AND THE NEXT ITEM WOULD BE TO NOTE THE PUBLISHER'S AFFIDAVIT.
[00:05:01]
OF THIS MEETING WAS PUBLISHED IN THE BPORT FACTS ON THE 27TH DAY OF AUGUST, 2024.PER THE AFFIDAVIT OF PUBLICATION NOTE, THE LIST OF PROPERTY OWNERS NOTIFIED BY MAIL.
THERE WERE 19 NOTICES MAILED OUT, NONE WERE RETURNED, SO WE'RE PRESUMING THEY WERE ALL DELIVERED.
THEN THE NEXT ITEM WOULD BE PUBLIC COMMENTS.
AND IT'S ON FOR A VARIANCE TO ALLOW A PROPOSED USE FOR THE BUILDING CONSTRUCTION OF TWO HOMES ON NONCONFORMING LOTS OR PROPERTY LOCATED AT 7 21 TRACK RIDGE ROAD, LEGALLY DESCRIBED AS LAKEWOOD PARK, A 0 0 6 6 J GROVE BLOCK.
A LOT, TWO THREE TEXAS, SOMETHING DON'T MATCH.
THE OTHERS HAVE PORTRAIT ENCROACHMENT.
IS IT A PORCH OR TWO HOUSES BEING BUILT? IT'S A PORCH.
UH, THIS IS A, UH, ITEM ONE UNDER B.
THERE IS, IS NOT, IS NOT CORRECT.
I JUST NOTICED IT JUST A LITTLE BIT AGO WHEN I COME IN HERE.
BUT NUMBER, NUMBER D IS, SO THE D SECTION IS CORRECT.
SO THE PORTION THAT WE READ IN THE VERY FIRST WERE PORCH ENCROACHMENT INTO THE SETBACK REQUIREMENT.
THAT'S WHAT WE'RE HERE, THAT'S WHAT WE'RE HERE TO DISCUSS THE VARIANCE ON.
SO OUT OF B NEEDS TO BE CORRECTED ON THE, ON THE AGENDA.
WE'RE OPEN FOR PUBLIC COMMENT.
IS THE HOMEOWNER HERE? I DON'T, YES SIR.
PLEASE, PLEASE TELL US YOUR NAME AND, AND MY, MY NAME IS RICHARD BROWN AND I, I'VE LIVED AT STRATTON RIDGE 7 21 STRATTON RIDGE ROAD FOR 31 YEARS.
AND MY 77-YEAR-OLD WIFE HAS ALWAYS WANTED A SCREENED IN PORCH WHERE SHE COULD SIT PROTECTED FROM MOSQUITOES IN THE SUN.
AND THIS YEAR SHE DECIDED SHE WAS GONNA DO IT AND SHE CONTACTED SOMEONE THAT'S DONE WORK FOR HER IN THE PAST AND THEY CAME UP WITH THE PRICE AND ALL THE MATERIALS NEEDED AND SHE, SHE GOT 'EM THE MATERIALS AND PAID THEM THE MONEY AND THEY STARTED THE WORK.
SHE DIDN'T KNOW ANYTHING ABOUT A PERMITTING PROCESS.
AND APPARENTLY THE CONTRACTOR DIDN'T DO ANYTHING ABOUT PERMITTING IT.
IT WAS ABOUT FIVE TO FIVE HOURS, SIX HOURS FROM COMPLETION.
AND THE CITY INSPECTOR SHOWED UP AND SHUT IT DOWN, WHICH I, I HAVE NO PROBLEM AT ALL WITH THAT.
BUT THERE'S, FIRST OF ALL, IT'S, I'VE LIVED THERE FOR 31 YEARS AND IN 31 YEARS THERE'S NEVER EVER BEEN A REASON FOR THE CITY OF CLU TO DO ANY BUSINESS IN MY YARD, EVER.
THIS PORCH WOULD NEVER HAVE INTERFERED WITH ANYTHING IN 31 YEARS.
THE DISTANCE FROM THE FRONT OF THE PORCH, I GAVE THEM A THIS IS WHAT YOU WERE LOOKING AT? YES, I HAVE IT RIGHT.
THAT WAS FROM ME, BUT I'VE GOT MY NUMBERS TOO.
THE FRONT OF THE PORCH IS, UH, 35 FEET TO THE EDGE OF THE ROAD.
AND I'VE TAKEN SOME PICTURES OF HOUSES RIGHT DOWN THE ROAD FROM MY HOUSE, AND I DON'T UNDERSTAND THE DIFFERENCE.
'CAUSE THEY'RE WAY CLOSER TO THE ROAD THAN, THAN THE FRONT OF MY PORCH IS.
AND I JUST, I DON'T UNDERSTAND WHETHER THERE COULD BE ANY PROBLEM FOR THE CITY OF CTH WITH THIS COURT.
AND I'M JUST ASKING YOU TO GRANT THE VARIANCE SO SHE CAN HAVE HER COURT.
ON THE PLA WE HAVE A MEASUREMENT OF 26 FOOT AND SIX INCHES FROM THE PROPERTY LINE TO THE FRONT OF THE HOUSE.
AND WHAT'S THE SETBACK? SETBACK IS 25 FEET.
AND WE HAVE HOW MUCH? 26, SIR, WE HAVE TO HAVE 26.
WHAT'S THE, WHAT'S THE MEASUREMENT FROM THE PROPERTY LINE? JERRY? I'M SORRY.
OUR SETBACK IS 25 FEET SAYING FROM THE PROPERTY LINE TO THE FRONT OF THE HOUSE IS 26 6, THE SETBACK IS 25 FEET.
DOES ALL OF IT FALL UNDERNEATH IT? NO, SIR.
IT GOES KIND OF ON A SKEW, BUT ACCORDING TO THIS LAYOUT DRAWING,
[00:10:01]
THAT'S 26 FOOT SET, CUT AND DRY.SO IT'S ONLY, THEY'RE ONLY OFF BY A LITTLE OVER A FOOT? NO, SIR.
THEY, THEY WOULD ENCROACH, THEY CAN BUILD AN 18 INCH PORCH OH, BEFORE THEY HIT THE LANE.
IT'S VERY SIMILAR TO THE CASE WE HAD ON EAST KYLE RIGHT BEFORE LAST.
SO HOW BIG OF A PORCH WERE Y'ALL BUILDING? 10, UH, UH, 10 FOOT, 10 FOOT OUT.
16 FOOT 11 WIDE WIDTH, UH, SET UP, UP DOWN THERE RIGHT NOW.
THAT'S THE, THAT'S THE NEW ONE? YES, SIR.
YOU CURRENTLY DID, THERE'S NO FRONT PORCH ON THE FRONT OF THE HOUSE, CORRECT? NO.
ONLY THING YOU HAVE IS A SIDEWALK.
THIS IS GOING UP TO THE SMALL, SMALL STEP, RIGHT? YES, SIR.
IS THIS YOUR HOUSE IN THE CORNER THERE ACCORDING TO THIS PICTURE? YEAH.
I GOT A PICTURE I CAN SHOW YOU.
YEAH, IT'S KIND OF WHAT, DO WE HAVE A BETTER VISUAL OF IT OR? THAT'D PROBABLY BE AS AS GOOD AS YOU'RE GONNA GET BECAUSE OF THE RO IN FRONT OF THE HOUSE.
WHERE BARBER DRIVE AND STRATTON RIDGE COMING HERE? YES, SIR.
YOU CAN'T EVEN TELL WHERE THE PORCH IS? I THINK SO.
I THINK IT'S THAT RIGHT THERE.
HOW FAR BACK IS THE SET? HOW FAR IS THE SETBACK THERE? 25 FEET.
SO THE HOUSE WAS BUILT ALMOST ON THE LINE.
BUT THIS HOUSE WAS BUILT WHEN BACK? IT WAS, YES.
THIS HOUSE WAS BUILT PRIOR TO IT TO ANNEXATION INTO THE CITY.
I BELIEVE IT WAS PART OF THE LAKE BARBER AT THE TIME AND WAS ANNEXED IN LATER IN THE FIFTIES.
IT WASN'T IN THE CITY LIMITS WHEN IT THEY GOT IT.
I WROTE 52 HERE AND IT WAS THE SECOND HOUSE BUILT OUT THERE.
THERE WAS ONE ACROSS THE STREET ON BARBARA STREET THAT WAS BUILT BEFORE MINE.
AND, BUT I'VE ONLY OWNED IT FOR 31 YEARS.
MR. BROWN, WHAT'S, WHAT'S LEFT ON, ON IT TO BE COMPLETED, COMPOSED, SIR.
WHAT, WHAT'S LEFT ON IT TO BE COMPLETED? THE PUTTING THE DOOR IN, PUTTING THE SCREENS AND PUTTING THE ROOF ON.
THERE WAS NO PROBLEM WITH THE CONSTRUCTION.
LET'S SEE, I THINK IT WAS MAYBE FIVE HOURS FROM BEING COMPLETED AND
IT IS GOING TO BE A REALLY BIG JOB AND A BUNCH MORE MONEY.
AND YOU SAID YOU WERE, THE HOUSE WAS THERE BEFORE WE ANNEXED IT.
WHICH IS WHY THEY ONLY HAVE THAT CLEARANCE.
RIGHT? I'M THE FIRST STICKLER AGAINST GIVING VARI VARIANCES.
I'LL, I'LL TELL YOU THAT STRAIGHT OUT BECAUSE IT SETS A TONE.
I DON'T THINK YOU FALL UNDERNEATH ANY OF THAT PERSONALLY BEING THERE BEFORE THE CITY ANNEXED IT.
I UNDERSTAND HE, YOU INHERITED THE SETBACK WHEN WE INHERITED YOUR PROPERTY PER SE.
I DON'T KNOW ABOUT THE NO PERMIT THING BEFORE IT HAPPENED.
OBVIOUSLY THAT CAN TURN, THAT'S A SEPARATE ISSUE.
OR IS IT WE NEVER ISSUED A PERMIT AFTER I SAW THAT ALREADY BEING BUILT WITHOUT IT.
I DIDN'T WANNA GO THERE UP UNTIL LONG AND I'M CERTAIN TO FINISH IT, THE PERMIT WILL HAVE TO BE APPLIED FOR.
WELL, CAN WE ANSWER ANY OF THESE QUESTIONS? PROVE SHEET? I MEAN, IT DOESN'T, IT'S REALLY UP TO US.
MR. WHERE WAS THAT CHEAT SHEET YOU HAD, RIGHT? YEAH, THEY'RE ON THE FRONT.
THE, UH, MR. DUNCAN, DO YOU WANNA WALK 'EM THROUGH THE, UH, CHEAT SHEET? I THINK I HAVE THE CHEAT SHEET.
THIS IS, WE DON'T HAVE TURN THAT IN OR ANYTHING.
MR. BROWN, YOU THE, THE ONLY REASON WHY IT'S DIFFICULT FOR US TO APPROVE ANY VARIANCE IS BECAUSE IT GOES OUTSIDE OF THE, THE ORDINANCES OF THE CITY.
[00:15:01]
ONE OF THE ISSUES THAT THIS COUNCIL HAS PRESENTED WHEN TRYING TO ISSUE VARIANCES IS IF WE ISSUE ONE, THEN EVERYONE WILL FOLLOW.AND THEN, YOU KNOW, WHAT ARE THE ORDINANCES FOR? I DO, I DO THINK THAT THIS IS A UNIQUE SITUATION.
UM, BUT THAT'LL BE FOR THE REST OF THE COUNCIL MEMBERS TO DECIDE AS WELL.
WELL, I PERSONALLY CAN COME UP WITH A YES FOR ALL THREE CAN.
AND THAT'S NORMALLY UNUSUAL FOR ME IF A QUALIFYING HARDSHIP TO ME IS A UNIQUE CONDITION DUE TO THE FACT THAT HE WASN'T IN THE CITY WHEN THE HOUSE WAS.
BACK HEAR ME? NO, Y'ALL HAVE AN OPINION ON THAT.
I MEAN, I THINK THIS IS ONE OF THE REASONS WHY WE SHOULD HAVE A VARIANCE, LIKE, AND BE ABLE TO GRANT THEM.
I GUESS THE ONLY QUESTION WOULD BE, IS THERE A REASONABLE USE DEPRIVED? WELL, I CAN TELL YOU THIS MUCH.
I'VE GOT MY HORSES RIGHT DOWN THERE BEHIND THEIR HOUSE, AND THERE'S ENOUGH MOSQUITOES DOWN THERE RIGHT NOW TO CARRY HORSES OFF
SO THEY NEED TO, THEY NEED TO SCREEN IN PORTS THEN TO SURVIVE.
OH, THERE'S A, THERE'S A WOODS ACROSS THE STREET THAT IS SWAMPED.
WE HAVE BAD MOSQUITOES DOWN THERE AND THE CITY DOES A GOOD JOB OF SPRAYING THEM OR SOMEBODY DOES.
WE HAVE THE, WE HAVE AN AGREEMENT WITH THEM, I GUESS.
WELL, I MEAN, TECHNICALLY CORRECT ME IF I'M WRONG, BUT TECHNICALLY THE REASON FOR IT, FOR SETBACKS, A LOT OF IT IS FOR SAFETY REASONS AS FAR AS FIREFIGHTERS, UH, OBSTRUCTING VIEW, THAT KIND OF STUFF.
THE PRIMARY, PRIMARY PURPOSE FOR A BUILDING SETBACK IS TO ALLOW FOR CLEAR SIGHT LINES.
LOOKING AT, LOOKING AT, LOOKING AT THIS PICTURE.
I DON'T KNOW HOW YOU EVER SAW THE PORCH
I MEAN WE'VE GOTTEN FROM THE GUS HEDGES GROWN ALL ALONG THE FRONT AND ALL ALONG THE SIDE.
I DON'T KNOW HOW WE EVER SAW IT.
FOR WHAT IT'S WORTH, UH, I MAKE A MOTION THAT WE OFFER YOU THE VARIANCE DUE TO THE CIRCUMSTANCES YOU'VE GOTTEN, NOT DEPRIVE YOU OF THE USE OF THE PROPERTY THAT YOU HAVE.
I, I REALLY APPRECIATE THAT, SIR.
I HAVE A MOTION BY COUNCILMAN CRISP AND A SECOND BY COUNCIL PERSON BOND TO GRANT THE VARIANCE.
DID I DO THAT RIGHT? ARE WE GOOD? I YES, I BELIEVE SO.
I'M JUST NO, I JUST, I DIDN'T KNOW WE WERE BOTH THE HEARING.
WE HADN'T CLOSED THE PUBLIC HEARING.
NO, WE'RE STILL, WE GOT AHEAD OF MYSELF.
WELL, I THINK WELL ISN'T THE FIRST STEP TO SEE IF THERE'S ANYBODY AGAINST IT.
WE DO NEED TO ASK IF THERE'S ANYBODY HERE TO SPEAK AGAINST YOU.
I MEAN, CAN WE SPEAK, I MEAN, IT'S NOT, I MEAN, IT'S PUBLIC COMMENT.
IT DOESN'T SAY FOR OR AGAINST.
I MEAN, IS THERE ANYONE ELSE IN COUNCIL CHAMBERS THAT WOULD LIKE TO HAVE A CHANCE TO COMMENT ON THIS SUBJECT IN REGARD IN FAVOR OR AGAINST? OKAY, THAT BEING SAID, WE WILL CLOSE THE PUBLIC COMMENT SECTION AND WE WILL MOVE TO ACTION ITEMS. AND WE HAVE A MOTION BY COUNCILMAN CRISP THAT THE VARIANCE BE GRANTED AND A SECOND BY COUNCILPERSON BOND.
ANY FURTHER DISCUSSION AT THIS TIME? I'LL ENTERTAIN THE VOTE.
A I STATE FOUR, FOUR OR ONE ABTA.
AND I'M ASSUMING NOW HE'LL NEED TO GET THE PERMIT.
HE TO GET A PERMIT AND HAVE IT INSPECTED.
GOT EVERYTHING MR. BROWN, MR. BROWN, MR. BROWN, THAT'S STILL TELLS YOU TO GET THE PERMIT.
NOW YOU'LL NEED TO GO THROUGH THE PERMITTING PROCESS WITH MR. HAYSLIP
[00:20:01]
AND SCHEDULE THE INSPECTION AND YOU SHOULD BE GOOD TO GO.THEN THE NEXT ITEM WOULD BE TO ADJOURN THE PUBLIC
[III. ACTION ITEMS]
HEARING.AND, UH, WE WILL ADJOURN THAT AND MOVE INTO OUR ACTION ITEMS. AND THE FIRST ACTION ITEM IS PROCLAMATION.
RECOGNIZING AN HONOR AND HISPANIC HERITAGE MONTH, SEPTEMBER THE 15TH TO OCTOBER 15TH, 2024.
AND IT WOULD BE STUDIO PLU PROCLAMATION.
WHEREAS EACH YEAR, THE FEDERAL, STATE, LOCAL GOVERNMENTS OBSERVE HISPANIC HERITAGE MONTH FROM SEPTEMBER THE 15TH TO OCTOBER 15TH BY RECOGNIZING AND CELEBRATING THE HISTORIES, CULTURES, AND CONTRIBUTIONS OF AMERICAN SISTERS WHOSE ANCESTORS CAME FROM SPAIN, MEXICO, THE CARIBBEAN, AND CENTRAL AND SOUTH AMERICA.
AND WHEREAS SEPTEMBER 15TH IS SIGNIFICANT AS A STARTING DATE FOR LATINO HERITAGE MONTH BECAUSE IT IS THE ANNIVERSARY OF THE INDEPENDENCE OF THE LATIN AMERICAN COUNTRIES OF COSTA RICA, EL SALVADOR, GUATEMALA, HONDURAS, AND NICARAGUA AND MEXICO ON SEPTEMBER THE 16TH AND CHILE ON SEPTEMBER THE 18TH.
THEY ALSO INCLUDE HOLIDAYS THAT RECOGNIZE HISPANIC CONTRIBUTIONS SUCH AS VIRGIN ISLANDS, PUERTO RICO, FRIENDSHIP DAY THAT ARE CELEBRATED IN THE US VIRGIN ISLANDS.
AND WHEREAS HISPANIC AND LATINOS HAVE AND CONTINUE TO SERVE AS EDUCATORS, PUBLIC SERVICE, BUSINESS OWNERS, ARTISTS, COLLEAGUES, FRIENDS, AND MUCH MORE IN OUR COMMUNITY AND ACROSS THE WORLD.
AND THEIR VALUES, SERVICE TO OTHERS, RESPECT FOR LIFE AND THE ENVIRONMENT AND CELEBRATING COMMUNITY ARE ALSO AMERICA'S VALUES.
AND WHEREAS HISPANICS AND LATINOS CONTINUE TO ENRICH OUR NATION'S CHARACTER, SHAPE OUR COMMON FUTURE, AND AFFIRM THE NARRATIVE OF AMERICAN UNITY IN PROGRESS.
AND WHERE THEN DURING NATIONAL HISPANIC HERITAGE MONTH, WE CELEBRATE HISPANIC CULTURE.
HONOR THE INVALUABLE WAYS HISPANICS CON CON CONTRIBUTE TO OUR COMMON GOALS AND WORK TOWARD A STRONGER, MORE INCLUSIVE, MORE PROSPEROUS SOCIETY FOR ALL.
NOW THEREFORE, OUR CALVIN SHIP DO HEREBY PROCLAIM SEPTEMBER THE 15TH, 2024 THROUGH OCTOBER 15TH, 2024 AS HISPANIC HERITAGE MONTH, AND ENCOURAGE ALL CITIZENS TO RECOGNIZE THE SIGNIFICANCE OF HISPANIC HERITAGE AND HISTORY IN OUR NATION AND OUR CITY.
THE WITNESS WHERE I HERE WITNESS WHERE I HAVE HERE UN TWO SET MY HAND AND CAUSE THE SEAL OF THE CITY OF CL TO BE AFFIXED THE 12TH DAY OF SEPTEMBER, 2024.
AND IT'D BE SIGNED BY MYSELF AND IT TESTIFIED BY ROSIE CORNER, IT CITY CLERK.
DO WE HAVE, WE HAVE, UH, I THINK IT WAS JUST MS. SILVAS WITH, UH, LULAC.
I DON'T THINK THERE'S ANYONE HERE FROM THE CHAMBER PHOTO OP.
ERIC, YOU SHOULD, YOU SHOULD GO DOWN.
YOU SHOULD ASK OUR NEXT ITEM WILL BE CONSIDERATION OF POSSIBLE ACTION TO APPROVE THE USE OF STRATTON RIDGE PARK FOR THE BRASSWOOD 2024 BONFIRE.
SEEMS LIKE WE HAVE SOME REPRESENTATIVE PRESENT.
UH, SPEAK WITH US MAYOR AND COUNSEL.
WE'VE GOT A FEW REPRESENTATIVES HERE FROM RAPORT HIGH SCHOOL.
TO ADDRESS Y'ALL IN GOOD EVENING.
MY NAME IS AVERY EO AND I AM THE SENIOR CLASS PRESIDENT AT BRAZEL FORD HIGH SCHOOL.
I'M THE VICE PRESIDENT OF THE SENIOR CLASS.
[00:25:03]
GOOD EVENING.I'M MCKINLEY BLANK AND I AM THE STUDENT BODY VICE PRESIDENT.
SO TODAY WE ARE JUST GOING TO WALK YOU THROUGH OUR PLAN OF ACTION.
WE WOULD LIKE TO THANK ON BEHALF OF BRASSWOOD STUDENT COUNCIL IN GENERAL.
WE WOULD LOVE TO, I'D LIKE TO THANK Y'ALL FOR HAVING US AND FOR CONSIDERING US AND OUR BONFIRE AT STRATTON RIDGE PARK.
OUR STUDENT BODY IS VERY, VERY EXCITED FOR THE BONFIRE THIS YEAR, ESPECIALLY FOLLOWING LAST YEAR'S BURN BAN.
UM, WE'VE SEEN AN INCREDIBLE RISE OF SCHOOL SPIRIT, UM, FOR THIS BONFIRE THIS YEAR.
AND WE WOULD LIKE TO THANK YOU FOR YOUR CONSIDERATION.
SO JUST TO KIND OF GO OFF OF WHAT SHE SAID ABOUT THE, UH, STUDENT SPIRIT, WE HAVE BEEN COLLECTING PALLETS EVER SINCE MAY OF LAST YEAR.
UM, WE HAVE HAVE HAD A LOT OF STUDENTS HELP OUT WITH THEIR PARENTS, THEIR THEMSELVES, WITH TRUCKS, WITH DONATIONS, WITH EVERYTHING.
UH, STUDENTS HAVE BEEN, UM, DRAWING ON BOARDS AND DOING DESIGNS TO PUT ONTO THE BONFIRE.
SO EVERYONE HAS BEEN REALLY, REALLY EXCITED.
UM, SO AGAIN FOLLOWING WITH THE BURN BAND LAST YEAR.
UM, EVERYONE IS VERY GIDDY TO DO IT THIS YEAR.
SO I JUST HAVE THE SCHEDULE FOR THIS YEAR.
UM, WHEN WE'RE USING STRAT AND RIDGE, WE WILL START OUR PALLET DROPOFF ON SEPTEMBER 26TH.
UM, PALLET DROPOFF WILL END ON THE SEPTEMBER 28TH AND OUR BONFIRE BUILD WILL START TO BEGIN ON SEPTEMBER 28TH AS WELL.
WE HAVE, UH, STUDENTS, UH, SENIOR STUDENTS AND SENIOR PARENT VOLUNTEERS TO HELP RUN AND MAKE SURE EVERYTHING IS, UM, SMOOTH AND NO ACCIDENTS OCCUR.
UM, OUR BONFIRE WILL BE BUILT FROM THE 28TH TO THE 30TH, UM, AND THEN OUR BONFIRE WILL OCCUR ON OCTOBER 2ND.
UM, THAT IS WHEN WE WILL ALSO BE CROWNING OUR HOMECOMING KING NOMINEE.
WE HAVE A VOLUNTEERED, UH, PARENTS TO BRING GASOLINE, WATER, UM, WOOD SCREWS, PALLETS, FORKLIFTS, AND UM, A TRUCK WITH A SPRAYER.
SO ALL OF OUR, UH, BOXES HAVE BEEN FILLED WITH, UH, VOLUNTEERS AND WE ARE STILL GETTING MORE VOLUNTEERS.
SO EVERYTHING SHOULD RUN SMOOTHLY.
AND WE WILL ALSO HAVE OUR STUDENT, UH, CLASS, UH, PRESIDENTS AND VICE PRESIDENT THERE TO MAKE SURE THAT, UM, EVERYBODY IS DOING WHAT THEY NEED TO TO MAKE THIS RUN SMOOTH.
ALSO, WITH THE GOAL OF SMOOTH OPERATION, WE HAVE A, LIKE A SET OF RULES IN PLACE.
THE GENERAL RULE IS THAT ALL THE ISD UH, RULES IN THE CODE OF CONDUCT ARE STILL IN PLACE.
SO THE, BASICALLY IF A STUDENT BREAKS ANY OF THESE RULES, THEY WILL BE DEALT WITH WITH THE SCHOOL.
UM, ALSO SOME OF OUR OTHER RULES IS THAT SENIORS MUST HAVE A LIABILITY FORM SIGNED BY PARENT AND STUDENT.
WE ARE CURRENTLY WORKING ON HANDING THOSE OUT AND WE HAVE TOLD OUR STUDENTS TO RETURN THOSE AS SOON AS POSSIBLE.
UM, WORK PASSES WILL BE ISSUED AFTER THE RECEIPT OF THE LIABILITY FORM AT THE BONFIRE SITE, AND THAT WORK PASS MUST BE IN THE POSSESSION OF THE STUDENT AT ALL TIMES.
SO WE MAKE SURE THAT EVERYONE IS ALLOWED TO BE WORKING THERE.
AND WE DON'T HAVE AN ISSUE WHERE WE DON'T KNOW IF SOMEONE'S ALLOWED THERE OR NOT.
UM, YEAH, PERMISSION MUST BE OBTAINED BEFORE PALLETS ARE TAKEN.
AND WE ARE, WE'VE BEEN KEEPING A LOG OF THE NAMES OF PEOPLE WHO GAVE PERMISSION TO TAKE PALLETS AND WE HAVE BEEN MAKING SURE THAT THERE'S NO VANDALISM OR DESTRUCTION TAKING PLACE THERE AS WELL.
UM, ALSO A BIG PRIVILEGE WITH THE BONFIRE AND WHAT THE BONFIRE IS KNOWN FOR IS, UM, STUDENTS PUTTING THEIR BONFIRE SIGN ON THE BONFIRE.
AND AGAIN, WITH THIS IS THAT WE HAVE SAID THAT THESE SIGNS MUST BE PROMOTING SCHOOL SPIRIT OR PERSONAL SPIRIT.
THEY SHOULD HAVE NO FOUL MESSAGES ON IT, NO FOUL, UH, SIGNS.
AND I CAN'T, I CAN'T THINK OF AN INSTANCE WHERE WE HAD AN ISSUE WITH THIS.
CORRECT ME IF I'M WRONG, BUT YOU'VE GOT THAT IN GENERAL.
WE ARE VERY, PEOPLE ARE VERY EXCITED.
I'VE SEEN PEOPLE'S BONFIRE BOARDS ALREADY COMPLETED AND THEY ALL LOOK SO GREAT AND PEOPLE ARE VERY EXCITED FOR THAT.
SO IS THAT ALL? ANYTHING ELSE WE NEED TO ADD? YEAH, FOR SURE.
UM, JUST TO KIND OF, UH, FOR ANYONE THAT IS ACTUALLY INTERESTED IN THE NUMBERS, UH, WE ARE LOOKING AT ABOUT 1500 PALLETS RIGHT NOW AND WE ARE STILL IN THE PROCESS OF COLLECTING THEM.
UH, SO AGAIN, WE WILL BE BUILDING IT UP.
SO WE NEED THE BASE AND KIND OF BUILDING IT UP AND UP.
UM, ALSO, UH, WE WILL HAVE LIKE A DJ AND, UM, A BUNCH OF STUDENTS.
WE DO HAVE A BUNCH OF TRADITIONS THAT WE USUALLY DO LIKE FOR OUR CLASS, SINCE WE ARE THE CLASS OF 25.
UH, WE RUN TWO LAPS ONE WAY, FIVE LAPS THE OTHER WAY.
SO WE DO HAVE A LOT OF
A QUICK FINAL NOTE, ANOTHER NOTE ABOUT SAFETY AND RULES.
WE WILL HAVE FIRE TRUCKS PRESENT IN ORDER TO CONTAIN THE FIRE.
YOU WANNA, THAT'S REALLY IMPORTANT.
THE MOST IMPORTANT THING TO BE HONEST.
[00:30:01]
AND WE WILL ALSO HAVE EMS PRESENT, UM, FOR THE SAME REASON, JUST REALLY TRYING TO PROMOTE SAFETY, MAKING SURE NO ACCIDENTS HAPPEN, MAKING SURE THIS IS A FUN COMMUNITY EVENT MEANT TO RAISE SCHOOL SPIRIT, NOT NECESSARILY TEAR IT DOWN WITH A TRAGIC ACCIDENT.ANY QUESTIONS FOR US? UH, DO YOU WANNA CLARIFY THE TRANSPORTATION PLAN? BISD IS GONNA PROVIDE STUDENT TRANSPORT TO AND FROM, CORRECT? CORRECT.
AND THE STUDENTS WILL BE BUSED.
UM, WE'RE NOT BUSTING PEOPLE THAT AREN'T STUDENTS THOUGH.
CAN WHO, WHO SPRAYS THE DIESEL AND THE BONFIRE? I WAS GONNA SAY DO, DOES THE FIRE DEPARTMENT DO? OKAY, GOOD.
SO WILL EVERYONE BE BUSED THERE OR JUST THE STUDENTS? JUST THE STUDENTS.
AND THEN ONE OF THE REASONS WE'VE TRIED TO COORDINATE THAT IS TO MAKE SURE THAT WE DON'T HAVE TOO, TOO MANY FOLKS CLOGGING THAT TWO LANE ROAD.
SO, UM, AS ANOTHER SAFETY PRECAUTION, STUDENTS MUST HAVE THEIR IDS NOT, IT'S OPEN TO ALL BE WITH STUDENTS, NOT JUST SENIORS.
UM, BUT THEY WILL MUST, THEY MUST HAVE THEIR ID AND WE'LL MAKE SURE THAT THEY'RE AWARE OF THAT BEFORE THEY GET ON THE BUS.
WELL, THANK Y'ALL FOR COMING UP HERE.
THANK FOR HAVING US SPEAK VERY WELL.
WE'VE BEEN HAVING IT OUT THERE FOR SEVERAL YEARS NOW, CORRECT? YES SIR.
AND EVERYTHING'S ALWAYS WENT WELL.
SO YEAH, WE REALLY ENJOY COMING UP HERE AND GETTING TO TALK TO Y'ALL, SO THANK YOU.
KIND OF OUT THE STICKS A LITTLE BIT, HUH?
I'LL CONSIDER A MOTION TO APPROVE THE USE OF STRAT RIDGE ROAD BY BRASSWOOD HIGH SCHOOL FOR THE 2024 BONFIRE.
I I'LL SECOND MOVE BY COUNCILPERSON BOND.
SECOND BY COUNCIL PERSON MATTERS.
ANY FURTHER DISCUSSION, QUESTIONS, COMMENTS? HEARING NONE, I'LL ENTERTAIN A VOTE.
WE'LL SEE Y'ALL AT THE BOTTOM.
NEXT ITEM WOULD BE DISCUSSED IN CONSIDERATION THE RESIDENT'S REQUEST BY KEN WHITLEY TO ALLOW THE USE OF GOLF CARTS ON CITY STREETS.
HOW ARE Y'ALL? MY NAME'S KEN WHITLEY.
I'M A LIFELONG CITIZEN OF TURN.
TURN YOUR MIC UP HERE A LITTLE BIT.
NEED A, IS THAT BETTER? HELLO? GOOD.
I'M A LIFELONG, UM, CITIZEN, UH, OF CLUE.
I'M A WOULD LIKE FOR THE COUNCIL TO CONSIDER A GOLF CART ORDINANCE, INCLUDING SIDE-BY-SIDES IN THE CITY LIMITS ALONG WITH THE, UM, COUNTY AND STATE LAWS.
I GUESS THIS IS BECOMING A MORE COMMON THING IN TOWNS, IN SMALL CITIES TO USE THE GOLF CARTS.
I DON'T KNOW THAT WE HAVE AN AUTHORIZED, WE DON'T, WE DON'T HAVE AN AUTHORIZED, IT FALLS THE STATE LAW, WHICH PERMITS THE USE OF NEIGHBORHOOD ELECTRIC VEHICLES AND GOLF CARTS WITHIN MASTER PLAN COMMUNITIES.
RIGHT NOW WE ONLY HAVE ONE COMMUNITY THAT MEETS THE STATE'S DEFINITION OF WHAT A MASTER PLAN COMMUNITY IS, AND THAT'S WOOD SHORE.
I KNOW IT'S GETTING A LOT OF USE IN COLLEGE PARK.
COLLEGE PARK TECHNICALLY DOESN'T FALL INTO THAT BECAUSE IT DOESN'T HAVE AN HOA, SO IT'S KIND OF A, KIND OF A HAIR SPLITTING ISSUE, UH, WHEN IT COMES TO THAT.
AND SO, UH, I WILL TELL YOU IN THE TWO CITIES I WORKED AT PREVIOUSLY, WE ADOPTED GOLF CART ORDINANCES.
UH, ONE OF THEM WENT TO AN EXTREME IN TERMS OF ADMINISTRATIVE PROCESS AND I THINK NOW REGRETS.
UH, I THINK THEY'VE GOT THREE STAFF ASSIGNED TO CONDUCTING INSPECTIONS AND PERMITTING FOR GOLF CARTS AND NVS AND SIDE BYSIDE.
WE DON'T WANT TO OR CAN'T AFFORD THAT.
UM, WE DO RECOGNIZE THAT THERE IS A PRETTY SIGNIFICANT SAFETY ISSUE WITH THE USE OF THE CARTS ON HIGHER TRAFFIC ROADS.
UM, AND SO, UH, STAFF HAS BEEN DOING SOME IN-DEPTH STUDIES SINCE MR. WHITLEY'S REQUEST CAME IN TRYING TO FIGURE OUT WHAT ARE THE PROS AND THE CONS.
CHIEF CAN'T BE HERE THIS EVENING.
I DON'T KNOW WHETHER HE BRIEFED YOU MITCHELL OR NOT ABOUT HE DID.
UM, CHIEF SAID THAT HE SENT Y'ALL OR SENT OUT SOME INFORMATION ON EXACTLY WHAT WOULD BE REQUIRED AS REGARD AS ORDINANCE AND, UH, FOR YOU TO LOOK THROUGH AND DETERMINE WHETHER OR NOT YOU WANTED TO OPEN THAT PARTICULAR FILE.
AND I THINK WE'VE GOT A SITUATION WHERE WE'VE GOT FOLKS USING THEM WITHIN THE NEIGHBORHOODS.
[00:35:01]
I DON'T THINK THE POLICE, THEY NEED DIRECTION FROM US IN TERMS OF POLICY.MR. DUNCAN, DO YOU HAVE A, WELL, IF YOU'RE GONNA ALLOW GOLF CARTS, YOU HAVE TO HAVE AN ORDINANCE.
UM, BECAUSE WE DON'T HAVE AN ORDINANCE AUTHORIZING, UH, THE ONLY PLACE THAT THEY'RE LEGAL CURRENTLY WOULD BE IN THE WOOD SHORE, UM, COMMUNITY.
AND, UH, THERE ARE, AND, AND I DON'T KNOW IF Y'ALL GOT THE, IF, IF Y'ALL DID NOT GET THE EMAIL FROM, UH, CHIEF FITCH, THEN THAT'S SOMETHING WE NEED TO GET TO YOU.
BUT HE WENT THROUGH A BUNCH OF, UM, UM, DIFFERENT FACTORS.
'CAUSE THERE'S SO MANY DIFFERENT TYPES.
ONE THING IS THERE'S A LOT OF DIFFERENT TYPES OF VEHICLES, RIGHT? YOU HAVE ELECTRIC VEHICLES, YOU HAVE GAS OPERATED VEHICLES, YOU HAVE, YOU KNOW, BASICALLY LIKE FOUR WHEELERS, UH, GOLF CARTS, YOU KNOW, I THINK HE HAD A, HIS HANDOUT HAD LIKE 93 DIFFERENT TYPES OF VEHICLES OR WHATEVER.
SO, UM, AND THEN THERE ARE OTHER FACTORS AS FAR AS WHAT ROADS DO YOU, IF YOU AUTHORIZE GOLF CART DRIVING ON, WHAT ROADS DO YOU AUTHORIZE? IS IT CERTAIN SPEED LIMITS AT CERTAIN AREAS THAT YOU DEFINE? UM, AND SO, UM, YEAH, THERE, THERE ARE A LOT OF SPECIFIC FACTORS THAT WOULD NEED TO BE REVIEWED AND CONSIDERED.
SO, UM, UH, I THINK THAT IF THE, IF THE CITIZENS, UM, RE REQUESTING THE USE OF GOLF CARTS, CERTAINLY IF THEY HAD ANY SPECIFIC REQUEST OF, YOU KNOW, HOW THEY SEE THIS WORKING, RIGHT? LIKE IN WHAT AREAS, UH, WHAT TA WHAT STREETS, SPECIFIC STREETS OR WHAT SPEED LIMIT AREAS, UM, UH, YOU KNOW, IF THEY HAVE ANY SPECIFIC REQUESTS OF SPECIFIC RULES, CERTAINLY THAT WOULD BE, UM, HELPFUL FOR THE COUNCIL TO KNOW EXACTLY, YOU KNOW, WHAT YOUR REQUEST IS AND HOW YOU SEE, UH, THE OPERATION OF, WE'LL JUST, YOU KNOW, WE'LL CALL IT GOLF CARTS, BUT THERE'S A LOT OF OTHER VEHICLES THAT ARE INCLUDED.
RIGHT? UM, SO IF Y'ALL HAVE ANY SPECIFICS THAT Y'ALL WANT TO BRING IT TO THE COUNCIL'S ATTENTION NOW, OR, YOU KNOW, WE WOULD NOT, I DON'T SEE THAT IT'S POSSIBLE WE WOULD PASS AN ORDINANCE THAT THIS IS JUST A DISCUSSION ITEM TONIGHT, RIGHT? UH, SO IF YOU HAVE YOUR THOUGHTS, YOU KNOW, TONIGHT IS THE NIGHT TO BRING IT TO THE COUNCIL, BUT IT WILL COME BEFORE THE COUNCIL AGAIN.
UM, AND THEN YOU'LL HAVE OTHER OPPORTUNITIES TO, WITH THAT BEING SAID, I THINK, UH, I DON'T THINK TONIGHT IS THE PLACE TO BRING IT BEFORE COUNCIL.
I THINK TONIGHT WOULD BE A PLACE TO SCHEDULE A WORKSHOP TO, TO GET EVERYBODY ON THE SAME PAGE.
YEAH, I THINK THAT WOULD BE, I THINK THAT WOULD COUPLE OTHER MICS.
I SAW THE, I RUN MAVERICKS CUSTOM GOLF CARTS.
SO ANYTHING YOU NEED TO KNOW ABOUT GOLF CARTS, THAT'S, THAT'S ME.
I'VE BEEN DOING IT FOR A LONG TIME.
SO WHAT THEY DO IS A LITTLE BIT DIFFERENT.
OF COURSE, YOU'RE GONNA HAVE TO HAVE SEAT BELTS, TAG, INSURANCE, REGISTRATION, ALL THAT KIND OF STUFF.
YOU WOULD JUST LIKE A NORMAL VEHICLE.
BUT ALSO THEY HAVE MAIN ROADS THAT THEY ARE, YOU CAN'T GO ON AND IT'S POSTED EVERYWHERE.
THEY ALSO DO IS MAIN STREET ON THEIR TOWN.
HOW THEY SET UP, THEY SHUT IT DOWN AT SIX 30.
SO THAT MEANS THAT AT THIS TIME YOU CAN ONLY TRAVEL GOLF CARTS.
WELL, WHAT DOES THAT DO? WELL, ONE, IT GETS PEOPLE OUT OF THE HOUSE INTO YOUR E-COMMERCE IN YOUR COMMERCE, RIGHT? AND THEN YOU DON'T HAVE ALL THESE TRUCKS ON THE ROAD.
THAT MEANS MORE MONEY INTO OTHER THINGS.
GOLF COURSE DON'T WEIGH NOTHING.
THAT'S A LOT OF WEAR AND TEAR ON THE CITY.
THERE'S A LOT OF THINGS YOU CAN DO.
UM, AS FAR AS LIKE, UH, SPEED LIMITS, UM, OF COURSE YOU GOTTA HAVE A VALID, VALID DRIVE LICENSE CAN LET KIDS RUN AROUND EVERYWHERE.
UM, BUT THAT'S, THERE'S A LOT OF THINGS IN THE GOLF CART WORLD THAT MIMIC AUTOMOTIVE, RIGHT? IS AS FAR AS SAFETY CONCERNS, THERE'S DIFFERENT DEGREES OF WINDSHIELDS, WIPERS.
IF YOU'RE GONNA WANNA REQUIRE THOSE RIGHT.
TURN SIGNALS, HORNS, ALL THESE THINGS THAT CAN BE DONE.
NOW, DON'T GET ME WRONG, THEY GET COSTLY.
BUT IF YOU WANT THEM ON THE ROAD, THEN IT CAN DEFINITELY BE DONE.
IF, YOU KNOW, UM, I DON'T SEE A REASON WHY NOT, BECAUSE OF COURSE YOU'RE NOT GONNA WANT 'EM ON A HIGHWAY.
THAT'S, THAT'S A LITTLE ABSURD.
BUT THERE'S MANY WAYS OF GETTING AROUND EVERYWHERE YOU NEED TO GO.
[00:40:01]
SOME PEOPLE CAN'T GET INTO CARS ANYMORE.HEY, I DON'T WANNA LIFT A GOLF CART.
I JUST WANT SOMETHING FOR MY GRANDMA TO GO CHECK THE MAIL, VISIT THE NEIGHBORS, VISIT HER GRANDKIDS LIVE DOWN THE STREET, BUT SHE CAN'T GET IN A CAR.
IT DON'T GO BUT 10, 15 MILES AN HOUR.
WHY NOT? UM, BUT WHAT QUESTIONS DO Y'ALL HAVE AND WHAT CONCERNS DO YOU GUYS HAVE? THEN MAYBE I CAN ANSWER.
BASICALLY, THE LIST COULD BE LONG.
WE NEED TO, WE NEED TO PUT TOGETHER A WORKSHOP FOR IT AND MAYBE GET YOU TO COME AND WE DO IT IN A LITTLE DIFFERENT SETTING THAN WHAT WE HAVE AS A MEETING.
LIKE I SAID, I MEAN, YOU KNOW, I I I THINK THAT THE CHIEF HAS DONE SOME RESEARCH AND YOU KNOW, WE NEED TO, WE NEED TO SEE HIS RESEARCH BEFORE WE WOULD EVER BE, YOU KNOW, BEFORE I WOULD SPEAK IN FAVOR OR AGAINST.
I'D LIKE TO SEE THE RESEARCH TO CORRECT.
YOU KNOW, AND, UH, YOU KNOW, I'M NOT, I'M NOT AGAINST IT BY ANY MEANS, BUT LIKE I SAID, I KNOW THAT THERE, I KNOW, LIKE I SAID, THERE'S GOTTA BE TURN SIGNALS.
THERE'S GOTTA BE THIS, THERE'S GOTTA BE ABSOLUTELY THAT.
I MEAN, YOU KNOW, MR. MR BISSO, HE, HE DOES HIS DEAL TOO.
I HAVE A RENTAL LOCATION THAT'S GOT A FLEET OF GOLF CARTS DOWN THERE AND HE REQUIRES WORKING HEADLIGHTS, TAG, REGISTRATION, ALL THESE THINGS.
VALID DRIVER LICENSE, PROOF OF INSURANCE, EVERYTHING.
AND I THINK WE FOLLOW SUIT WITH THAT.
THERE'S NOT MUCH I I I GET IT.
AS FAR AS THE LIABILITY IS CONCERNED.
PEOPLE ARE GONNA GET BANGED UP.
EH, BUT REALISTICALLY YOU'RE NOT GOING BUT 15, 20 MILE AN HOUR THE MOST ANYWAY.
WHAT ARE YOU GONNA DO END UP IN A DITCH
THERE'S JUST, THERE'S JUST A, I THINK THAT WE ALL NEED TO BE ON THE SAME PAGE SO THAT WE DON'T HAVE TO RIDE AN ORDINANCE 15 TIMES.
AND PLEASE DON'T FOLLOW GALVESTON.
'CAUSE THEY HAVE A NIGHTMARE OF A PROBLEM WITH THEIR STUFF.
I DON'T, I DON'T THINK WE WANT TO WRITE THE, WRITE THE ORDINANCE AND REWRITE IT AND THEN REWRITE IT AND RE IT.
I THINK WE ALL NEED TO SIT DOWN AND PUT OUR HEADS TOGETHER AND COME UP WITH A COMMON SENSE SOLUTION THAT'LL FIT EVERYBODY.
CJ DOES THE CITY OF LAKE JACKSON HAVE A YES, THEY DO.
IS IT COMPLICATED OR IS IT, IS IT FOR OR AGAINST GOLF? IT'S FOUR.
IT'S, IT'S FOUR BUT IT'S ALSO VERY RESTRICTING.
IT'S ADMINISTRATIVELY RESTRICTIVE.
VERY MUCH LIKE I'M ALL FOR IT, BUT I DON'T WANNA MAKE IT COMPLICATED TO WHERE THEY CAN'T NEVER RIGHT.
ARE WE ONLY TALKING ABOUT GOLF CARTS OR YOU SAID THERE WAS AN EMAIL? NO, NO.
THERE'S FOUR WHEELERS AND STUFF.
SO, WELL, I THINK MR. WHITLEY, YOU TALKED ABOUT SIDE-BY-SIDES, FOUR WHEELERS, GATORS, UH, YOU HAVE UH, WHAT ARE CALLED NVS, WHICH LOOK KIND OF LIKE A MARRIAGE BETWEEN A GOLF CART AND A CAR THAT HAD LIKE ROLL UP WINDOWS AND IS THAT WHAT THEY CALL A NEIGHBORHOOD VEHICLE OR SOMETHING LIKE THAT? NEIGHBORHOOD ELECTRIC VEHICLES.
UH, THERE'S ALSO SCOOTER, UH, THERE'S, IT'S A BROAD ARRAY OF VEHICLES.
THAT WOULD BE, THAT'S WHAT LAKE JACKSON HAS IS THEY, THEY CLASSIFY THAT AS NV GOLF CARTS IS NV NEIGHBORHOOD ELECTRIC VEHICLE.
THEY HAVE GAS MO, SOME OF 'EM HAVE GAS MOTORS, BUT YOU'RE TALKING ABOUT 250, 300 CCS AT MOST.
AND YOU, WHEN YOU GOT FOUR PASSENGERS ON THERE, THEY DON'T GO VERY FAST.
I MEAN, THIS ISN'T MY OBJECTED TONIGHT WAS TO BRING IT TO ATTENTION.
FOR US TO START FORWARD WITH A PROCESS AND DEFINITELY GET YOUR NAME OR WHEN IT GOES OUT TO HELP US SIT DOWN AND FOR SURE PUT SOMETHING TOGETHER WE CAN ALL LIVE WITH WITHOUT STRAPPING IT DOWN TO THE POINT THAT YEAH.
YOU KNOW, YOU USE IT FOR 10 MINUTES, 10 MINUTES AN HOUR.
WE DON'T WANT TO DO SOMETHING LIKE THAT.
YOU KNOW WHAT I MEAN? I UNDERSTAND.
WE WANT, WE WANNA MAKE, WE DON'T WANNA MAKE IT RESTRICTED, BUT WE WANNA MAKE IT SAFE.
BACK IN, BACK IN MY DAY WHEN USED TO RIDE MOPEDS.
LET'S, UH, LET'S GET, UH, WE'LL GET A DATE, SOME, SOME POSSIBLE DATES SET UP FOR A, A WORKSHOP.
WE GET A COUPLE ITEMS THAT NEED TO BE WORKSHOPS.
SO WE'LL TRY AND COME UP WITH A DATE HERE.
CAN I SOMETHING? PLEASE COME TO THE MIC.
HELLO, MY NAME IS MICHAEL GER.
MY WIFE AND MYSELF LIVE IN COLLEGE PARK.
WE ALSO HAVE A PLACE IN SMITHVILLE WHERE WE ARE, HAVE OUR GOLF CART REGISTERED.
WE'RE MEMBERS OF THEIR GOLF CART COMMUNITY.
AND I'M, IF YOU'RE GONNA DO SOME WORK SHOPPING AND LOOK INTO IT, I, I WOULD IMPLORE YOU TO LOOK AT THE CITY OF SMITHFIELD'S WEBSITE, LOOK AT THEIR WEBPAGE.
'CAUSE THEY HAVE A PRETTY GOOD PROCEDURE IN PLACE.
IT'S HAS AN INSPECTION PROCESS AND SOME, SOME GUIDANCE AND GUIDELINES YOU HAVE TO FOLLOW.
SO IF Y'ALL ARE LOOKING FOR A LITTLE BIT MORE GUIDANCE, THERE'S A PLACE FOR YOU TO START AT AS WELL.
THAT'S WHAT WE'RE LOOKING FOR.
THAT'S WHAT WE'RE LOOKING FORWARD IN THE WORKSHOP.
AND I WAS WONDERING, ARE WE JUST TALKING ABOUT RIDING AROUND NEIGHBORHOODS OR ARE WE TALKING ABOUT WELL THAT'S, THAT'S MAYBE LIMITING SAYING OKAY.
DIXIE DRIVES A LITTLE KIND OF CRAZY 'CAUSE WE DON'T WANT EVERYBODY TAKING THEIR
[00:45:01]
KIDS TO SCHOOL IN A GOLF CART.'CAUSE CARS CROSSING DIXIE THE SPEED, IT'S 35 MILES AN HOUR.
WELL, AND WE WOULD ALSO NOTE THAT DIXIE BRYAN, BUT YOU GOTTA GET THERE
WELL, I WOULD ALSO NOTE, YEAH, AND I WOULD ALSO, WE NEED TO TRY TO KEEP THIS ONE PERSON AT A TIME SO WE CAN GET THE MINUTES AND SO FORTH.
I ALSO LIVE IN COLLEGE PARK AND I RECENTLY PURCHASED A GOLF CART.
I'VE NOT SEEN ANY PROBLEMS OTHER THAN WITH YOUNG KIDS ON THEM SIDE BYSIDE AND THINGS LIKE THAT.
I THINK THAT'S WHERE YOU NEED TO FOCUS, YOU KNOW, BECAUSE THERE IS A PROBLEM WITH THAT.
YOU KNOW, I KNOW THAT WHAT I WAS TOLD, YOU HAD TO HAVE A DRIVER'S LICENSE.
MINE IS INSURED, MINE HAS A TAG, MINE HAS THE WARNING SIGN ON THE BACK, IT HAS THE LIGHTS AND EVERYTHING LIKE THAT.
AND NO, I'M NOT DRIVING IT 35 MILES AN HOUR.
AND SO I DON'T KNOW WHO YOU PUT ON YOUR WORKSHOP, BUT I WOULD LIKE TO BE, AND I HAVE A NEIGHBOR WHO WOULD ALSO LIKE TO BE AT CLERK.
WE'LL POST IT AND LET Y'ALL KNOW WHEN WE'RE GONNA HAVE IT.
E EVERYBODY'S INVITED TO THE WORKSHOP.
WORKSHOP WILL BE OPEN TO THE PUBLIC.
THEY JUST NEED TO KNOW WHAT, WHEN IT'LL BE, YOU JUST ANSWERED MY QUESTION.
I, I LIVE IN COLLEGE PARK ALSO.
WHAT, WHAT'S YOUR NAME, SIR? JEFF DO
SO I GUESS WHAT, WHAT'S OUR CURRENT PROCESS NOW WHEN WE COME ACROSS, OR MAYBE LT YOU CAN PROBABLY ANSWER THIS.
SO IF WE DO COME ACROSS SOMEBODY IN A NEIGHBORHOOD, IS IT JUST OFFICER DISCRETION RIGHT NOW? JUST, YEAH.
UM, OFFICERS USE THEIR DISCRETION.
UM, IS THE OPERATOR OF THE GOLF CART WITH A SIDE BY SIDE IS DOING SOMETHING THAT DRAWS OUR ATTENTION OR THE ATTENTION OF THE PUBLIC, WHEREVER THEY CALL IT IN.
UM, THEN THE OFFICER MAY TAKE ACTION.
WE HAD A PROBLEM IN WOOD SHORES.
SOME KIDS GOING REALLY FAST AROUND THE, YEAH.
DIDN'T YOU HAVE A DRIVER'S LICENSE? I DON'T THINK THEY WERE OLD ENOUGH TO HAVE A DRIVER'S LICENSE.
I, I WOULD SEE, I WOULD SEE THE AGE ISSUE AS THE, AS THE, PROBABLY THE BIGGEST PROBLEM TO ENFORCE
'CAUSE YOU KNOW, SOMETIMES KIDS DO DO A LOT OF THINGS WHEN THEIR PARENTS AREN'T AROUND
ALRIGHT, WELL, WE'LL WE WILL GET SOME POSSIBLE DATES SET UP AND WE'LL MAKE SURE THEY'RE PUBLISHED SO THAT EVERYBODY CAN, WE'LL CERTAINLY LOOK INTO THE SMITHVILLE THING.
CJ, WHEN, WHEN WE COORDINATE THE WORKSHOP, CAN YOU MAKE SURE TO WORK WITH MR. WHITLEY ON THAT? YEAH, WE'LL MAKE SURE HE'S IN FRONT.
THEN THE NEXT ITEM WOULD BE CONSIDERATION AND POSSIBLE ACTION TO APPROVE RESOLUTION NUMBER 53 DASH 2024 DECLARING CERTAIN ITEMS AS SURPLUS AND SALVAGE AND OR APPROVING AND OR APPROVING OF THEIR DISPOSAL.
AND IT WOULD BE RESOLUTION NUMBER 53 DASH 2024.
IT'S A MIXTURE RESOLUTION OF THE CITY COUNCIL, OF THE CITY OF KLU, TEXAS APPROVING THE DISPOSAL OF CITY PROPERTY DECLARED SURPLUS AND SALVAGE.
WHEREAS THE CITY OF KLU HAS, HAS DETERMINED THAT CERTAIN VEHICLES, EQUIPMENT AND ITEMS THAT SHOWN IN THE EXHIBIT A ATTACHED HERE TO AND MADE A PART HERE OF ARE SURPLUS OBSOLETE, ARE UNUSABLE FOR PRESENT AND FUTURE CITY NEEDS.
WHEREAS THE CITY AUTHORIZES THE AUCTION OF SALVAGE VEHICLES ITEMS DETERMINED TO BE SURPLUS.
AND WHEREAS THE CITY DESIRES TO DISPOSE OF BY PUBLIC AUCTION THROUGH GOV DEALS.COM, THE VEHICLES ITEMS DESCRIBED IN EXHIBIT A ATTACHED HERE TO AND MADE PART HEREOF, WHICH IS HAVE BEEN DETERMINED TO BE SURPLUS, OBSOLETE, OR UNUSABLE FOR PRESENT OR FUTURE CITY NEEDS.
WHEREAS CITY COUNCIL CONCURS IN THE FINDING THAT THE VEHICLES AND ITEMS DESCRIBED IN EXHIBIT A ARE SURPLUS AND NO LONGER NEEDED FOR PUBLIC PURPOSES.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF CITY OF INCLUDE TEXAS THAT GOV DEALS.COM IS HEREBY AUTHORIZED TO
[00:50:01]
DISPOSE OF BY PUBLIC AUCTION.THE SURPLUS VEHICLES AND ITEMS DESCRIBED IN EXHIBIT A ATTACHED READ PAST AND ADOPTED THIS 12TH DAY OF SEPTEMBER, 2024, SIGNED BY MYSELF AND ROSIE CLERK AND IT WOULD BE, IT LOOKED LIKE A WHOLE BUNCH OF TAHOES.
THESE ARE ALL FORMAL POLICE VEHICLES THAT ARE AT THEIR END OF SERVICE LIFE.
MR. ROSIE ON HERE, IT'S THE 54 ON THE SCREEN, BUT WE'RE ON 53, RIGHT? YES.
OKAY, MAYOR, I'LL MAKE THE MOTION TO APPROVE.
HAVE A MOTION BY COUNCILMAN AGUILAR THAT WE APPROVE RESOLUTION NUMBER 53 DASH 2024.
DO I HAVE A SECOND? I'LL, I'LL SECOND.
MR. LOPEZ MAKES A SECOND DISCUSSION.
HEARING NONE, I'LL ENTERTAIN THE VOTE.
ALL IN FAVOR A AYE, I APOLOGIZE, I DIDN'T GET WHO MOTION.
I YOU AND THE NEXT ITEM WOULD BE CONSIDERATION OF POSSIBLE ACTION TO APPROVE RESOLUTION.
RESOLUTION NUMBER 54 20 24 APPROVING REVISED LABOR CHARGES FOR FREEZING NICHOLS ENGINEERING SERVICES RELATED TO THE GLO HAZMAT PROJECTS AND IT WOULD BE RESOLUTION NUMBER 54 DASH 2024.
THE RESOLUTION OF THE CITY COUNCIL OF CITY OF CL TEXAS APPROVING THE REVISED RATE FOR PROFESSIONAL SERVICES PROFIT BY FEES AND NICHOLS INCORPORATED FOR ENGINEERING SERVICES RELATED TO THE CITY G-L-O-C-D-B-G HAZMAT GRANT PROGRAM WHERE THE CITY COUNCIL OF CITY INCLUDE HAS PREVIOUSLY INCLUDED FREEZE AND NICHOLS INC.

WHEREAS THE CITY UNDERSTANDS THAT THE COST OF DOING BUSINESS MUST BE ADJUSTED FROM TIME TO TIME AND WHEREAS THE REVISED RATE SCHEDULE ENCLOSED IS FOUND TO BE REASONABLE BY STAFF AND COUNCIL OF THE CITY APPROVED, WHEREAS THE CITY UNDERSTANDS THAT THIS RATE SCHEDULE MUST BE APPROVED FOR THE CONTINUING REIMBURSEMENT OF SAID COSTS UNDER THE GRANT.
WHEREAS THE CITY COUNCIL OF CITY UDE IS DESIRES OF CONTINUING F I'S ROLE IN THE ONGOING G-O-C-D-D HAZMAT GRANT PRO PROJECTS.
NOW THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF CITY CL TEXAS HEREBY APPROVES THE REVISED FNI RATE SCHEDULE FOR PROFESSIONAL SERVICES ATTACHED HERE.
TWO PASSED AND ADOPTED THIS 12TH DAY OF SEPTEMBER, 2024 APPROVED BY MYSELF AND I TESTIFIED BY THE OTHER DEPARTMENT, THE CITY CLERK.
OH, YOU DON'T HAVE TO READ ALL THAT, BUT YOU DON'T HAVE TO READ ALL THAT IF YOU DON'T WANT.
I'M JUST SAYING IS THERE ANY KIND OF PERCENTAGE OF INCREASE WITHOUT READING ALL THESE NUMBERS? YEAH, BASICALLY.
NO, I DON'T HAVE A PERCENTAGE INCREASE.
I DIDN'T COMPARE 'EM TO THE NUMBERS THAT THEY INITIALLY PROVIDED.
IF YOU RECALL THOUGH, THEY WERE ACTUALLY AWARDED AND HIRED BACK IN 2020.
SO IT'S BEEN FOUR YEARS SINCE THEY'VE ADJUSTED THEIR RATES.
UM, WHICH IS WHY THEY'VE ASKED FOR THIS NOW.
UM, AND THEN WE'RE NOT ALLOWED TO REIMBURSE THEM THROUGH THE GRANT WITHOUT APPROVING THEIR ACTUAL RATE SCHEDULE WITH AN INCREASE.
WELL, I MEAN, JUST LOOKING AT THESE CREW SIZES, GOT A ONE MAN SURVEY CRUISE $120 AND A FOUR MAN SURVEY CRUISE 240.
TELL ME WHAT I DON'T, I DON'T UNDERSTAND THE REASONING FOR THAT, BUT CJ YES, THE SAME AMOUNT OF EQUIPMENT FOR ONE GUY JUST REPORTS.
WHEN DID THEY START WORKING? UH, THEY ACTUALLY STARTED WORKING WHEN WE GOT THE CONTRACT DOCUMENTS IN 2022.
IF YOU RECALL, WE GOT THE GRANT AWARD.
AND THEN WE LINGERED FOR TWO YEARS TRYING TO GET THE CONTRACT.
UH, WE'RE ACTUALLY SUPPOSED TO BE WRAPPING THIS PROJECT UP.
AND WE STILL HAVE YET TO TURN A SPADE OF DIRT BECAUSE THE STATE KEEPS MOVING GOALPOSTS.
NO, WE HAVEN'T EVEN DUG THE DITCHES YET.
NO, THEY HAVEN'T DONE ANYTHING.
WE DID DIG UP SOME DITCHES AND NOW THEY TOLD US WE'VE GOTTA DIG UP SOME MORE DITCHES TO MAKE SURE THERE'S, THIS IS NO SKELETAL REMAINS.
YES, NO SKELETAL REMAINS WERE DISCOVERED WHEN WE DID OUR INITIAL EVALUATION.
UH, HUD HAS SUBSEQUENTLY CHANGED THE RULE, WHICH MEANS WE NOW HAVE TO BLESS YOU.
WE'VE REQUESTED A WAIVER TO GET AN EXTENSION SO THAT WE CAN EITHER ABIDE BY THE NEW RULE OR ABIDE BY THE FINDINGS OF THE OLD RULE THAT WE'VE ALREADY DONE.
EITHER WAY WE'RE LOOKING AT A SIX MONTH PROCESS BECAUSE
[00:55:01]
IT'S THE FEDS.UM, AND SO, UH, WE HIRED THESE INDIVIDUALS.
WE GOT THE CONTRACT DELAYED, WE STARTED THE PROJECT LATE, AND NOW WE'RE ASKING FOR A DELAY BECAUSE HOW DOES DECIDED THEY WANT TO MOVE THE GOALPOST ON WHAT AN ENVIRONMENTAL REVIEW ENTAILS.
AND AT THE BOTTOM OF THE PAGE IT SAYS THESE RATES ARE SUBJECT TO CHANGE ANNUALLY IN FEBRUARY.
BUT I WILL SAY THIS IS THE FIRST TIME THEY'VE SUBMITTED THIS IN THE, IN, IN THE TIME THAT THEY'VE WORKED FOR US.
SO IT SAYS THEY'RE SUBJECT TO CHANGE.
MAYBE THEY'LL GO DOWN WHEN THE INTEREST RATES GOES
I'VE GOT SOME PROPERTY I'D LIKE TO
I'LL MAKE THE MOTION TO APPROVE.
I HAVE A MOTION BY COUNCILMAN AGUILAR THAT WE APPROVE RESOLUTION NUMBER 54 DASH 2024.
WE DON'T GET, WE DON'T GET SOMETHING GOING.

WHERE IS WHERE MAYOR, WHERE YOU USED TO USED TO WORK? YEAH, IT'S RIGHT NEXT DOOR TO OKAY.

AND THAT IS ON THE SAME DATE, THE SAME TIME? YES SIR.
DO I HAVE A MOTION? ISN'T THAT ALREADY A THIS IS NEXT DOOR TO THE ONE THAT'S ALREADY THERE.

THEY SELL IT IN YOU? ARE THEY SELLING IT? AND SAME BASE TIME? THAT'S WHAT I WAS THINKING TOO.
JUST TO CLARIFY, OWNERSHIP CHANGES REQUIRE A NEW SUP.
IS IT GONNA BE ON THE SAME DAY? MOTION BY COUNCIL AGUILAR, WHAT ARE WE DOING? IS THAT ON THE SAME NIGHT? SAME DATE? YES SIR.
[01:00:01]
PERSON.ANY NO DISCUSSION? ALL IN FAVOR? AYE.
WE'RE GONNA BE BUSY ON OCTOBER 10TH.
THAT'S WHAT I'M TRYING TO MAKE.
THAT'S HOW I WAS TRYING TO CONFIRM.
EVERYBODY WEARING A HALLOWEEN COSTUME? IT MIGHT BE SIX.
[IV. CLOSED EXECUTIVE SESSION]

THAT BEING SAID, WE WILL RETIRE TO EXECUTIVE.
I WOULD CONSIDER A MOTION TO COME BACK INTO OPEN SESSION.

THE NEXT ITEM ON THE AGENDA WOULD BE ACTION TAKEN AS A RESULT OF THE CLOSED EXECUTIVE SESSION.
THERE'S NO ACTION TAKEN THIS EVENING.
