[IV. CITIZENS/VISITORS COMMENTS ]

CITIZENS VISITOR COMMENTS, THERE'S AN OPPORTUNITY FOR ENT VISITORS TO SPEAK TO COUNCIL RELATED TO AGENDA AND NON AGENDA ITEMS. SPEAKERS WERE ADVISED THAT COMMENTS CANNOT BE RECEIVED ON MATTERS, WHICH ARE THE SUBJECT OF A PUBLIC HEARING.

ONCE THE PUBLIC HEARING HAD BEEN CLOSED.

SPEAKERS ARE REQUIRED TO REGISTER IN ADVANCE.

MUST LIMIT THEIR PRESENTATION TO FIVE MINUTES.

WE HAVE A REQUEST TONIGHT FROM MR. ARTHUR CHANDLER TO ADDRESS COUNSEL.

YES.

UH, MY NAME IS ARTHUR CHANDLER AND, UH, I'VE LIVED IN KLUTE NOW FOR ABOUT THREE YEARS, AND I, UH, CERTAINLY EN ENJOY IT HERE.

AND, UH, THE ATMOSPHERE AND EVERYTHING.

I, I LIVE IN THE VANDERBILT APARTMENTS AND, UH, UH, THAT'S WHERE I MOVED TO FROM, UH, WHEN I MOVED FROM SWEENEY.

AND I WASN'T FAMILIAR WITH THEIR BILLING PRACTICES FOR THE WATER.

AND UH, YOU KNOW, I GUESS THEY, THEY WANT TO ADVERTISE, UH, THEIR APARTMENTS, UH, YOU KNOW, WITHOUT THE, THE WATER BILL INCLUDED IN IT.

SO IT SOUNDS MORE, UH, AVAILABLE TO PEOPLE AND, UH, YOU KNOW, BUT WE ALL KNOW WE HAVE TO PAY FOR WATER.

AND, UH, BUT THEY, UH, I DON'T HAVE ANY ANY METHOD OF, OF CHECKING.

THEY TELL ME WHAT MY WATER BILL IS EVERY MONTH, AND I, I USED TO GET A, AN ACTUAL BILL IN THE MAIL.

I DON'T GET THAT ANYMORE.

AND, UH, YOU KNOW, I, I HAVE TO ACCEPT WHATEVER THEY TELL ME.

UH, YOU KNOW, IF I WANT TO KEEP LIVING THERE AND THERE'S NO WAY TO CHECK IT.

I'M, I LIVE IN A ONE BEDROOM APARTMENT, IT IS JUST ME.

AND I DON'T, I USE A LOT LESS THAN THE AVERAGE PERSON DOES FOR WATER, ESPECIALLY WITH OTHER PEOPLE IN THEIR APARTMENT.

AND IT'S BEEN MY UNDERSTANDING WHEN I CHECKED INTO THIS, THEY SAID, WELL, THERE ARE NO METERS FOR YOU TO CHECK YOUR USAGE.

UH, IT'S BILLED TO THE APARTMENTS.

AND THE APARTMENTS, UH, BASICALLY BREAKS UP THE BILLING TO THEM ACCORDING TO WHAT SIZE APARTMENT YOU LIVE IN.

WELL, THAT'S NOT EXACTLY FAIR, BUT, UH, YOU KNOW, I GUESS IT'S ONE WAY TO DO THINGS.

AND, UH, UH, YOU KNOW, I'M JUST WONDERING, UH, WHETHER, UH, THE CITY OF CLUT THINKS THIS IS, UH, LEGAL AND, UH, AND, UH, A A WAY TO DO THINGS AND, UH, OR IF THEY'RE, IF THEY'RE NOT MAYBE NOT AWARE OF, OF THIS GOING ON.

BUT, UH, MY WATER BILL IS CONSISTENTLY GONE UP.

AND I, I GUESS THAT'S THE WAY THINGS ARE NOW.

DAYS, UH, THINGS GOING UP ALL THE TIME.

BUT, UH,

[00:25:01]

UH, UH, YOU KNOW, I I, EVEN WHEN I DIDN'T GET MY BILL IN THE MAIL, I PAID THE SAME AMOUNT OF WATER BILL I PAID THE PREVIOUS MONTH.

'CAUSE THAT'S HOW THEY TOLD ME TO DO IT.

AND, UH, AND THEN, UH, ALL OF A SUDDEN I GET THIS NOTICE AND I'VE GOT A COPY OF IT HERE, AND IT'S BASICALLY, UH, YOU OWE AN ADDITIONAL 90 SOMETHING DOLLARS, UH, YOU KNOW, AFTER I, WHEN MY AVERAGE BILL IS, UH, USED TO BE IN THE, THE THIRTIES, BUT NOW IT'S IN THE, THE FIFTIES, THE FORTIES AND FIFTIES.

AND, UH, AND THEN THIS COMES OUT OF THE BLUE AND I'VE JUST GOT TO ACCEPT IT.

AND I DON'T, I DON'T KNOW IF THERE'S A, A WAY THAT, UH, THAT, UH, YOU KNOW, THAT THIS CAN BE HANDLED BETTER AND, AND THAT, THAT'S ALL I'VE GOTTA SAY.

I'VE GOT, I'LL ANSWER ANY QUESTIONS IF ANYBODY HAS ANY, UH, FOR ME.

OKAY.

SO, YOU KNOW, THE, AS YOU KNOW, THE, THE CITY, UM, UH, SELLS THE WATER TO THE, YOU KNOW, THE WATER CUSTOMERS HERE IN THE CITY OF KLUT AND FOR APARTMENT COM COMPLEXES, UH, THEY DON'T HAVE INDIVIDUAL METERS.

AND SO THE CITY WILL BUILD THE APARTMENT COMPLEX AS A WHOLE.

THEY, THEY HAVE ONE METER, RIGHT? AND THEN, UH, IT'S UP TO BETWEEN YOU AND YOUR APARTMENT COMPLEX AS FAR AS HOW THEY DIVIDE THAT ONE BIG BILL INTO SMALLER BILLS FOR ALL OF THEIR TENANTS.

AND SO, YOU KNOW, UM, THE CITY DOESN'T, YOU KNOW, HAVE A, A SAY IN THAT PROCESS.

THAT'S A, THAT'S A CONTRACTUAL PROCESS BETWEEN YOU AND YOUR LANDLORD OR YOUR APARTMENT COMPLEX.

RIGHT? SO I WOULD, UH, YOU KNOW, WHAT, WHAT YOU HAVE IS LEGAL QUESTION, RIGHT? AND, UM, FOR CITIZEN COMMENT, YOU KNOW, THE, THE COUNCIL CAN'T REALLY ADDRESS, UH, ITEMS BROUGHT IN CITIZEN COMMENT.

IF IT'S NOT ON THE 'CAUSE, IT'S NOT ON THE AGENDA.

RIGHT.

BUT, UH, AND ALSO WE CAN'T GIVE YOU LEGAL ADVICE EITHER BECAUSE WE'RE THE CITY, WE'RE NOT YOUR, YOUR ATTORNEYS.

RIGHT.

BUT WHAT I WOULD RECOMMEND IS IF YOU HAVE QUESTIONS ABOUT YOUR LEASE AND, AND YOUR RIGHTS UNDER YOUR LEASE, YOU COULD CONTACT A PRIVATE ATTORNEY.

WE ALSO HAVE, UM, UH, LONE STAR LEGAL AID HERE IN CLUT, AND I KNOW THEY DO A LOT OF WORK WITH TENANTS.

AND SO YOU MIGHT CONTACT THEM AND SEE WHAT YOU CAN DO.

I'M SORRY, WHO WAS THAT? UH, LONE STAR LEGAL AID.

OKAY.

THE OFFICE HERE INCLUDE ACTUALLY, SO, UH, YOU MIGHT CON IF YOU NEED LEGAL ADVICE, YOU MIGHT CONTACT THEM ALSO.

SO, UH, BUT YOU, IF YOU HAVE QUESTIONS AND NEED LEGAL ADVICE, THEN YOU NEED TO TALK TO AN ATTORNEY, UH, ABOUT THE CONTRACT BETWEEN YOU AND YOUR APARTMENT COMPLEX O OKAY.

UH, I I GUESS SO.

AND THEY MAY NOT, THEY MAY BE ABLE TO, YOU KNOW, HELP YOU FIGURE OUT HOW TO, HOW THEY COME UP WITH THAT NUMBER AND SO FORTH.

WELL, IT, IT'S MY UNDERSTANDING THAT, UH, YOU KNOW, THE APARTMENTS THAT IF THEY HAPPEN TO FILL UP THEIR SWIMMING POOL OR SOMETHING THAT MONTH, YOU KNOW, I, I GUESS MY BILL IS GONNA SHOOT UP, YOU KNOW, AND I, I DON'T REALLY THINK THAT'S THE WAY TO DO THINGS.

UH, MAYBE, UH, UH, YOU KNOW, FIND A WAY TO, TO BILL US MORE FAIRLY, UH, SOMEHOW I, I DON'T KNOW WHAT THE ANSWER IS, YOU KNOW? WELL, I MEAN, I CAN TELL YOU THIS MUCH THAT, THAT THE WATER BILL IS NOT JUST A WATER BILL.

YEAH, IT'S WATER BILL, WATER BILL, SEWER BILL AND TRASH BILL.

EXACTLY.

I UNDERSTAND THAT.

YEAH.

AND YOU KNOW, I THINK THAT THE, THE MINIMUM BILL IN THE CITY OF INCLUDE IS IF YOU, IF YOU HAVE THE MINIMUM USAGE, I THINK THAT THE MINIMUM BILL IS RIGHT AT $50, ISN'T IT 1477? THAT'S JUST A, THAT'S JUST THE WATER.

WATER SEWER.

1477 AND THE GARBAGE IS 20.

HUH.

BUT, UH, UNDER THE WATER SEWER, THEY HAVE A BASE AMOUNT.

YEAH.

AND THE BASE AMOUNT, THE FIRST THOUSAND IS 1477 ON THE WATER, AND THEN THE SEWER RESIDENTIAL GOES UP TO, BUT, BUT THAT'S WHAT THEY BASICALLY, THE MINIMUM BILL IS PROBABLY AROUND $40, 45, 2.

YES.

YEAH, WITH, WITH WATER, SEWER AND GARBAGE.

RIGHT.

SO, YEAH, IT'S JUST THAT I'VE GOT EXTRA CHARGES I DON'T UNDERSTAND AND THERE EVERYTHING, SO I, I WASN'T SURE WHETHER TO TURN TO THE WATER DEPARTMENT HERE OR THE APARTMENTS OR WHO, YOU KNOW, IT'S, IT'S ALL I CAN DO TO, TO GET A, UH, SOME TIME WITH DEPARTMENT MANAGEMENT THERE, YOU KNOW, TO, TO GO OVER THINGS LIKE THIS.

BUT THAT'S, YOU KNOW, LIKE I SAID, WE CAN'T REALLY GIVE YOU A WHOLE LOT OF MORE INSIGHT THAN WE HAVE, YOU KNOW, OTHER THAN YEAH.

MR. MR. DUNCAN'S ADVICE TO HAVE THOSE PEOPLE TO

[00:30:01]

INVESTIGATE BECAUSE YEAH, IF THEY'RE NOT ADVERTISING ON THEIR THING, MAYBE THERE'S SOMETHING THAT THEY NEED TO, THAT, THAT'S SOMETHING THEY NEED TO MAKE SURE THEY DO.

ALRIGHT, THANK YOU SIR.

THANK YOU.

[V. CONSENT AGENDA ]

THEN THE NEXT ITEM WOULD BE THE CONSENT AGENDA AND ITEMS LISTED ON THE CONSENT AGENDA ARE CONSIDERED ROUTINE.

THEY'RE GENERALLY ENACTED IN ONE MOTION.

YOU ACCEPTED THIS RULE THAT COUNCIL MEMBERS MAY REQUEST ONE OR MORE ITEMS BE REMOVED FROM CONSENT AGENDA FOR SEPARATE ITEMS. TONIGHT'S CONSENT AGENDA, CONSISTENT MINUTES OF REGULAR CITY COUNCIL MEETING, SEPTEMBER 26TH, 2024 AT 7:00 PM I HAVE A MOTION TO APPROVE CONSENT AGENDA.

SO MOVED, MOVED BY COUNCIL PERSON BOND SECOND ABOVE I'LL SECOND COUNCIL PERSON MAD.

YES.

OKAY.

AND ANY ITEMS NEED TO BE REMOVED? NO.

ANY DISCUSSION? HEARING NONE.

I'LL ENTERTAIN A VOTE WITH ALL A FAVOR.

AYE.

AYE.

UNANIMOUS.

THANK YOU.

THEN THE NEXT ITEM WOULD

NEXT ITEM IS CONSIDERATION OF POSSIBLE ACTS TO ADOPT RESOLUTION NUMBER 60 20 24 ACCEPTING THE RECOMMENDATION BY THE PLANNING AND ZONING COMMISSION TO APPROVE THE PRELIMINARY PLAT FOR THE PROPERTY LOCATED AT TWO 13.

CAN STREET AND SET IN A JOINT PUBLIC HEARING DATE FOR THE POSSIBLE APPROVAL OF THE FINAL PLAT RECOMMENDED

[00:45:01]

THE DATE IS NOVEMBER THE FOUR 14TH 2024 AT 7:00 PM I'M GONNA HAVE TO MAKE SOME CHANGES ON THIS RESOLUTION.

YOU WANNA EITHER NOT I HAVE TO PARAGRAPH ACTUALLY ADJUSTING THE LINES ON THREE BLOCKS.

SO CAN WE JUST TABLE IT OR DOES YEAH, IF YOU, YOU CAN, BUT IT WILL, IT WILL AUTOMATICALLY BE APPROVED.

THE, HIS UH, SCHEDULED JOINT PUBLIC HEARING DEPENDS ON WHAT YOU GUYS DO TODAY.

WELL, I MEAN THIS IS, THIS IS BASICALLY THE PRELIMINARY AND SETTING A DATE FOR SETTING A DATE FOR THE, FOR THE FINAL.

CORRECT.

I MEAN ALL OF THE, THE STUFF THAT'S BEEN BROUGHT TO PLANNING AND ZONING IS CORRECT STUFF, CORRECT? WELL, YEAH, IT WAS ALL CONTAINED ONE PROPERTY, BUT WE JUST KIND OF MISUNDERSTANDING DOING SOMETHING.

IT'S ALL ONE ADDRESS, BUT IT'S THREE LOTS.

HE'S, HE'S CLEARING, HE'S CLEARING IT, CLEARING UP LOCK LINE IS WHAT HE'S DOING.

YEAH.

IT WILL NOT AFFECT THE FINAL FLAT.

THIS IS JUST RIGHT.

THIS IS SETTING THE DATE BASICALLY.

YEAH, THIS IS THE WAY I'M READING IT IS JUST ADOPTING THE RESOLUTION TO APPROVE THE PRELIMINARY RELA AND SETTING A PUBLIC HEARING FOR, FOR THE FINAL RELA.

SO I MEAN ANY YOU HAVE THE, CAN WE, WHERE ARE WE IN THE DEADLINE AS FAR AS IF WE DON'T TAKE ACTION, THE PRELIMINARY PLA WOULD AUTOMATICALLY BE APPROVED, CORRECT? UH, NO, BECAUSE WE'VE ALREADY MET DAY 30 DAYS TODAY.

OKAY.

MEET UNTIL NOVEMBER.

WHICH EVERYTHING IS CORRECT ON THE FLAT.

IT'S MY WORD IN THE RESOLUTION.

RIGHT.

CAN WE JUST APPROVE IT WITH THE AMENDMENTS TO THE RESOLUTION? YEP.

MS AND MS. ROSIE, WHAT WERE THE, WHAT WAS THE CHANGE THAT NEEDED TO GO ON THE PAPER? UH, IT SHOULD BE, AND I JUST LEARNED THAT SECOND PARAGRAPH.

I APOLOGIZE FOR THAT.

IT'S ADJUSTING LOT ON LOT LINES ON THREE EXISTING LOTS.

IT'S THREE EXISTING LOTS AND HE'S CHANGING THE LINE ON ALL THREE OF THEM.

IT'S JUST AMAZING.

CONTIGUOUS LOTS.

ADJACENT LOTS.

SO, SO WHAT YOU'RE SAYING HERE IS WE'RE SAYING YEAH, 'CAUSE WASN'T THE ISSUE THE WIDTH OF THE LOT, WHY HE COULDN'T BUILD OR SOMETHING LIKE THAT? PLA PROPERTY SUBDIVIDING ONE LOT TO ADJUST THE PROPERTY LINES INTO THREE LOTS.

IT WOULD JUST BE SUBDIVIDED ONE LOT TO ADJUST TO ADJUST THE PROPERTY LINE ON THREE.

YES.

ADJUST THE PROPERTY LINES ON ALL THREE LOTS.

YEAH.

SO INSTEAD OF, SO, INSTEAD OF IN, INSTEAD OF IN TWO, THREE LODGES, THAT COULD JUST BE ON THREE LOTS.

IT LOOKS LIKE THERE'S STAR WARS.

SO YOU'RE CHANGING ONE WORD.

IT WAS BIG .

YEAH.

OKAY.

SO YEAH, IT'S ALL WITHIN HIS BIG ROBOTS.

MM-HMM.

THAT'S WHAT CORRECT.

WELL, I WILL READ IT LIKE THAT AND THEN WE COULD RETAP IT BEFORE I SIGN IT.

WELL, OKAY.

THAT'S NOT, NOT THERE ARE EXIST.

THERE'S NOT ONE LOT BEING DIVIDED INTO A THREE.

NO, THERE'S THREE EXISTING LOTS.

CORRECT.

AND HE'S ADJUSTING THE LINES OF THOSE THREE LOTS.

SO THE PART OF THIS SENTENCE SAYS SUBDIVIDING ONE LOT IS NOT TRUE, RIGHT? IT'S, IT IS, UH, IT'S UH, IT'LL BE, UH, THE PROPER LANGUAGE WOULD BE, UH, ADJUSTING THE PROPERLY LINE OF THREE CONTIGUOUS LOTS.

THREE WHAT? CONTIGUOUS.

LOTS CONTIGUOUS.

OKAY.

YES.

AND I WOULD LIKE TO MAKE A MOTION WITH THE AMENDMENT THAT, UH, THE ATTORNEY STATED.

MM-HMM? .

WELL HE'S BASICALLY DIVIDING ONE LIGHT TO ADJUST.

THERE'S THREE NO, THERE'S NO ONE LIGHT, ONE LIGHT, TWO LIGHT, THREE LIGHT.

THERE ARE THREE LINES.

IT THAT IT'S NOT ONE BIG LIGHT LINES ON ONE LOT TO ADJUST THE OTHER TWO.

I DON'T KNOW.

THIS IS WHAT I'M SENDING TO

[00:50:01]

NEWSPAPER.

WHAT I SENT, I CORRECTED.

HUH? DO YOU WANNA SEE THE PAPER ADJUSTING LOT LINES ON ALL THREE EXISTING LOTS.

SO HE IS PROBABLY MOVING AFTER PHOTO.

IT'S, IT'S, WELL THIS IS THE LOTS.

IS THIS THE BEFORE OR THE AFTER? THIS IS THE BEFORE.

THIS IS WHAT IT LOOKS LIKE NOW, SIR.

WELL, I DON'T KNOW WHERE THOSE CIRCLES CAME FROM, BUT, OH NO, THAT'S ME MAKING NOTES.

, THAT'S A CUL-DE-SAC.

AND THIS IS SOME WATER, RIGHT? BUT HIS, IS THIS WHAT IT'S GONNA LOOK LIKE AFTER? THAT'S WHAT'S PROPOSED TO BE THE REPL CIRCLE, BUT THIS IS WATER IS A CUL-DE-SAC.

YEAH.

THESE, THOSE ARE MY DRAWING UNDER SOMETHING BECAUSE TO REPLANT PROPERTY.

UNDER, UNDER, UNDER I, I DON'T THINK SO.

OH, OKAY.

SO WE DON'T KNOW.

HE MAY BE MOVING A BUNCH OF THESE LINES AROUND.

RIGHT.

SEE WHICH ONE YOU HAVE THREE AND THAT GONNA BE THREE DIFFERENT.

THAT'S A CUL-DE-SAC.

BUT THIS IS NOT WATER THERE.

I KEEP SEEING MY DRAWER , BUT THAT'S HOW I CAN, IT'S WEIRD, BUT I DON'T KNOW WHAT IT LOOKS LIKE NOW OR THAT'S WHAT'S PROPOSED.

NO, THIS IS WHAT IT LOOKS LIKE NOW.

CHICKEN SCRATCH.

I DON'T SEE BUILDINGS ON PROPERTY TO ADJUST THE PROPERTY, BUT IT'S LIKE, IT'S A REALLY WEIRD THIS IS WHAT, THIS IS WHAT OUR LEGAL BELE SAYS WE DO LITTLE TREES ON ON THAT RESOLUTION.

60 DASH 2024 WOULD BE A RESOLUTION OF CITY COUNCIL OF CITY CLUTE, TEXAS APPROVED THE PRELIMINARY RELA OF PROPERTY LOCATED AT TWO 13 CAN STREET CL TEXAS.

.

THAT'D BE RED PAST ADOPTED THIS 10TH DAY OF OCTOBER.

YEAH, LET'S TAKE IT OFF THE SCREEN REAL QUICK.

.

WELL, IT DIDN'T HAPPEN.

REGARDLESS IF WE DON'T SET A PUBLIC HEARING, THEY'RE GONNA GET, THEY GET THE RELA AUTOMATICALLY CORRECT? CORRECT.

SO IF IT, IF IT HITS THE EXPIRATION DATE, THEY GET IT WITHOUT, WITHOUT US APPROVING IT.

SO WE HAVE, WE HAVE CORRECTIONS MADE.

THEY'LL HAVE TO RETYPE IT BEFORE WE SIGN IT.

SO I'LL MAKE, THAT'S BASICALLY THE RESOLUTION.

ANYONE CARRIER MAKE A MOTION TO APPROVE RESOLUTION OF CCP DASH 2024.

YEAH, I'LL MAKE THE MOTION TO APPROVE.

I HAVE A MOTION BY COUNCIL .

SECOND, I'LL, I'LL SECOND.

PAYMENT IS REIMBURSED OUT OF THE $250,000 GRANT.

SO IT'S NOT ANY ADDITIONAL MONEY THAT WOULD BE OWED BY THE CITY.

'CAUSE THAT WAS THE QUESTION I HAD, SIR.

YEAH, I SEE THE $300 HOURLY RATE FOR THE PRINCIPAL.

THAT CAUGHT MY EYES.

YEAH.

, ANY OTHER QUESTIONS OR COMMENTS? I, I'LL JUST, I KNOW THEY'RE NOT HERE, BUT JUST THE KUDOS TO WILL AND CJ FOR THE, UH, GETTING THIS PREPARED.
