[00:00:25]
THE CITY OF FLUTE PROCLAMATION.
WHEREAS IN 1952, CONGRESS PASSED A BILL ESTABLISHING A NATIONAL DAY OF PRAYER WHERE WE HAVE CONTINUED THE GREAT TRADITION ESTABLISHED FOR AMERICANS TO PRAY AND, AND MEDITATE WITH CHURCHES AND, AND GROUPS AS, AS INDIVIDUALS.
AND WHEREAS THE POWER OF PRAYER HAS UNITED THE AMERICAN PEOPLE ON OUR DARKEST DAYS AND HELP US MAKE SOME OF OUR BRIGHTEST DAYS POSSIBLE.
AND WHEREAS THIS YEAR OUR PRAYERS WILL FOCUS ON PRAYING FER FERVENTLY IN RIGHTEOUSNESS AND AVAIL MUCH.
THE NATIONAL DAY OF PRAYER CELEBRATION REMINDS US OF FAITH'S PROMINENCE PROMINENT PLACE IN OUR NATION'S FOUNDING, AND WHEREAS WE PRAY FOR AMERICA, THE CHURCH, FAMILY, EDUCATION, MILITARY WORKPLACE, GOVERNMENT ARTS, ENTERTAINMENT, MEDIA, AND FOR THE PROTECTION OF ALL THE COMMUNITIES WITHIN OUR NATION, OUR EMERGENCY MEDICAL SERVICE WORKERS, LAW ENFORCEMENT OFFICERS, AND ALL THE HEROES THAT PLAY A VITAL ROLE ON DAY-TO-DAY TASKS.
NOW, THERE ARE, THEREFORE OUR CALVIN SHIFFLET BUREAU OF THE CITY OF FLUTE TEXAS CALL UPON THE CITIZENS OF INCLUDE TO OBSERVE AND HONOR MAY 4TH, 2023.
IT IS NATIONAL DAY OF PRAYER, THE WITNESS WHERE OF HERE UNTO TO SET MY HAND AND CAUSE THE SEAL OF THE CITY OCCLUDE TO BE AFFIXED.
IT'LL BE SIGNED BY MYSELF AS THE TESTED BY ROSE APPOINTMENT CITY CLERK.
NEXT ITEM ON THE NINTH'S AGENDA WOULD BE A PRESENTATION BY B I S D STUDENT COUNCIL.
UH, WE HAVE A LIST OF FOLKS HERE.
I DON'T KNOW Y'ALL HAVE, I DON'T KNOW YOUR NAMES, BUT WE HAVE GRACIE PRICE LISTED AS PRESIDENT.
WE HAVE REAGAN BLANK AS VICE PRESIDENT MADELINE NICHOLS AS SECRETARY ROCKER BLANK IS TREASURER CORY RIVERA AS PARLIAMENTARIAN AND CLARISSA PENA IS HISTORIAN AND THE PRESENTERS TONIGHT WILL BE, WE'RE SUPPOSED TO BE GRACIE, CLARISSA AND MADELINE, BUT I ONLY SEE TWO OF Y'ALL, SO IF YOU WANT TO INTRODUCE YOURSELF, THAT'D BE FINE.
WELL, HELLO, I'M MADELINE NICHOLS, THE STUDENT BODY SECRETARY AT BRASSWOOD HIGH SCHOOL.
AND I'M CLA SAPINO, THE STUDENT BODY HISTORIAN AT BRASSWOOD HIGH SCHOOL.
UM, IN JANUARY WE HAD OUR FIRST ANNUAL CARNIVAL, WHICH ALL IS THE SPORTS AND THE CLUBS HAD A BOOTH AT THE CARNIVAL AND THEY MADE PROFITS ON HOW WELL, HOW WELL THEIR BOOTH DID.
AND IT WAS ALSO OPEN TO THE PUBLIC.
UM, IN MARCH, WE HAD OUR ANNUAL COLOR RUN.
IT'S OPEN TO THE COMMUNITY AND WE DONATE PART OF THE PRO PROFITS TO THE BRAZORIA COUNTY ALLIANCE FOR CHILDREN.
AND THE OTHER PART OF THE PROFITS WE DONATE TO THE BE LIKE HANNAH SCHOLARSHIP IN MARCH.
WE ALSO HAD OUR FIRST TALENT SHOW SINCE 2018.
IT WAS FREE ADMISSION, BUT WE WERE TAKING DONATIONS FOR BACKPACK BUDDIES.
UM, THIS PAST WEEKEND WE WENT TO IRVING.
WE HAD OUR, OUR TEXAS STUDENT COUNCIL CONVENTION.
THERE WE HEAR KEYNOTE SPEAKERS AND WE HAVE AN IDEA EXCHANGE, UM, TO MAKE OUR SCHOOL BETTER AND TO HELP MAKE OTHER STUDENT COUNCILS IN TEXAS, THEIR SCHOOLS TO BE BETTER PLACES AS WELL.
AND WE ALSO HAD THREE TABLE TALKS, WHICH IS WHERE WE SHARE OUR IDEAS WITH OTHER SCHOOLS.
UM, OUR TABLE TALKS WERE THE CARNIVAL FROM OUR SCHOOL, UM, THE COLOR RUN THAT WE DO, AND THE KLONDIKE CHALLENGE THAT WE DO AT OUR SCHOOL AS WELL.
AND THEN IN SEPTEMBER WE HAD OUR BONFIRE AT STRAND RIDGE PARK, WHICH WE HOPE THAT Y'ALL WILL ALLOW US TO CONTINUE THAT TRADITION OF HAVING AT ES RIDGE PARK.
IN MAY AND THE LAST WEEK OF THE SCHOOL YEAR, WE HAVE A SENIOR PEP RALLY, AND THEN WE GO, THE SENIORS WILL GO DO AN ELEMENTARY SCHOOL WALK WHERE THEY VISIT THEIR ELEMENTARY SCHOOLS FOR THE LAST TIME.
AND THEN AFTER THAT WE GO HAVE A SENIOR PICNIC, WHICH IS THE LAST TIME THAT WE GET TO HANG OUT WITH OUR FRIENDS BEFORE GRADUATION AND MAY, WE ALSO WILL HAVE OUR SENIOR SUPER LITS, WHICH IS BASICALLY AN AWARD SHOW FOR MOST LIKELY, AND IT WILL BE HELD AT IN THE BRAESWOOD AUDITORIUM.
UM, OUR FINAL THING IS THAT ON MAY 16TH AND 17TH, WE WILL HAVE OUR FINAL BLOOD DRIVE OF THE SCHOOL YEAR.
[00:05:01]
DONATE.UM, AND THIS IS ALSO THE LAST CHANCE FOR SENIORS AT OUR SCHOOL TO QUALIFY TO GET A BLOOD DRIVE CORD FOR GRADUATION.
I WOULD LIKE TO TELL Y I WOULD LIKE TO TELL Y'ALL THAT THE SENIORS GRADUATED THIS YEAR ARE GRADUATING 50 YEARS AFTER I DID FROM THE SAME SCHOOL.
NEXT ITEM WOULD BE THE FINANCIAL REPORT FOR QUARTER ENDING MARCH 31ST, 2023.
AND AGAIN, MY APOLOGIES, UH, MS. KNOX IS NOT ABLE TO JOIN US.
YOU'RE GONNA HAVE TO LISTEN TO MY, UH, DRONING ON AND ON, UH, NOT HER D TONES AND GOOD LUCK.
UH, WE ARE, UH, CAN YOU SPEAK? OH, YEP.
I'LL TRY TO GET THE DULCE TONES INTO THE MICROPHONE.
UH, WE, UH, JUST FINISHED OUR SECOND QUARTER OF THE FISCAL YEAR.
UH, WE CONTINUE TO BE IN STRONG POSITION, UH, REVENUES.
IF YOU CAN GO TO THE NEXT, I'M SORRY, LAURA.
UH, REVENUES CON CONTINUE TO BE STRONG, UH, ESPECIALLY SALES TAX.
WE WERE A LITTLE SURPRISED BY THE INDUSTRIAL DISTRICT DEPOSIT, WHICH WAS AHEAD OF WHAT WE ANTICIPATED.
UH, BUT THAT FALLS IN LINE WITH THE VALUATIONS THAT WE GOT THIS MORNING FROM THE BRAZORIA COUNTY, UH, APPRAISAL DISTRICT AND TAX ASSESSOR COLLECTOR'S OFFICE.
THEY HAD ALL THE TAXING ENTITIES IN FOR WHAT THEY CALL THEIR KICKOFF MEETING.
UH, AND UH, I CAN SAY THAT THE, IT WAS QUITE A ROWDY, UH, A ROWDY MEETING FOR A CHANGE.
UM, CLTE, I, UH, I IS, UH, SOMEWHAT REMARKABLE IN THAT WE, OUR VALUES INCREASED TO ABOVE 1 BILLION FOR THE FIRST TIME IN THE CITY'S HISTORY.
SO WE LAUNCHED FROM 6 52, 650 2 MILLION IN OUR LAST CYCLE TO 1.007.
WE ANTICIPATE THAT THAT NUMBER AFTER PROTESTS WILL COME DOWN SIGNIFICANTLY.
UH, SEEING AS WE HAD A VALUATION INCREASE OF ALMOST 48%, UH, YEAR OVER YEAR, WE WERE SECOND ONLY BEHIND OYSTER CREEK, WHICH INCREASED THEIR TOTAL VALUE BY 50%, UH, YEAR OVER YEAR ACCORDING TO THE ACADEMY.
AND I DON'T WANNA GET TOO FAR OFF INTO THE WEEDS WITH, UH, WITH THE DISCUSSION ABOUT THE CAD CUZ WE'RE GONNA HAVE PLENTY OF TIME TO TALK ABOUT TAX RATES AND, AND THE BUDGET SEASON COMING UP.
UH, BUT BASICALLY, UH, THEY'RE SAYING THAT THE STATE OF TEXAS IS DRIVING THE INCREASE BASED ON MARKET SALE COMPARISON COUNTYWIDE.
AND SO THE, THE ELE THE EXAMPLE THAT HE GAVE TO US WAS A 40 FOOT LOT IN ANGLETON THAT SOLD FOR 25 2 LAST FISCAL CYCLE IS NOW SELLING FOR 47 5.
AND THAT WAS THE BASIS FOR THE COMPTROLLER TO COME IN AND BASICALLY NOT SLAP THE COUNTY'S HAND, BUT BUT TELL THE APPRAISAL DISTRICT THAT THEY HAD TO INCREASE THEIR RATES.
UH, THE ALSO STATED THAT THE COMPTROLLER'S OFFICE STATED THAT BRAZORIA COUNTY WAS THE MOST UNDERVALUED COUNTY IN THE STATE FOR COMMERCIAL RAW LAND AND INDUSTRIAL PROPERTIES.
SO, UH, EVERYBODY'S RATES WENT THROUGH THE ROOF.
UM, THERE WERE A LOT OF HEATED QUESTIONS ABOUT, WELL, WE UNDERSTAND THAT COMMERCIAL AND RAW LAND MAY HAVE BEEN UNDERVALUED, BUT WHY IS IT THAT RESIDENTIAL HAS SEEN SUCH A SIGNIFICANT INCREASE? UH, THE, THE APPRAISAL DISTRICT WAS ADAMANT THAT FOLKS NEEDED TO FILE A PROTEST, AND THEY NOTED THAT THEY TOO ARE FILING A PROTEST AGAINST THE COMPTROLLER'S DIRECTIVE, UH, TO, UH, TO INCREASE VALUES.
SO, UH, THAT'S THE REVENUE SIDE OR THE, THE, WHERE THE REVENUES ARE GOING.
I WOULD NOTE, UH, IN TERMS OF SALES TAX, WE'RE DOWN SLIGHTLY, BUT WE'RE STILL AHEAD OF PACE, UH, YEAR OVER YEAR.
UM, WE'RE DOWN ABOUT, UH, WE'RE UP ABOUT 73,000 COMPARED TO LAST YEAR.
UH, WE ARE STILL SEEING SOME WEAKNESS IN HOTEL MOTEL AND WE EXPECT THAT TO CONTINUE, ESPECIALLY AFTER THIS MORNING.
OUR DISCUSSION ABOUT THE, UH, ABOUT THE PLANTS AND PROPOSED CONSTRUCTION PROJECTS.
UH, MR. LANDRUM GAVE KIND OF A DOWER REPORT IN TERMS OF WHAT'S GONNA BE HAPPENING INDUSTRY-WISE IN TERMS OF MAJOR INVESTMENT IN NEW INFRASTRUCTURE THAT APPEARS TO BE HALTED AT THIS TIME UNTIL THE, UH, CAPITAL MARKETS KIND OF RETURN.
THE GOOD NEWS IS FOR US, UH, THAT THE INCREASE IN, UM, THE INTEREST RATE HAS PAID HUGE DIVIDENDS TO US IN, IN, IN MARKET SHARE RETURN IN TERMS OF SAVINGS ON OUR INVESTMENT ACCOUNTS.
UM, AND SO HOPEFULLY WE SEE THINGS START TO LOOSEN UP.
UH, THEY SAY THAT WE'RE IN LINE FOR A SOFT PLANNING.
I DON'T KNOW WHAT THAT REALLY LOOKS LIKE.
I GOT A FEELING WE'RE REALLY IN LINE FOR A, UH, A RECESSION LATER IN THE YEAR.
UH, LOOKING AT THE EXPENDITURE SIDE OF THE PROJECTS, UH, WE ARE LAGGING, UH, IN TERMS OF, UH, PROJECT LAUNCHES.
UH, WE FINALIZED OUR, OR HOPEFULLY WE'LL BE FINALIZING THE ENGINEERING DESIGN COMPONENT TO THE HAZMAT PROJECT, WHICH WE HAD HOPED TO BE ACTUALLY TURNING DIRT AT THIS TIME.
UH, BUT WE'RE STILL A WAYS BEHIND, SO WE'RE GONNA READJUST OUR SCHEDULES AND TAKE ANOTHER LOOK AT THAT.
UH, THAT PROJECT'S GONNA LAG OR GONNA LAG A LITTLE WHILE, BUT WE THINK WE FINALLY HAVE, WE DO HAVE THE AGREEMENT IN PLACE NOW WITH THE ENGINEERS TO COMPLETE THE ENGINEERING DESIGN.
I WOULD NOTE THAT FROM, UH, FUND, LET'S, LET ME FINISH ON THE, UH, EXPENDITURES.
UH, WE STILL HAVE FINISHED THANKS TO THE STRONG REVENUE.
AND I WOULD ALSO NOTE THE, UH, CONSERVATIVE NATURE OF OUR DEPARTMENT HEADS IN
[00:10:01]
BEING GOOD FISCAL STEWARDS.WE ARE STRONG, WE ARE VERY, VERY STRONG AND I WANNA APPLAUD THEM FOR THAT IN THEIR EFFORTS.
THEY'VE DONE A REALLY GREAT JOB OF KEEPING THINGS IN CHECK, UH, CASH FLOW WISE.
IF YOU TAKE A LOOK AT OUR TOTAL CASH BALANCE, UH, WE'RE IN GREAT SHAPE.
26 MILLION 4 26 6, UH, WITH A, ABOUT A $400,000 INCREASE.
AGAIN, THOUGH THAT NUMBER WILL COME DOWN AS WE GET PROJECTS LAUNCHED.
WE MET WITH THE, UH, SIDEWALK CONSULTANT, UH, HAD A CONFERENCE CALL WITH HIM, UH, HOPEFULLY GETTING THEM BACK DOWN HERE.
UNFORTUNATELY FOR US, WE ARE SECOND ON THAT CONTRACT TO THE CITY OF BEL AIR AND BEL AIR HAS BEEN FLEXING THEIR MUSCLES.
SO, UH, THEY'VE GOT SOME PROJECTS THAT THEY'RE JUST ABOUT TO WRAP UP AND WE HOPE YOU GET THEM BACK DOWN HERE.
UH, LIKEWISE, WE WANNA GET THE ENGINEERING DESIGN ON THE DRAINAGE INITIATED.
UH, AND THEN THE COUNTY HAS COMPLETED, JOHN, ARE THEY DONE WITH THE PAVEMENT IMPROVEMENTS? THEY FINISHED OVER THERE.
I'LL, SO, AND THEN, UH, THEY'LL FINISH THE RILEY ROAD SEGMENT AS WELL.
UM, AND THEN WE'LL HAVE SOME INFO PROJECTS AND HOPEFULLY BE READY TO LAUNCH OUR BRYANT SUBDIVISION WATERLINE REPLACEMENT WITHIN THE NEXT COUPLE OF WEEKS.
SO EXPENDITURES WILL START TO FLOW OUT, UH, RELATED TO THOSE CAPITAL PROJECTS.
UM, WITH THAT, I THINK THAT'S THE ONLY, THOSE ARE THE HIGHLIGHTS.
I KNOW I PROBABLY SPEED THROUGH IT.
IF YOU HAVE QUESTIONS, PLEASE FEEL FREE TO ASK.
NOT TO BOG US DOWN, BUT I DO HAVE A QUESTION.
WHEN WE ORIGINALLY SET WAS TALKING ABOUT THE TAX RATE, DIDN'T, WEREN'T, WE, I GUESS, SUGGESTED THAT OUR EVALUATION WAS GOING, SORRY, WAS GOING DOWN.
OUR EVALUATIONS, IF YOU RECALL, UH, YEAR BEFORE LAST, OUR EVALUATIONS DROPPED ABOUT 13% RELATED TO THE MULTI-FAMILY ADJUSTMENT.
LAST YEAR, THOSE CAME BACK UP TO 6 52.
SO WE WENT FROM 6 25 TO 5 87, 590, AND THEN BACK UP TO 6 52 LAST YEAR.
AND SO THIS YEAR WE HAVE JUST SPRINGBOARDED OUT THE TOP TOWARDS 1 BILLION.
I STILL FEEL LIKE THE INFORMATION WE GAVE THOUGH WAS REALLY, OR WE WERE GIVEN, I FEEL LIKE I WAS KIND OF MISLED ON WHERE I WENT WITH THE TAX RATE PERSONALLY.
WELL, I, I JUST, UH, MAYBE I'M, MAYBE I'M NOT, BUT NO, WHAT I WAS GONNA SAY, IS IT, ARE YOU IN REGARD TO THE RATE THAT WAS SET OR THAT WELL, WE SET THE RATE RIGHT, DUE TO THE INFORMATION THAT WE HAD.
AND IT SEEMS TO BE NOT E THE INFORMATION THAT WE GOT IS NOT EVEN CLOSE TO WHAT, IF YOU RECALL, WE SET OUR, WHEN WE HAD OUR INITIAL SETTING, WE WERE LOOKING AT A TAX RATE OF 55, RIGHT.
AND THEN WE GOT THE VALUES BACK AND WE JUMPED UP TO, WE HAD TO GO BACK TO 62.5 YEAR BEFORE LAST, AND WE SET IT AT THAT NUMBER, WHICH WASN'T THE VOTER APPROVED RATE.
AND THEN LAST YEAR WE GOT THE NUMBERS IN, WE DROPPED THAT RATE AGAIN BACK DOWN TO 59 BECAUSE THAT WAS WHERE WE WERE AT, AT THE V A T R AND WE'RE AT 59.35 AND THAT 92 BASED ON THOSE NUMBERS.
AND SO WE'RE LOWER THAN WHERE WE HAVE BEEN.
AND WE WILL CONTINUE TO PUSH, OBVIOUSLY WITH THIS NUMBER, WE'LL CONTINUE TO PUSH LOWER.
WELL THAT'S, I GUESS THAT'S WHERE I WAS GOING.
SO YOU, I WOULD REMIND COUNSEL AND THE PUBLIC, WHEN THE VALUES GO UP, THE RATES COME DOWN.
SO WE CAN ONLY, WE CAN ONLY RECEIVE A VERY SMALL PERCENTAGE OF THE INCREASED REVENUE.
I JUST, UH, IF WE'VE GOT AN EVALUATION THAT'S THROUGH THE ROOF, THEN THE RATE GOES DOWNWARD, THAT, WHAT IS IT, LIKE 3.5%, SOMETHING LIKE THAT? 3.5 IS WHAT'S CALLED THE V A T R, WHICH IS THE VOTER APPROVED TAX RATE.
IF WE ADOPT THAT RATE, THAT IS THE MAXIMUM RATE, THAT WILL NOT TRIGGER AN ELECTION.
IF WE GO ABOVE THAT RATE, THEN IT AUTOMATICALLY TRIGGERS AN ELECTION BY THE PUBLIC.
SO THAT WILL ALL, THAT WILL ALL CHANGE THIS YEAR.
WHEN, WHEN EVERYTHING, I MEAN, IT'S, THE APPRAISALS GONNA GO UP.
I MEAN, IT'S, THAT'S OBVIOUS THAT THE APPRAISAL'S GONNA GO UP.
AND HOW MUCH IS, IS 40 SOMETHING PERCENT? SEEMS A LITTLE OUTTA THE QUESTION.
48% SEEMS A LITTLE OUTTA THE QUESTION, BUT, UH, I'D BE TICKLED TO DEATH WITH A 40% INCREASE ON MINE RIGHT NOW.
BECAUSE I'M AT OVER A HUNDRED.
BUT ANYHOW, THAT'S, THAT'S WHERE THAT'S AT.
AND ANYONE HAVE ANY QUESTIONS ON THE FINANCIAL REPORT? I DID ON THE, WITH THE REPORT.
I KNOW YOU SAID WE'RE A LITTLE AHEAD OF SCHEDULE AND EVERYTHING.
HOW DOES OUR EMPLOYMENT LOOK LIKE? IS THAT, UH, WELL, YOU'RE, UH, AT FULLY, FULLY STAFFED IN PD.
WE'RE, WE'RE LAGGING ONE, ONE OR TWO POSITIONS.
JOHN, TWO POSITIONS IN PUBLIC WORKS CURRENTLY, UH, THAT WE'VE ADVERTISED FOR.
WE RECENTLY, UH, REFILLED THE JANITORIAL POSITION.
EVERYBODY ELSE IS FULL EXCEPT FOR PUBLIC WORKS.
SO ALL THE NUMBERS SHOULD BE, SHOULD BE
[00:15:01]
GOOD COMPARED.UNLESS WE'VE BEEN SHORT IN EVERY DEPARTMENT FOR, FOR SIX MONTHS.
WE'VE HAD A COUPLE OF VACANCIES THAT HAVE DRUG, BUT NOT TOO MANY.
ANY OTHER QUESTIONS OR COMMENTS ON THE FINANCIAL REPORT BEFORE I MOVE ON? AND WE WILL MOVE TO ITEM D, CONSIDERATION THE POSSIBLE ACTION TO ADOPT ORDINANCE NUMBER 2023 DASH OH OH SEVEN FOR A SPECIFIC USE PERMIT FOR A CHURCH LOCATED AT FOUR 17 SOUTH MAIN AND IT WILL BE ORDINANCE NUMBER 2023 DASH OH OH SEVEN AND ORDINANCE OF THE CITY OF FLUTE, MISSOURI COUNTY, TEXAS, CONTAINING FINDINGS OF FACTS AND CONCLUSION OF LAW AMENDING THE COMPREHENSIVE ZING ORDINANCE OF SI CITY TO PERMIT THE SPECIFIC USE OF LOT THREE BLOCK TWO, THE ACO AND THOMAS SUBDIVISION IN THE A CAL LEAGUE ABSTRACT 49 BRAZORIA COUNTY, TEXAS, ACCORDING TO THE MAP ARE PLAT THEREOF RECORDED IN VOLUME THREE, PAGE 180 4 OF THE PLATTER RECORDS OF MISSOURI COUNTY, TEXAS AND WITHIN THE CORPORATE S OF SAID CITY KNOWN LOCALLY AS FOUR 17 SOUTH MAIN INCLUDE TEXAS AS A LOCATION FOR OPERATION OF A CHURCH KNOWN AS FIVEFOLD FAITH CENTER BY JAMES A CUD.
IS THAT WHAT I HEARD YOU SAY? I THINK SO.
IN ADDITION TO OTHER PERMITTED USES UNDER CERTAIN CONDITIONS, THEREFORE SPECIFIC THEREIN SPECIFIC PROVIDING THAT SAYS SPECIFIC USE PERMIT SHALL NOT BE TRANSFERABLE.
CONTAIN CONTAINING A REP REP REPEATER CLAUSE IN EVENT OF PARTIAL IN VALIDITY.
AND PROVIDING THIS ORDINANCE SHALL TAKE EFFECT TO BEING ENFORCED 10 DAYS AFTER ITS PASSE GENERAL APPROVAL.
WE CARE TO MAKE A MOTION TO APPROVE ORDINANCE NUMBER 2023 DASH OH SEVEN.
I'LL MAKE A MOTION THAT WE APPROVE THAT ORDINANCE.
AGUILAR, DO I HAVE A SECOND? I'LL SECOND.
HEARING NONE, I'LL ENTERTAIN A VOTE.
NEXT ITEM WILL BE CONSIDERATION AND POSSIBLE ACTION TO ADOPT RESOLUTION NUMBER OH THREE DASH 2023 AUTHORIZING TASK ORDER NUMBER ONE UNDER THE MASTER SERVICE AGREEMENT BETWEEN THE CITY AND FRIESEN NICHOLS, INC.
FOR ENGINEERING DESIGN SERVICES RELATED TO THE US DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, HUD COMMUNITY DEVELOPED BLOCK BLOCK GRANT.
C CD B G MITIGATION MIT PROGRAM REGIONAL FLOOD RISK REDUCTION PROJECT UNDER THE TEXAS LAND OFFICE G PROGRAM NUMBER 2222 DASH 82 DASH OH THREE DASH D 1 98 AND IT WOULD BE RESOLUTION NUMBER OH THREE DASH 2023.
THE RESOLUTION OF THE CITY COUNCIL OF THE CITY OF INCLUDE TEXAS APPROVING PROPOSAL FOR TASK ORDER NUMBER ONE UNDER THE MASTER SERVICE AGREEMENT BETWEEN THE CITY AND FRIES AND NICKEL INC.
FOR ENGINEERING DESIGN SERVICES RELATED TO THE US DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, H U D HUD COMMUNITY DEVELOPMENT BROCK GRANT CD B G MITIGATION MIT PROGRAM ORIGINAL FLOOD RISK REDUCTION PROJECT UNDER TEXAS GENERAL LAYOFFS G O PROGRAM CONTRACT NUMBER 22 DASH OH 82 DASH OH 3 0 3 DASH D 1 98.
WHEREAS THE CITY OF INCLUDED IN PARTNERSHIP WITH THE CITY OF LAKE JACKSON AND VELASCO DRAINERS DISTRICT WAS AWARDED APPROXIMATELY 9.6 MILLION IN CDBG HAZARD MITIGATION.
HAZ MET GRANT FUNDS BY THE TEXAS GENERAL LAND OFFICE JAIL LOW FOR THE MITIGATION OF FLOOD RISK ALONG THE FLAG LAKE PLANTATION DRIVE SYSTEM, THE PENMONT DRAINAGE SYSTEM AND THE DIXIE DITCH A DRAIN SYSTEM.
WHEREAS FEDERAL, STATE, AND CITY PROCUREMENT POLICIES REQUIRE THE SOLICITATION OF PROFESSIONAL SERVICES THROUGH A COMPETITIVE REQUEST FOR QUALIFICATION RFQ PROCESS.
WHEREAS UNDER THOSE RULES, THE CITY DID ISSUE SUCH AN RFQ ON AUGUST 26TH, 2022, WHICH CLOSED ON OCTOBER 10TH, 2022, WHEREAS THERE WAS ONLY ONE RESPONDING FIRM TO THE RFQ, WHICH PROMPTED THE CITY TO RELET THE RFQ WITH A CLOSING DATE OF DECEMBER 16TH, 2022.
WHEREAS STAFF REVIEWED THE THOSE DO AND THE PREVI PREVIOUSLY SUBMITTED PROPOSAL FOR THE PROFESSIONAL SERVICES HAVE RECOMMENDED FREEZE AND NICHOLS, INC.
FNI OF HOUSTON, TEXAS, TO PROVIDE ENGINEERING DESIGN SERVICES RELATED TO THE G O CDBG HAZMAT GRANT PROJECTS, WHEREAS THE STAFF CS AND FNI HAVE ENGAGED IN LENGTHY DISCUSSION TO REVISE AND REFINE THE ATTACHED PROPOSAL TO ENSURE THAT THE CITY AND STATE RECEIVED THE SERVICES DESIRED.
AND WHEREAS THE CITY COUNCIL SELECTED AWARDED FNI AS THE PREFERRED FIRM FOR SUCH PUR PURPOSE AND RESOLUTION NUMBER 60 DASH 2022 AND LATER A MASTER SERVICE
[00:20:01]
AGREEMENT UNDER RESOLUTION NUMBER OH 2 20 23 TO WHICH THE PROPOSED ATTACHED TO THIS DOCUMENT WOULD BE CONSIDERED TASK ORDER NUMBER ONE.NOW THEREFORE BE RESOLVED BY THE CITY OF COUNCIL OF CITY OF INCLUDE TEXAS, THAT THE PROPOSAL HERE UNTO ATTACHED IS APPROVED AS TASK ORDER NUMBER ONE, MADE ONE UNDER THE MASTER SERVICE AGREEMENT BETWEEN THE CD AND F AND I FOR THE ENGINEERING DESIGN SERVICES RELATED TO THE US DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, HUD AND COMMUNITY DEVELOPMENT BLOCK GRANT, CDBG HAZARD, H AZ MITIGATION M MIT PROGRAM FOR THE REGIONAL FLOOD RISK REDUCTION PROJECT UNDER THE TEXAS GENERAL LAND OFFICE.
CONTRACT NUMBER 22 DASH OH 82 DASH OH THREE DASH D ONE E D 1 98 READ PAST AND ADOPTED THIS 27TH DAY OF APRIL.
AND WE SIGNED BY MYSELF AND AS TESTED BY ROSE APPOINTED AT CEDAR CLERK.
AND, UH, AND A NEAR FULL, UH, BASICALLY THIS IS THE ENGINEERING, THIS IS WHERE THE RUBBER MEETS THE ROAD IN TERMS OF HOW WE'RE GONNA DESIGN THE DRAINAGE IMPROVEMENTS ON THE THREE SYSTEMS MENTIONED.
SO THAT'S FLAG LAKE ROAD PIN MONEY, AND THEN THE DITCH A SEGMENT FOUR, WHICH IS THE SEGMENT THAT SERVES THE CITY OF KLUTE.
UH, THIS IS FUNDED UNDER THE 9.6 MILLION CDBG HAS MET PROJECT.
THIS DOES NOT RELATE TO THE MIT MOD, SO I WANT MAKE SURE THAT THOSE STAY SEPARATE AND APART.
IT'S TAKEN US THREE MONTHS OF NEGOTIATION AND DISCUSSION WITH OUR PARTNERS AT CS R S AND FNI TO GET TO THIS POINT.
THEY HAVE A TIMELINE THAT IS MORE REASONABLE THAN WHAT WAS INITIALLY PROPOSED.
AND SO WE FEEL LIKE WE'RE AT A PLACE NOW TO RECOMMEND APPROVAL OF THE TASK ORDER AND INITIATION OF THE PROJECT.
SO FOLLOWING YOUR ISSUING OF THEIR APPROVING TONIGHT, WE WOULD ISSUE THE NOTICE TO PROCEED, WHICH WILL ALLOW THEM TO START ACTUALLY WORKING ON THE DESIGN BASIS, THE DESIGN FOR THE, FOR THE SYSTEMS AND THE CHANGES THAT WE'RE GONNA MAKE UNDER THE GRANT OR THE IMPROVEMENTS THAT WE'RE GONNA MAKE USING THE GRANT FUNDS.
SO AFTER, AFTER WE APPROVE THIS, I MEAN THIS HAS BEEN GOING ON FOR, WHAT, THREE, FOUR MONTHS? YES.
AFTER WE APPROVE THIS, HOW LONG IS IT GONNA TAKE THEM TO START THE PROCESS? WELL, SO THEY WILL START, ONCE WE ISSUE THE NOTICE TO PROCEED, THEY WILL INITIATE THE SURVEY WORK, WE'LL MEET WITH THEM AND HOLD A KICKOFF MEETING NEXT WEEK.
I THINK THAT'S SCHEDULED FOR THURSDAY OR FRIDAY.
THEY'LL BRING THE SURVEY UNITS IN AND BEGIN THEIR SURVEY AND ENVIRONMENT.
WE'RE ABOUT THREE MONTHS INTO THAT PROCESS OF PROBABLY TAKE ABOUT SIX INITIAL DESIGN THEY'RE SAYING COULD LAST AS LONG AS EIGHT MONTHS.
WE HOPE IT'S NOT THAT LONG, DEPENDING ON WHAT THE SURVEY RESULTS FIND.
UH, AND THEN WE'LL BE PROBABLY LOOKING AT LETTING AT THE BEGINNING OF EARLY NEXT YEAR.
SO I KNOW THE, THE GRANT FUNDS THAT WE HAD GOTTEN, WERE ON A TIMELINE.
ARE WE GONNA BE ABLE TO MEET THAT TIMELINE? WE BELIEVE WE ARE.
UH, WE DISCUSSED THAT WE HAD A CONFERENCE CALL WITH GLO ON TUESDAY TO KIND OF TALK ABOUT OUR TIMELINE AND PERFORMANCE.
UH, AND THEY ASSURED US THAT THEY FELT LIKE WE WERE GONNA MEET OUR GOALS AND IF WE NEEDED TO, THAT THEY WOULD PROVIDE SOME ALLOWANCE FOR SOME ADDITIONAL TIME IF NEEDED.
BUT THEY FELT LIKE BASED ON OUR COMFORT LEVEL, FOLLOWING THE REVISED PROPOSAL, THAT THEY WERE COMFORTABLE WITH OUR CONTRACT.
I KNOW LAST TIME WE HAD TALKED, THEY, UH, YOU HAD OR SOMEBODY HAD SAID THAT THEY WERE, UH, POSSIBILITIES OF ASKING FOR MORE FUNDS.
THEY, UH, THAT'S, UH, THERE WAS, THERE WAS A BONUS OF CONTENTION RELATED TO, UH, Y WE RESOLVED THAT QUESTION.
THERE ARE NO THAT THEY, THEY'RE AT WHAT THE CONTRACT ALLOWS 'EM TO, TO TAKE.
UH, STAFF RECOMMEND APPROVAL MAY MAYOR, I'LL MAKE A MOTION TO APPROVE SUBCONTRACT OPPOSED BY COUNCIL AGUILAR THAT WE ADOPT RESOLUTION NUMBER OH THREE DASH 2023 AUTHORIZING WORK ORDER, TASK ORDER NUMBER ONE WITH FREEZE NICHOLS INC.
THE HOUSE SECOND COUNCIL PERSON MATTER.
HEARING NONE, I'LL ENTERTAIN A VOTE.
NEXT ITEM WILL BE CONSIDERATION OF POSSIBLE ACTION TO APPROVE RESOLUTION NUMBER 25 DASH 2023 APPROVING AND RATIFYING TASK ORDER NUMBER THREE UNDER THE CITY'S MASTER SERVICE AGREEMENT WAS MCMANUS JOHNSON, CIVIL ENGINEER RELATED TO THE CDB G C D B G FUNDED WATERLINE AND HAS PROJECT FOR THE BRYAN SUBDIVISION, SIR.
AND IT WOULD BE RESOLUTION NUMBER 25 DASH 2023.

AND WHEREAS THE CITY DID BUDGET FOR THE ENGINEERING SERVICES FOR THIS PROJECT IN THE CURRENT FISCAL YEAR, WHEREAS THE FOLLOWING COORDINATION TALKS WITH STAFF, MJ C E IS READY TO INITIATE WORK ON THE STUDY, INCLUDING SURVEY WORK NOW.
THEREFORE, IT BEING RESOLVED BY THE CITY COUNCIL OF CITY OF INCLUDE TEXAS, THAT THE WORK AUTHORIZATION HERE TO ATTACH IS APPROVED AND RATIFIED.
READ PAST AND ADOPTED THIS 27TH DAY OF APRIL, 2023, SIGNED BY MYSELF AS TESTED BY ROSE APPOINTMENT CITY CLERK.
AND AGAIN, WE BUDGETED FOR THIS WORK.
THIS TIES INTO THE SMALLER CDBG, THE BRAZORIA COUNTY CDBG PROJECT RELATED TO THE WATERLINE REPLACEMENT ON BRYANT'S SUBDIVISION.
I HAD THOUGHT WE, WE HAD AUTHORIZED WORK ORDER NUMBER ONE AND NUMBER TWO THEY PRESENTED WORK ORDER NUMBER ONE AND NUMBER TWO.
BUT THEN WHEN THIS TURNED OUT TO BE WORK ORDER NUMBER THREE, WHICH IS ACTUALLY WORK ORDER NUMBER TWO, I KNOW IT CONFUSED THE HELL OUTTA ME TOO
SO I SIGNED IT AND THEN REALIZED AFTER THE FACT THAT WE NEEDED TO BRING THIS BACK TO YOU GUYS.
CAUSE YOU HAD NOT SPECIFICALLY SIGNED THIS WORK AUTHORIZATION OR GIVEN YOUR BLESSING.
OH, IS THIS THE, THE ONE THAT YOU HAD SAID THAT YOU WERE GONNA TAKE A PROTOTYPE OR THE THIS, WELL, THE, THE LARGER PROJECT FOR BRYANT SUBDIVISION IS GONNA BE THE MODEL FOR HOW WE REDEVELOP.
SO WE'RE GOING TO, WE'RE THIS PORTION OF THE PROJECT IS THE WATERLINE REPLACEMENT.
OLD AC LINE WITH A SIX INCH WATER INSTALLING THE FIRE HYDRANTS.
THE NEXT STEP WILL BE THE SEWER.
THE NEXT STEP IS THE DRAINAGE AND THEN THE STREET, ULTIMATELY STREET.
AND HOPEFULLY, UH, IF WE'RE ABLE TO DO IT SIDEWALK, UH, ON AT LEAST ONE SIDE.
SO, OKAY, THIS IS THE ONE FROM LAST MEETING? YES, YES, YES.
AND I INADVERTENTLY LEFT IT OFF LAST MEETING, SO MY APOLOGIES.
DO I HAVE A MOTION TO APPROVE RESOLUTION 25 DASH 2023? I'LL MAKE A MOTION.
MOTION MADE BY COUNCIL PERSON.
DO I HAVE A SECOND? I'LL SECOND.
MAKE THE SECOND FURTHER DISCUSSION.
HEARING NONE, I'LL ENTERTAIN THE VOTE.
