.
HOW MANY CDL DRIVERS DO WE HAVE OR DO WE NEED, I GUESS I SHOULD SAY? WELL, MOST OF YOUR EQUIPMENT WITH SANITATION, LIKE YOUR GARBAGE TRUCKS, YOUR, UH, FLATBEDS AND ALL THAT EQUIPMENT REQUIRES CL WE ARE IN THE PROCESS OF TRYING TO GET EQUIPMENT TO WHERE IT DOESN'T REQUIRE CDL TO DRIVE IN THE WATER AND WASTEWATER SIDE.
UM, THERE'S THINGS LIKE THE GRADE ALL THAT REQUIRES A CDL.
NOW THEY ARE ACTUALLY, YOU'RE ABLE TO GET EQUIPMENT THAT IS BELOW THE WEIGHT LIMIT, BUT IT STILL DOES THE SAME WORK, SMALLER DUMP TRUCKS.
[00:15:01]
YOU'RE ALLOWED TO DO THOSE WITHOUT CDLS.BUT MOST ALL OF THE, UH, SANITATION DEPARTMENT HAS CDLS IN THE OTHER, UH, WATER.
SO WE DON'T HAVE AS MUCH EQUIPMENT THAT REQUIRES IT WHERE, UH, YOU KNOW, IT, IT, IT IS CRITICAL THOUGH BECAUSE WE DO HAVE SOME EQUIPMENT WHERE WE NEED PEOPLE TO DRIVE THOSE, BUT IT IS A WAY OF, OF GETTING THIS WITHOUT HAVING A LARGE EXPANSE THAT YOU WOULD NORMALLY HAVE TO, TO DO OTHERWISE.
IT'S GONNA BE ANOTHER ONE OF THEM THINGS WHEN WE GET 'EM TRAINED, THEY GONNA LOOK, THEY GONNA GET ANOTHER
WELL, THAT'S, I, I'LL TELL
BUT ACTUALLY HERE LATELY WE'VE BEEN ON THE RECEIVING END OF GETTING EMPLOYEES FROM THAT SIDE OF LINE OVER HERE.
WELL, I'M TALKING ABOUT, I'M TALKED ABOUT THEY GET C THEY GO THE PLANT, THEY GO ANOTHER OR SOMEWHERE ELSE AND YEAH.
YOU KNOW, UNFORTUNATELY, WHAT I KNOW OTHER ONES WE HAVE RIGHT NOW WHO IS IN THE WATER SIDE, HE'S, HE'S TRAINING, HE'S, HE'S REAL AGGRESSIVE AND LEARNING EVERYTHING HE CAN.
HE'S EAGER TO GET HIS WATER LICENSE.
HE'S, HE'S ASKED ME ABOUT, UH, GETTING THE CDL AND DOING THAT.
WE WERE WORKING ON THIS HERE, SO I INFORMED HIM THAT HIS PAST, HE WOULD BE ONE OF THE FIRST ONES TO GO THROUGH THAT PROGRAM.
AND HE'S VERY AGGRESSIVE ABOUT IT.
AND SO I THINK HE'S GONNA BE REALLY GOOD.
YOU KNOW, SOME OF THE OTHER ONES IS THEIR FEAR OF TAKING THE TEST IS, IS IS YOUR BIGGEST HOLD UP, YOU KNOW, THEY'RE AFRAID THEY'RE GONNA FAIL TEST, WHICH ALL YOU FAIL, TAKE IT AGAIN.
BUT THAT'S, THAT'S ONE OF THE BIGGEST HANGUPS.
AND WHAT'S THE COST DOING IT THIS WAY? UH, I DON'T KNOW RIGHT OFF HAND.
I DON'T THINK THAT, UH, I THINK THE BASE FEE IS LIKE 17.
BECAUSE WE'RE ACTUALLY WAY BETTER THAN 3,500.
WE'RE NOT PAYING FOR OVERNIGHT STAY.
WE'RE NOT PAYING FOR MEALS OR PER DIEM.
WE'RE JUST SITTING OVER THERE.
WHAT THEY DO IS OVER PLAYING PARK.
AND THEY TAKE 'EM THROUGH THE PROCESS THERE.
SO IT, IT IS A, IF, IF THERE'S A COST ASSOCIATED WITH IT, TOTALLY REDUCE A LOT.
AND IS THERE A STIPULATION THAT WE CAN PUT FOR WHENEVER WE DO PAY FOR SOMEBODY TO GET A CDO LICENSE FOR THEM TO STAY FOR AT LEAST A YEAR? WE TYPICALLY, WHAT WE DO IS WHEN WE PUT SOMEBODY THROUGH A TRAINING PROGRAM THAT WE PAY FOR, UH, LIKE OUR PARAMEDICS, POLICE, FIRE MARSHAL, WHOEVER, UH, YEAH.
WE TYPICALLY STRUCTURE A, A PAY WEPAY, 'EM A REPAYMENT, A CONTRACT THAT'S TRIGGERED IF THEY LEAVE BEFORE A THAT TIME PERIOD, DEPENDING ON THE TRAINING THAT WE PROVIDE.
SO, UH, I BELIEVE IF IT'S A PARAMEDIC, IT'S A THREE YEAR COMMITMENT FOLLOWING ON, UM, CHIEF WHEN WE DO THREE THREE ALSO FOR POLICE OFFICERS.
SO IF WE'RE GONNA PAY FOR THAT TRAINING, THE, THE CONTRACT BASICALLY SAYS, LOOK, WE'LL PAY ALL EXPENSES SUCH AS TUITION OF THEIR EMPLOYEES DIRECTLY TO THE WILL PAY THESE EXPENSES FOR CURB REVENUE WILL ALSO BE FINANCIALLY RESPONSIBLE.
ANY DAMAGE CAUSED BY THEIR EMPLOYEE ANY LAKE JACKSON PROPERTY.
WE DON'T HAVE TO WORRY ABOUT THAT THOUGH.
YEAH, BUT NO, UH, AT THE END OF THE, AT THE END OF THE DAY, YEAH, THEY'RE REQUIRED.
ONCE THEY GET THAT TRAINING, WE EXPECT THE TIME PERIOD AFTER THAT THAT THEY WOULD BE STUCK OR NOT.
AND I JUST SLAUGHTERED THAT SENTENCE.
THEY WOULD BE, THEY WOULD REMAIN WITH THE CITY.
WELL I KNOW THAT THERE'S BEEN INSTANCES IN THE PAST WHERE WE HAD SENT OFFICERS TO FBI TRAINING AND THIS AND THAT AND A COUPLE MONTHS LATER THEY'RE GONE.
YOU CAN'T DO NOTHING ABOUT THAT.
I HAVE A, DO I HAVE A MOTION TO APPROVE RESOLUTION 30 DASH 2024.
I WILL MAKE A MOTION MOVE BY COUNCILPERSON MATT, SECONDED BY I'LL SECOND COUNCILMAN LOPEZ.
ANY FURTHER DISCUSSION? HEARING NONE, I'LL ENTERTAIN A VOTE.
NEXT ITEM WOULD BE A RESOLUTION AUTHORIZING THE DENIAL OF CENTER POINT ENERGY'S RATE INCREASE.
AND ON THIS ONE, I THINK I'M JUST GONNA READ THE CAPTION.
YEAH, YOU DON'T NEED TO READ THE WHOLE THING.
WE'VE ALREADY DONE THIS ABOUT THREE TIMES ON.
HOW, HOW OFTEN DO THEY DO THIS? OH, EVERY YEAR.
THIS IS, UH, THIS IS LITTLE, SEEMS LIKE IT'S MORE OFTEN
WELL, YOU GOTTA REMEMBER, SO CENTER POINT ELECTRIC GETS TO DO THIS AND THEN CENTER POINT TRANSMISSION GETS TO DO THIS.
AND CENTER POINT GAS GETS TO DO THIS.
SO WE GET TO DO THIS DANCE THREE OR FOUR TIMES A YEAR.
[00:20:01]
AND SO STAFF OBVIOUSLY RECOMMENDS APPROVAL.IT WILL HAVE A NEGATIVE IMPACT ON OUR RESIDENTS.
UH, I THINK THEY'RE SAYING THAT THEY WOULD BE $17 MILLION FOR RESIDENTIAL SERVICES ON THE TOP OF A $60 MILLION TOTAL ADD-ON.
UM, AND WE KNOW THAT ONCE THEY START TAGGING THOSE FEES ON THERE, THEY NEVER, EVER, EVER GO AWAY.
LIKE THEY TRIPLED MY ELECTRIC, MY BUSINESS ELECTRIC BILL AND THAT ONE OF THOSE, IT WAS ALL CENTER POINTS.
YEAH, THAT WAS, UH, SO WHAT HAPPENED THERE WAS THAT'S THE, THE, UH, WINTER STORM URI RECOVERY BOND PAYMENTS.
I WILL GLADLY MAKE THAT MOTION.
WE HAVE A MOTION BY COUNCIL COUNCILMAN LOPEZ THAT WE APPROVED RESOLUTION 31 DASH 2024.
ANY FURTHER DISCUSSION? ALL IN FAVOR? AYE.
NEXT WOULD BE CONSIDERATION OF POSSIBLE ACTION TO ADOPT RESOLUTION NUMBER 32 DASH 2024.
COMMEND ACCEPTING THE RECOMMENDATION BY THE PLANNING AND ZONING COMMISSION TO APPROVE THE PRELIMINARY RECLA FOR THE PROPERTY LOCATED AT 1 32 COMMERCE AND SETTING A JOINT PUBLIC HEARING DATE FOR APPROVAL OF THE FINAL PLAT WITH A PROPOSED JOINT PUBLIC HEARING DATE.
IT WILL BE RESOLUTION NUMBER 32 DASH 2024.
RESOLUTION CITY COUNCIL OF CITY CL TEXAS APPROVING THE PRELIMINARY RE PLAT OF PROPERTY LOCATED AT 1 32 COMMERCE STREET, KLU, TEXAS, WHERE THE CITY OF KLU THROUGH IT PLANNING AND ZONING COMMISSION AND THE CITY COUNCIL HAS THE AUTHORITY TO REVIEW IT, APPROVE OR DENY PLAS OF RE PLATS OF REAL PROPERTY WITHIN THE CITY LIMIT AND THE EXTRA TERRITORIAL JURISDICTION TO THE CITY.

WHEREAS AFTER DUE CONSIDERATION THE DISCUSSION, THE PLANNING AND ZONING COMMISSION VOTED THE RECOMMENDED APPROVAL OF SAID PRELIMINARY RELA REQUEST FOR THE SETTING OF A JOINT PUBLIC HEARING DATE.
AND WHEREAS THE FLU CITY COUNCIL FINDS ITS REQUEST OF DULY MADE AND CON CONFORMS WITH ALL DEVELOPMENTAL REQUIREMENTS FOR REPLAT.
NOW THEREFORE IT BE RESOLVED BY THE CITY COUNCIL OF CITY, THAT SECTION ONE, THE CITY COUNCIL OF THE CITY INCLUDE, FINDS THAT THE FACTS CITED IN THE PREAMBLE HEREOF ARE TRUE.
SECTION TWO, THE CITY COUNCIL APPROVES A REQUESTED PRELIMINARY REFL OF REAL PROPERTY LOCATED AT 1 32 COMMERCE STREET, TEXAS, WITH A JOINT PUBLIC HEARING DATE OF JULY THE 11TH, 2024 AT 7:00 PM SECTION THREE, EFFECTIVE DATE.
THIS RESOLUTION AND THE RULES, REGULATIONS, PROVISIONS, REQUIREMENTS, ORDERS AND MATTERS ESTABLISHED AND ADOPTED HEREBY SHALL TAKE EFFECT AND BE IN FULL FORCE AND EFFECTIVE ON THE DATE OF PASSAGE.
AND UPON EXECUTION BY THE MAYOR OF THE CITY, SECRETARY, SECRETARY AS SET FORTH BELOW, TRYING TO READ TOO MANY WORDS AT ONE TIME.
SECTION FOUR, PROPER NOTICE AND MEETING IT IS HEREBY FOUND AND DETERMINE THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS ATTENDED BY A QUO OF THE CITY COUNCIL.
IT WAS OPEN TO THE PUBLIC IN THE PUBLIC NOTICE OF THE TIME, PLACE AND PURPOSE OF THAT MEETING WAS GIVEN AS REQUIRED BY THE OPEN MEETINGS AS TEXAS GOVERNMENT CODE CHAPTER 5 5 1 RED PASSES ADOPTED THIS 13TH DAY OF JUNE, 2024 AND BE SIGNED BY MYSELF AND ROAD THE CITY CLERK.
HE'S LOOKING AT A SECOND BUILDING AND OUR GOOD FRIENDS AT CENTER POINT, UH, HE'S GOT THREE AND I'M NOT SURE HOW WE ENDED UP WITH THREE LOTS ON THIS SITE, BUT HE WANTS TO TAKE THREE, CONSIST OUT OF TWO, BUT HE WANTS TO DO SO BECAUSE, UH, HE WAS GONNA BUILD A SECOND BUILDING AND BECAUSE OF ADDRESSING ISSUES, CENTER POINT WANTED TO CHARGE HIM AN ADDITIONAL $70,000 TO ADD THE SECOND BUILDING RATHER THAN GIVE HIM A NEW ADDRESS AND THEN CREATE A NEW ACCOUNT.
ANYWAY, OUR GOOD FRIENDS PARTNERS THERE, UH, HAVE KIND OF ASKED, FORCED HIM INTO DOING THIS.
HE'LL HAVE TWO LOTS, TWO ADDRESSES, TWO DO BUILDINGS ON THE SITE.
UH, BUT, UH, AND THERE'S PLENTY OF SETBACK OTHERWISE HE MEETS ALL THE REQUIREMENTS THAT WE HAVE.
AND STAFF RECOMMENDS APPROVAL OF THE, UH, RESOLUTION.
THOSE THREE LOTS ARE OWNED BY THE SAME PERSON.
IS THAT, THAT, IS THAT SONNY'S THE SONNY'S MECHANIC SHOP? IS THAT WHAT IT'S NEXT, UH, NEXT DOOR TO SONNY'S? OH YEAH.
AND THEN HE BACKS UP TO THE QUONSET HUT AND THE LITTLE BOUTIQUE PLACE THERE.
THE FRONTS ON THE, UH, PLANT PLANT.
THIS IS THE, THIS IS THE TACTICAL STORE? YES SIR.
IT'LL BE ATTACHED TO THE TACO STORE, NOT TO THE OTHER ONE BESIDE IT.
[00:25:01]
HE'S GOT PROPERTY BEHIND, I THINK THE KIND OF WEIRD SHAPE, IF I REMEMBER RIGHT.IT'S GOT A KIND OF A POLY AGONAL.
AND HE'S GOT THE ONE BUILDING WHERE HE IS DOING MANUFACTURING.
THEN THEY'RE GONNA DO, UH, EXPANDER MANUFACTURING FOR CABINETS AND OTHER UH, FURNITURE.
AND HE'D BE HERE TONIGHT JUST TO LET COUNSEL KNOW.
BUT HIS, UH, HAD THAT FAMILY EMERGENCY THAT HE WAS, HAD THAT LEAVE FOR IT'S PRELIMINARY ANYWAYS, RIGHT? YES SIR.
SO WHAT WE'RE GOING, WHAT WE'RE APPROVING IS FOR IT TO BE BROUGHT UP AT THE JULY, RIGHT.
YOU'RE OPINION DISC PRELIMINARY AND THEN IT'LL COME BACK FOR THE JOINT PUBLIC HEARING ON JULY.
THERE WILL BE A PUBLIC HEARING FOR EVERYBODY TO VOICE ANY OPINION THAT THEY MIGHT HAVE.
I'LL MAKE A MOTION TO JULY THE 11TH.
WE HAVE A MOTION BY COUNCIL PERSON, MADDOX, RESOLUTION NUMBER 32 DASH 2024 BE PASSED.
I'LL SECOND SECOND BY COUNCIL LOPEZ, ANY FURTHER COMMENTS, QUESTIONS, HEARING NONE.
ALL, EVERYTHING OPPOSED? ALL IN FAVOR? AYE.
NEXT ITEM WOULD BE CONSIDERATION POSSIBLE ACTION TO APPROVE RESOLUTION NUMBER 33 DASH 24 AUTHORIZING MAYOR TO SIGN GRANT AGREEMENT WITH TEXAS GLO FOR RESILIENT COMMUNITY PROGRAM GRANT.
AND IT WOULD BE RESOLUTION NUMBER 33 20 24 RESOLUTION OF THE CITY COUNCIL OF CITY TEXAS AUTHORIZING AND THE MAYOR TO EXECUTE A GRANT AGREEMENT BETWEEN THE CITY AND THE TEXAS GENERAL LAND OFFICE GLO FOR PARTICIPATING IN THE RESILIENT COMMUNITIES PROGRAM WHERE THE CITY OC INCLUDES PROXIMITY TO COAST, ENSURES A HIGH QUALITY OF LIFE.
IT ALSO ENSURES SIGNIFICANT RISK FROM NATURAL DISASTERS SUCH AS TROPICAL WEATHER, FLOODING, AND OTHER EVENTS.
AND WHEREAS THE CITY HAS APPLIED FOR A GRANT TO BETTER PLAN FOR RESILIENT DEVELOPMENT THROUGH THE TEXAS GLO WHERE THE CITY WAS SUCCESSFUL IN OBTAINING A $250,000 GRANT UNDER THIS PROGRAM TO AID IN PLANNING AND DEVELOPING GUIDELINES FOR DEVELOPMENT THAT WILL ENHANCE THE CITY'S RESILIENCE TO FUTURE THREATS WHERE THE CITY COUNCIL AND CITY BELIEVE PARTICIPATION IN THIS PROGRAM WILL BE OF BENEFIT TO THE HEALTH AND WELFARE, WELFARE CURRENT AND FUTURE RESIDENT.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL CITY CLAY, TEXAS HEREBY AUTHORIZES THE MAYOR'S EXECUTION OF A GRANT AGREEMENT BETWEEN THE CITY AND THE TEXAS GLO FOR PARTICIPATION IN THE BRAZIL COMMUNITY PROGRAM.
ATTACHED HERE TO IS EXHIBIT A PATH AND ADOPTED THIS 13TH DAY OF JUNE, 2024, SIGNED BY MYSELF AND TESTED BY ROAD EMPLOYMENT CITY CLERK.
SO THIS IS AN ANOTHER OUTGROWTH OF THE VILLE CENTER SUCCESS THAT WE'VE HAD.
UH, JLO UH, PUT THIS OUT THERE LAST SUMMER.
AND QUITE HONESTLY, I HAD FORGOTTEN WE'D EVEN APPLIED 'CAUSE IT'S ONE OF THOSE THAT WE DIDN'T HAVE TO PROVIDE MATCH TO.
UH, BUT WE'LL GET $250,000 TO HELP WITH THE PLANNING.
AND BASICALLY IT'S TO HELP US LAY OUT, IMPLEMENT THE LIVING LIVABLE CENTER STUDY, UH, IN A WAY THAT'S GOING TO ENSURE THAT THE LAND USE WE COME UP WITH IS MORE RESILIENT AND MORE SUSTAINABLE, UH, TO FUTURE EVENTS AND CLIENT.
YOU KNOW, WE MAY HAVE FLOODING, WE MAY HAVE THAT KIND OF STUFF.
IT'LL ALSO HELP US DEVELOP DESIGN AND CONSTRUCTION REGULATIONS THAT MIGHT HELP US MITIGATE THAT AS WELL.
HOPEFULLY REDUCING THE NEED FOR FUTURE DETENTION AND RETENTION AND ALLOWING FOR MORE PERMEABLE PAYMENTS, THAT KIND OF STUFF, UH, IN OUR DESIGN REQUIREMENTS.
SO, UH, WE FEEL LIKE IT'S A A GREAT OPPORTUNITY FOR US.
WE CAN MATCH THIS ALSO WITH THE TA GRANT, THE $288,000 TA GRANT THAT WE GOT FROM TDOT.
AND, UH, I GOTTA GIVE KUDOS TO WILL.
HE'S KNOCKING HIM OUTTA THE PARK WITH GRANTS RIGHT NOW, SO.
ONLY THING I'LL SAY IS Y'ALL ARE DOING A GREAT JOB.
I LIKE THE BRINGING IN THE, BRINGING IN MONEY.
AND I'LL SECOND AND SECOND IT BY COUNCIL PERSON.
MADS FURTHER DISCUSSION AGAIN, WE'LL ENTERTAIN A VOTE.
NEXT ITEM IS CONSIDERATION OF POSSIBLE ACTION TO APPROVE RESOLUTION NUMBER 34 DASH 2024 APPROVING POLICIES GOVERNING THE USE OF ARTIFICIAL INTELLIGENCE AND USE OF UNAUTHORIZED SOFTWARE AND HARDWARE IN CITY'S DEVICES.
AND, AND IT WOULD BE RESOLUTION NUMBER 34 DASH 2024.
RESOLUTION OF CITY COUNCIL CITY INCLUDE APPROVING POLICIES FOR THE GOVERNANCE OF ARTIFICIAL INTELLIGENCE AND USE OF UNAUTHORIZED SOFTWARE AND HARDWARE ON THE CITY'S DEVICES AND OR CONNECTED TO THE CITY'S NETWORK.
WHEREAS THE CITY OF CLUE UNDERSTANDS THE PACE OF INNOVATION AND INFORMATION TECHNOLOGY IS
[00:30:01]
ALWAYS INCREASING, WHEREAS THE CITY WISHES TO ENSURE THAT OUR CURRENT FUTURE EMPLOYEES UNDERSTAND THAT THE IMPORTANCE OF RESPONSIBILITY UTILIZING TECH TECHNOLOGY, INCLUDING ARTIFICIAL INTELLIGENCE AND THE SECURITY OF THE CITY WET NETWORK.AND WHEREAS THE CITY INCLUDE, UNDERSTANDS THE POLICIES OR LIVING DOCUMENTS THAT MUST BE UPDATED FROM TIME TO TIME TO DEAL WITH CHANGES IN CULTURE, TECHNOLOGY OF SOCIETY.
AND WHEREAS THE CITY COUNCIL CITY INCLUDE BELIEVES THAT THE ATTACHED POLICIES ARE A GOOD START IN PROVIDING GUIDANCE TO OUR STAFF ON THE RESPONSIBLE USE OF AI, WHILE ALSO PROTECTING OUR EQUIPMENT AND NETWORK, THEREFORE BEING RESOLVED THAT CITY COUNCIL CITY INCLUDE TEXAS HEREBY APPROVES AND ADOPTS THE POLICIES RELATED TO THE USE OF ARTIFICIAL INTELLIGENCE AND UNAUTHORIZED USE OF SOFTWARE AND HARDWARE ON CITY ISSUED DEVICES, AND ARE CONNECTING TO THE CITY'S NETWORK ATTACHED HERE TO IN TODAY PASSED AND ADOPTED THE 13TH DAY OF JUNE, 2024, APPROVED BY MYSELF TO
SO WE HAVE, UH, THIS IS KIND OF A TWOFOLD POLICY THAT WE'RE LOOKING TO ADD AT THAT PERSONNEL HANDBOOK.
WE'VE BEEN TRAINING, UH, SEVERAL STAFF HAVE BEEN ATTENDING TRAINING THROUGH BC ON AI.
I I'VE ACTUALLY STARTED USING AI.
UH, BUT IT'S A DOUBLE-EDGED SWORD BECAUSE IT CAN BE GAMED IN WAYS THAT AREN'T APPROPRIATE, ETHICAL OR RESPONSIBLE.
UH, WE'RE ALSO WORKING ON AN INTERNAL AI, WHICH AT ONE POINT WE HOPE TO LAUNCH ON THE WEBSITE THAT WOULD HELP BASICALLY ANSWER QUESTIONS AS THEY COME UP THROUGH THE WEBSITE AS OPPOSED TO SOMEBODY HAVING TO PICK UP THE PHONE NECESSARILY, UH, AND MAKE THE CALL.
SO THERE, IT'S A GREAT TOOL, BUT IT NEEDS TO BE USED APPROPRIATELY.
UH, IN TANDEM WITH OUR USE OF AI
UH, WE HAD A RUN IN WITH A, UH, A STAFF THAT WAS USING A PIECE OF TECHNOLOGY THAT COULD HAVE HACKED THE ENTIRE NETWORK.
UH, COULD HAVE BEEN USED TO ACCESS AREAS OF THE CITY THAT DID NEED TO BE ACCESSED AND COULD HAVE DUPLICATED ANYBODY'S CARD KEYS.
UM, AND SO, UH, WE DON'T, DID NOT HAVE A, WELL, WE HAVE A TECHNOLOGY USE POLICY IN THE PERSONAL HANDBOOK.
IT DOESN'T REALLY GET INTO SOME OF THE THINGS, SOME OF THE, UH, SPECIFICS THAT THESE TWO POLICIES DO.
AND LANDON AND ANGEL WORKED ON THESE FOR ABOUT THREE WEEKS, MODELED ON BEST PRACTICES FROM OTHER CITIES.
AND SO STAFF RECOMMENDS APPROVE, UH, APPROVAL OF THE POLICIES MOVING FORWARD.
AND AGAIN, SHE SAYS IT'S A WORKING DOCUMENT, CORRECT.
YEAH, BECAUSE IT MIGHT BE DIFFERENT NEXT WEEK.
IT PROBABLY, I WAS GONNA SAY THIS IS PROBABLY ALREADY OUTDATED.
SO RIGHT NOW, IS THERE LIKE AN AI SOFTWARE THAT CITY EMPLOYEES USE? YES.
SO WE'VE UH, WE'VE UH, WE'VE GOT, UH, A SUBSCRIPTION TO CHAT GPT-4.
UH, I'VE USED THAT, UH, WITH, UH, WITH WALLY, UH, FOR ACTUALLY THE PRESENTATION YOU GUYS WILL SEE ON THE 13TH OF JULY.
WE'LL INTEGRATE A LOT OF THAT.
UM, WE USE COPILOT FROM MICROSOFT AND ACCOUNTING.
UH, IT'S ONE OF THE ONLY AI TOOLS THAT REALLY WORKS WELL WITH NUMBERS AND WITH SPREADSHEETS.
SO IT'S REALLY HELPED, UH, WITH HELPED QUERY QUITE A BIT.
UH, MOST OF OUR JOB DESCRIPTIONS NOW ARE DONE THAT, AND THEN WE'VE JUST TODAY THEY WENT AND LEARNED HOW TO USE MATRIX, UH, THROUGH CHAT GPT, WHICH WILL HELP US ID WHEN WE HAVE SOMEBODY, WE HAD A, A CANDIDATE THAT ACTUALLY USED AI TO ANSWER
AND SO, UH, WE WOULD, USING THIS MATRIX TOOL THAT'S JUST BEEN DEVELOPED, WE CAN ACTUALLY FIGURE OUT PRETTY QUICKLY WITH ABOUT 85% ACCURACY THAT IT'S ENTIRELY AI OR HOW MUCH HUMAN INPUT WAS DONE.
AND SO NOW IT'S JUST PLAGIARISM WITH AI
IT'S JUST, YOU KNOW, AND THE CRAZY THING IS, IS, UM, I WAS READING AN ARTICLE AT LUNCH, UH, THERE'S A THEORY NOW THAT EVERYBODY TALKS ABOUT WHEN IS IT GONNA PASS CERTAIN BENCHMARKS, LIKE THE ABILITY TO WRITE TRUE PROSAIC POETRY AND IIC, TIM PATTERN, IIC, WHATEVER IT WAS THAT WE ALL HAD TO STUDY IN HIGH SCHOOL THE WAY THAT SHAKESPEARE WROTE AND UH, 'CAUSE IT'S VERY, VERY DIFFICULT IN ARCANE.
AND UH, THE PROJECTION IS NOW 2026.
YOU CAN ALREADY WRITE, LIKE, I'VE GOT A POEM THAT WILL HAD IT GENERATE FOR THE MOSQUITO FESTIVAL, UM, THAT WE'LL BE SHARING SHORTLY AS WELL.
UH, WE, LANDON WROTE AN ENTIRE, UH, CHRISTMAS ALBUM, UH, THAT HE CAN PLAY FOR YOU AT SOME POINT, UH, USING AI.
AND WITH REALISTIC VOICES, IT SOUNDS LIKE DOLLY PARTON SINGING IT'S SNOWING IN HOUSTON.
THAT'S THE CRAZIEST THING YOU'VE EVER HEARD.
UM, SO, BUT WE WANNA MAKE SURE THAT WE'RE ETHICAL WITH IT BECAUSE EVERYTHING THAT DOES COME OUT OF IT, IT'S A TRUE RIPPLE EFFECT BECAUSE IT GOES BACK INTO THEIR LARGE LANGUAGE MODEL.
AND SO WE WANNA MAKE SURE WE'RE DOING THAT ETHICALLY SO WELL IF SOMEBODY, SOMEBODY DOES SOMETHING ON IT, ON THE CITY, DOES SOMETHING WITH IT ON THE CITY COMPUTER THAT IS
[00:35:01]
UNETHICAL, THAT WE'RE ALL LIABLE.SO I GUESS NOW WE'RE LOOKING FOR SPELLING MISTAKES, GRAMMAR ERRORS AND STUFF ON RESUMES, JUST TO KNOW THAT IT WAS A HUMAN THAT WROTE IT.
THAT'S EXACTLY
AND SO I ALWAYS GO BACK AND STRIP 'EM OUT AND THEN IT FIGHTS WITH ME.
AREN'T YOU SUPPOSED TO
I'M NOT, I'M NOT AN OXFORD COMMA GUY, SO HECK, HE WAS SPELLCHECK THAT, SO YEAH, I WAS GONNA SAY SPELLCHECK TRIES TO JACK WITH ME AS WELL.
I WAS TRYING TO FIGURE OUT IN THAT LAST ONE WHAT I GOTTEN WRONG.
'CAUSE IT HAD THE BLUE UNDERLINES, BUT IT DOESN'T LIKE WHEN I CAPITALIZED CITY.
SO I KNOW THERE'S LIKE A, LIKE FOR EXAMPLE, A COMPANY THAT I WORK FOR, UM, THEY DO LIKE TRAININGS ON LIKE, UH, BEING SECURE WITH LIKE AI MM-HMM.
I MEAN THERE'S OTHER COMPANIES THAT DO THAT TOO.
YOU KNOW, 'CAUSE IT, IT SOME DO POSE A RISK OF LIKE, UH, SECURITY PURPOSES.
IS THERE'S EVERYTHING WE DO, UH, WE HAVE THE AI THAT WE'RE BUILDING INTERNALLY IS ON ITS OWN SEPARATE AIR GAP SERVER.
SO IT'S NOT TIED TO THE NETWORK ANYWHERE YET.
UH, LANDON IS FEEDING IT DATA.
AND THEN WHAT WE USE IS PROPRIETARY AI THROUGH A SUBSCRIPTION, UH, WITH UH, CHAT GPT AND WITH MICROSOFT.
SO WE FEEL PRETTY GOOD ABOUT THE SECURITY THERE BECAUSE IT'S NOT, UH, BECAUSE WE'RE GOVERNMENT ENTITY, IT DOESN'T HANG ONTO OUR MATERIAL LIKE IT DOES.
LIKE IF NICOLE, YOU WANTED TO GO HOME AND WRITE RECIPE, A RECIPE BOOK AND JUST ASK TO DEGENERATE IT, IT KEEPS ALL THAT DATA.
CHE GBT FOUR OH WILL NOT KEEP THAT DATA.
MICROSOFT DOES, BUT IT WILL LET US KNOW IF IT'S GOING TO USE OUR DATA FOR SOMETHING ELSE.
SO, AND AS FAR AS THIS, UH, SECOND ONE THAT YOU'RE WRITING FOR THE UNAUTHORIZED SOFTWARE AND HARDWARE.
DO YOU GUYS, DOES THE CITY, DO WE, I GUESS NOT YOU GUYS DO WE AS A CITY HAVE LIKE A, UH, WHERE WE DO LIKE FISHING YEAH.
AND SO YOU'LL, IF YOU'LL RECALL, EVERY YEAR YOU GET A CHECKLIST OR A TEST FROM ANGEL AND EVERY ONCE IN A WHILE, IF YOU SHOULD GIVE ONE EVERY YEAR RIGHT NOW.
AND I, I WILL TELL YOU THAT I GET, I FELL FOR ONE FROM LANDON THE OTHER DAY, SO, UH OKAY.
BUT HE DOES SEND OUT YEAH, HE'S PHISHING EMAILS AND THINGS LIKE THAT AND HE JUST COMPLETED A, A IT OR, WELL, HE STARTED IN FOR INFORMATION SECURITY MEETING THIS MORNING, BUT THEN HE PULLED OUT OF IT 'CAUSE IT WAS NOT WHAT HE THOUGHT IT WAS.
BUT YEAH, WE, WE TRY AND STAY ON TOP OF THAT.
UH, THAT'S WHY IF YOU'LL NOTICE WHEN I ATTACH A DOCUMENT, I'LL PUT PARENTHESES SAFE IN ALL CAPS BECAUSE WE'VE FOUND THAT WORMS DON'T REALLY DO THAT WHEN THEY'RE TRYING TO GET INTO YOUR INFORMATION.
SO CJ AND LAND GET EMAILS FROM ME PRETTY REGULARLY ABOUT, I GOT ONE FROM YOU AND, BUT YOU WEREN'T ACTING RIGHT.
I'M LIKE, SOMETHING WRONG WITH THIS.
WELL, THEY, THEY GET EMAILS FROM ME QUITE OFTEN FOR PEOPLE TRYING TO SEND ME INVOICES.
I GET, I GET INVOICES ABOUT YOU DON'T WANT MAKE, THEY'VE KIND OF, THEY'VE KIND OF SLOWED OFF IN THE LAST MONTH OR TWO, BUT I WAS GETTING TWO OR THREE A MONTH.
SO HE'S CRANKED THE FIL THE INTERNAL FILTER ON OUR EMAIL SERVER TO RECOGNIZE IT BECAUSE LIKE IF YOU GET ONE THAT ENDS IN AN IO OR AN AI OR AN IT OR SOMETHING LIKE THAT, WE KNOW IT'S PROBABLY NOT LEGIT.
SO IT'S AUTOMATICALLY WASHING THOSE OUT.
WELL, I'LL MAKE A MOTION THAT WE PUT THIS INTO PLAY.
WE HAVE A MOTION BY COUNCILMAN COUNCILPERSON MADDOX THAT WE ADOPT RESOLUTION NUMBER 34 DASH 2024.
AND SECONDED BY, I'LL SECOND THAT.
LIKE I SAID, THIS, THIS IS GONNA BE AN EVERGREEN DOCUMENT 'CAUSE IT'S GONNA CHANGE ALL THE TIME.
EVERY TIME SOMEBODY FIGURES OUT SOMETHING NEW IS WE'RE GONNA HAVE TO GO BACK AND ADJUST FOR IT.
DID WE USE AI TO WRITE THE POLICY? UH, ACTUALLY SOME OF IT WAS, WAS
HAVE A MOTION OF A SECOND PENDING.
